The petition was moved by Sameer Kulkarni, who, along with six others, including BJP MP Pragya Singh Thakur and Lieutenant Colonel Prasad Purohit, is facing trial for the blast at Malegaon on September 29, 2008.
Last month, a retired IAS officer, who gave the sanction to prosecute the accused under UAPA, had in her deposition said there was no independent reviewing authority in the state till March 31, 2009, as required under the amendments carried out to the Act in 2008.
The court said the issue can be decided only after taking into consideration the entire evidence.
