Attorney General Kwame Raoul is asking an appellate court to vacate a temporary restraining order blocking enforcement of the state’s recently-passed assault weapons ban for some.
Republican state Rep. Dan Caulkins says he's collecting names from gun owners and firearms dealers who want to challenge the ban. A judge last week issued a temporary restraining order, but that only applied to about 860 plaintiffs in the case.
Multiple county sheriffs across the state have said they won’t enforce it. On Friday, a circuit court judge in downstate Effingham County issued a temporary restraining order blocking the new law — although that ruling only applies to the 850 plaintiffs and four licensed gun dealers named in the case.
