Suit filed by mothers of overseas-born children, NGO to be heard on June 30


KUALA LUMPUR: A lawsuit filed by an NGO and six mothers seeking for overseas-born children to be given citizenship will be heard at the High Court on June 30.
This is following a decision by Justice Akhtar Tahir that dismissed the government s application to strike out the suit.
In his decision, Justice Akhtar ruled that the main lawsuit was not frivolous, vexatious and an abuse of court process.
Lawyer Datuk Dr Gurdial Singh Nijar told reporters that the court found there was no justification by the government in its application to strike out the suit.
On the face of it (the lawsuit), there is apparent discrimination. The legal action will proceed and the court has given us a hearing date on June 30, he said here on Thursday. ....

Kuala Lumpur: The government today failed in its bid to have the court throw out a lawsuit filed by a civil society and six Malaysian women who are married to foreigners for their overseas-born children to have the right to become Malaysian citizens.
High Court Judge Datuk Akhtar Tahir, in dismissing an application by the Attorney-General Chambers (AGC)  to strike out the lawsuit, rejected  the government’s argument that the court case was frivolous.
He said there  was clearly discrimination in Malaysia’s citizenship laws against Malaysian mothers, which the government has to justify in the lawsuit. ....

KUALA LUMPUR, April 27 The Malaysian government today argued that the High Court should strike out a lawsuit filed by several Malaysian mothers with foreign spouses who want their children born abroad to automatically be recognised as Malaysian citizens.
But the mothers’ lawyer said that the doors of the courts should not be closed to them at this stage and that they should not be denied access to justice, and the High Court should hear their court challenge instead of throwing it out now. ....

AGC seeks to strike out mothers' child citizenship suit


KUALA LUMPUR (April 27): The government of Malaysia has asked the High Court to strike out a lawsuit filed by civil society and six mothers, who are married to foreigners, for their overseas-born children to have the right to become Malaysian citizens. 
Among the grounds cited for the striking out of the application were that the suit, which was filed by way of an originating summons, was scandalous, frivolous and vexatious and an abuse of court process. 
Senior Federal Counsel Ahmad Hanir Hambaly, who acted for the government, said that under the Federal Constitution in relation to children born outside of Malaysia, it was crystal clear that only those born to a Malaysian father would be entitled to citizenship by operation of law.  ....

SHAH ALAM, April 23 The High Court today ordered for Nigerian man Simon Adavize Momoh to be released, which means he would be able to be reunited with his Malaysian wife and their two young Malaysian children soon.
High Court judge Datuk Ab Karim Ab Rahman ordered for the release to be done as soon as practical, after having found that Simon was detained unlawfully and unconstitutionally. ....
