The Madras High Court on Thursday directed the State government to file its counter affidavit to a writ petition filed by former Chief Minister Jayalalithaa’s nephew J. Deepak challenging the validity of Tamil Nadu Puratchi Thalaivi Dr. J. Jayalalithaa Memorial Foundation Act of 2020, enacted for converting her residence, ‘Veda Nilayam’, into a memorial.
Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy agreed with Advocate-General Vijay Narayan that the petitioner may not have, prima facie, made out strong grounds for declaring the law invalid. However, they questioned as to how many memorials the government would keep establishing by acquiring private buildings and occupying public spaces.

The Madras High Court on Monday agreed to hear on January 27, instead of February 4, the writ petitions filed by former Chief Minister Jayalalithaa’s nephew J. Deepak and niece J. Deepa challenging the acquisition of her Poes Garden residence, Veda Nilayam, for conversion into a government memorial.
Justice N. Seshasayee acceded to a request made by Mr. Deepak’s counsel S.L. Sudarsanam since there was reportedly a plan to inaugurate the memorial on January 28, a day after inaugurating Jayalalithaa’s mausoleum at the Marina beach. The judge made it clear that he would hear the case only on the plea for interim orders. Advocate-General Vijay Narayan and Special Government Pleader E. Manoharan told the court that the government was fully entitled to convert the residence into a memorial since it had been acquired in accordance with law after depositing the compensation amount of ₹67.9 crore before the City Civil Court.

‘Jayalalithaa Memorial Foundation Act has been passed’
The State government on Monday contended before the Madras High Court that its officials were entitled to visit former Chief Minister Jayalalithaa’s residence Veda Nilayam at Poes Garden here since the legislature had passed the Tamil Nadu Puratchi Thalaivi Dr. J. Jayalalithaa Memorial Foundation Act, 2020.
The submission was made before Justice N. Seshasayee during the hearing of writ petitions filed by the former Chief Minister’s nephew J. Deepak and niece J. Deepa. They had been legally declared as her legal heirs.
The petitioners had challenged the acquisition proceedings and the award of over ₹67 crore passed by the acquisition officer. During the course of the hearing, advocate S.L. Sudarsanam, representing Mr. Deepak, complained to the court that even on Monday about four to five government officials were found to be inside Veda Nilayam, despite the court being seized of the two writ petitions in which the entire acquisition proceedings had been challenged.
