Here is Senate Judiciary chairman Lindsey Graham on this program two weeks ago. Well i hope to have the trial over by the end of january. We used the clinton model, where you take the record established in the house, let the house managers appointed by pelosi make the argument. Let the president make his arguments why the two articles are flawed. Then well decide whether or not we want witnesses but this should be done in a couple weeks. The president and white house coming out with a Statement Last night ahead of the trial. Would you agree this could be as shore as two weeks . What is your expectation . I think it is certainly possible this trial could last one to two weeks. On the other hand if the senate makes decision to go town to additional witnesses that could extend it six or eight weeks, even longer. There are two paths here. What you noted this week will be the first time in a year that the president had the opportunity to defend himself, to lay out the facts, to lay out the law, to lay out the actual substance. Weve seen months and months and months of a onesided show trial from House Democrats where they didnt want to hear from the defense. They shut out the white house. They shut out the minority. The good news in the senate what im confident well have a fair trial. Well not give into the kind of games House Democrats have played. Instead well give both sides a full and fair opportunity to present their case. The house managers will have every opportunity to stand up, present their arguments, put forth whatever evidence they have, but for the first time the president , White House Defense team is going to be able to walk through the facts and substance. I think that is a very, very important development. Maria talk about your reciprocity resolution. If you were were to to down the road of witnesses, you want it to be reciprocal. Tell us about that. That is right. Kind of strange how we got here. Democrats have been having hearings, being doing impeachment for months in the house. Brought in all sorts of witnesses. They blocked the minority from having any witnesses. Soon as we get to the senate, the democratic talking point is, we want more witnesses. Never mind all the witnesses they called before they want yet more. Theyre trying to delay this. Theyre trying to drag this out. They want this trial to go on forever they have a political objective attacking the president. What i have said, what i have urged the conference, listen if we go down the road of witnesses well not do what the house did. Well not have a onesided kangaroo court. Instead well respect reciprocity. What does that mean . If the prosecution gets a witness, the defense gets a witness. If the prosecution gets two, the defense gets two. If the prosecution gets to call john bolton, the president gets to call hunter biden. The democrats are terrified seeing a witness like hunter biden testify. They dont want to hear evidence of actual corruption, corruption potentially of joe biden, corruption that occurred during the obama administration. They blocked all the witnesses in the house. They will not succeed blocking them in the senate. If they want to go down the witnesses that means the president enjoys the rights to due process. That means he can call witnesses to lay out a defense. Maria would that open up a whole another can of worms, obviously the whole focus on president impeachment trial put hunter bide own and joe biden on the back seat. Nobody talks what went wrong, leadership of Foreign Countries while his father was sitting Vice President . Maria, youre right. The democrats desperately want to keep the topic off the news. Sadly awful lot of folks in the media are compliant with that. The president having opportunity to defend himself is so important. Because i think one of the fundamental defenses i expect to hear from the white house this week is that the president has inherent tort, in fact a responsibility to investigate corruption. And when you look at what happened with joe biden and hunter biden, there is at a minimum prima facie evidence of corruption. You have got hunter biden, getting paid 83,000 a month, by burisma, the Largest National gas company in ukraine, 83,000 a month, is a Million Dollars a year. Hunter biden had zero experience in oil and gas. Not like he was geologist or physicist, he was getting that money, the obvious inference is because his daddy was Vice President. The joe biden on video in front of the council of Foreign Relations he blocked a billion dollars of foreign loans, in ukraine, until they fired the prosecutor who was potentially investigating burisma, the company on which hunter biden sat on the board. If the biden family is profiting to the tune of millions of dollars, the president is entirely justified saying, lets investigate and find out what happened. That is why hunter biden is such such an important witness. Why the democrats dont want to focus on evidence of actual corruption. I expect to hear a lot from the White House Defense team this week. Maria you have a 51 vote threshold in terms of getting that vote to hear witnesses. Do you want to hear from witnesses . Then i want your take on the white house letter sent last night, basically calling the articles of impeachment violations of the constitution . Well, starting with the second part first, i do think what weve seen, coming out of the house is an abuse of the constitution. The reason is, that theyre using this for political purposes. This is the first time in history any president has alleged, has been impeached without the articles alleging any criminal conduct at all, without alleging any federal crime was violated. They dont allege any federal law was violated. They dont allege as much as the president has a speeding ticket. That has never happened in our countrys history. To use impeachment like the House Democrats are doing, to express their political disagreement with the president , to try to overturn an election theyre unhappy with, that is an