This morning, a federal Appeals Court ordered the judge to dismiss the criminal case against Michael Flynn. Well im sure hes learned his lesson that rich, well connected people dont have to learn lessons. The order to dismiss the case without review is called a writ of mandamus, which is also the name of a poorly received harry potter courtroom novel. as harry potter your honor, expecto objectum this comes even though Michael Flynn already twice pleaded guilty of lying to the f. B. I. But, in the end, it was just a case of he said. That he did it, twice. And the whole thing feels fishy. The two judges who ruled in flynns favor have a history of seeing eyetoeye with the trump administration. And one of them, judge neomi rao, is a former white house official whom trump appointed to the Appeals Court last year. Look, im not saying shes in trumps pocket, but i was suspicious when she gave that ramp the death penalty. This ruling means the politicization of the Justice Department has sunk to new lows. But i guess we should have expected that. After all, it is literally run by a low barr. So congratulations, Michael Flynn. Youre off the hook. You can now go back to your day job of peddling influence to foreign powers for cash. Turns out, trumps right businesses are opening up again. If anything, the plague is getting worse. Yesterday, the number of new cases grew to their highest levels since april. What . April come on, we have to have made progress since april. The covid spikes are especially bad in three states florida reported a new daily high of 5,508 cases. Texas reported more than 5,000 cases, its largest singleday total yet. Things are so bad in the rest of the country that new york, new jersey and connecticut will now require certain outofstate travelers to quarantine upon arrival. They havent made any improvement over the last 102 years, somebody screwed up. I feel like the last big improvement was during the black death, the plague, somebody went, should we be going to the bathroom in the drinking water, or is that something we should stop in . Okay, lets talk about the incredible civil rights demonstrations that have been going on in the wake of George Floyds death and Breonna Taylors death and ahmaud arbery. Why do you think right now there has been such a powerful movement in the streets that has been so broad, like, 2,000 different towns and cities . People from all walks of life, all taking to the streets demanding change. What do you think is different now . Boy, thats such a great question. Stephen thank you. Its funny, i was thinking back when this happened to when i was still doing the show and the terrible tragedy in charleston, ferguson, eric garner, and and i dont know. Its because those i remember those moments being so chilling and feeling like such a wakeup call. But also feeling hopeless that we continue to stare at the sort of this abyss of a gaping racial wound that we never seem to do anything about. And so, in this moment, i dont know if it was i think will smith said its not that racism is worse. Its being filmed. But the others were on camera as well. In some respects, i wonder if the pandemic, because we all went into kind of a stasis, and so much of our the distractions of your daily life were removed, that it allowed the country a moment of clarity because so much of the noise its almost like in this moment of more quiet reflection, america suddenly stopped and smelled the racism. Do you know what i mean . Stephen yeah. There was that feeling that we were in a moments pause, and in that in that one breath, maybe it suddenly became clear to us. Because, look, the biggest obstacle to change has always been our inability to understand that its not just about ending segregation. Its about dismantling the barriers. I was talking to charlamagne in the morning, and it feels like black people have had to fight so hard for equality for so long, and the exhaustion of that, and the just despair of that, the anguish of that. While they were fighting for equality, white people were building equity. And the disparity then between a lack of equality and a rising of equity just exacerbated. So theyre always negotiating from this subservient position what should not be a negotiation. They had to, from the getgo, ask for humanhood, ask for those things that in our declaration of independence say, very clearly, are your inalienable rights from your creator. Theyre not, you know if god creates us all equal, the American Government somehow got to be the bouncer of that creed, and you had to ask and beg and plead and fight and take to the streets to gain an equality. But while that was going on, we still have legal boundaries to keep them from gaining equity. And i think equality will only come once the community can gain the equity thats been taken from them bleep from the beginning. I mean, youre talking about the homestead act. You know, all the slaves were freed. They werent allowed to have their own land. They didnt get their 40 acres and a mule that was promised to them. Andrew johnson made sure of that. And we did the homestead act, white homesteaders were given millions of acres of land, which was the equity somebody was telling me. I think they were saying that 20 of the people from that of the wealth in that area can actually be traced to the homestead act, which explicitly did not include black people. Federal Housing Administration in the new deal explicitly said you cannot loan these lowcost loans that were intended so that white people could gain equity, you cannot give them to black people. This is the most progressive piece of legislation that may have ever happened on the soil of america, explicitly excluded black people. The g. I. Bill in long island, when everybody was buying into levittown, explicitly excluded