With a growing issue weve followed closely here on power lunch. Tomorrow the Maryland State Assembly takes up a bill treating Energy Drinks like tobacco banning sales and marketing to minors. If it goes through in maryland, that state would be the first to make that kind of a move, although several cities are considering legislation. Despite that, Monster Energy stock is on a tear. In the last through months alone stock up 17 . Near a record high. Were going to talk with analyst john foshae in a moment. One of many wall street analysts with a buy on that stock. One of tomorrows star witnesses, a maryland cardiologist who joins, dr. Stacy fisher, who has seen the effects of these drinks firsthand. Dr. Kim williams, Vice President of the American College of cardiology who recently told us it took researchers decades to study the effects of cigarette smoking. Mow data is needed before we can heal tell how Energy Drinks impact the heart. Is it fair to move forward without more studies . The Beverage Association sent interesting comments on that. Go to dr. Fisher and talk to her about this. Doctor, you have seen first hand this week alone, i believe, several instances that are linked to these Energy Drinks. Correct . Absolutely. Weve seen issues in both healthy and unhealthy patients, and a lot of emergency room visits. As a matter of fact, the emergency room visits from 2003 to 2011 have quadrupled. Theres poison control data that shows that emergency room visits in 2011 directly related to Energy Drinks for more than 20,000. Those emergency room visits often dont include people that were actually there for Energy Drinks because were just learning as a medical community to even ask. You know, what about dr. Kim williams statement . He thinks that there needs to be more time to study whether or not what youre seeing in the emergency room can be directly linked to these Energy Drinks, and he points out the fact that it took us decades to study the effects of smoking before we put in the kind of restrictions that we now have on cigarettes. I would assume you disagree with that . I do. I think were better than that at this point. As a matter of fact, maryland chapter of the American College of cardiology fully supports this bill and has sent written testimony from dr. Mugman, the head of the maryland chapter to annapolis even last night. Really, we think that we could do a lot bet petebetter. Theres a lot of mounting data and no evidence that the drinks are safe or the mix of caffeine and the newer ingredients have even been tested together nevertheless tested in our children. Quickly, doctor, you believe that its the mix thats in the drinks . Not just the caffeine alone, but the other parts of the beverage that contribute to the effects that you believe its having on some of your patients . Exactly. And, again, these ingredients added are not really meeting generally recognized to safe standards and have never been tested in the quantityies being used and with the combinations that are being used. Today its down, but one year move on that stock of better than 50 , 50 and 1 3 as matter of fact. While we wait for the president to make his statement, lets get the stock side of things and get to john foushey who joins us. You have an overweight or buy on this particular stock. Are you at all worried about the potential liabilities outlined by dr. Fisher . Yes. I think the entire investment xmunt concerned in terms of some of the regulatory overhang. Thats had two impacts over the last 12 months. Kept the multiple lower than anticipated and probably has a little, has had a little bit of a dampening effect on demand. Right now, though, i think the Beverage Industry is doing a great job in terms of working with the fda, working with the senate to try to move this along, and i think the key factor is, they are tightening their marketing standards to make sure theyre not marketing the problem to marketing the product to kids under 18. I think thats the key factor. Making sure theyre going after the right target. We have to go to the white house. Excuse me, john. Theres the question. I wanted to provide a brief update on our efforts to address the ongoing crisis in ukraine. Since the russian intervention, weve been mobilizing the International Community to condemn this violation of International Law. And to support the people and government of ukraine. This morning, i signed an executive order that authorizes sanctions on individuals and entities responsible for violating the sovereignty and territorial integrity of ukraine, or for stealing the assets of the ukrainian people. According to my guidance, the state department has also put in place restrictions on the travel of certain individuals and officials. These decisions continue our efforts to impose a cost on russia, and those responsible for the situation in crimea. And they also give us the flexibility to adjust our response Going Forward based on russias actions. We took these steps in close coordination with our european allies. Ive spoken to several of our closest friends around the world and am pleased that our International Unity is on display at this important moment. Already weve moved together to announce substantial assistance for the government in kiev, and today in brussels, our allies took similar steps to impose costs on russia. I am confident that we are moving forward together. United in our determination to oppose actions that violate International Law. And to support the government and people of ukraine. And that includes standing up for the principle of state sovereignty. The proposed referendum on the future of crimea would violate the ukrainian constitution and violate International Law. Any discussion about the future of ukraine must include the legitimate government of ukraine. In 2014, we are well beyond the days when borders can be redrawn over the heads of democratic leaders. While we take these steps, i want to be clear that there is also a way to resolve this crisis that respects the interests of the russian federation. As well as the ukrainian people. International monitors, let them into all of ukraine including crimea assuring all rights of respected including russians. Between consultations between the government of russia and ukraine with the participation of the International Community. Russia would maintain its basing rights in crimea, provided that it abides by its agreements and respects ukraines saovereignty and territorial integrity and the world should support of people of ukraine as they move to elections in may. Thats the path of the escalation. And secretary kerry is engaged in discussions with all of the relevant parties, including russia and ukraine to pursue that path. But if this violation of International Law continues, the result would be the united and our allies and International Community will remain firm. Weve taken this to the allies and to support the people of ukraine. One last point. A lot in congress about these issues. Today once again im calling on congress to follow up on these words with action. Specifically to support the imfs capacity to lend resources to ukraine and provide american assistance for the Ukrainian Government to weather this storm and stabilize their economy, make reforms deliver for their people all of which will provide a smoother pathway for the elections that have already been scheduled in may. Today the world can see that the United States is united with our allies and partners in upholding International Law. And pursuing a just outcome that advances Global Security and the future that the ukrainian people deserve. That could, michelle carusocabrera, a referendum, as i understand it, on secession for the region or province of ukraine known at the crimea . Absolutely. Right on that, tyler. The imf, wants more funding. The u. S. Needs to give funding to the imf. The gop has thus far gone against that. Now it looks like theyre going to try to wrap ukrainian funding into the imf funding to make both of them move forward, and so that was a subtle message to the gop that if you want to help the ukrainians, which the vast majority, its our understanding do, you have to go along with that as well. Another thing of note there, hes calling for international monitors to be put on the ground throughout ukraine, including crimea, to ensure that all parties, ethnic russians, ukrainian as well, have their rights protected.
