martha: what about that? well, this is part of the unfortunate aspect of being a public figure. she s allowed to her opinion. she s allowed to disagree with a jury s decision. she s allowed to view what he did as murder. i think a court will allow that to be to remain opinion. even calling somebody a racist or white supremacist, the courts treat that as part of the public debate. they allow free speech to combat free speech. it s a huge cost to a teenager like kyle rittenhouse that just proved his innocence for a jury in wisconsin. but now he face as public forum, a trial before the public at large. there s a lot of people that won t accept any evidence to the contrary. it was clear in the media coverage. for a year, the media withheld facts that supported his self-defense claim. they repeated facts that were
self-defense claim from arms people who deputized themselves, and cbs is now saying this is an oversight in language. that s their way of correcting this is not an oversight in language, this is an oversight and facts. the bad part of this is cbs is not the only news i would to be putting out this information. there is no accountability pair that s the part that s the most frustrating. now you re going to see these protesters going on the street protesting about something they don t even know what they are protesting about. putting it out on the esteemed sunday show, they were just rife with misinformation. these facts have been out since day one. exactly. you don t have to be a juror to know it can be just have to do your research and read. and i was part of the conclusion by the way of the sandman court, it wasn t just the printing of the misinformation of the false fact, it was the amplification, the refusal to rectify that also led to them being held accountable. all right,
particularly when a person brings the weapon to the fight, as it were? exactly. and, you know, the prosecutor sort of made that point in her closing, not necessarily in rebuttal, but she said, you know, they were the ones that brought the gun to the knife fight, so to speak. well, in this instance, they brought a gun to arbery s jog. so there is in the law, there s this idea of proportionality, and the prosecutor made that clear that when you have a self-defense claim, you can only use a proportionate amount of defense to make yourself sort of safe in that regard. so, what is a proportionate amount of defense when somebody is unarmed? she noted over and over again, you know, the bagginess of arbery s pants, that it was clear that he went armed, that in the defendant s post-arrest statements, they did not make it clear that they thought necessarily that he was armed.
implemented by a citizen and whether that the crime and/or felony had to be committed within the direct presence or sometime thereafter. really, that s all the defense has their hat to hang on in this trial if they don t get the benefit of the citizens arrest law, their whole case goes down the drain because then they don t get to argue self-defense. the defense honed in on the key parts but the prosecutor did a great job rebutting it. in terms of the self-defense claim, she made it clear you can t claim self-defense if you re the one who started it. did she make that point effectively today? i think she did. i think she s done a really good job with using the totality of the circumstances, because sometimes you want to really break it down moment by moment to show that a split-second decision actually was something much longer, and that s what the
