That off duty Alaska Airlines pilot accused of trying to crash a flight headed to San Francisco this past sunday had his first appearance in federal court this afternoon. And dan, this was the first appearance and arraignment for 44 year old Joseph David Emerson of Pleasant Hill on the federal charge. Emerson pleaded not guilty to interference with flight crew members and attendants. That one charge could bring up to 20 years in prison after the hearing. Emersons wife, sarah, told reporters that she knew her husband was struggling with depression, but, quote, this is not my joe. He never would have done that. He never would have knowingly done any of that. That is not the man i married. Also today, federal prosecutors filed an amended complaint against emerson. It now says emerson had not slept for 48 hours before the flight. Not the 40 hours first noted. And that corresponds with the time frame in which he told police he took psychic delic mushrooms. Emerson claimed he was despondent over the recent death of his best friend, but the amended complaint now says that friend died six years ago. According to the fbi affidavit, emerson felt he was suffering a nervous breakdown aboard the Alaska Airlines flight operated by horizon air from everett, washington, to San Francisco sunday. The off duty pilot was riding in a cockpit jump seat when he said, im not okay. And reached up for the emergency engine, shut off, handles the pilots had to wrestle with emerson to keep the plane under control. Theres a new effort to make it easier to prosecute suspects in car break ins. Tonight we take a closer look at revised legislation that local leaders hope will help crack down on crime. Abc7 News Reporter suzanne phan is live in the newsroom to explain exactly what is changing. Suzanne so dan, state senator scott wiener says he wants to hold auto burglars accountable by changing a serious loophole in a current law. Its an absurd requirement, but it makes no sense. State senator scott wiener says theres an auto burglary law on the books that needs a big change. We are going to get rid of that useless requirement. That requirement is to prove someone is guilty of breaking into a car. Californias current auto burglary statute requires proof the vehicle was locked. Even if you have a video of the person smashing the window, even if theres clear evidence, the person broke into the car. The da also has to prove beyond a reasonable doubt that the car was locked. Wiener says his legislation, which hes introducing for the third time, will remove that requirement. San francisco da says criminals are more brazen, more organized. Theyre going through windows and seconds to take stuff. But because of that current requirement that victims are required to physically come back to San Francisco to testify that their doors were locked, that prevent prosecution of these crimes from being successful. Supporters say this proposed legislation would benefit communities across the bay that are being hit hard by car break ins. In oakland, police are ramping up patrols, bringing back foot patrols in the downtown area and this weekend, opd is launching a pilot program. People can report an auto burglary on instagram and in San Francisco, sfpd is adding more officers in neighborhoods where break ins are happening, even using bait cars to catch thieves. Im going to avoid wearing a robe. Superior court judge michael benkhert is overseeing the court and says building a relationship is key. Im not trying to address the big policy questions. Im trying to work with the person whos before me and see if i can make a difference in their life under californias care act, everyone from First Responders to family members can petition for people with severe Mental Illness like schizophrenia, to get the help they need. In San Francisco, Health Officials estimate between 1 and 2000 people in the city could qualify. How many petitions have you seen so far today . We have seen five. And is that what you were expecting . I didnt. I tried not to have any expectations. I mean, i didnt find any of the predictions to be very reliable. Well, most of them related to how many people out there might qualify, which is much different than the number of people who are actually going to have a petition filed. And beyond getting people into the court, he says getting people care is another challenge. I also run three different treatment courts and so i have been dealing with the availability or the lack of availability of treatment programs, says San Francisco county has about 2500 Mental Health and Substance UseDisorder Treatment beds and are adding more. But the judge says its not just about the number this is a voluntary program. So if i want somebody to go and be successful in a program, im, you know, in a Mental Health treatment facility, it should be a place that they want to stay. They it should be a place where theyre getting better. And he says people on the streets deserve the help they need. Bikes for life in west oakland isnt a traditional bike store. They dont sell bikes. They give them away. We want formerly incarcerated people who are coming home between a clipper card and a bicycle. They should be able to get anywhere in the bay area that they need to go for jobs, for opportunities, services. George galvez is the executive director of courage Communities United for restorative youth justice, the group also runs the newly opened bike shop, providing opportunities for formerly incarcerated people. Is critical in terms of reducing recidivism, in terms of promoting Public Safety and theyre the best messengers and mentors as folks whove been there and done that the shop was inspired by biking advocate and Community Activist tony coleman, who died last year. Staying true to his mission, bikes for life also hires those who were formerly incarcerated, dated like jesus kaba. They have all these goals because their time stood still for a little bit and they want to make sure that when they hit the ground, they hit the ground running. They dont want to stand still. They dont want