High Court said that CCI cannot investigate if a company has abused its dominant position while exercising patent rights; this can only be done by Controller of patents.
Among other findings, CCI concluded that mandatory pre-installation of the entire Google Mobile Suite with no option to un-install the same was an unfair condition on device manufacturers.
The Court prima facie opined that Star India was in a dominant position in the relevant market and had acted in contravention to the Competition Act’s provisions.
The CCI observed that the restraints imposed by Apple on app developers from reaching users of apple's mobile devices by forcing such developers to go through App Store is prima facie violation of Competition Act.
