A little bit later today, donald trump will be under arrest in a washington, d. C. , Federal Court and new reporting in the case against him in this latest indictment. Huge Security Preparations are under way because of that, and washington, d. C. , security is on alert because of it. What is happening ahead of this historic moment. I have come to believe that he knew well that he had lost the election. An extraordinary interview with former attorney general bill barr and why he believes that the information in the indictment is the tip of the iceberg against donald trump. Federal court later today, donald trump will be under arrest, and those are live pictures, and that is where it will all take place, and we are covering this from every angle with our reporters literally standing at each side of the building, and trump is going to face a judge and the charges and we expect he is going to be fingerprinted and the expectations is that he is going to plead not guilty to the four criminal charges. Sara murray is outside of the court for us this morning of how we expect this to play out, sara. Well, john, donald trump is going to be showing up here at this Federal Court in washington, d. C. , and the same courthouse where we have seen so many of the rioters who stormed the capital on january 6, show up, be prosecuted and face the sentencing, and today, donald trump is going be here at 4 00 p. M. , and he will arrive and be arrested and the fingerprints will be taken digitally, and we do not expect a mug shot to be taken, and then a brief appearance in court. Again, this not the first time that we will see donald trump appear for the arraignment, and this is the third time that he has had gone through this but the first time in the court, and advised of the charges against him and the four counts, and advised of the rights, and he may have the opportunity today to enter the plea. We of course, expect that if he is presented the opportunity, he is going to plea not guilty so we will pay close attention to see if he says anything in the court proceedings, and also look agent who is in the courtroom. We expect a lot of the special counsels team to be in there and waiting to see if jack smith himself shows up the way he did in miami when donald trump faced the charges in the classified documents case, guys. Notable, sara, that donald trump is the only defendant for now in this case, correct . Yeah, for now, maybe, as the key part of the sentence, because in jack smiths comment, it is clear that investigation is ongoing, and even though no one else is charged in the indictment, it lays out six unnamed six coconspirators and there are five of them like his former attorney Rudy Giuliani and sidney powell, and maybe this is a warning shot to the folks that they are still investigating and other people could be charge as part of the criminal conspiracy. John . And thank you, sara murray standing in front of the barricades and as you noted the security there is a real thing. Yes, outside and inside and Digging Deeper into what the security is going to look like and what it means in d. C. This morning, the barricades and snowplows lining the streets, and they are taking extra precautions and ramping up the security ahead of the appearance. And there are legal Law Enforcement analyst andy mccabe and we saw the snowplows lining the barricades, and what level of security rampup do you see this looking like today . Well, kate, this is really what i expect to see for us to secure an event or a situation like this. The snowplows are a goto tool in creating what we refer to as a frozen zone. So they are used to block the vehicular traffic on to the blocks or the area around where your major threats might take place, and the protech tee is going to be. That is why they are staged on the streets in d. C. Today and not because they in a position now the protect, but deployed quickly to stop the traffic in the event that the motorcade arrives later. You know, you make a great point, and it is really important and significant that donald trump is coming in to be presented to the court to be arraigned in the same place where all of those other, a thousand or more, insurrectionists have been brought in and processed and had to face justice. It is important for those people to understand that the person who inspired them, who drew them to d. C. , who sent them up to the cap capitol, and gave them the Marching Orders one way or another, is being held to the same standards and the same federal laws in the same courthouse and in the same way, and it is a really Important Message to them and the broader nation to see this. There are so many false statements out there. So many Conspiracy Theories and baseless accusations about the politicization of justice, and so it is important for the courts and the prosecutor the treat mr. Trump as any other defendant would be treated in that courthouse. Look, with all of these, and the eyes of the world if you will on this courthouse today, it would be foolish for anyone or any one group to try to make any trouble, and lets be honest, it is not just about today, but it is the Going Forward and this is what january 6th comes down to and what it means for the bedrock of our democracy, and donald trump was asked about concerns for violence Going Forward if he were indicted during an iowa radio show in july 18th, not so long ago and this is how he answered question. Is it something that concerns you of, you know, the people making sure that they dont go out of their right mind if Something Like that happens . Because i know what i am thinking of could happen if that for example they do, and jack smith says, okay i, i am going put donald trump in jail. I think it is a dangerous thing to talk about, because we have a tremendously passionate group of voters and i think that maybe, you know, maybe 100 or 150, and i have never seen anything like it, and much more passionate that they had in 2020 and much more passionate than they had in 2016. Andy what do you think of what do you think of that commentary even still today or do you think that i have heard from some folks that the prosecutions against the January 6th Rioters to date and how severe the penalties have been for some, and should, hopefully do act as a deterrent of any future violence. What do you think . Well, like we often see with donald trump, kate, this is one side is what donald trump says, and the other side is reality. So what he is saying there, and this is not dog whistling or a coded message, but it is an implied threat. He is literally talking about people who are followers of his who might be prone to violence depending upon what develops in the case, and he is referring to them of people with great passion, and like, if you come after me and put me in jail, my followers will wreak great violence in the country, and yes, we have seen a deterrent of great threat. So this is not speech to go attack the capitol, and it is going to land you in jail. That is going to discourage a great portion of people who might be motivated to show up at one of the arraignments to cause trouble, but dont forget it is only going to take one highly motivated one delusional heavily armed person to create chaos, and this is what the Law Enforcement has to prevent today and all of the days Going Forward. And now, back to the legal case, how will