Breaking news now. Police in riot gear moving in to clear out those protesters who illegally took over a building owned by uc berkeley. More than 20 Law Enforcement agencies teamed up to clear them out. Nbcs pete serratos is in berkeley with the very latest pete. Reporter. Well yeah, those demonstrators inside of that abandoned building here in berkeley, as you can see behind me, they have been arrested. We still do have some police here on site, crews on site, as are working to board up that building. But some of those demonstrators outside say that they plan to come back to this site in the coming days. The tension escalating between demonstrators and officers this evening in berkeley, outside of an abandoned building taken over last night by propalestinian protesters calling for an end to the war in gaza. But in less than 24 hours, a heavy Police Presence involving multiple Police Agencies shut down nearby streets, outnumbering the group of protesters, allowing police to arrest 12 people inside of the building. The takeover of the building, happening just days after the uc berkeley encampment, disbanded after student organizers came to an agreement on their demands with university officials. Its unclear what the specific demands are for the group that occupied this abandoned building, but the University Says they are not affiliated with the student groups on campus. Pretty typical for berkeley for just the current situation. Tim mitchell from berkeley is one of the many onlookers at tonights demonstration in his neighborhood. And with protesters chanting to officers, well be back hes expecting the protest to continue until the war comes to an end. Its just going to keep happening. I think people are just the propalestinian protesters are just fed up at this point after after that many months. So they really want to just go all out. Now, uc berkeley officials made it clear that no one is inside of that abandoned building, and those arrested could face charges of trespassing, vandalism and destruction of property. The whole thing she never saw coming lasted fewer than 10s ending with a store owner of kansas food market stepped in, tossing the woman out. Video shows a shocked and hurt kate laying on the ground, wondering who and why when she says she had no interaction with anyone outside. When it happened on tuesday afternoon, i was. So lets see what tomorrow brings today, Jessica Blasi pleaded not guilty at an arraignment after the District Attorneys Office charged the 26 year old with two counts of assault. It is random acts of violence like this that negatively impact a feeling of safety. Fried food, fun rides and an extra set of eyes. Its Opening Night for the Contra Costa County fair and teenagers are welcome, but only with an adult. Theres now a chaperon policy for the next four days. Anyone under 18 will need to be accompanied by an adult whos at least 25 years old. Each chaperon can only have four minors with them. This is all in response to a series of fights between groups of teenagers last year at the county fairgrounds. A lot of people tell us tonight, though its sad to see all this happen, but they understand thats crazy. All the kids in high school or school, they cant get dropped off no more and come by themselves, you know what . I think its a pretty good idea. I know they had a little bit of problems last year, so i think its better that they have more supervision. The county fair isnt the only place thats made changes due to teenager brawls. Last year, Great America also instituted a chaperon policy, bringing it back to life. Downtown san jose has faced a number of issues over the last few years, including homelessness and concerns over open air drug use. But the city is hoping to bring more foot traffic in. Live music, food, art and Small Businesses downtown is open for business, all with the hope to bring more foot traffic to downtown. We have incredible entrepreneurs in credible diversity of restaurants and bars and cultural venues. Downtown san jose has faced issues over the last few years. The pandemic, of course, impacted businesses and in turn, foot traffic. And about a year ago, residents expressed their concern to nbc bay area regarding open air drug use. The city responded with officer foot patrols tonight as the city moves forward with its second summer of block parties, businesses around are optimistic. One of the businesses welcoming this is good time bar. Theyve been open for about a year. The owner hopes this block party brings more customers in. A lot of folks in san jose are still unfamiliar with with the product, but you know, as we bring in more customers, people get to try it, they really like it. And we kind of make a lot of lifelong customers. The San Jose Downtown Association points to a recent study showing downtown activity is up 20, and even with good time, bar says hes seen it. Were seeing more foot traffic sort of month over month, were really excited about the summer. A number of vendors also get the chance to show off their products. That package was delivered to the swing space building late this afternoon. Thats about two blocks from the capitol building. The package contained a threat that there was anthrax inside. All Staff Members quickly evacuated, but were allowed to go back inside that building once officials tested the substance. A teacher strike has been averted in Contra Costa County after a tentative deal was reached late tonight. This comes after teachers rallied in Pleasant Hill earlier this afternoon. Members of the contra costa Schools EducationAssociation Teachers were calling for better pay. They claim that they werent making enough money to live in the district. That they teach in. Well, tonight, the Contra Costa County office of education said that they have reached a tentative deal. The two Year Agreement includes a 6 raise that can be renegotiated if the cost of living rises more than 2. Superintendent released a statement saying in part, quote, this agreement increases the compensation for our hardworking employees while ensuring that this agency remains fiscally sound. More drama in the San Francisco mayors race a planned forum between mayor breed and supervisor aaron peskin has been canceled, and the chronicle reports a separate debate scheduled to happen at the same time, which is next monday, has lost another participant, daniel lurie. Breed and peskin have all dropped out of that debate. Hosted by together. Sf mayor breed cited