I will tell you that in a few minutes, we are going to be pushing out some information electronically and that information will have some information about the officers that were involved in this incident. The spelling of the officers names will be on that document that i have passed around. I asked that you do not ask speakers repetitively to spell their names. That will be provided through the news organizations as this press conference is in progress. If you need clarification on that, please csn we will provide you with that. At about 4 10. For this afternoon, i will tell you this will be the order of speakers. We will begin with our police chief, scot smithee. His first name is spelled scot smithee, followed by john bennett, and limited interviews following the press conference for some of the Media Outlets the chief has arranged to speak with. Give me a moment and we will bring our speakers out. Accompanying them today will be the fire chief, jeff klatt, the city of gilroys mayor, Roland Velasco and one of our city councilmembers, mary blankley and the city administered, gabriel gonzalez. Give me one moment and i will be right with you. They should be starting there in a few minutes but i remember the Gilroy Police department coming and giving us a break thing a briefing of who would be speaking with us and an fbi reset representative will be speaking on this will start any minute as some folks are coming through the doors. In fact we have been hearing from the chief and from that representative of the fbi over the last couple of days as they investigate, as they continue to investigate and also the update of the Gilroy Community of how the investigation is going, any new information about the victims, any new information about the gunman and again, we are waiting to hear from the Gilroy Police chief as he gives an update on where things stand now and lets go ahead and listen in. I want to give you another brief update as to the status of this case and new developments. We are continuing to and put information together. As you can imagine, the amount and volume of witnesses, the thing we have looked at is very substantial so this will be a case that will be work for a long period of time. A couple of updates. One is my initial press conference, the night of the incident, i said that we had 15 victims and then we had that had been shot and 3 victims that were fatally wounded and the suspect who was killed in the altercation. We have located a not another victim that received a slight graze wound so did not go through the process that we were aware of. They sought their own attention and but they have come forward now and we are aware they were also injured so we will update that to reflect 16 people injured rather than the 15. Probably the biggest piece of information i will give you today, and i was asked at the press conference a couple of days ago, was when i would identify the names of our officers. Im going to do that today. So there were 3 officers, all gilroy officers involved in the shooting. First is officer derrick fryer. He is a 22 year Law Enforcement veteran. The second officer involved in the shooting was officers singo delmorale, a 17 year veteran. And the third officer is a 13 year teran of our agency. Giving out the officers names, i would respectfully request that you would respect their privacy. Obviously there confirm their concern for their families and i would greatly appreciate you avoiding contacting them at their homes and whatnot. I have talked with those officers and if they are coming to a point where they are ready to have a discussion and do interviews regarding this, we will certainly try to facilitate that for you. The last piece of information and it is just kind of an update and i will turn it over to the fbi because they are handling the evidence of their, as we are going to talk about the evidence processing and releasing of peoples property out at the park site. It afternoon. My name is john bennett. Im a special agent in charge of fbi San Francisco and i appreciate everyone coming out and spending a few moments with us. I would like first to start by offering my condolences to the victims of the tragedy. It is a senseless act and our hearts and prayers go out to the families impacted. I want to talk about the fbi resources we are providing to the Gilroy Police department. Right now, we have multiple evidence Response Teams in from across the country. Pretty much every fbi Field Division has evidence Response Teams. When the call goes out, they start flowing in this direction. That is coordinated by our headquarters at its response units we have people from virginia, west coast, east coast and everywhere in between helping to process the scene. We also have our victims assistance unit out here right now and they are working with the Gilroy Police department and sent a cleanser santa clara d. A. , the people involved with victims and getting some of the personal belongings back to everybody. We have special agents that are working sidebyside with the officers of gilroy and santa clara to run down investigative leads, talk to and interview not only victims but run down whatever leads that are needed to be done out there. We have technical specialists exploiting Digital Media that has been collected throughout the investigation and those technical specialists are local and also back at quantico at our lab. We also have the Behavioral Analysis unit here, the profilers. We asked them to come in to holistically take a look at everything being collected so they can give us some idea of motive, ideology, and we still have not had a firm grasp of ideology. We are working towards that. It is still very early on putting this together. It is a pretty massive site. Beginning today, personal effects from the parkside region of the park can be picked up at the Family Assistance Center located at rucker elementary school. That