法警提告討加班費北檢敗訴確定要發加班費還要補休 - 社會

台北地檢署廖姓法警認為加班費只計入「值庭期間」、「解送人犯」，導致少領加班費，提告要求北檢給付6小時加班費與執勤費共1314元。台北高等行政法院審結，判北檢應作成處分核給廖員加班費1314元並給予補休4小時；全案確定。判決指出，2019年6月27日，廖員請北檢就同年月6月12日下午5時30分至隔日上午8時30分、共15小時執勤時間，核給6小時加班費1314元及9小時加班費630元，總計1944元。由於北檢超過2個月時間未決定准駁，廖員向保訓會提起復審但遭駁回，提起行政訴訟。 ....
