Alleged assassination plot against president zelenskyy. We begin this hour with a looming deadline for former president donald trump. His legal team has six hours to respond to Special Counsel jack smiths request to limit what trump can say about the ongoing 2020 election interference case. The request for a special order came after the doj said trumps social media posts could, quote, have a harmful, Chilling Effect on witnesses or adversely affect the Fair Administration of justice. The doj cited a post in which the former president wrote, quote, if you go after me, im coming after you. Campaign called the postpolitical speech and said it was meant for the former president s political adversaries, but just this morning, trump put out another set of posts attacking the Special Counsel calling on the judge presiding over the case to recuse yourself and accusing mike pence, former vp of disloyalty. Joining us now nbc news justice and intelligence correspondent, ken dilanian and tali farhadian weinstein, former federal and state are prosecutor in new york. She is also an msnbc legal analyst. So ken, what are we expecting today . Good morning, jose. We expect Donald Trumps lawyers to argue for a less restrictive protective order in this case after one of them said this weekend that the public is entitled to see some of the evidence as long as it isnt sensitive. The Justice Department wants an order forbidding mr. Trump from making public any evidence turned over in discovery, and as you said, doj lawyers pointedly noted in that filing friday night that mr. Trump has a habit of attacking witnesses, prosecutors, judges on social media, and they cited that truth social post where they said if you come after me, im coming after you. The judge can rule anytime after she receives the response from trump lawyers, and that could be as soon as tonight. It will be interesting in this first ruling from the judge to see what she says having come under attack herself from mr. Trump. He says he cant get a fair shake from her. Well be watching for any comments he makes about mr. Trumps ability to attack core personnel, prosecutors, judges on social media, jose. How unusual is this kind of request from the Justice Department . Well, jose it is actually entirely typical for a protective order to be worked out early in a case, to make sure that the integrity of the proceedings are protected, hence the word. Of course obviously theres a lot about this case that is atypical. I do think its important to emphasize that the Special Counsels reasons here are entirely ordinary, and they mostly have to do with protecting witnesses, and so really what they are asking for are a set of ground rules that would prevent mr. Trump from threatening witnesses, tampering with witnesses, somehow making them uncomfortable so that they might change the evidence that they can bring forward, that their testimony might be affected, and i dont expect this to really veer out of the usual considerations there. Lets talk about those ground rules. What kind of limits could the judge place on trumps speech in this case . Well, so i dont think that she would prevent him from voicing his opinion about the fact of this trial, but it would have to do with how he talks to witnesses directly or incorrectly. I mean, when he says im going to come after you, many people could think that is directed toward them, and it could be intimidating toward them. It could also have to do with how the Special Counsel is already requested with how the material is handled, where he views it in the presence of his lawyers in particular locations, and what he can sort of disseminate if its particularly sensitive. Its both his statements regarding people who have evidence in the case and how he handles the actual evidence in the case. Its different from expressing political opinions. And ken, you were referring to that truth social post where the former president said he will immediately ask for a new judge and venue for this case. Do you expect his lawyers to formally request those changes . Its a good bet, jose. This judge was appointed by former president barack obama. You know, is clearly a democrat and has already ruled against mr. Trump in a consequential case involving turning over documents to the january 6th committee. None of that, by the way, are legal reasons that she should be disqualified. There are certainly reasons that are giving former President Trump pause and his legal team, so it seems likely that they will ask for a different judge, and theyre going to ask for a different venue because they dont think they can get a fair trial in heavily democratic washington, d. C. Legal experts say theyre very unlikely to get either of those things. Over the weekend, we heard from former Vice President pence on this case. Take a listen. I have no plans to testify, but look, well always comply with the law. There actually are profound issues around this pertaining to the first amendment, Freedom Of Speech and the rest. Im confident he and his lawyers will litigate all those thing i think there is a real likelihood that he will be required to do so, and you know, i think one thing we have to keep in mind, jose, is that were going to see this case play out in court and on television, and you know, sometimes people have different strategies in terms of what they have to say politically, and then ultimately what they have to do when they, for example, receive a subpoena. And ken, theres also another legal setback for trump in the manhattan d. A. s case . Yeah, and in the e. Jean carroll case. A Video Deposition taken of donald trump last october, handed over to new york prosecutors for use in the Hush Money Trial against the former President Set for March 25th Of Next year. In that Deposition Trump is asked about his infamous Access Hollywood comment where is he talks about grabbing women in a way that constitutes sexual assault, and he says he can do that because hes a star. When asked about that as a lawyer, trump answered if you look over the last million years, i guess thats largely been true. Asked if he considered himself a star, trump responded i think you can say that, yeah. So that video is now going to be available at trumps trial. Ken dilanian and tali farhadian weinstein, thank you both for being with us this morning. And we turn now to another trump legal cas we are closely watching in georgia. Joining us from atlanta, nbc news correspondent blayne alexander. Good morning, were awaiting a potential indictment there, right . Reporter absolutely, jose. We are watching and watching closely. One of the changes weve already seen is security has increased around the courthouse. Keep in mind, this is something the Sheriffs Office let us know was going to happen. Certainly to see it, to know that both sides of the street behind me are blocked by sheriffs vehicles, no vehicles allowed to pass. Certainly a stronger indication of what we could likely see coming in the next couple of weeks. Were talking about a time frame of three weeks. Right now were at the beginning of that second week during which District Attorney fani willis has strongly indicated we will know her charging decisions. She is preparing to present her case before a grand jury here in fulton county. Two different grand juries have been seated. We know that one of them is going to be hearing that case. We also know that subpoenas have started to go out, have been going out for people to come forward and testify before the grand jury as part of fani williss case. One of those people, for instance, happens to be a reporter, somebody who back in 2020 stumbled upon the room of those alternate electors. Another is a former state lawmaker, somebody who was seated and listening to Rudy Giulianis presentation in 2020. So of course both of those have tad with things we know fani willis is investigating when it comes to alleged interference in the georgia election, so certainly showing that things are ramping up here. Again, very much a watch and wait and see game here in fulton county. Blayne alexander, thank you so much. Good morning. So abortion was one of the issues that came up during the interview. What did he have to say . Reporter well, jose, as we talked about on this show before, Governor Desantis did sign a sixweek abortion ban in the state of florida. Its a bill that even some of his supporters were concerned was a little bit too harsh but a little bit too far. And he has implied in the past in some of his previous interviews, on the issue of abortion he believes it should be a Bottom Up Approach meaning he does think it should mostly stay with the states, but hes been less clear on what he would do if a bill, a federal bill, came to his desk when he was in the white house. Take a listen to what he had to say about that. So would you veto any sort of federal bill that tries to put a nationwide ban in place . So we will be a prolife president , and we will support prolife policies. I would not allow what a lot of the left wants to do, which is to override prolife protections throughout the country all the way up really until the moment of birth in some instances, which i think is infanticide. Well, actually, i got to push back on you on that because thats a misrepresentation of whats happening. I mean, that 1. 3 of abortions happen at 21 weeks or higher, theres no evidence of democrats pushing for abortions up until their view is is that all the way up and to that, yet there should not be any legal protections. Theres no indications of democrats pushing for that. Reporter and jose, of course abortion is an issue thats been coming up on the Campaign Trail for democrats and republicans. Democrats certainly are going to be using this issue to try to attack republicans. Theyve already been using it against governor ron desantis, this is certainly not the last that he and other republicans will be having to answer that question. And dasha, we also heard from the governors wife as well. Reporter thats exactly right. She has been a very strong presence on the Campaign Trail since even before they officially launched this bid for the white house, jose. We talked about all of this with her including her battle with breast cancer, which is something that shes been talking about on the Campaign Trail. Its something she can relate to with a lot of other women and mothers. Shes launched an initiative called mommas for desantis, really trying to engage mothers and grandmothers in this fight on the trail. Take a listen to some of our conversation. There for me, and he was there to go pick up my kids when i couldnt, and he did it with humility, and he did it with love, and ill tell you what, cant ask for a better husband than that. Reporter casey has really been credited with bringing a lot of the charm and charisma that some of desantiss critics say he lacks on the Campaign Trail and certainly in the interview she really opened up, talked about some of those personal issues, and he commended her for that. Youre going to be seeing a whole lot of her, a whole lot of the