Well, kate, we expect that the former president is going to come to washington tomorrow. He had the option to do this first appearance via videolink. He can do this by zoom from his golf club in bedminster, new jersey. Instead, hes likely to come here and do it in person. Instead, hes going to be read these charges and we expect that hes going to plead not guilty and this begins the court process. Those four charges, of course, that you just read right there are what he is facing the prosecution made it clear in this 45page indictment that the president had the right to challenge the Election Results and he had the right to even lie about fraud. What he did not have the right to do is to engage in these multiple conspiracies, one to defraud the United States and the government from the ability to count the votes, defrauding, obstructing the process of congress to certify the Election Results and of course, denying the right of millions of americans of their having their vote counted. This is how jack smith put it yesterday after the indictment had been released. The attack on our nations capitol on january 6, 2021, was an unprecedented assault on the seat of american democracy. Its described in the indictment. It was fueled by lies. Lies by the defendant targeted at obstructing a Bedrock Function of the u. S. Government, the nations process of collecting, counting and certifying the results of the president ial election. And one of the things that you see in this indictment is prosecutors tying the violence that you saw on january 6th, tying it to the former president s, fort to exploit that violence, to try to find a way to remain in power. They say for more than two months following the election day, the president determined fraud in the election and that he had actually won. So you will hear obviously from the former president and his lawyers that this was an assault on free speech and thats what you will hear from them. The prosecution here has really made this a very narrow case, guys. You notice that the codefendants are not actually named and theyre not charged in this indictment and its clear what they want is to bring this case to trial as soon as possible before the 2024 election and now its in the hands of this judge. Cnn has been able to identify five of the six. They are not named as they are not charged with any kriecrimes, but that doesnt mean they are out of the weds. Cnns Jessica Schneider has more on this. If they are charged what kind of charges could they be facing . They could ultimately face any number of charges and it is likely that they could be similar to the charges that donald trump is face. Hes facing Conspiracy To Defraud the United States and charges related to obstructing the certification of the election so maybe those are some of the charges these coconspirators could face. Special counsel jack smith has been very clear that this investigation continues. So its likely that at least some of these six coconspirators could face charges or at the very least maybe theyre mentioned in the indictment under coconspirator, one, two, three, et cetera, just to highlight a few of these coconspirators here, cnn has identified Rudy Giuliani as coconspirator number one. Hes described in this indictment as an attorney who is, quote, willing to spread knowingly false claims and pursue strategies that other attorneys involved in the Campaign Just wouldnt after the 2020 election. So that description alone really indicates that charges could be coming here because giuliani was front and center pushing these Election Claim Election Fraud claims. Coconspirator number two weve identified as former trump lawyer john eastman, he circulate circulated a twopage plan to overturn the election and eastman has been trying to fight Disciplinary Proceedings in california as he tries to keep his law license. On top of that there could be more legal fights to come if hes indicted and coconspirator number three, former trump lawyer, sydney powell, she, too, has faced Ethics Complaints in a few states after her conduct after the election. Shes described in this indictment as circulating claims of Election Fraud that even trump acknowledged sounded crazy. So this isnt the end, guys, with this indictment of the former president. Rudy giuliani spoke out last night and kind of reacting to the indictment and also just what could be coming for him. Lets listen for him. Lets listen to this. Violating the right of free speech of an american citizen, never mind whether he was president or not. It could be anybody. It could be a homeless person. You dont get to violate peoples First Amendment rights no matter who the hell you are or no matter how sick you are with Trump Derangement syndrome and this isnt the first time youve acted like an unethical lawyer. It should be the last hes not charged. He is an unnamed coconspirator in this indictment. What do you see in that reaction . Okay. This argument about Free Speech Being on trial here. Kate, im going to burn your house down. If i say that to you in seriousness and then either take steps toward burning your house down or believe it, i could be charged with a crime. The idea that there are statements that are not criminal or may not be wim nal is foolish and that is not how the law works and