I am writing to ask you, Hon Chris Bowen MP, as the Minister for Immigration and Citizenship, to uphold Australia’s legal and ethical obligations towards children seeking asylum in Australia.. . As a country, Australia ratified the UN Convention on the Rights of the Child in December 1990. This committed the Australian Government to upholding the rights of all children in Australia. The announcement to have unaccompanied children deported under the proposed Malaysia solution is a clear violation of this convention.. . Under obligations set out in the Convention on the Rights of the Child, all unaccompanied children seeking asylum in Australia are entitled to:. · appropriate protection and humanitarian assistance. · receive the same rights as children have in Australia. · not be subjected to cruel, inhumane or degrading treatment. · prompt access to legal and other appropriate assistance. . To send unaccompanied children to a country which has not signed the 1951 Refugee Convention and Convention against Torture is seemingly a breach of Australia’s legal obligations as well as lacking care and compassion.. . As Immigration Minister and the official guardian of all unaccompanied minors in Australia, your actions reflect on us all. You have a specific responsibility to ensure Australia complies with our legal obligations and I would urge you to act in accordance with our international and moral obligations.. . Can you please advise what steps are being taken to review your policy with the Australian people. Can you also advise the steps your department is taking to work with state and local authorities to minimise the impact these policies are having on the mental health of the remaining refugees.
