Going forward? >> it would be removed in theory and in actual operational status what would happen is more litigation. so let's say a state court was asked to step in, the court probably would not say hands off, we can't do anything, they probably would give their decision, which would then immediately be brought to federal court. what this would do is it would transform all of these state issues into what they call federal question jurisdictions because all of the arguments would be that whenever the state legislature acts if you interfere with it that violates the u.s. constitution. >> right...
