DACH roundup: German parliament eases Pensionskassen bailouts

The German parliament, Bundestag, has approved a law that facilitates the bailout of Pensionskassen by sponsoring companies.
The new section 234 paragraph 7 of the Insurance Supervision Act (VAG) gives Pensionskassen the opportunity to change their statutes to improve the framework conditions to receive funding from employers if their financial situation deteriorates.
The new rule should enter into force in 2022.
Sponsoring companies currently deploy their own funds to close deficits in Pensionskassen, ultimately covering also employers that do not provide financial support to pension funds.
This, according to the legislator, leads to a blockade, with either all sponsoring companies agreeing to financially supportng Pensionskasse or none. The mechanism may become unsustainable particularly for Pensionskassen structured with multiple sponsoring companies. ....

BaFin reviews solvency rules for Pensionskassen, Pensionsfonds

The German financial supervisory authority, BaFin, has stressed the need to comply with the strict solvency rules for Pensionskassen and Pensionsfonds in the new circular 5/2021(VA).
The regulator has thus amended the circular 4/2005 (VA) on solvency rules for insurance companies following the implementation of the EU Directive 2016/2341 on the activities and supervision of institutions for occupational retirement provision (IORP II Directive) into German law.
The new circular addresses Pensionskasssen, Pensionsfonds, Sterbekassen and insurance companies.
According to BaFin, which offers a binding interpretation of the solvency rules in the Insurance Supervision Act (VAG), creditors of subordinated loans are already liable before the insolvency of a Pensionskasse or a Pensionsfond, if the regulator approves the decision for occupational pension institutions to cut benefits or orders it according to Section 314 paragrap ....

Caritas, Kölner Pensionskassen close business after restructuring

The Pensionskassen for the catholic aid organization Caritas and its affiliate Kölner are liquidating their pension businesses following a restructuring process.
The duo will, however, continue to operate for a “very long period of time” in order to phase-out the existing pension contracts of the members, they announced. Existing contractual relationships or other agreements do not fall under the process of liquidation, the funds said.
The German financial regulator – BaFin – has also revoked the license to operate both schemes’ insurance businesses based on Section 304 Paragraph 1 No. 2 of the Insurance Supervision Act (VAG).
According to such section, the Pensionskassen are not allowed to sign new insurance contracts or extend existing insurance contracts. ....
