No doubt this is the most wide ranging of the four indictments that former President Trump is facing. Of course, the grand jury late last night voting to indict the former president. 18 of his associates. The d. A. Here in fulton county, georgia, foni willis saying that they were operating as a criminal enterprise. Heres a snippet from that indictment. Defendants refused to accept that trump lost and they knowingly and willfully joined a Conspiracy Top unlawfully change the outcome of the election in favor of trump. Trump faces 13 criminal charges including a racketeering rico charge, which if guilty carries a fiveyear sentence, 25,000 fine or both. The other 18 defendants include his former chief of staff, markmer doughs, rudy guliani, john eastman and sydney powell. The 98 Page Indictment alleges the defendants lied and committed fraud to persuade Georgia Legislators to reject georgias duly electoral vote and to replace them with fake electors. Theres charges related to stealing data from Voting Machines in small rural coffee county. The d. A. Says she intends to try all 19 defendants at the same time and to find a trial date keeping in mind that trump has three other criminal cases. Listen. I dont have any desire to be first or last. I want to try him. We do want to move this case along. So we will be asking for a proposed order that occurs a trial date within the next six months. On truth social today, trump said he would release a Quote Large Complex Detailed but irrefutable report on the Election Fraud in georgia next monday. Brian kemp said the 2020 election was not stolen for three years now, anyone with evidence of fraud has failed to couple forward under oath and prove anything in a court of law. The fulton county, georgia clerk released a statement showing how a copy of the charges was released hours before this grand jury voted to inindictment. An identical copy. The clerk released a statement saying they were operating a trial run and happened to use for the system because they were anticipate ago large indictment. In that trial run, they happened to use the charges that were then in the indictment for the former president. They said it is a fictitious document because it did not include the official stamp from the clerk. Neil . Neil i notice he would not let go of that with her. Good for you. Hunter biden and his lawyers are saying it wasnt fair. The government reneged. The government said we didnt reneg on anything. David spunt has more. How things change in three weeks. Three weeks ago tomorrow when david weiss, the now Special Counsel and hunter biden were in a courtroom in delaware before a judge. They were moments away before it fell apart in open court. Now the Special Counsel is fighting back against Hunter Bidens attorneys writing the government did not as you say reneg on the previously agreed upon Plea Agreement as the defendant inaccurately asserts in the first substantive sentence. Hunter bidens attorneys say the Diversion Agreement on the gun where hunter is accused of lying on a gun form is valid because it was signed by both parties. Abby lowell wrote the defendant intends to abide by the Diversion Agreement executed at the july 26th hearing. The parties have a valid and binding by late raleigh Diversion Agreement. They what abby lowell said on camera. Special counsel david weiss team says not so fast. The Diversion Agreement was not valid even though it was signed. The withdrawn Diversion Agreement is not in effect. Hunter is also parting ways with his lead attorney in the matter, chris clark who had been dealing with this case, the architect of the plea deal when it fell through in open court. Abby lowell, a power house d. C. Attorney that represented bill clinton, Jared Kushner is on the case officially. Hes been involved in other matters involving the president s son. The way hunters team is framing this is that chris clark may be a witness in an upcoming case about this Plea Agreement falling through. According to a delaware code of conduct rule, an attorney that will be a witness in a future case cannot currently be an attorney. Thats why clark is out and lowell is in. Neil . I think i got it. Tom, i want your take on Hunter Bidens lawyers demanding the Department Of Justice honor that part of the plea deal. Seems to have been blown up now and nowhere near getting back together. What do you think . Im very skeptical of Hunter Bidens lawyers argument that this is binding and valid. It was not approved by the judge. Although theres some truth that Diversion Agreements are different than Plea Agreements, i dont see how they can have a Binding Agreement if the Justice Department does ant agree that this Diversion Agreement is in effect. Its all fine and good for Hunter Bidens legal team to say were going to follow the terms of the Diversion Agreement. If doj doesnt see it that way, i dont know how much good it is for them. Neil katie, id like to get a sense of what david weiss who is in this capacity in a grander role, whether he changes right now, broadens the case himself, whether republicans who arent a fan of what hes done before in being a key part of that plea bargain can be trusted here. I think weiss is compromised. Hes allegedly looked into this case for five years. I cant imagine what Additional Investigation hes going to undertake. Im not optimistic in terms of any sort of legitimate differences in the outcome here. Again, i agree that that plea bargain is not going to be in