Donald Trumps attorneys defend his actions on and before january 6th, and you have heard them on Tv Telegraphing the defense, and what they call his First Amendment rights, and they are expected to try and prove that he truly believed his claims of election fraud. And last night bill barr was on with Kaitlan Collins and he addressed points. They are not attacking his First Amendment right. He can say whatever he wants, and he can even lie and tell people that the election was stolen when he knew better. But that does not protect you from enter into a conspiracy. All conspiracies involve speech and all fraud involve speech. So, free speech does not give you the right to engage in a fraudulent conspiracy. Do you think that he knew that he lost the election . Do i personally believe that . At first i was not sure, but i have come to believe that he knew well that he had lost the election, and also, i dont think that this defensive advice of counsel is going to go forward, because the president would have to get on the stand and subject himself to crossexamination to waive that Attorney Client privilege, and he would not do that. What would happen if he got on the stand . It would not come out well for him. Would it hurt him . Yes, yes. Why do you think that . Because he was subject to very skilled crossexamination, and i doubt he believes all of the different versions of the events that he has given over the last few years. And he just brought on two new attorneys, todd blanche, and april ludnar and what do you have for advice for them . Get a lot of insurance. He is such an interesting character in this episode in american history, because you recall in the runup to the 2020 election, he was fully on board with what trump was seeding the ground with a little bit, and then it took him a little while in the aftermath to come out to say enough is enough, and then in the january 6th testimony, he sort of broke with him on all of this, and what is intriguing about his analysis is his progression on believing that donald trump knew that he lost the election. In that in the indictment he is listed as one of the experts who looked into this, and informed donald trump that he lost the election, and he believes that donald trump believed that, and this is going to be critical to this case. Look, im with you, and it is riveting to see that it is very hard to get beyond, this is the bill barr part of it, and the whole time you are thinking, this is bill barr, and you are talking about bill barrs evolution, and the new cnn poll here, and his evolution brings him to a place in the Republican Party that is the minority. Substantially so. So we did a checkin on how people felt about the 2020 election, and overall, if you are looking at everyone overall, and you will see that 61 of the americans say yes, and joe biden legitimately won 2020, and 33 say no, and this is the Mi Authority Position in the country, and among republicans, it is ticking back up in those believing that joe biden was not legitimately elected and now 69 , and 7 in 10 republican and republican leans in the poll say that joe biden was not legitimately elect and this is proof point that donald trump has successfully told this lie to tens of millions of republicans across this country. I, when you say that it is stacking up to ticking back up to earlier in the year, and even through late fall, that is one thing they want to know why is it is not ticking back up . The person with the biggest megaphone and the dominant frontrunner the news far more than he was last year continues to stay committed to this. I think that is largely why we are seeing the uptick, and, guys, it is beyond looking back to 2020, and we asked people do you think that the Election Results will reflect reality, and the majority of the americans in this poll, and 58 have little or no confidence that the Election Results will actually reflect that, and when we ask, do you think that election is going to be overturned for partisan purpose, it is 5050, and 50 say yes and 50 say no, and it is not a good health sign for the democracy. And when fitch downgraded the bond grading for the bond rating, that is what they are concerned about, and they say that you have a Stability Problem with this poll, and David Chalian, it belies that. And it is, and david alluded to this every time trump is indicted and trump is talking about the election fraud. Support for him among the republicans on this issue goes up. The flipside of that though is that among the independents, they keep hearing this drum beat, and it is reminding them that they know the threat of democracy, and we saw this election denialism, from trump and trump the candidates and we will have to see in if in 2024 if this is a threat and problem work to his advantage or not. And anna, you the number that the republicans have to contend with of 69 , and the fact that they have to beat donald trump, and how do the other candidates square this, square this box, no, forget it the box is square, kate. If it is possible, he has run as trump, but dumber politically, and he seem like a mentor in candidate, and this is the answer to trump the, but there is nothing there. And what people are not realizing, including ron desantis and other contenders is that trump is a cause for so many voters, and they dont care about the indictments, and that in fact endears them. Debt downgrade is coming in the form of interest rates, and on tuesday the u. S. Well, kate, it is safe to say that the white house was frustrated, and they were miffed when they saw this decision from fitch when they learn of it on monday. The fact that it happened when it happened and the fact that it was based on what fitch called deterioration of governance and not on the relative strength of the economy. It is that strength of the economy that made the white house and treasury and the Biden Reelection Campaign all extremely confident that they believed that fitch had made in their words a mistake, and that they needed to craft a forceful and aggressive response. A Senior Administration telling me this about the white houses response once they learned about it from fitch that 24 hours where they essentially circled the wagons to figure out exactly what they needed to say to response, and the senior official is saying that the view directly from the Economic Team is that we need to be aggressive in the response. Well, i know that, the performance has been slower than most people hoped for, and i think that one of the reasons is that ukraine has gone from being on defense to offense, and the russians have had plenty of time to interdict progress with the laying of landmines and two or three layers of the defensive measures that would prohibit and restrict a rapid advance, but the defense to offense, and when you are on offense you need a threetoone advantage, and you take more casualties, and the other thing that is important here is that ukraine is trying to fight a combined arms tactic which is a western tactic but without adequate air power. That element that is missing is really important. The sooner that we can help them with air power and it is not going to be any time real soon unfortunately, but that is the missing element right now, and this is going to contribute to a slower rate of events by ukraine, although they are making some progress, no question about it.
