Detailed description is The Coalition Protecting Auto No-Fault (CPAN) is a broad-based, bipartisan coalition of 26 professional associations formed in 2003 to preserve Michigan’s model no-fault automobile insurance system.. Consisting of 15 major medical groups and 11 consumer groups, CPAN’s primary mission is to make sure that the Michigan auto insurance industry keeps the solemn promise made to Michigan citizens when the No-Fault Act was passed in 1972. That promise was essentially this:. . The no-fault law will guarantee payment of lifetime medical and rehabilitation expenses for all individuals sustaining injury in motor vehicle accidents regardless of fault, in exchange for reasonable and fair limitations on the rights of seriously injured victims to recover noneconomic damages from drunk and reckless drivers who cause injury.. . Several years ago, the auto insurance industry launched a vigorous campaign to break the original promise of no-fault. That campaign has been waged in the Michigan Legislature and the Michigan Appellate Courts, where the insurance industry seeks to significantly limit no-fault insurance benefits while advocating severe restrictions on the legal rights of innocent victims.. . Unfortunately, the insurance industry has achieved some success in its efforts to break the no-fault promise. In the last few years, insurance companies have won several important appellate court decisions which have resulted in a substantial loss of rights for injured people. In addition, the insurance industry has proposed legislation that would reduce insurance benefits, adopt managed care, impose medical fee schedules, and allow insurance companies to write policies that would pay for only a fraction of the medical expenses suffered by a catastrophically injured person. These very serious efforts by the insurance industry to judicially and legislatively erode the fundamental nature of Michigan’s original auto no-fault law are what led to the creation of CPAN.
