On March 3, 2021, the
Resolution That Establishes the Goods Whose Import and Export Are Subject to Regulations Issued by the Ministry of Energy (the “Resolution”) was officially suspended through a resolution published in the Federal Official Gazette by the Ministry of Economy and the Ministry of Energy (
Secretaría de Energía, “SENER”) in accordance with the precautionary measures ordered in the
amparo proceeding 16/2021 (the “Suspension Resolution”).
As mentioned in our
previous Legal Update, the permitting regulations for the import and export of hydrocarbons and petroleum products that were originally published by the SENER on 2014 will continue to apply to all companies requesting permits before the SENER. ....

1 it is informed that the Resolution that establishes the products whose import and exports is subject to regulation by the Ministry of Energy (the Resolution ) was published on December 26, 2020 and entered into effect on the 28th of the same month and year.
As reported by White & Case, on December 1, 2020, the Ministry of Economy (
SE ) and the Ministry of Energy (
SENER ) published before the National Commission of Regulatory Improvement the preliminary draft of the Resolution, in order to consolidate, update and modify the current regulations regarding import and export permits for hydrocarbons, petroleum products and certain materials, equipment and nuclear fuels, which are the responsibility of SENER and the National Nuclear Safety and Safeguards Commission. ....

On December 1, 2020, the Ministry of Economy ( SE ) and the Ministry of Energy ( SENER ) published the preliminary draft (the Preliminary Draft ) of the Resolution that establishes the products whose import and export is subject to regulation by the Ministry of Energy (the Resolution )

The tariff codes of the products that will be subject to regulation by SENER and the National Nuclear Safety and Safeguards Commission (
CNSNS ) are established, whose compliance must be evidenced before the corresponding authorities;
Control measures are established by means of prior authorization requirements to be granted by SENER through the CNSNS, to the import and export of nuclear materials and fuels, radioactive materials, equipment that generates ionizing radiation, equipment and dual-use goods in nuclear matters and related technology that are susceptible to diversion for the prolife ....
