if paul manafort gets indicted, what? well, does paul manafort think donald trump will pardon him if he hangs tough? i m struck by this story, though, especially a cnn story out of fisa wiretapping which those things usually do not leak. i was thinking what will donald trump s reaction to the story be? and if i were he, not that i m usually in the business of giving donald trump advice, but he s a pretty shrewd fighter in certain ways. he will attack the leaks, outrageous leaks, he ll say they re coming from mueller. i don t think they are, but the fisa leak came from somewhere. if he wants to go on the offensive and try to rally his base to sort of preemptively not believe what mueller says and to begin discounting mueller, laying the groundwork for firing him, laying the groundwork for pardons, this is not a bad excuse for trump to begin doing that, i think. you agree with the position that the sheriff joe pardon was an exercise to get people used to the exertion of the pardon ....

Wiretapped and he was. it sounds like if it was, it was paul manafort s apartment and they followed the law. that s the problem with wiretapping. you may have a target of a wiretap, but that person is talking to other people and you pick up other voices. in a case like this, there are two ways they could have wiretapped manafort, through the foreign intelligence surveillance act and through what we call title 3. title 3 you need to show probable cause of criminal activity. the standard is lower under the other. you need to show probable cause that this person, the target, may be a foreign agent and sometimes we act unwittingly as foreign agents. maybe knowingly acting as a foreign agent. if you can make that showing to a court, then you will get your warrant, you are going to get your wiretap. the numbers over the decades bear it out. they grant these warrants in almost all of the cases. ....

With the russians and that was able to restart if i can add one point. the fie sa court has often been accused of being a rubber stamps for prosecutors, they don t turn down a lot of warrants. however, this is the real world, this judge, we don t know who the judge was, had to know that paul man forwas likely speaking to the president elect or president of the united states and they were not going to willy kneelly give any sort of warrant absolutely. the fbi must have had some considerable interest to get the court to grant the warrant. what exactly manafort did to help the russians with the pain and what exactly the second round of wiretapping began and ended. we don t know yet who the person is or persons, plurl, who talked to manafort who were russians. what we do see here is the court ....

Were wiretapping me. see, they did have potential wiretaps in trump tower. that would be my guess. there s no evidence they were wiretapping him. some indirect vindication of what he said earlier. look, this is a serious matter and something that the president and his team should be concerned about. i mean depending on what the nature of this potential indictment is and whether it implicates manafort and some activity in the campaign or something outside the campaign, i don t think we know that yet. but it certainly has to be a concern to them, and from my perspective, you know, best left alone and focus on the things at hand, which is what he s doing at the u.n. and hopefully trying to get a health care bill passed here and other things that would not add to the story if i were them. mark, is this vindication because his own justice department came out just a couple weeks ago saying there was no evidence, and wouldn t his justice department know about this as well? ....