is the parkside of the park right now. The other side of the park is still an active crime scene. Vendors are being contacted by the Festival Association to arrange for scheduled pickups. We are trying to be respectful and understand that peoples livelihood is tied to some of the booths that they had out there and we are trying to get that cleared as quickly as we can. We continue to follow leads wherever they may take us. That could be something as simple as somewhere where this person was eating lunch so maybe where they were living in the past, that could be nationally as well. We must collect and verify any information and any evidence that is not a fast process. Yesterday, as i said, the fbi only knows one way of doing things and that is the right way and that takes time. I mentioned the motive. We have not yet determined the ideology. If ever. We have requested a Behavioral Analysis unit two support us in looking at this. They are at the crime scene and are also looking at it through the Digital Media with us as well. They review Raw Materials from the case. They focus on motivation. What is the meaning behind certain activities, certain writings that we may find throughout the course of the investigation. Im not a trained behavioral analyst. These folks of the experts. That is why we brought them in. It is another resource we can offer to the chief here. The crime scene is dropping by about 50 today so we are trying to get those vendors back in. There are still parts of the crime scene that is very slow and methodical. We are collecting evidence and doing bullet trajectory and we have to account for every round that came out of everybodys weapons. Some of those rounds in an open environment can travel quite the distance and there is a process to go through that we used to track the rounds and most of the time we find them pick sometimes they may not be found and we have a pretty good handle on most of them right now. So again, this is very slow is going to take a while for us to continue to go through but we are working as quickly and as diligently as we can and we are asking for everyones patience and we appreciate all of the accolades we are getting in support from the community but it is the chief of police, gilroy pd that is the lead agency on this and we are here to back them up. I think i have one more for you. One finalized, i want to finish with thinking with the are fbi agents working sidebyside, doing an amazing job, there is no shortage of volunteers from our office and surrounding offices that we keep bringing in. Thanks to the Gilroy Police department, including their officers who responded so quickly to neutralize the threat. They really acted with tremendous courage. Most people run from gunfire and they ran toward it and that saved lives. There is no doubt. And the city and the people of gilroy for all of their support has been quite amazing and very humbling. We have people bringing us drinks and making sure we are taking care of as part of the investigative team. We are still asking for the Public Health help. Any videos or photos people may have or may have captured that day that they feel maybe of interest can be uploaded to fbi. Gov gilroy. Again, i will give you that one more time. Fbi. Gov gilroy. Victims who want to get their properties back, can go to fbi. Gov gilroy victims and that opens a website where names and emails and phone numbers can be entered and we will get in contact with them within a day, back to the people looking for their belongings out there. We are trying to do that as quickly as possible. Again, that is very slow. We have to verify people belong to their belongs belongings. With that, i will turn it back over to you, sir. Thank you. I would say that all 3 of these officers are incredibly humble. I think they are heroes. I dont think they view themselves that way. I think they view themselves that they were just doing their jobs. I dont think they are particularly excited about being in the limelight. But i certainly think that they deserve recognition for what they did. Youve been listening to Gilroy Police chief, scot smithee. An update, the main headline is the investigation goes on. They still have not identified a motive here. But the chief really proud of the officers who confronted and killed the shooter on sunday, identifying those officers, all veteran offices of the force. A 23 year veteran, 17 year veteran and 13 year veteran of the department. As you just heard, he called the officers humble saying they were just doing their jobs but again, he believes that all of the praise coming in from the Gilroy Community and beyond is well deserved. You have to figure that the attendees, survivors at the festival, vendors are also thinking these officers, all part of the department and they are asking for everyone to give the more time. As the chaplain told us yesterday from the police office, as far as getting your long expect, the fbi gave an update that 50 of the crime scene has been processed and if you left your belongings on the parkside of the crime scene over christmas so park them you can get those back at rucker elementary school. The investigation continues. They are making progress. Again, the real challenge here is identifying and locating the bullets, the trajectory of the bullet so therefore, as you can imagine, it really entails a very large crime scene but they are working as quickly as possible to limit it, get it all processed and get everyone their personal belongings back as soon as possible. Survivors of the garlic festivals are beginning to share their stories after leaving the hospital. Kate abuse ann rubin spoke with two women who were actually shot on sunday. Reporter today, the two women spoke out about how fast they are healing and how grateful they are for the community members, doctors and First Responders who helped them. Gabriella goss was shot in the shoulder. Bryn