Reporter we went in to the amazon hub in downtown san jose. They had no comment. We also reached out to Amazon Corporate this morning and were promised a statement by this afternoon but we have still not received that statement from amazon. Reporting live in san jose, marianne favro, nbc bay area news. Okay. Thanks so much, marianne. Well, it was a mild day today. We hoped you enjoyed it because its now over. A warmup begins tomorrow. A live look at our traffic cameras. This is San Francisco where you can see the fog is now gone. Walnut creek, where well see some of the warmest temps. Lets check in with meteorologist rob mayeda. A little bit warmer. Still 70s in san jose. You mentioned walnut creek, another spot tomorrow. Concord climbing into the 90s. We did return to the 80s today. 90s making a big comeback that will take us to the weekend. Well be watching air quality very closely and this time around fire danger could actually be a bit more of a concern because this time we could be seeing seven to ten days of these above average temperatures. So while temperatures may not initially be as hot as they were last week, this pattern will be sticking around for awhile. Coming up, well show you when to expect the hottest temperatures in our full forecast coming up in about eight minutes. Thanks, rob. Keep track of the temps at nbcbayarea. Com. Type in your zip code on the front page to get the temps in your neighborhood. A story is turning into a political hot potato. Its all about the homeless problem in San Francisco. The transient caught on camera right there at that door attacking a woman in her condo complex last week was back in court to face charges on another crime. Today 25yearold Austin Vincent pleaded not guilty to assault with a Deadly Weapon and making criminal threats. The charges are linked to a february attack where four people say he threatened them with a knife. Vincent was tied to the crime after someone recognized his mugshot from this condo attack. Today, the judge also ruled vincent needs to stay in jail while awaiting trial. Theres always a balance thats done, and we believe that balance definitely merits keeping the defendant in to advance public safety. He was getting the help that he needed. He was having the root cause of some of his issues being addressed and now hs in jail where hes not going to get help with those issues. The District Attorneys Office also confirming its trying to figure out if vincent is linked to two other crimes in San Francisco. New drama in the ghost ship fire trial, but this doesnt involve the two men on trial. Were now learning why the judge tossed two of the three jurors from deliberations yesterday. They could be held in contempt for violating court orders. Nbc bay areas melissa colorado joins us with more from the courthouse. No verdict yet but theres lots going on there. Reporter janelle, if there is another juror shakeup this trial could be in jeopardy because we only have one alternate left, and its very likely these 12 jury members did not anticipate for all of this deliberation to drag on because now were learning, according to the judge, that several jury members made travel plans for the next month of september. So this is a logistical, this is a scheduling hurdle that this judge now has to deal with. Now, attorneys are still forbidden from talking why the three women were booted off the jury yesterday. The judge Trina Thompson shed some light when she said the misconduct is demonstrable. There is a chance two exjurors could be held in contempt of the court. It all depends on the nature of the defense, but if found guilty, the women could face heavy fines or even jail time. The judge said she is still gathering information about the third jurors involvement. Our nbc bay area legal analyst jean johnson says it is rare for a juror to be held in contempt. There is so much thats unprecedented about this jury. Whatever they did, they must have done it together and it must have been very serious. Okay, melissa colorado joining us now live again. Now, we know today was the first full day of this new jury with the three alternates. You say some have travel plans. So any indication from the inside or from our analysts how long these deliberations could drag on . Reporter you know, that is the milliondollar question. We saw them for a couple of minutes today. Judging from their body language it seems that all 12 jury members get along, but according to the judge, at least two jury members have made travel plans for the month of september. One juror is een requesting four weeks off. So its very likely we could see added pressure on this jury to come up with a verdict quickly or maybe they go to the court and tell the judge its time to declare a mistrial. Guys . Okay. Thanks so much, melissa, for the updates. Take a look. A tahoe vacation theyll never forget. Two San Francisco teenagers have an incredible tale to tell and the video to back it up. You can see it right here. They came facetoface with that bear. Thats a big bear right inside their home. That bear walked through the front door and into their vacation home. President trump today backed off stricter background checks on gun purchases even though voiced support for that just a couple of weeks ago. After Mass Shootings in dayton and el paso, the president signalled support for stronger background checks. In a new wall street journal nbc poll shows 89 of americans support them. We have very, very strong background checks right now. But we have sort of missing areas. It is a mental problem, and ive said it 100 times. Its not the gun that pulls the trigger, its the person. Im sure the nra and its allies are putting a lot of pressure on the president to back off. And you are right that ultimately republicans in the senate are not going to vote for a background checks bill without the president s support for it. House and Senate Leaders say gun control will be a top priority when lawmakers return to capitol hill next month. Up next here at 5 00, are california gun laws working . Theyre reminding students to be aware of their surroundings and travel in groups. Well, gun laws can help prevent Mass Shootings. Thats the finding of a new study. Californias among 17 states with socalled red flag laws which allow police or family members to petition for police to take guns away from a relative. Now, after the 2014 mass shooting near uc santa barbara, california did pass a law allowing family members to request a gun be confiscated from a relative they believe presents a threat. Their data shows 21 Mass Shootings were likely prevented by the law. Most subjects were white men, 14 to 65 years old. 52 guns were recovered. In three cases, subjects had purchased guns that they had not yet been allowed to pick up because of californias tenday waiting period. Researchers stressed the study doesnt definitively prove that red flag laws work. Only that people calling police with their concerns can make a difference. Effective today, plastic Water Bottles are no longer allowed at sfo. Sort of. The airport announced earlier this month that it would ban plastic bottles starting today with the first of the kind ban in the nation. However, there is a significant loophole. You can still buy plastic Water Bottles there if theyre one liter or bigger. The ban also doesnt apply to flavored drinks including sodas, teas and juices. Anything that we can do to save the planet, from Plastic Straws perfect. To me that sounds kind of stupid but, i mean, whats it supposed to cause . Well, its for the environment. To help the environment. Okay, if it helps the environment, im all for it. Sfo says this is just the start. The goal is to have zero waste going to landfill by 2021.