to be forgotten about. They want to be a part of society, you know, so no ones perfect. But an opportunity always helps. And thats what were here to do. Thats right and its a very complex right argument here and both sides are very apart now because in San Francisco one group is focused on one thing and one thing only, which is keeping people alive, period. Full stop. It ends there. There are others who believe that recovery or abstinence is the only way to help a drug user get out of their situation. Now, they disagree on many things, especially when it comes to Harm Reduction and the supplies that come with it, which, by the way, are allowed by california law. This is a woman foil. This is a lot of it. What is it used for . This is used so they can put their fitting all on here and then they burn it and they smoke it through a straw. Thats longtime tenderloin resident jj smith, who showed us whats inside this Harm Reduction kit accessed able to any drug user in the neighborhood, which includes straws and other drug paraphernalia. The hypodermic needles in the syringes. I can understand you dont want to pass borne diseases with those items, but theres a lot of items in there that doesnt have anything to do with passing diseases. This tin can they give you to cook up drugs which shouldnt have nothing to do with Harm Reduction because as you cannot get catch any disease from about this can. So this is an enabling device right here. But others argue that giving out straws and pipes keep drug users from sharing with one another and therefore preventing the spread of hepatitis c and other infections. Were worried about people all having cracked lips or blood at the source of the site of smoking and by offering these supplies, we reduce the risk of folks transmitting between sharing supply. Its part of San Franciscos Public Health strategy called Harm Reduction. Take steps to reduce the negative consequences of using drugs. We want to make it clear the San Francisco aids foundation does not offer pipes as part of their Harm Reduction strategy. But some other organizations do. A few medical studies have found that hepatitis c can be passed among drug users by sharing their pipes, but only under certain circumstances is that other person has to have open sores for blood to enter their bloodstream from this pipe. So in general, yes, i mean, clean. And your own material is a good thing. Advocates say Harm Reduction kits keep people healthy, yet, as we have witnessed many times, as some of those suffering from addiction are not always so particular about how and with whom they share their drugs. As Los Angeles Council member tracy pak came to San Francisco to meet with people affected by the drug crisis. We see the same type of approaches being used in los angeles. It isnt working. Its making things worse. We have got to shift the focus to actual rehab and recovery so that we can treat the whole person and get them stabilized and on a path to recovery. But as far as we can tell, theres no mention of getting people off drugs, not even brochures when handing out Harm Reduction supplies. You got one of those things. You can put the needles in . So just recently, Governor Newsom signed into law ab 663, a bill proposed by assemblyman matt haney, which would allow for mobile pharmacies to travel to neighborhoods like the tenderloin and south of market that have been hit especially hard by the fentanyl epidemic. Now the mobile pharmacy would then dispense medication that treat opioid addiction, and that could be a game changer. Really . Yeah. Yeah. Could be. So well see. So complex. Yeah, it is. All right. That was the takeaway from this years indicators report, which outlined the growing affordability crisis in the county. The indicators report says homelessness unaffordability poor access to child care and Food Insecurity are pervasive issues affecting residents on the peninsula. The report recommends building more affordable housing, improving child care opportunities and expanding a guaranteed income program. Were hollowing out the middle class in this county with just the poor and the rich living here. Weve got to change that with more housing. A one big recommendation is the creation of a new county department to oversee all of this. San mateo county currently does not have one. Consumer watchdog filed a public records request, and today says the documents it received proves the proposed bill was a lousy deal for consumers. We did get this one draft proposal that was apparently drafted by the insurance commissioner that would give away all his authority and power over the Insurance Companies. It would basically deregulate the Insurance Companies. A big selling point for the proposal, we were told, was a guarantee that Insurance Companies would sell more insurance in difficult to insure parts of the state like wildfire areas. The documents, as read by consumer watchdog, would allow Insurance Companies to wiggle out of that part of the agreement. But when you look at the fine print of the proposal that we obtained that the commissioner drafted, theres absolutely zero commitment to come back into the marketplace. I asked for an interview with the commissioner. He did not reply, but i did receive this statement from deputy insurance commissioner michael soler. The consumer watchdogs latest cynical claims hide the truth that the group has earned millions of dollars signing off on rate increases while denying the reality that insurance has become impossible for some. California ans to find at any price. His statement goes on to say consumer watchdog is turning a blind eye to the consumers needs while defending its own insurance piggy bank. The Deputy Commissioner is referring to this on the commissions website. It says Public Participation in the rate setting process is authorized to recover their costs, expenses and attorney fees. Deputy commissioner soler says consumer watchdog has collected nearly 9 million. Consumer watchdog says its challenges to Homeowners Insurance rate increases have saved californians. 2. 2 billion.
