JCC fact-checks Faris on procurement law

President of the Joint Consultative Council for the Construction Industry Fazir Khan fact-checked the Attorney General and called for further clarification of aspects of the new procurement legislation in a release sent to the media on Wedensday.
The release was sent days after a press conference at the Attorney General’s office on St Vincent Street, Port of Spain where the AG explained parts of the legislation and called for public bodies to speak “facts,” as well as calling on media houses to do fact-checking whenever quoting public figures.
Khan first agreed with the AG that the Office of the Procurement Regulator still has oversight of the disposal of public property, but said contrary to the AG’s statement that government had aggressively pursued the implementation of the regulation, the former president had not appointed the regulator until 2018. ....

Some clarity needed

Permit me on behalf of the Joint Consultative Council to address Attorney General Faris Al-Rawiâs statement via a news conference on Monday.
First, we agree that only Clause 5 of the Amendment Bill makes a tangible difference to the original act in seeking to amend Clause 7. To clarify, the AG is correct that the OPR still has oversight on the disposal of public property, and it is unfortunate that some commentators have misinterpreted the removal of Clause (o) from Section 13 (1) of the act via Amendment Bill Clause 6.
The AG states repeatedly in his discourse, however, that the Government has aggressively pursued the implementation of the procurement legislation and he laid the blame squarely at the feet of the former president for not appointing the Regulator until 2018. We need to inform the public that the fact is that it was the civil society groups, including the JCC, that pursued the former president on this matter. JCC to AG: Enlighten the public on procurement issues

The Joint Consultative Council for the Construction Industry (JCC) has called on Attorney General Faris Al-Rawi to advise on specifically what is missing from the draft regulations so that the public can get a sense that the Government is actually aggressively pursuing operationalisation of the Office of Procurement Regulator (OPR).
JCC president Fazir Khan stated in a news release yesterday that civil society groups do not have a cadre of lawyers at their disposal, like the AG or the Finance Ministry, and would therefore welcome full disclosure at this time from the offices and officers who are responsible for all activities required for implementation and full proclamation. ....
