They didn t belong to trump. he didn t have this ability to keep them. but trump, what people argued is he doesn t see the national archives as this entity that really has teeth that he has to listen to. when the justice department got involved, it was a little bit different but it does raise questions about the correspondence and what that looked like. one thing that stood out, his attorney makes the argument that he has the power to declassify things. that s what we ve heard. he doesn t say that he did declassify all these documents that were unfoldered in these boxes. as we look at all of this, too, the message has been this well worn message. this is a witch hunt. this is all political. but based on everything we re learning, i wonder, perhaps the message hasn t changed from the former president himself. but is there a sense that this information could be taking the wind out of sails of others ....

we now know why this escalated to a criminal investigation. there s two sets of boxes here. it s the boxes that the fbi removed from mar-a-lago during the search warrant. we already know a good bit about those boxes because we ve seen this receipt for property that was laid out that there was classified evidence in those boxes, including sci, which is the highest level of top secret documents. however, there was a second set of documents, an earlier set of documents that archives, the national archives got from mar-a-lago. 15 boxes. and we knew next to nothing about what was in those boxes. but now we know a lot that s really important. we know they contain 184 classified documents. 25 of them were top secret. they contain donald trump s handwriting. we don t know when that got in there. they were unfoldered and intermixed with other documents. that tells me somebody was in there doing things, moving documents around. we don t know whether for good reasons or bad. and we know, not su ....

Exculpatory evidence. this is the part that stands out where evan corcoran is making this argument in a letter about a week before investigators visited mar-a-lago where he says that pursuant to a policy where the doj must present exculpatory evidence to a grand jury, we request that the doj provide this letter to any grand jury considering evidence in connection with this matter or any grand jury asked to issue a subpoena for testimony or documents in connection with this matter. that is a letter that was sent from trump s attorneys to the justice department officials on this case about a week before those very same justice department officials went to mar-a-lago to see where these documents are being stored. i want to note one other thing as evan was talking about what they found down there at mar-a-lago in the initial 15 boxes that were sent to the national archives, abby. they talked about how they were being kept. and basically they say that of the most significant concern was tha ....

Their merry time as well. to allow five months to lapse with those documents sitting there? it is important to keep in mind, during that crucial period in early 22, that s when this case escalated from the archives trying on get these documents back administratively, bureaucratically, into a criminal matter. that s one of the biggest questions we had answered today. how did this get to doj? how did it become criminal? they got the boxes, they saw there were documents that were un unfoldered. word of the day. unfoldered. me, too. but to see classified documents mixed in with newspaper clippings, photos, no wonder that s alarming. and then when they realized, we didn t even get them all. trump does not care about the national archives. he does not respect it as an institute. likely wasn t familiar with it. this is what i heard from people. clearly they made it very obvious they wanted these documents back. ....

Team. if this is the way he handled documents, former officials were not surprised to hear that there were boxes co-mingled, unfoldered, improperly identified newspaper clippings, i didn t know they were in there. i didn t take it on purpose. let s be clear, we re very focused on the defense because trump and his team. some of which are self-contradictory. if there will be a prosecution, prosecutors have to prove their case beyond a reasonable doubt. often the hardest part as a prosecutor is knowledge and intent. essentially that donald trump had some idea what was in those boxes and he acted with intent. you don t have to show that he understood each of the specifying elements. law. if it is the case this was careless, mayhem, chaos, that won t be enough for prosecutors. what about this claim that he had absolute authority to declassify documents? so two issues here. ....
