We happened to be across the street here i think a day after it happened and the police were here. And thats all i really remember. It was you know, a home invase that was really unpleasant for the person who lived there, obviously. Reporter and in 2009 Palo Alto Police had a lead. Muller was a named suspect in our case prior to the events unfolding within the last couple weeks. So what our hope is is that these new cases will give us another opportunity to see if theres additional evidence that may connect him to our case. Reporter why wasnt he arrested and charged then . An arrest requires probable cause and there was never enough probable cause to arrest muller or anyone else. Reporter what made him a person of interest back in 2009 . I cant discuss any specifics at this time since its still open and ongoing. Reporter it may involve advice descriptions of the suspect and also materials used to blindfold and bind. Today the prosecution and defense each had two hours for closing arguments. En the District Attorney arguing james holmes was sane at this time of the attack, pointing to his meticulous planning as well as the emotional toll the shooting took. And the defense argued for their side arguing that he was on the brink of a psychotic break. He said the only reason it occurred was because of mental illness. Two defense psychiatrists determined that holmes was insane, and two courtappointed psychiatrists determined that he was sane. Ready for the next step in the proceedings, which is closing argument. Reporter after hundreds of hours of testimony and thousands of pieces of evidence today one last chance for attorneys to make their cases during closing arguments. This guy walked into that theater and tried to murder everyone in it. Reporter prosecutors claim holmes was legally sane at the time of the shooting, pointing to his meticulous planning of the attack assembling weapons and body armour. Rigging his apartment with explosives and a notebook he filled withdrawings and details of the movie theaters layout. Other experts testified he was insane in the days leading up to the shooting unable to know right from wrong or stop himself from carrying out what holmes described as a mission. When mr. Whom stepholmes stepped into that theater, he had lost touch with reality. Reporter holmes did not take the stand but evidence included comments he made. The prosecution has proved beyond a reasonable doubt that that monster was sane at the time of the shooting. Reporter soon the jury will decide holmes mental state when he killed 12 people and injured 70 others. Were all getting anxious because we dont know what the verdict will be and we dont know what that will lead to next. Reporter an agonizing step for many towards closure. If found guilty holmes if the jury finds that he is guilty the Death Penalty phase would begin. That could take weeks.
