ROME — To escape persecution in his homeland, a 27-year-old Pakistani man walked over mountains and through woods on an arduous 18-month journey across Bosnia, Croatia and Slovenia until he finally reached the Italian border.
A few hours later, Italian guards in the city of Trieste took him to a hill, counted to five, and told him to run back across the border into Slovenia, he recalled. The following day, he said, the Slovenian authorities handed him over to Croatian police at the border, who beat him with batons wrapped with barbed wire as he lay handcuffed before deporting him to neighboring Bosnia. ....

We warmly commend the decision of the Court of Rome, deeming the pushbacks of asylum seekers and migrants on the Italian-Slovenian border illegal; condemning the Italian Ministry of the Interior and acknowledging the inhuman and degrading treatment migrants are subjected to along the Balkan Route; Euro-Med Human Rights Monitor said in a statement today. We further urge the EU Commission to step in to put an end to Italy s informal readmissions and illegal push backs in the Balkan Route.
On 18 January 2021, with a 13-page verdict the Judge Silvia Albano of the Court of Rome declared the illegality of informal readmissions of migrants and asylum seekers to Slovenia, increasingly carried out by Italy since the Spring of 2020, on the basis of a bilateral agreement with Slovenia signed in 1996 and never ratified by the Italian Parliament. ....

A court in Rome has ruled that “informal readmissions” from Italy to Slovenia are unlawful, in a case concerning a Pakistani asylum seeker who was subjected to a series of violent pushbacks stretching from Italy to Bosnia-Herzegovina.
Informal readmissions unlawful
A ruling by Rome tribunal (personal rights and immigration section) on 18 January 2021 declared the practice of informal readmissions from Italy to Slovenia that have intensified since the spring of 2020 to be unlawful,

The ruling concerned a case brought by lawyers Caterina Bove and Anna Brambilla on behalf of a Pakistani asylum seeker who was sent back from Italy after reaching Trieste, and who ended up living in destitution in Sarajevo in a case involving serial pushbacks. ....