effect at this point because part of that required that the judge actually act as a fact finder in terms of the terms of that probationary deal. That is a null and void argument. Neil if i can go back to the trump case, the fourth indictment against the president. I am curious that in this one, in particularly in georgia, he cant pardon himself out of it. What does that mean . Yeah. Thats true. Its different under state or federal federal offenses but cannot pardon state offenses. It just underscores the potential serious any of this charge. Its one thing for former President Trump to be fighting off charges in the federal system where potentially he would have a pardon power down the road. On the state side though, the calculus shifts. He couldnt pardon himself and he couldnt direct a georgia prosecutors to drop the case. So i think it underscores the significance, the potential severity of how this plays out. Also wouldnt surprise me that if President Trumps legal team tries to blow this case out of state court and pull it in to Federal Court where the president would think he would draw a more favorable judge and would draw a more favorable jury pool. Martha neil i can understand the defense will always want to postpone and push back trials. That i get. I can understand the prosecutors wanting to in in particular case expedite. But theres a lot of cases here were talking about. A lot of charges. 91 criminal charges. Do you envision any of them as they stand now getting adjudicated or even addressed before the election . Well, the right to a speedy trial is by and large a defendants right. Every prosecutor has said that. The defense needs time to go through the ed, all the discovery and ultimately any of these defendants, including donald trump, if they decide to release counsel on the eve of trial, they will likely be allowed to do so, which would prolong the trial even further. So i think for all practical purposes, its going to be very difficult to get these cases to go to trial. These are complex litigationtype cases. Within the next six months in my opinion. Neil so having said that, tom, and this this georgia case specifically and uses the rico act, largely reserved for mob figures and the like at least in the past, the likelihood of that getting done before the election or at least even starting before the election seems remote, but could i miss something here . Id say its remote to zero. I dont see how this case moves forward quickly. The prosecutor made the decision to swing for the fences. She named nearly two dozen defendants. She included sprawling charges. Any time they try to manage a case with nearly 20 defendants, particularly a case like this one that is on a complicated facts, conduct that expands years, theres no way you can move it forward quickly. Too many variables, too many balls to juggle in the air. Not to mention the possibility of trump tries to remove it from state court to Federal Court that will add months to to process. Theres no way that they can mow forward before the election. Its not likely. Neil tom, final word. Thanks, katie. Neil let me ask you a little bit about these georgia indictments against the former president. You call them political persecutions. Explain. Look, neil, i cant think we look at these indictments without the context of three other separate indictments. Several of which came in the last four months alone. Four different indictments in the middle of an election. It sets an awful precedent in our country for the ruling party, the power in party to use the police force to indict political opponents in the middle of an election. I say this as somebody im polling at second in this race, third overall. It would be a lot easier for me if donald trump were eliminated from competition. But that is not how i want to win. The way we win elections in this country is we convince the voters of this country of our vision and what we stand for. Thats why ive said i would pardon for the federal crimes donald trump to help move this nation forward. I am focused for example on your economic message. Thats what we need to be talking more about. Less about the politicized indictments that have distracted us from the fundamental issue. Thats the fault of the biden doj and the democrat prosecutors across the country instead of explaining why bidenomics is a farce, a failure with more job openings than people looking for work. I say yes, these prosecutions are wrong. Neil i can understand that. Theres 91 criminal charges in all, vivek, as youre aware over 4 criminal cases. They cant all be politicized, can they . Something that the former president must have done in any one of these that struck you as wrong if not illegal. I think just because the government has brought a case, if were going to be a culture that says there must be something wrong if the government has charged 91 counts, thats a people of sheep. That breeds a government of wolves. Thats the reality. Neil you dont think theres anything in this case that shows or even strongly hints of the former president trying to reverse that georgia contest . Neil, you know, ive had this conversation before. Theres a difference between a bad judgment and an illegal act. I view this indictment in the context of as you put it, three other independent indictments. The first beginning in new york for a novel election and Campaign Contribution theory to one that has a novel theory interpreting the president ial records act to a novel theory