it has broad latitude to speak and uttering words absolves him from all criminal liability is silly. But its not just Rudy Giuliani making this case. You have john lauro, one of his attorneys kind of saying saying, let me play this. Sure. So at the end, our defense is going to be focusing on the fact that what we have now is an administration that has criminalized the free speech and advocacy of a Prior Administration during a time that there say political election going on. So i think the question then, im curious and youre getting at it and where the beginning and ends and where the boundary of the defense and how does it fit into this indictment . Its blurry and fuzzy, and to be clear, many of the things in the law will be subjective. As to the bounds of the First Amendment defense. If the president were charged with just his speech on january 6th with saying were going to march down to the capitol and fight like hell, i think youd have a very strong First Amendment case there. A candidate for Office Making aggressive claims, but certainly nothing that is a slam dunk for saying that high incited people for violence. It lays out over a period of months over trying to sub jvert the will of the American Voters and conduct in serve states that goes beyond simply than the words the president uttered on january 6th. Look at the sound strategy from a Defense Strategy and its probably what i would do if i were defending him and i would make it all about just the speech on january 6th, but there is far more conduct than that. Tomorrow begins the most immediate steps in the process with him facing arraignment. Timing of all of this, do you think i mean, its impossible to guess, but do you think do you see this case as more or less complicated than a classified documents class . I think yes and no. The classified documents case is really two cases when you think about it because number one, youve got the classified documents portion of it and thats complicated and it will take a long time to get that to trial because you have to litigate it, but theres another portion of that which is Obstruction Of Justice which is quite straightforward and they could have if they could have brought that to trial tomorrow. This is less complicated because you dont have all of that National Security information that you have to fight about. There will certainly be things that the defendants will challenge throughout this case, but it is more straightforward. What does a judge do in this . I think last hour i was just going through how this calendar lines up with the political calendar, legal and political, are not the same things. We do know that. Whats a judge to do . The judge will bring the parties into court and say i am setting this trial for june 15th or whatever and the defendant will say i have another trial, and the judge may choose to delay her trial and she can talk to the other judges and they communicate with each other and its a question of scheduling for individual judges and to protect the defendants rights for a fair trial and its for his protection this they want to get these cases brought up as quickly as they can. Very quickly, to go full circle, would you surprised if no one else is charged and if these remain uncharged, unnamed coconspirators. How is this playing with his supporters . Many now starting to react as, you know, as this indictment is settling in. Well, as far as i know and ive spoken with many of Donald Trumps supporters and they are very much behind him and they believe that he did not commit any crime and i was with him in yea erie, pennsylvania and i spoke with donald Trump Supporters and they argueded and used the same rhetoric that donald trump has been using is that he is the target of political persecution, that he is a victim of an unfair Justice Department and they really do believe that he did nothing wrong, kate. Well, first, thanks for having me, john and second, what they were after was evidence that helped them establish probable cause before a grand jury. It was the grand jury made up of citizens who determined there was probable cause to move forward and that evidence probably helped them put together the entire story that we see in this indictment which is pretty damning, but if youre here in arizona and you were running elections like i was in 2020, you already know that the big lie was a big lie. Now we have an indictment that illustrates it pretty clearly for the rest of the nation. You say the big lie was the big lie and in the indictment the prosecutors point out that donald trump is entitled to lie to the american people. Its not a crime to lie to the american people. You need to have corrupt, illegal actions. What illegal actions do you think took place in arizona . Well, the corrupt actions were an attempt to it was laid out pretty easily. Ask the speaker of the house to call a special session to set aside the votes and thats the real problem that i see here is the attempted abuse of arizonaans of the right to vote. Arizona voted a particular way, and it may not have gone the way mr. Trump liked and maybe he does have the right to lie, but he doesnt have the right on to pressure the government to overturn american votes and thats where this becomes a problem and the fact that he tried with other