autumn matthews took a bullet to the uraised her long and lodged in her liver. The friends ran for their lives sunday when gunfire erupted at the gilroy garlic festival. Shooter, Santino Legan killed 3 people, stephen romero, Keyla Salazar and trevor irby. 12 others including gabriella were injured. They spotted the gunmen waiting in line for an inflatable slide. They say he looked like a professional soldier to them but still, they thought, at first, it was a joke. We got out of there as fast as they could. It was the most terrifying place for us to be. It was just boxed in on all four sides. At the middle of the top, the gunmen can see and you get to the bottom and hopefully you can run and we ran. I was running and i felt like i got pinched a burnt, bee sting type thing and i knew, i remember being like, im hit but i did not look back. I kept running. Reporter the two were. That picked up by a stranger who brought them to the hospital. They say they are grateful for the care and support they received but they say they cannot stop thinking about those who did not make it. Our hearts go out to those who are not here to share their stories, stephen romero, trevor irby, Keyla Salazar. We are here for them. They are not here to share what they witnessed and what they went through and to the families, like, we are so sorry. The jury in the ghost ship case and the first day of deliberations without reaching a verdict Crime Reporter henry lee has been standing by the courthouse and joins us live with more on the questions, henry that the jury has been asking . Reporter within the last 15 minutes, i did see members of the jury walkouts of the courthouse here. At this point, it is clear they are spending time to review all of the evidence, all of the testimony and decide whether or not to convict the two men on charges of involuntary manslaughter. Thursday came and went. The fate of ghost ship defendants Derick Almena and max harris still up in the air. The jury went to lunch. By days end, still no verdict. The jury seems to have been really attentive and taking notes and i certainly hope and pray that and trust that they will be swayed by some of the honestly, the das, at best, i can call them tricks and just sometimes just crazy deception. I think when you are sitting and waiting and you dont know what people are discussing but you know they are discussing your fate, naturally, they are going to be a little more anxious. Reporter within an hour of starting deliberations on wednesday afternoon, the jury sent a note to the judge, asking if there was a Legal Definition for the term authorized agent as it pertains to the Building Owner and required permits. Judge Trina Thompson said there is no established definition but said the fire code refers only to agent. Was quote prosecutors declined to comment outside court. Defense attorney say the fact that the jury asked the question bodes well for the clients. My client cannot be considered an authorized agent under any definition on the section says the owner therefore is responsible for permits. We interpret this dialogue with the jury right now as a very good sign for mr. Harris. Of course, we dont know but we are optimistic that the jury is going in the right direction. Reporter the jury also asked for the terms leaseholder, authorized agent, occupant, and tenant were interchangeable. The jury was told, now. Now and oh n o. They were issue oriented, a very good jury. Reporter the jury will not be meeting friday or monday so the earliest they could come back with a verdict is next tuesday. It doesnt surprise me at all. It is a very collocated case. The jurors have a lot to talk about. They send the jury instructions back, a big packet back to the jury room. They will have to go through that. They have to go through a lot of facts. They begin by taking a fourperson, that is usually the first step. Onestate. The foreperson. So they talk about it, all of the evidence, the law, and then see where you are. Okay, we know of some of the questions that they have submitted thus far. This one, focusing on authorized agent. What do you make of the question . Ive done this for over 35 years and i tried enough a lot of jury trials. One thing i know, you never know why jurors ask certain questions. I try try to murder case one time and i was a prosecutor in a. Com oligarchical were going to lose this, oh my god, that question is so bad and then they came back with a guilty verdict in the case and said well, we had one juror that needed to know the answer to that question and that person changed their mind immediately upon the judges response to that. So you never know. When i hear the defense say, oh, these are good for us. Bunch of baloney. That is what weve heard. We are hearing the questions they are answering so far as a positive sign. You dont know. You absolutely dont know. And talk about the arguments that the teams give, the people have to argue twice because they have the burden of proof. Each defending defendant gets one argument and i was sitting back while they were arguing and i was thinking, attorneys get 3 argument, the one you write, the when you give and the one you should have given after the verdict comes in so you never know where a jury is going on this case. Like i say, they have to got to talk about criminal negligence in this case and that is a definition where it is not normal negligence because his. It is where you have absolute disregard for human life. That is why so many witnesses were put on. People that went in and said, i did not see anything long wrong. Then they argue if they did not see anything wrong, why are these defendants criminally negligent. The jurors will have to talk about that. The big thing here, heather is there are 36 people that are gone and the jury is going to have to deal with that and i know from trying so many cases, you can tell jurors, keep emotion out of it.