of Attorney Client relationships. When you have a series of novel theories used to inindictment a prior president and a sitting candidate, i dont think its good for the country. Im this to lead our nation forward, not to be a political commentator or legal analyst on a series of legal cases. What i will say as a candidate in this race is that i do not think its good for our country to set this precedent. Neil i understand that. But if there is if there is wrong doing, vivek i understand. When you have the republican governor of georgia who has said this report is irrefutable and that this was an attempt at voter fraud that was scorching and you have others that have taken similar views including Secretary State that is republican, that said that donald trump went too far, wouldnt you put your trust or at least your instincts in those guys, republicans that said that this has been wellexamined, aggressively examined and there was nothing to it. Neil, im running to be our next president. I ask what is in the interest of this nation. Do i believe that these prosecutors or these elected officials or these federal prosecutors are advancing the interests of this nation when they bring this unprecedented indictment, not one time baseball four times over . No, our country is worse off because of this politicization. Would i have made different decisions than donald trump . Absolutely i would. Have ill remind you, im running for u. S. President in the same race that he is. I think its so important, this conversation that you and i are having is evidence enough why this is a bad idea. Were not talking about how to improve a economy or how to revive our National Identity neil i understand what youre saying but this is a big deal. Of course it is. Thats why im neil let me ask you, when you talk about wanting to pardon donald trump for this, why . What would be good about that if you became president of the United States to pardon him . I think the right answer for this country is to move forward. We should be able to disagree fiercely with one another, but still sort out those disagreements through our civic process. Culminating at the ballot box while every vote counts equally. Thats how we do things in the United States. Not by eliminating our opponents using back door mechanisms. So my reason, my chief reason for pardoning donald trump at least in the federal offenses, which will be what is in my power, that includes the New York State offenses because they include the charge of an underlying offense as well, it will move this nation forward. Thats why im saying even now, when it would be in myself interest last a candidate to see donald trump eliminated by some counts that would put me at number 1 in the republican primary polls, thats not how i want to see it done, thats why ive been so particular about being vocal on this. Neil you also spoke about the idea of seeking out donald trump as someone youd use as an adviser. What did you mean by that . I was asked about the Cabinet Members i would choose. Would i choose rivals of mine in the republican Primary Field . The answer is i think several of them could be good Cabinet Members. I brought up donald trump because i dont think he would serve in my cabinet but the role id wanted to see him play, be an adviser on understanding where he might have fallen short if he would do it again. Shutting down the administrative state. Thats top of my agenda, shut down the administrative bureaucracy, the deep state, reduce the federal employee head count by 75 . Ive read the law, neil. A lot of questions right now. The first of all, how did this all begin and secondly, when will we have a true count on loss of life. Right now were at 99 poor souls that have died. To give you a graphic illustration of how hard it is to identify the people that have passed, only two people of the 99 could be identified with fingerprints. That is how terrible this situation is on the coast and the Historic Town on west maui right now. Fema is still searching a fiveminute gap of the area looking for human remains. Officials think this number of the dead will likely go up in the coming days. Were talking to survivors, how many of them barely got out. Some with children and relatives. I talked to one woman about her familys escape from the fire last week. We had a Police Officer come down to our neighborhood and tell us we were evacuating. We contuldnt leave here so we went down the loop. Its hard to digest and accepted. Theres so many people that have lost more than we did. Everything weve lost is just attorney. My family made it out safe and sounds. Everyone is accounted for. Thats the most important thing. Im happy to have what i do have. And what perspective from that woman and her family and so many others as people are out of homes, out of businesses living in shelters. Some working to move in to hotels that fema is trying to block off rooms. Meanwhile, again, i cant state this enough. The search for Human Remaining and the missing which are in the hundreds still continues here. You know, the look at how these people passed in the middle of the night as flames took over the region down there and even up here. Some people caught in the smoke couldnt breathe, couldnt see, couldnt get out. They were incinerated unfortunately while this fire raged. What you see behind me, just one example of a home here where 20 plus structures have been destroyed. You can smell the smoke as this is only 65 contained up here. From