Remind the jury that, forget the noise about a mistake, because it s not a defense. sentencing, i think we will expect aggravating factors to be argued by the prosecution. we will expect mitigating factors in response by the defense. the idea that she has a family. she s had 26 years with law enforcement. she never had any record of discipline or criminal record. of course, that mistake which was not a defense could potentially be a mitigating factor for the defense in sentencing. the prosecution will argue she violated public trust in such a horrible way and that she violated department policy by not practicing with her taser. it will be interesting to see what the judge does. the judge can go from zero to max on count one. thanks for being with us and helping us understand the trial. ....

Guidelines and based off of certain characteristics of the defendant here. ms. potter has no previous offense so is in a criminal history category that puts her in the lower level. we did hear the prosecution say they were going to argue for aggravating factors which essentially means they are going to be arguing for a longer sentence than typically would be seen in this type of case. some of those aggravating factors include we saw in that body camera footage, you know, kim potter immediately after she discharged her weapon did not seek to render aid. instead she sort of stepped back and really monopolized the other two officers at the scene with her own remorse and guilt and, certainly, that remorse and guilt will be used by the defense saying that should be a mitigating factor. but i think the prosecutors have a point here that she had a chance to render aid and she didn t do it. it is remarkable. i wonder, when we look again at other issues connected to this ....

Defendant. police say that the adults in that home actually this is from police, that they groomed the girls for sexual assault. i want to listen to i ll tell you, we don t have the sound, belter s attorney argued that his client is, quote, tremendously remorseful for what he s done, and he went on to say this, there are clients never able to empathize with their victims no matter how much counseling they receive. chris isn t one of them. do you think that assertion had anything to do with this sentence, and do you think this is a man who is still a danger? i ll answer both questions and say the statement of remorse should not have had anything to do with whether he was held accountable. our criminal justice system sometimes will allow victims i mean defendants in this case, their actions, their conduct can be a mitigating factor but should not have been a sufficient factor to allow him ....

Up. we need better systems now to protect the country going forward in the months and probably years to come. i think for a lot of people, incredibly depressing to hear an expert like you say that, the idea the pandemic will stretch through another potential winter looking ahead to what s to come. talk about the short term. a lot of people are traveling labor day, doing stories about it, et cetera. unofficial end to summer, a lot of activities are outdoors which helps, that s a mitigating factor. do you think there will be a post labor day surge? when might we see some indications? two things. first, i don t want to make people hopeless. you can still do more things than you were able to last year as you are describing, during labor day. take time to travel, do outdoors activities, especially if vaccinated. we see surges after every major holiday, usually two to three weeks later. i expect to see those particularly among people that traveled to areas of the u.s. ....
