Just days from the NSW ski season opening, the NSW Land and Environment Court (Court) has delivered its second decision in relation to the ongoing prosecution of Charlotte Pass Snow Resort Pty Ltd (Ski Resort) by the Environment Protection Authority (EPA). 
This article explains two key rules applying to NSW environmental prosecutions after the Court s two Ski Resort decisions or, in the spirit of ski season, après ski . Whilst procedural in nature, these rules are important as they can materially affect the outcome of environmental prosecutions.

Key takeaways from government response to Productivity Commission s Review of Infrastructure Contributions in NSW
The government response was released on Friday, 5 March 2021. In summary, the government has accepted all of the recommendations of the NSW Productivity Commission – a somewhat extraordinary outcome.
The government response will require a slew of legislative changes. Some of the key changes are:
Changes to rate pegging: Local councils will be able to grow their rate revenue as their population increases – a logical and long overdue reform which should relieve some of the pressure on developer contributions to cover funding gaps.
Introduction of a “direct land contribution”: This will be a requirement for a landowner whose land is rezoned to pay money, or dedicate land, which will be secured by a charge on the land. The payment/dedication will be required to be made either on sale or development of the land. ....

Six hours north of Sydney, a straight shot up the Newell Highway, lies the Pilliga Scrub: the largest remaining stretch of native forest, west of the Great Dividing Range.
Pilliga (or
Billarga) is a Gamilaraay word meaning ‘swamp oak,’ reminding visitors that these woodlands are sites of unceded Gamilaraay land. During a trip up to Narrabri in February alongside a group of students from universities across Sydney, I had driven up to Narrabri in rural northern New South Wales with (admittedly) little-to-no knowledge as to what to expect.
