Brayden Bushby should spend several years behind bars at a federal prison for his role in the death of Barbara Kentner of Wabigoon Lake Ojibway Nation, both Crown and defence lawyers agreed at his sentencing hearing on Wednesday.
But the decision as to how long of a sentence Bushby should receive rests with Superior Court Justice Helen Pierce, who has reserved her judgment to May 4.  ....

More than four years after Brayden Bushby threw a trailer hitch from a moving car, striking Barbara Kentner of Wabigoon Lake Ojibway First Nation in the abdomen while she was out for an evening walk with her sister in a residential neighbourhood in Thunder Bay, Ont., family members will have a chance to tell the court how Bushby s actions have caused harm to them and the broader community. ....

Bushby manslaughter sentencing hearing could consider factors such as racism, community behaviour


A manslaughter conviction has a maximum sentence of life in prison, but does not carry a mandatory minimum.
Donald Worme, a lawyer in Saskatoon, who is also a member of Saskatchewan s human rights tribunal, said there are six guiding principles that are considered during any criminal sentencing, including an attempt to denounce the crime and deter others. 
As well, Canada s criminal code provides for harsher sentences for crimes motivated by bias, prejudice or hate against identifiable groups.    
Though the four-day trial did not question Bushby s motivation, with no direct evidence that the act was intentionally racist, Worme said the local history of acts targeting the Indigenous community could be considered. ....

Young Man Who Threw Trailer Hitch to an Indigenous Woman Found Guilty of Manslaughter


The young man who threw a trailer hitch to an Indigenous woman was found guilty of manslaughter after the woman died six months later.
Following a four-day trial last month, Superior Court Justice Helen Pierce released her ruling against Brayden Bushby on Monday, according to a Canadian Broadcasting Corporation s report.
The suspect, 21, had already pleaded guilty to aggravated assault. Bushby admitted that he threw the object that struck Barbara Kentner from a passing vehicle. The aggravated assault charge has been maintained due to the manslaughter conviction.
Kentner was a 34-year-old mother. She hailed from Wabigoon Lake Ojibway Nation and died on July 4, 2017. ....
