Yeah, that judge with the 9th Circuit Court of appeals said that the city can, in fact. Sweep in campus, but only if the an house person refuses an offer of shelter. And this is part of an ongoing lawsuit between the city and the coalition of homelessness. Lets get more now from kron 4 Sarah Stinson. The San Francisco City Attorney says officials can sweep encampments only if an an house person refuses offered housing, but the coalition doubts the city is offering real housing opportunities to those on the streets. San francisco is in the middle of an ongoing legal battle over homelessness enforcement. The coalition on homelessness sued the city last year accusing it of cleaning encampments without offering people a place to live. A federal court issued an injunction that has restricted the city from relocating. Some People Living on the streets. The City Attorney david chiu says a judge is clarification on monday eases some of the obstacles. 9th circuit recently clarified. That if the city were to make a specific offers available shelter to unhoused individuals. They would not count as involuntarily Homeless Individuals and dos the city can enforce our laws against those individuals. Chew says this injunction has made it difficult for the city to clean up sidewalks and streets for the last 9 months. But one of the lead attorneys for the coalition all shroff says the city has been sweeping encampments this entire time and the injunction has always allowed them to do so. So they can clear 3 times a day, 5 days a week for the 9 months that the injunction has been enter. And its important to note that even injunction the city is allowed to clear an address, homeless encampments that are opposing fair health and safety violation where someone is violating accessibility laws. Trough says Council Still has doubt that the city is offering housing at all to people on the streets. We see after 3 years of data is that time and again on a daily basis, there is not nearly enough shelter for the people that i have that school seeks forcibly displace chu says they do have available housing, but some people refuse the offer. We know or have heard that individuals have shelter somewhere within our system, but they choose to maintain a tent on the streets. In other instances when they turned us down, there are different reasons. But we also hear that their attorneys have advised him to turn it down during this litigation. So thats frustrating. Trough denied advising anyone of declining shelter. He says people refusing housing is a narrative the city has been pushing from the start.
