The shooting earlier this month left two people wounded and sent shoppers running for safety. San jose fire crews battled a fiveacre brush fire this afternoon. It broke out just after 2 00. This is off highway 237 near north first street. 60 firefighters from different agencies took on the blaze. Crews say with the windy conditions today theyre lucky the fire didnt spread. You can see a wall of water there flowing into the embarcadero station forcing that closure. Water was coming from the muni station one floor up. Both bart and muni saw big slowdowns for much of the day as you can imagine. Muni says it all started when they were testing fire sprinklers and then something went wrong with the drainage system. As for the man behind the wheel he told us it was an accident. He didnt realize he hit someone. That driver cooperated with police after being stopped about a mile from the incident. Sam, thanks so much for that report. Will it stay or will it go . A battle over a cross in the east bay has played out in the 9th Circuit Court of appeals in San Francisco today. The cross sits on top of albany hill. Heres some video of it. Been there for decades. But now a federal judge ruled it unconstitutional. It belongs to the lions club which is an International Service club. The lions club was given a small space to maintain the cross in 1971 during a land deal with a former city councilman. The cross is opposed by a group of atheists and city officials who want it removed. The lions club wants to exercise its constitutional right of free speech and free exercise of religion to display a cross. They are taking the place of government with a permanent monument, a very large one, lit up at night at easter and christmas, and theyre projecting their religious message to the whole community. The court now has 60 days to make a decision on it. They are a real life dynamic duo. Steph and ayesha curry are teaming up to make a big splash in the east bay in more ways than one. A San Francisco judge tossed out some evidence in the highprofile case against a freelance journalist at the center of a police raid. Sfpd officers raided brian carmodys San Francisco home and offices in may. They were investigating the leak of the Police Report in the death of former public defender jeff adachi. Police are trying to determine who leaked the report and whether it constitutes a crime. Today a judge ruled that police cannot use any evidence collected from his cell phone. The judge says she was never told that carmody was a journalist when police requested the warrant. California shield laws protect all journalists from search warrants that seek evidence identifying unnamed sources. Initially the department defended the raid. It is now being recommended that five Oakland Police officers who shot and killed a man over a year ago be fired. In march of 2018 five officers fatally shot joshua pollack as he was laying on the ground between two houses. This is body cam footage of that very incident. Pollack was waking up as the officers shouted commands at him. He was holding a gun at the time. Now comes word that a federal monitor overseeing the Oakland Police department as well as the citys Police Commission want all five officers fired. Those officers will now go through an appeals process. The city administrator released a statement on behalf of the police department. It read, the city of oakland supports the Due Process Rights of all employees. A disturbing discovery in the south bay. San jose police found a dead body along the river in the Guadalupe River park. Officers were doing a stress passing sweep along the river when they discovered a womans body. Police say it is now being investigated as a suspicious death. Things are moving again on highway 80 but earlier today an overturned tanker truck spilled liquid asphalt all over the highway. It happened at 5 15 this morning on richmond parkway overpass right over pinole city limits. Crude were able to get everything cleaned up by 2 00 this afternoon. It has been two years since bart workers were killed by a train while they were working on the tracks during a strike. The operator of that train had virtually no training. But since then bart has continually fought state regulators fines, even taking them to court. Investigative reporter Jaxon Van Derbeken tells us bart has spent more money on that fight than it might ever have to pay in fines. Reporter bart recently posted this notice telling riders about a 1. 3 million safety fine from the states Public Utilities commission. The notice was posted because bart is now on probation for safety lapses leading up to the deaths of two workers back in 2013. What bart doesnt say is that its gone to court to challenge the Oversight Authority of the state p. U. C. Claiming it doesnt have the power to enforce barts internal safety rules. Bart board member debra allen wonders about going to war with state regulators. So i cant really comment on the case itself. Bart claims those five violations amount to an unlawful expansion of the commissions authority over a Statutory Public agency. That defies logic and law, regulators counter, and could hinder bart being held accountable for safety lapses. While the fight goes on, legal fees are mounting. A deadly arson fire at a popular japanese Animation Studio has shocked the nation. The fire killed 33 people, left dozens more hurt. Police say a man walked into the building and shouted you die as he ignited the flames. He is not a current or former employee. Some employees reportedly tackled him and handed him over to police. He is in custody tonight. One witness heard him angrily complaining that something had been stolen from him, possibly by the company. Kyoto animation is best known for its hit stories featuring High School Girls which have millions of fans. Hawaiis governor has declared a state of emergency after dozens of protesters were arrested near an iconic volcano. Demonstrators gathered near the monakea volcano in a lastditch effort to stop the construction of a telescope. The protesters say the land is sacred. The governor says the emergency proclamation gives authorities more flexibility to clear the way for construction equipment. The protests have been peaceful. In fact, some of the 33 people arrested hugged officers before being taken into custody. Okay. To the weather now. A lot of the country facing a heat wave. I mean, miserable conditions. Very dangerous. You know, certainly over 100, h. So were going to have a look across the nation at where some of the hottest temperatures are. Well start off our microclimate forecast in a much more comfortable location right into San Francisco where we have a fog storm happening. Right now some areas of spotty drizzle as well if youre heading into the city tonight. Might actually need those windshield wipers for a little bit. Currently we are at 59 degrees as we move through tonight. 50s are staying put and also that fog with us. Now, as we move through tomorrow morning we see the best chance of that fog right at the immediate coastline through the peninsula and also into the north bay. Otherwise, its cool, upper 50s and low 60s with the best chance of sunny skies right down there through the south bay and 61 degrees. Well take you here to the east ba w also berkeley. Otherwise, a good start. And the coolest temperatures in San Francisco in the north bay with plenty of mid 50s moving on in. I dont see temperatures changing a whole lot as you move through tomorrow. Its going to keep it pretty comfortable down here in the south bay for july. 83 in los gatos, 84 downtown san jose, and 80 in gilroy. Now, gilroy is usually one of our hottest, but that ocean breeze is going to kind of sneak in from the south. Thatsing whats going to keep from you getting too hot. Right through the east bay 90s tomorrow. Thats a little bit of relief for you. 84 in concord, 86 in livermore. Back by the bay looking good in aekland at 72. Peninsula 78 in redwood city. Then you notice daly city cooler, 60s. Thats because that ocean breeze of course is quite a bit stronger there. And that will leave us with widespread 60s through San Francisco and even after that morning fog we should get some sunshine through the afternoon. And for marin, napa, sonoma counties probably some of the best weather here tomorrow. 70 in mill valley, 79 santa rosa, and also 78 here in sonoma. So looks good here, but if youre doing any traveling be aware that it is going to be hot and humid forcity. 108 in chicago. 104 in louisville. 101 new york city. And 100 in charlotte. So very thankful here to be back in the bay area where theres going to be nothing in the way of temperatures like that. San francisco 60s as we head throughout that next sevenday forecast. Little bit of morning fog, afternoon sunshine. Inland valleys well warm it up to the upper 80s this saturday and sunday and then well see some 90s eventually by next wednesday and also thursdays forecast. Okay.