abuse of the constitution. Now the first question you asked about process and witnesses, let me tell you what we can expect to see in the next week or two Going Forward. On tuesday, when we come back the senate will convene at one p. M. Well start with pretrial motions. Well start with probably battling motions. What i expect the senate to do is adopt a scheduling order laying out the next couple of weeks. That scheduling order is modeled after the scheduling order for the bill clinton impeachment. It is very, very similar. So it provides that we start with the house managers, getting 24 hours spread over two days to present their case. They can argue evidence. They can argue law. They can argue whatever they want. After that the president and white house, they get 24 hours spread over two days to present their case. Then we shift to questions from senators. Senators get 16 hours. Our questions have to be in writing. The chief justice asking them for us. All of that us i anticipate take as week, to week 1 2. At that point the scheduling order provides the senate will vote whether or not additional witnesses are necessary. That is 51vote threshold. I dont know how the vote will come out. I think all 47 democrats will vote yes. The open question is, whether there will be four republicans to join with those 47 democrats. Look, i think some of that depends what happens in the first week 1 2. What arguments the house managers put forward. The white house puts forward. What questions comes out. I hope at the end of the week 1 2 where republican senators are, is weve heard enough. The evidence they put forward doesnt satisfy the constitutional standards. The constitution says impeachment lies for high crimes and misdemeanors. Maria right. This was not a high crime or misdemeanor. They didnt allege any crime at all. I hope at the end of this process well get at least 51 votes to say, lets move to final judgment. When we move to final judgment, the outcome of this will be the president will be acquitted. The senate will vote not guilty and reason i can say that with confidence because on their face the articles of impeachment, they dont allege high crimes and misdemeanors. They fail on their face. I hope we get 51 votes in week 1 2 to say this is over. If not, if not, if there are at least four republicans democrat for witnesses were looking at a trial will probably last six or eight weeks or longer. Because you have to assume there will be litigation over the witnesses, there will be delay. If we go down the road of witnesses all the democrats envisioning only prosecution witnesses and no defense witnesses theyre in fantasyland. The senate will not do like the house, play political games. Well be fair. Well give the president pull opportunity to defend himself. Maria how likely we see a motion to dismiss in the, after the first 48 hours, after you actually look at those articles . You know, i dont think it is that likely. The reason is i think dismissing this case is a much less attractive option than rendering final judgment and acquitting the president. Maria sure. The reason is twofold. Number one if you do a dismissal, the additional doesnt reach the merits. On acquittal a verdict of not guilty, that verdict stands for all time. Nancy pelosi is going out on tv crowing that the president has been impeached forever. Maria right. When we get to final judgment, the president will have been acquitted forever of the boeing bus impeachment charges. That is much better outcome for the president and country. Secondly, if we dismiss at the outset the president would never get a chance to defend himself. The president , the white house lawyers would never get the opportunity to put on the affirmative case. Maria thats true. Think about it in the months and months of house hearings, what i said about hunter biden you didnt hear witnesses say that because the House Democrats didnt want those facts in evidence. They didnt want to explore the evidence of corruption. The president is entitled to have his case, laid out, laid out persuasively to point out as the brief president filed this weaken points out, these House Democrats have wanted to impeach the president since november of 2016. They debated quite a bit where to do the impeachment, particularly after president. One of the options they considered was the u. S. Supreme court. They also considered the senate. They considered a third option, combination of the two, combining two. That is sort of what they did by bringing the chief justice of the United States in to preside over the senate but if you look at the federalist papers, Alexander Hamilton explains the reason they chose the senate was two things. Number one, they wanted the institution with the credibility to resolve issues. Impeachment of the president is a big deal. They knew it would be politically contentious. They wanted a institution that could have credibility with the American People to be fair. Secondly they wanted an institution that could withstand buffeting of politics. Wouldnt be like the house. The house is designed to respond to momentary political surges. Senate is designed to be stable, consistent. That is why the framers gave it to the senate. This has to do obviously with the transcript with the president released right after this began . No, look, they never expected him to do that. One of the great moves the president made, released the call of the transcript. The transcript says no quid quote pro. President trump and zelensky repeatedly said there is no pressure, linkage, any type of investigation to the Security Assistance dollars. Third point, the ukrainians didnt even know at the time of the call the aid was on hold. They didnt learn until a month later from the politico article. This is most important fact, the one democrats can never get past, important fact, ukrainians took no action. No promise to start. No investigation, to start, no announcement of doing investigation into bidens or burisma to get the aid released.