people and other people helped him with this push, with this attempt to overthrow the government, thats where the conspiracy comes in. If there ever was a reason to have the rule of law, to have people held accountable for crimes, this is it. This is going to be the true test of american democracy, whether or not this can be meted out. What has the impact of all of this been on the ground in arizona in term of the faith of the voters there . Well, i think overall voters can have faith that systems are systems and they operate at lightning speed, but our process guaranteed by the constitution is guaranteed and lets not forget the defendant still has fourth, fifth, Sixth Amendment Rights and he deserves a fair trial and he will get one and thats what we want, right . But at the end of the day folks want stable, reasonable, reliable government. They want folks who will be levelheaded, apply the law and move things forward because the business of america is business and the business of arizona is business and folks want to get around their own business and i think mr. Trumps grip on the Republican Party here is loosening. I think his grip on American Politics is loosening, and i cannot wait for this country to be able to move forward and get on with the ret of what we need to do. Do you expect the evidence that you provided will come to light in the trial when and if it takes place . Well, interestingly, a lot of what was provided was discovery from two prior cases and some of what was discovery and it was never presented publicly at a trial and again, as i indicated before i will not be a fly in the ointment to the prosecutors and they will get to choose how they prove their case into a trial if it happens and the defense will be able to use any evidence disclosed in any way they see fit and again, thats the process. It has to play out and we want it to play out and thats the faith. The civic faith that americans should maintain in our systems. I hold this faith try, and i trust that this will be a fair process when this is over, and im glad we helped do our part for moving the chains. Mr. Fontes, thanks so much for coming on. Youre not hearing much defense in the former president s conduct in the runup to january 6th and youre Hearing Accusations from leading republicans and Speaker Mccarthy of bias by not pursuing the hunter Biden Allegations and instead pursuing an indictment against former President Donald Trump, but i did put the question to several top senators last week right as we were expecting a third donald trump indictment. Some of them indicated that they believe it will ultimately help trump politically and others said that donald trump was not responsible for any of the violence that occurred on january 6th. And so these strategies to dig back as far as you can and trump up some charges against him is just backfiring. Well, when they were in the building. Im not saying they were responsible. They were involved. Hopefully in a good way. Senator tuberville walking back his claims that the fbi was somehow involved with what happened that day on january 6th and we are seeing a difference in the approach to this indictment from the Top Republicans in congress. Mitch mcconnell, the senate gop leader has been silent so far, unlike Speaker Mccarthy who has defended donald trump and that has been similar to the past two indictments, but it also underscores how different these two leaders view donald trump, his role in the party and how to respond to these charges, kate . And what hes talking about there he believes there should be a higher par abar and hes lg into the Justice Department. No matter how this plays out why are republicans leaning so hard into this . What effect do you think this eventually has . Its very simple. All you need to do is look at poll numbers and this is what members of congress see and hear every day and as weve seen with the way Congressional District lines are drawn, republicans have overwhelmingly republican districts and democrats have overwh overwhelmingly democratic districts and theyre first in their mindset. Isnt that a little bit of a chicken and an egg thing and just leaning in on that, right . Absolutely. The constituents are feeling this way because theyre being told this over and over again by their leaders or is it the other way around . Well, you have both of those and then you also have what theyre not being told and if youre a republican who is running against donald trump at least in Theory Running against donald trump for president in a normal political world you would use multiple indictments as an opportunity to attack your opponent, but what weve seen so often, mike pence and Chris Christie and Asa Hutchinson is a reluctance to go after donald trump on anything and as he goes through this process where we not only have to see the government prove what donald trump did and also what his intent was, we know that donald trump will use a George Costanza defense that its not a lie if you believe it. His base reacts accordingly and members follow in that way, as well. Van, were not forgetting you because i have a lot of questions for you. Its not just that these other republicans are standing by and in some cases theyre defending and parroting trumps defense. Trumps campaign right now