JOHANNESBURG (Reuters) - A South African judge said he had halted the radio frequency spectrum auction planned this month by regulator ICASA because he deemed the process unlawful and irrational.
High Court Judge Selby Baqwa passed an order on Monday prohibiting the Independent Communications Authority of South Africa (ICASA) from proceding with the auction, pending a hearing on contentions raised by telecoms operator Telkom and broadcaster e.tv.
The reasons for his decision were not contained in the order shared with journalists at the time.
At the heart of the dispute is a decision by ICASA to put up for auction the 700MHz and 800MHz spectrum bands, currently used by television broadcasters, before the migration of broadcasting services to digital from analogue has been completed. ....

South Africa’s telecoms regulator Icasa said on Tuesday it will appeal a court order restraining it from proceeding with an auction of radio frequency spectrum licences, needed to lower data costs, expand 4G capacity and roll out new 5G technology.
On Monday, High Court Judge Selby Baqwa passed an order prohibiting the regulator from going ahead with the auction pending a hearing on contentions raised by operator Telkom and broadcaster e.tv.
Monday’s ruling is a major blow to the industry, especially mobile operators MTN and Vodacom, who have been forced to re-purpose their existing allocations of 2G and 3G spectrum to deploy new 4G technology in the absence of new licences. ....

The auctioning of high-speed internet spectrum will face further delays in South Africa after Telkom won a court ruling suspending the process.
This week the Pretoria High Court ruled that the Independent Communications Authority of South Africa (Icasa) should hold off on the auction and lift a deadline for the submission of final bids while Telkom’s case is considered.
