In her ruling, Justice Ngugi dismissed Mberia’s application and ruled it is not for the court to determine whether or not the Speaker will declare the seat vacant as a result of his conviction.
The judge further ruled that the court had not been shown a basis for staying the execution of a lawful judgment and sentence imposed against him under the Bribery Act.
"What this court can do is put in place administrative directions that enable the applicant to expeditiously prosecute his appeal and should it be successful, protect his entitlement to hold the public office that he seeks to protect," the judge ruled.

Nairobi Deputy Governor Anne Kananu will today (Tuesday) hold her first cabinet meeting.
This is even as the county government kicks of a public participation exercise to get the public's views on the state of service delivery in the capital.
As her first task, Kananu will hold the cabinet meeting which will be the first since 2019 when Sonko last called for one before the courts barred him from accessing his office over graft allegations.
This was confirmed by Health Services CEC Hitan Majevdia.

Kananu to hold first cabinet meeting after taking over City Hall

The meeting comes just over a week after Nairobi County Assembly Speaker Benson Mutura handed over the reins of City Hall to Ms Kananu ending his short stint as acting governor.
“We have been told there will be a cabinet meeting tomorrow (Tuesday) at City Hall but the official invitation and the agenda will be communicated later in the day,” confirmed Health Services CEC Hitan Majevdia.
The cabinet will then retreat to Mombasa on Wednesday for a meeting with Nairobi Metropolitan Services (NMS) team over the way forward for the city county.
This follows a similar meeting between NMS and Nairobi County Assembly in Mombasa last week over the state of the county.

The swearing-in of Speaker Benson Mutura as the acting Governor of Nairobi failed to take place yesterday.
Mutura was to be sworn-in just hours after Mike Sonko was voted out by the Senate following his impeachment by the county assembly.
Sonko was impeached by the county assembly over charges of abuse of office, gross violation of the law, committing a crime under the national and international laws and lacking the capability to run the county.
According to the law, the deputy governor takes over once a governor has been impeached and removed from office. But Nairobi has had no deputy governor following the resignation of Polycarp Igathe in 2018.