is all about being targeted unjustly by the Justice Department and its central to his campaign and you have more than half of the republican field buy into that and thats got to have an impact in the primary. Doug . Oh, im sorry. I thought that was for van. Yes, it absolutely has an impact in the primary and thats what were seeing, we are about three weeks away now from the debate, we dont really know if anybodys going to say anything critical of donald trump in any real capacity at this debate. How theyre campaigning is essentially a campaign of hope. They hope that somebody else will knock off donald trump. They hope that donald trump will go away on his own, and i can tell you in any campaign and legislative strategy that ive been involved in hope is not that strategy. You have to put plans in action and thats what were not seeing these members and these candidates do which tells us that nothings going to change unless the candidates try and change it themselves. One person in this whole republicanfocused conversation, i am very interested in hearing from if and when it happens is Mitch Mcconnell. I want to play for everyone just a reminder of Mitch Mcconnell from February Of 2021 and this is as republicans in the senate were deciding they were voting against convicting the president of impeachment and this is what Mitch Mcconnell said around that. Listen. President trump is still liable for everything he did while he was in office. As an ordinary citizen unless the statute of limitations is run, still liable for everything he did while he was in office. He didnt get away with anything yet. Yet. We have a criminal Justice System in this country. We have civil litigation, and former president s are not immune from being accountable by either one. Hes talking about this exact scenario. Yeah. Has he painted himself in a corner . Well, well see, but you know, hello . Here we are. You said youre not going to convict him in the senate because the criminal Justice System can do its job. Well, guess what . You woke up in this country where the criminal Justice System is desperately trying to do its job. What is its job . Count number four in the indictment is the most important one for me, the conspiracy against rights. What right . The right to vote. The right to have your vote count in this country. Thats what donald trump has thrown in the garbage can. I dont care about your right to vote. I dont want to lose face and leave office. You have a prosecutor standing up and saying, you know what, mr. President . Youre a fraudster, and more importantly, the right to vote counts and i will defend that right to vote. A jury has reached a verdict on whether the pittsburgh synagogue mass shooter should be sentenced to death. This is the man convicted of killing 11 people and injuring six others at that synagogue in 2018. So lets get right to cnns Danny Freeman for the latest on all of this. How will this play out over the next few minutes, danny . Yeah, so, john and kate, we just got notice about 15 minutes ago that the jury has reached a verdict after only ten hours of deliberation on this question of life or death for 50yearold Robert Bowers who as you said, committed that Atrocity Back in 2018 at the pittsburgh synagogue here in the city. So heres what were expecting at this point. At this point the jury is still i stand corrected, we are just getting information from the courtroom the jury is walking in now, john, as we speak, and we are expecting a few different things. This is a long process to actually get to the point of making this decision whether it is death or life in prison. There are right here, i have the jury form right in front of me, there are more than 100 mitt ga Mitigating Factors that the defense has put up to spare mr. Bowers life. They said these are the factors that the jury should consider when theyre thinking about whether or not to kill him. The prosecution, though, they have a number of aggravating factors that say these are the reasons why bowers should be sentenced to death. The judge in a matter of moments is going to read off all of the aggravating factors and all of those Mitigating Factors, like i said, over a hundred and the judge will read out how the jury basically weighs those two elements. So if the jury is unanimous in the aggravating factors, but only a few of them think that some of the Mitigating Factors are important, that is what were going to hear in the next couple of minutes and john, this is important because the Death Penalty here and the decision to give bowers the Death Penalty or not is mathematical or presented this way. The judge says to the jury you have to take all of these aggravating factors and take all of these Mitigating Factors and weigh them basically on the same scale and see which one comes out as more important in this jurys mind and then and only then can you make a determination if you are going to sentence to death or life in prison. And just to give you an example, some of the aggravating factors, the prosecution said includes the shooter showed no remorse and they targeted jewish people and that Robert Bowers suffered Mental Illness or he had a hard childhood. The jury is in and we should be getting this decision on life or death momentarily, john . Kate . All right.
