A clarification from a judge about a current injunction involving sweeps of homeless encampments in San Francisco and the judge with the 9th Circuit Court of appeals says the city can sweep encampments if the unhoused person refuses shelter. This is all part of an ongoing lawsuit between the city and the coalition of homelessness. But for Sarah Stinson spoke with both sides. She joins us now what this means going forward. Sarah . San Francisco CityAttorney Says officials can sweep encampments only if an an house person refuses offered housing, but the coalition doubts the city is offering real housing opportunities to those on the streets. San francisco is in the middle of an ongoing legal battle over homelessness enforcement. The coalition on homelessness sued the city last year accusing it of cleaning encampments without offering people a place to live. A federal court issued an injunction that has restricted the city from relocating. Some People Living on the streets. The City Attorney david chiu says a judge is clarification on monday eases some of the obstacles. 9th circuit recently clarified. That if the city were to make a specific offers available shelter to unhoused individuals. They would not count as involuntarily Homeless Individuals and the city can enforce our laws against those individuals. Chew says this injunction has made it difficult for the city to clean up sidewalks and streets for the last 9 months. But one of the lead attorneys for the coalition all shroff says the city has been sweeping encampments this entire time and the injunction has always allowed them to do so. So they can clear intent 3 times a day, 5 days a week for the 9 months that the injunction has been enter. And its important to note that even injunction the city is allowed to clear an address, homeless encampments that are posing their health and safety violation worsens, violating from alexis ability laws. Trough says Council Still has doubt that the city is offering housing at all to people on the streets dc after 3 years of data is that time and again on a daily basis, there is not nearly enough shelter for the people that i have. That chance is going cease to forcibly displace chu says they do have available housing, but some people refuse the offer. We know or have heard that individuals have shelter somewhere within our system, but they choose to maintain a tent on the streets. In other instances when they turned us down. There are different reasons. But we also hear that their attorneys have advised to turn it down during this litigation. So thats frustrating. Shroff denied advising anyone of declining shelter. He says people refusing housing is a narrative the city has been pushing from the start. This lawsuit is pending in the injunction remains in place. The District Attorneys Office has announced an initiative to support victims of Domestic Violence and enhance Domestic Violence. Prosecution. They say last week, 19 officers began training to become Domestic Violence experts. They claim this training gives them the knowledge to testify on those cases in court and ultimately prosecute them more effectively. A federal judge has overturned californias ban on large capacity magazines. These are guns that would have more than 10 rounds of ammunition. The judge says based on the second amendment, the ban is unconstitutional. The same judge overturned the same ban in 2019. California now has 8 days to appeal the decision. Governor newsom has signed a bill that classifies child trafficking as a serious felony in the state of california, which could lead to increased jail time for convicted traffickers. Were seeing some scattered showers popping up. In fact, some parts along the north coast over 4 inches of rain up in those areas. So you get toward honeydew yet or Crescent City get toward eureka over an inch of rain inch and a half in some spots. Some active fires in northern california. Of course, we saw that smoke last week. That will go a long way to really dampen those fires. But here in the bay area started to see some scattered showers out there right now. In the east bay, a father and daughter were both shaken up, says they were being swarmed by deputies while filming a tiktok video. Yeah. Deputies say that they got a report that the father and daughter had a gun. Thats traumatizing anthony hudson, who goes by tone main online was recording a comedy skit with this 14 yearold daughter by the hayward bart station that went from funny to frightening on friday. He says they were suddenly swarmed by Alameda County sheriffs deputies who told him that they got a call about a gun in the area, then turned their firearm on him was scared. You know. Remember last week we couldnt see across the bay, there was just too much haze from all that smoke. So everything is change now in the atmosphere are also seeing some very large waves generated by that intense low in the gulf of alaska. So were look at the potential for maybe some 16 footers, maybe some 20 footers along the coastline through tuesday night. So be very, very careful. If you plan to do a little surfing it, make sure youre not an amateur. You know what youre doing and also watch out. If youre just walking along the beaches, want to get knocked off the rocks and dragged back into the water tonight. Increasing clouds throughout the night with a chance of showers developing as we head throughout the night, spreading the showers maybe early tomorrow morning, possibly in the south and along the peninsula and then sunny and breezy. So if you sleep might miss most of it then will probably warm things up a little bit midweek before getting windy over the weekend. All right. We talked about all that rain and they had some flood watches up to the north continuing in the shasta areas. Theyre seeing some of very heavy rainfall. So the worry about some of the debris flows there from some of those burn scar areas from those fires so that some to watch out for. But boy, this has been some time low spinning around for this time of year in september. Thats pretty intense for this time of year. So bring some heavy rainfall of north. Were going to catch the trailing edge. The system you can see really just some scattered light showers around the bay area right now. But that front likely to throughout the night tonight and into early tomorrow morning. Kind of moving on through kind of falling apart as it does behind that. Weve got a quick moving up front, but that is likely to head north of us but will leave a chance of scattered light shower early tomorrow morning. You see coming through right here as we head through the night midnight. You can see that band of rain moving to the north bay that spreading the south by about 02 00am right across the central bay and then heading even further south and by 06 00am or so. Maybe a couple of scattered light showers and then it moves out of town. We start to dry things out. So not going to be huge event. Fairly light showers with this storm system. Temperatures for tomorrow afternoon after we get done with the work early on sprinkles early on 60s and some 70s around much of the bay area tomorrow, 60s along the coastline will be breezy out toward the beaches about 71 in burlingame numbers warming up down the peninsula, but certainly looks like a wet start in some spots early on, especially to the north the by the afternoon that is long gone as very back back to some very nice temperatures around the bay area. So a good news is we like to see the rain coming through. The bad news is theres a chance that well see another weak system come through over the weekend. That system likely to bring some gusty winds, the bay area. And yes, you were talking about earlier job we may be looking at a wind event, maybe red flag warnings, excuse me as we head toward next saturday get a pole. Got a lot of talk about the fires. I rather talk about rain a lot more interesting and what will it help has a little bit of that rain. First maybe yeah. Around rain.