family on the trail as thats something that hes really using to tout the youth, the vbrancy of his candidacy, jose. And with us now to continue our conversation, peter baker, New York Times chief White House Correspondent and an msnbc political analyst, victoria defrancesco soto, dean of the Clinton School of Public Service at the university of arkansas. Also an msnbc contributor and former Pennsylvania Republican congressman charlie dent. So charlie, desantis has spent the past couple of weeks trying to reboot his campaign. Were 16 days from the first republican debate. Just over five and a half months now from the iowa caucuses. First of all, how long does it take to reboot, and is this reboot working, do you think . No, jose, i dont think the reboot is working at all. I think ron desantis is discovering very quickly that trying to unite the nontrump Republican Voters is harder than he thinks. He thought what he needed to do is appeal to the trump voter whos tired of donald trump. Hes finding out by passing sixweek Abortion Bans and engaging culture wars, thats not appealing either. He seems to be in this no mans land. Hes not a natural candidate, so he is really struggling. Also, i think the bigger mistake is when donald trump was on the rope with these indictments, he more or less jumped to Donald Trumps defense and said hes a victim of the deep state, when he should have been bludgeoning his opponent over these indictments, explaining why donald trump is too great a risk for the party to be its nominee, and certainly for the country. He hasnt done that. Im not sure where hes going with this campaign. Whatever hes doing, it isnt working right now. Charlie was talking about desantis as a socially awkward campaigner, do you think that Casey Desantis could play a significant role in changing things around for him . I think it can help, but at the margins, jose, at the end of the day, this is a race about whos going to be president and ron desantis is the one who hopes to be on the ticket. That being said, i do think his wife does bring an added asset in terms of softening some of that awkwardness, but also appealing to and mobilizing republican women. We have seen republican women throughout the decades really mobilize in support of more conservative agendas, coming forward to sarah palin. Were seeing nikki haley now, so adding in this kind of Pink Elephant i think is really powerful. We tend to think of that gop base as that white male, but women can also be a very strong force. We out vote men, and weve been out voting men for a long time. So i am curious to see this. But at the end of the day, ron desantis has to find his footing. If he does, his wife is going to be an incredible asset. Peter, meanwhile, President Biden is focusing on selling bidenomics out west. What are his challenges . Well, youre right. Hes going to go to arizona, new mexico, and utah to talk about the advantages of his program, particularly the inflation reduction act, his climate spending. He wants to claim credit for improving economy. Were seeing a real disconnect for him. A lot of indicators are much better today than they have been, whether it be inflation, gas prices, immigration, crime, a lot of these indicators are off their peak, are much better in some ways than they had been a few months or a year ago. But the one indicator thats not changed is his Approval Rating and in fact, his competitive, you know, status against donald trump if hes a republican nominee. Our poll that was Sienna College last week, found that the president still had that 39 Approval Rating. Thats the lowest any president going back to the history of polling except for jimmy carter, that didnt work out well for him. Our poll showed him tied 43 to 43 with trump. What they hope is that over time that will be a lagging indicator, that as people become more confident about the economy and Consumer Confidence is up, as people feel the impact of his policies they hope his numbers will begin to rise as well. Well see that, thats happened in the past, reagan, clinton, obama, did terribly in their midterms and came back and won convincing reelections. Thats what biden is hoping for here. Peter, what do you think that disconnect or that lag is attributable to . Well, one of the things of course is the environment has changed so much since the days of those past president s, right . There used to be something of an allowance on the part of at least some people for the president of the other party, but today were locked pretty tightly in our polarized spaces. Theres no president whos getting 55, 60, 70 of the Approval Rating as there used to be back in the day of reagan, clinton, so forth. Youre locked into a smaller pool of voters you can appeal to. For biden, its about getting those democrats and independents back who dont like former President Trump and making them feel more confident in his leadership. Part of this is issue is something he cant do anything about which is his age. Theyre going to telling people, look, yeah, he is the age he is, but hes not donald trump, and remember how much you didnt like him two years ago, you should think about that in two years from now or a year and a half from now. Speaking of the former president , victoria, donald trump spoke at an Alabama Republican Party dinner on friday night and had this to say about the impact his legal troubles are having on his campaign. Every time they file an indictment, we go way up in the polls. We need one more indictment to close out this election, one more