time to time youll have some of this charred earth start to come up with smoke and some fire and trucks have to come up here and try to put it out. This is just a continuing disaster here. The questions that loom are how did it all begin. When can all of this come to a result as far as the dead and when can people get back in to these places, get insurance going and get this incredible island back to where it was. So i took my wife to the airport and went to work. Later on that afternoon, i got a call from my son said hey, theres smoke. Im having a tough time breathing. So i called my neighbor. He said, well, its not that bad. You know, its a ways away. So i called my son and said hey, gary says its not that bad. So id stay. Well, you know, he said i got to go. Its really bad. He asked him to go to our house, get our dogs. He did. That lessons cost him his life. He got caught in a traffic jam. Its sad. You know a lot of people in those traffic jams didnt make it out. They couldnt outrun the fire. He said it was black smoke. He was following taillights in front of him. He said it was he thought it was over. Getting back the maui, were a resilient people, an island. You know, the fire was tuesday, wednesday morning, our guys at hitech sent food and blankets the first day. 20 truckloads brought to our store. You know, they continue to do that here. We have clothing vendors, surf wear vendors that we deal with that have been sending footwear and clothing. Weve had constant people coming that lost everything. So we were able to help them. Neil, the day before title 42 ended back in may, Alejandro Mayorkas had a Press Conference at the white house where he said anybody caught crossing the border illegally after title 42 ended would have more serious consequences. Heres what he said. I want to be very clear, our borders are not open. People that cross our border unlawfully and without a legal basis to remain will be prompt lead to us a national processed and removed. So you heard it there. He said they will be promptly removed. Thats not the reality of what were seeing on the ground in the Rio Grande Valley where we witness mass releases of migrants. We shot this video here in front of Catholic Charities in the mcallen area. A couple of hours, we saw bus load after bus load of migrants being dropped off. Once they get to this clarity, theyll be assisted with travel and going all over the country and theyll have Immigration Court dates several years down the road. Now, Border Patrol agents tell us these migrants once they cross the border illegally, the family groups, they look for Border Patrol and turn themselves in because they have little or no fear of deportation and three not hoping to be released into the u. S. Theyre expecting to be released into the u. S. Take a look at this footage. We embedded with texas dps. Were watching at night as a smuggler was guiding illegals through the brush. Texas dps arrested him. It was a Mexican National charged with smuggling. And our Fox Drone Tomorrow in eagle pass. Migrants continue to try to cross illegally despite the fact that texas has fortified it with rows and rows of razor wire, shipping containers, buoys in the water. The migrants will find a way to get in. Back out here live, dhs and ice posted a Video Showing multiple deportation flights. Theyre trying to put the message out there theres some deportation flights happening. The videos showed flights going to central and south america. The deportation flights are just a tiny drop in the bucket compared to whats coming across the border. The sheer amount of people coming across our border day in and day out. Now back to you, neil. Many in washington who are saying that that cooperation should end. A number of democrats say it goes too far and its not what your assigned roles should be. What do you think of that . Well, first off, great to have you back and great to be on with you. For any lawmaker or elected official to suggest that u. S. Border patrol end cooperation with the Texas Department of Public Safety is irrational and malicious. That would undermine the long history working with the Border Patrol to secure the border. We need to work with each other. We continue to work with each other. Thats an example with bill melugin reporting on, that is texas dps and u. S. Border patrol working together to apprehend criminals. Were the ones out there. Our state troopers, Border Patrol agents are on the front line seizing drugs, coming across the border. Without our efforts, these drugs would make it to the interior. Neil im curious, chris, when you hear these reports coming out that deportations are going on as planned and picking up steam and we listen to bill melugin who says theyre like a spit in the ocean here, what is true . Help me out with that. Well, the fact is, neil, theres some deportations but the vast majority are being released, whether theyre crossing at the ports of entry or those that are being released at the ports with the cbp 1 f. The fact of the matter is, the federal government is releasing mass illegals. Thats why they continue to come. Theres no consequences. When you dont have consequences and you catch and release, more will continue to come. Thats why we see this Flow Of Mass Legal Migration taking place between both ports of entry and at the ports of entry. Until we stop that. When we stop the activity at the river, we can stop the criminals that are exploiting the fact that we have a lacks border.