concerns that the group is too closely connected to one of her opponents, mark farrell. For 80 year old zeta flowers, this isnt just a house. Its her home of 26 years. Its where she raised her four adopted children and more than 20 foster children, all on her own. But now shes being forced to leave. Its not fair. Its not fair. Bloom flowers runs a daycare out of her home, but the pandemic decimated her small business. Her rent of nearly 2,000 a month, she says, became unaffordable before covid. Had you ever not paid your rent . Oh no. Never. Not ever. No. Im a believer in paying for where you stay. Like many cities across california, oakland enacted an Eviction Moratorium during the pandemic, prohibiting landlords from kicking out tenants unable to pay their rent. But after that three year long moratorium ended last july, landlords were allowed to begin demanding up to a years worth of back rent and evict tenants who didnt pay up. Were seeing an alarming rise in the eviction of low income seniors, attorney and tamika zamora is the executive director of the eviction defense center, a nonprofit providing legal aid to more than 3000 low income tenants each year. They have fixed incomes, right . Like Social Security that barely, barely covers the rent. So they had like little side jobs to supplement and the moment the pandemic hit, all those jobs dried up. Today, nearly a quarter of the oakland clients at the eviction center are seniors. Thats up 17 compared to prepandemic. Tenants advocacy groups in San Francisco and berkeley are also seeing spikes in the number of elderly facing eviction. Nationally seniors are now the Fastest Growing age group experiencing homelessness. Roughly 140,000 and counting. How do you tell somebody whos 75 get back in the job market . Because you need to make 600 more a month, right . Its a lot of these situations are really impossible. Her nonprofit took on zetas case after zeta got an eviction notice from her landlord, demanding she pay nearly 18,000 in owed rent or move out in three days. What went through your mind . What went through my mind . First of all is they didnt care to expect me on a short notice to move that fast. Like in three days. Impossible tenants can legally fight off their eviction for rent missed during the pandemic, if they can show they endured a substantial Financial Hardship as a result of covid 19. You cant just say it. You have to be able to support it, real Estate Attorney mark chernov says renters need to have documentation proving their struggles. They may also have to get an attorney if their landlord disagrees and takes them to court. What would you say to those who argue that this puts an unfair burden on the shoulders of tenants . Because the only way to make the defense is to have to go through this legal process. If its truly the result of substantial Financial Hardship, you would have bank records, you would have credit card bills, you would have loss of income that you could show, you could have decreased of hours. That would be pretty easy to prove up. Chernov has represented hundreds of landlords, including the homeowner who sent zeta her eviction notice. As unfortunate as it is, small Property Owners cant subsidize these types of situations. Its not fair to ask them to. While zeta received her notice after the moratorium ended, weve learned hundreds of seniors were also getting eviction notices during the moratorium when it was illegal to force someone out of their home because of missed rent payments. Records we obtained from oaklands Housing Department show the number of eviction notices filed against renters did drop by about 80 once the moratorium went into effect, but during the three years it was in place, weve learned landlords still sent out more than 2500 eviction notices, including to low income seniors. The letters threatened to kick out renters within just a few days, even though landlords didnt actually have the legal power to evict them during the moratorium. Courts werent granting evictions for lack of payment. There is no teeth behind those notices because the law says you cant collect that rent for that time period. But for many tenants, just getting those eviction notices was reason enough to pack up. That can cause very vulnerable populations like low income seniors, to be scared and not know their rights. And you know, to basically move out. In fact, during the moratorium, we discovered oakland landlord sent at least 350 eviction notices to renters at ten apartment buildings that cater to low income seniors and those with disabilities. The apartments are all owned or operated by three companies Newport Partners llc, Christian Church homes, and human good, which calls itself california s largest nonprofit provider of senior housing. That group was the only one that responded to our request for comment, telling us the eviction notices. Its centering the moratorium do not reflect the actual number of evictions, which are extremely rare and must be approved by the court. They werent allowed to serve serve that notice in the first place. And if a tenant moved as a result, they could sue the landlord for wrongfully evicting them. So it seems like really the only way to be able to fight that is the tenant first has to move out and then argue that it was a wrongful eviction. Yeah, for a tenant to have an action for wrongful eviction, they cant be living in a rental unit anymore. So you cant be living somewhere and say that you were wrongfully evicted. Hi, this is amanda calling back from the eviction defense center. We spoke yesterday briefly, which puts the burden on the renter to find a new place and then take the landlord to court. Advocates say the government is doing next to nothing to protect them. The Alameda CountyDistrict Attorneys Office wouldnt tell us how many wrongful eviction cases its prosecuted, if any, and the city Attorneys Office in oakland has only tried for wrongful eviction cases over the past five years, but even lawful evictions can still feel wrong. To those forced to leave, im seeing seniors out pushing carts now because theyre homeless instead of going to court. Zeta flowers reached a settlement with her landlord that forgives her, owed rent and provides her with moving expenses if she leaves by next month. I had help many others didnt have the knowledge of knowing what to do, and i think that when they were served, they just moved out. They just left. Zeta now has time to pack and say goodbye.
