Increased compliance burdens may lead to loss of customers
The Ministry of Electronics and Information Technology (MeitY) has prepared a draft Bill, titled the Digital Personal Data Protection Bill 2022 and has invited feedback from the public. The draft Bill sets out the rights and duties of the citizen and the obligations of the Data Fiduciary to use the collected data lawfully.
While the Bill takes several commendable steps to ensure that it complies with global standards of data protection, it nevertheless suffers from several infirmities that render its constitutionality questionable.
A rapid shift towards the digital modes of service delivery has highlighted the urgency to protect the privacy and security of the citizens’ data. Through a critical examination of India’s fragmented state of data protection legislation, we advocate for centralising the citizens’ rights in all policies and legislations.
