The man accused of killing tech executive bob lee is expected back in court right now. Nima momeni will face a judge who will decide whether to keep his trial in San Francisco. The defense argues that holding a trial in the city would be unfair because lee was well known here. Today, attorneys will also learn how long it may take to get evidence off of these newly released phones. Two San Francisco hotels and several residence in the tenderloin district are coming together to sue the city. They say the city is treating the neighborhood like a containment zone for drugs. They are not seeking monetary damages. Instead, they are demanding officials to clear the sidewalks and treat the tenderloin as it would any other neighborhood where crime is not tolerated. We reached out to the city but have not heard back. San jose is on the hunt for its next police chief and it is asking its residents what they want to see out of the next top cop. A meeting on thursday night at the kurt Community Center gave the public a chance to weigh in. Chief anthony mata is set to retire at the end of the month after 28 years with the department. Meanwhile, there will be another Community Meeting tomorrow at the school of arts and culture from 10 00 in the morning until noon. Listen to that. The winds really whipped around the bay area yesterday. Strong winds caused a tree to fall and land across power lines on highway 35. It temporarily shut down the roadways. It is gusty near Stinson Beach and all the way up into sonoma. Earlier this morning, we saw wind speeds up to 50 Miles Per Hour. It will take a while, even after the wind advisory expires for the winds to really calm down and the northbay. Here is what it is looking like by noon. Breezy up in the northbay, starting to die down into the east bay. For our friends in the santa clara valley, a Winter Weather advisory. It will calm down a lot more into the afternoon hours today and then we are left with a beautiful weekend ahead of us with the wind whipping up the pollen. Keep that in mind if you are sensitive to allergies. Protesting is a longtime part of bay area culture and we have seen a lot of it already this year including criticism of how people go about it. Dozens of propalestinian protesters were arrested last november for blocking the upper deck of the bay bridge for hours. Did not just keep people from work, it even delayed lifesaving operations as organs for transplant were caught in that gridlock. When the da announced charges, reaction was split. The 78 protesters facing a possible trial scored a major legal victory instead. The bay bridge 78 walked out of the court room to a cheering crowd that had packed the hallway to support them. The outcome, in the words of one organizer, a complete vindication and victory. Essentially, the judge dismissed our case with a diversion offer of five Hours Community service and a little under 4500 and restitution. I think that the das retaliatory charges were an attempt to put a chill on mobilization. As for some kind of precedent, we have seen incidents like this before. 2016, protesters with black lives matter took over the bridge and the Highway Patrol arrested 25 people. District attorney George Gascon reduced the charges to simple traffic citations saying it was in the interest of free speech. Than a judge just threw those charges out. While blocking the bridges a legal, there is plenty of room for discretion. Yes, the government does have a certain amount of prosecutorial discretion in terms of whether it will arrest people orsay go home and allow people to leave. There is all sorts of discretion that creeps in. Certainly, in teams in terms of the question, they say stop your protest. The protesters initially asked for the charges to be dropped completely and there was a great deal of anger directed toward District AttorneyBrooke Jenkins for her pursue all of charges at all. One of the 70 i defended the protest, saying the movement is being persecuted and misrepresented. I still stand behind what we have done in that we needed to make the statements that we needed to do in order to make our voices loud and clear. This movement is much larger than what is being perceived on the media and i hope that you as a reporter can reflect that in your own reporting. The das office says if the protesters are arrested again in the next two months, the deal could be off the table and criminal proceedings could be on the way. Live now to oakland where a popular barbecue restaurant is closing down permanently. The owner of horn barbecue says he will not reopen the eatery at its mandela parkway location in east oakland. It has been closed since a fire broke out at the building last year. The owner says that since then, they have been dealing with squatters and vandals but he does say a relocation is possible, just somewhere else in oakland. For the next 10 days, participating restaurants will offer special menu items that celebrate oakland cuisine and culture. Restaurant owners, a week to showcase the best they have to offer. Custody animals are those at the shelter because of a family emergency. We see 500 cases a year but last year we saw over 800. This year, we are on track to repeat the number. That is way, way more animals than we are used to. That adds to the increase they are seeing from a drop in the spayed and neutered animals. During the pandemic, Veterinary Care went down and surgeries were delayed. It is not just affecting dogs, they are taking in twice the number of bunnies they would see over six months, even more guinea pigs as well. They are asking anyone thinking of surrendering an animal to check for additional help first. We are jammed full. We have no room. March is Developmental Disabilities awareness month. An oakland nonprofit is doing important work to champion talented bay area artists with disabilities. The public will have an opportunity to enjoy their art as part of a new exhibit at sfmoma. We spoke with one of the artists who hopes his mural will spread a message of peace for San Francisco and beyond. Art is his gift but love is his view will. Artist William Scott is making final touches on his upcoming mural exhibition at the sfmoma. William is autistic and yet, he has not let any learning differences stop them from his creative abilities. Partnering up with creative globe, an oaklandbased nonprofit that supports artists with disabilities, william has been able to reach more art lovers. He has one main goal for fans of his art. To feel good, to feel good. Using advanced digital architecture programs to help create his blueprints, william s art has a deeply empathic lens, focused on themes of faith and family. He reimagine San Francisco through his imagery with the city entitled praise frisco where honest leaders will bring positive change to the city. The only rest that he gets his when he goes to church but he is always working. William hopes his art will bring about transformation not just for San Francisco but globally.