blacks. Until we address that, there is theres equality wont come. I think you have to that, to me, feels like the root. Stephen i think that is the root. I think if i would only add to that is that i think one of the reasons why this is a catalytic moment is because of all the work done by black organizers over the last five or six years, specifically black lives matter, who four years ago in the election was like, who is this radical organization . And now is generally accepted as having a proper goal. The understanding of what black lives matter means is more broadly accepted. The second thing would be go ahead. No, i was just going to say, you know, but still its going to be the but people. The things working against it are the but people. Its the people that are and, by the way, as ridiculous as it is for two old white dudes to be sitting around going, the problem with racism in this country. Stephen but i think its valid to talk about why its widely accepted. Because im talking about why its not just the black community who believes this has to happen now. Right. And here is why i think this is important. I believe white people can function as avatars for some reason and we used to have it some times on the show, we did a bit on it, where it was myself and Jordan Klepper and jessica williams, talking about one of those instances in ferguson, and she was making great points about systemic racism. And Jordan Klepper would say, i dont know, that just doesnt sound like its real. And i would say the same thing she said, slightly reformatted, and he would go, that is so deep and profound. You are such a thought leader on race, and i really respect you on that. And shed go like, i just said that. And hed go, i dont think you did. Because i think the problem here has always been maybe twofold. One is the but people. And you see them theyll come out, you know, what happened to george floyd was awful. We watched it. And no one condones that. But. As soon as you hear but, you know theyre about to negate the reality of the situation. He wasnt an angel. Yeah, but you know, the criminality in that neighborhood. One of the biggest problems i think the problem is twofold. One is i think theres a large swath of the white population and you know this as well as i do that believes somehow that the inequality in the black community is on them. Stephen right, theyre just not working hard enough. Correct. That there is a it is a it is a problem of virtue and culture. If you just work my grandfather had to work. Right, your grandfather when he came home from world war ii, they gave hem a lowcost loan to buy a house. When a black g. I. Came home from world war ii they werent allowed to, and they were never allowed to built that equity. The first thing is to try to have the conversation to convince people because we dont talk about entrenched white poverty in the same way. Look at the way they talk about poverty in the inner city. Somehow its the fault of the denizens there. But white poverty is a tragedy of circumstance. Its globalism. Its jobs that go overseas. Their problems are depths of despair. Like opioids are treated differently than crack. Crack is criminalized and people put away. Opioids, theyre just sad because the jobs have gone. Well, how would you handle what has been systemically done to the black and to the black community, its always, come on, man, were not slave holders. Were not why cant you get over it . Meanwhile, look what happened to white people. Six weeks of quarantine, and they were like, im going to storm the government with my ak47. Stephen jon, were going to to take another break. The presidency is supposed to age the president , not the country. And i do think at some level, its like, i think bidens slogan should just be, its enough already. Like, you clearly youve got one bit. Stephen biden has literally tweeted that, just that word, enough. Completely. Stephen yes. I dont feel like this election is just. And i really tried to parse this. Like, is it just anybody but trump . And i do believe that in some sense. Biden was not my guy. You know, wasnt even in the top four. I was more of a sanders, warren, thats just the direction stephen you were a Tulsi Gabbard man all the way. There you go. Yang gang 2020. So, you know, not my guy. And i have recently been thinking about something, and that is that we are a country in terrible anguish right now, just terrible we are in pain. American exceptionalism the kind of. The blindfold is off, and were kind of seeing ourselves as who we really are, that american exceptionalism is not like a title that you wear like you were miss america in 1937, and youll always be miss america. Like, it takes effort and work to maintain. And if you treat it as a fait accompli, it will erode, and you will lose it. And we are seeing that erosion. And we are fearful and we are angry, and we are in pain. And when i when i see biden past the schtick, i see a guy who knows what loss is. Stephen thats it. Knows grief. Stephen thats it. And i think that that kind of grief humbles you. When you lose like and you know this. And weve talked about these kinds of things because its something that i appreciate about you as well. Theres a humility to the randomness of tragedy that brings about a caring that cant be faked, and it cant be contrived. And what i think in this moment this country needs is a leader of humility, that understands that he doesnt understand, that understands the humanity of this experiment and the difficulty that it is in maintaining it, and that we have to connect with each other on a much deeper level without the bleep . And it gives me hope that that can bring about that maybe he is the man of the moment. Because the whole time listen, man, trump doesnt have that gear. He just doesnt. Stephen no.