indictment and this election is closed out. Nobody has even a chance. Weve already defeated the republicans. Victoria, how do you read that. Take him at his word, jose, and look at the numbers as well. We have seen that whenever donald trump faces legal action, he sees that bump in the polls, and it goes back to the fact that he is so incredibly adept at framing himself as the underdog, as the victim, as the everyday guy that people are coming after, and that connects well with a lot of the folks in his base. This is something that donald trump has been doing since he started in the foray of politics in 2015, and it has just beat up. So this is classic trump, and were going to be seeing more of it. And im just thinking, charlie, is there anything you looking at this, is there anything Going Forward that could change that in the republican primary race . Look, when i hear about these indictments, i just got to say this, i dont know one independent voter who is somehow persuaded to support donald trump because hes going to be indicted four or five times. This is not helping him. Among the hardest elements of the republican base. These indictments, i believe, are disastrous for the party and for the country. Now, look, i would also argue for republicans, in order to beat donald trump and his primary opponents want to do that, theyre going to have to take him down politically. They want the Justice Department, jack smith to take down donald trump for them, to do all the hard, dirty work that needs to be done to take him down. I dont think that by itself is going to do it. That said, most people who get indicted, that disrupts their lives. Frankly, its about the worst thing that can happen to you in your life other than losing an immediate family member. Donald trump wears it as a badge of honor. I have to think this is weighing heavily on the former presi cer a lot of problems in the general election, not just for donald trump should he be the nominee but for down ballot republicans who are where you think a guy whos been indicted five times. One of the officers involved in George Floyds death is significantly higher than what even prosecutors were asking for. Important to note once you factor in factors like Good Behavior and time served, this would not result in him serving any significant more time behind bars. It will just be about two more months. This is the final officer connected to George Floyds death, the final criminal case connected to that, and it marks the end of that procedure. One thing that we saw in court and that were still waiting for the feed to come in, but were hearing from some local reporters is that we heard tao not take responsibility. He said that he didnt want anyone to get hurt that day, but he didnt take any responsibility as he spoke to the court for about 23 minutes. Judge cahill, who sentenced him, said that the fact that he didnt take responsibility and wasnt showing remorse, thats what led to him sentencing giving that sentence of about 57 months. I believe we had that graphic on screen right now. I mentioned this is the end of the Legal Proceedings with the former officers involved in George Floyds death. You see the sentences range from the 22 1 2 years for Derek Chauvin who had his knee on George Floyds neck for more than nine minutes, all the way down to three years with thomas lane. There are still some appeals that are making its way to the supreme court. In terms of the criminal proceedings were seeing in minneapolis, this marks the end of the road for those officers, jose. And now to new york city where police have arrested a 17yearold High School Student on a hatemotivated Murder Charge in the deadly stabbing of a professional dancer. Investigators say the teen whose name is not being released as of right now, stabbed 28yearold oshae sibley who is gay, during an altercation at a gas station on the 29th of july. Authorities say the stabbing occurred after two groups got into a confrontation at one of the gas pumps where sibley was dancing with his friends to a beyonce song. His group was being taunted with Homophobic Slurs by the other group before the stabbing. Thats been one of the more contested regions in this war. Again, according to ukrainian intelligence she had been seen traveling around mykolaiv taking photographs of what they said were potential targets like Electronic Warfare systems and ammunition warehouses, and the sbu said that the suspect had been seeking information about president Volodymyr Zelenskyys itinerary in mykolaiv ahead of his visit, and now all of this was done to prepare for some kind of air strikemykolaiv, its assets and presumably president Zelenskyy Itself whos thought to have been a target of russian Assassination Attempts since this war began all the way back in february of 2022, and thats why the ukrainians are calling this an attempt to kill the president , an assassination. This woman was caught red handed, she was detained reportedly while she was passing this information on to her russian handlers. Again, this is all ukrainian intelligence. So like i said, theres a lot of sketchy information here, jose. Another interesting thing is that ukrainian authorities havent reported actually charging this woman with anything. They said that she had only been detained pending an investigation, but they added that if found guilty, she faces up to 12 years in prison. Jose. This is something that they might not comment on so directly straight up, but this is something that we can probably expect to hear from them.
