And thats despite the promise from President Trump time and again that he would protect the most popular provisions of the law like protecting people with preexisting conditions. Now, clearly not so much. Adding to the head spinning confusion here, there are new report this is mos this morning some key cabinet members arent on board with the president s decision to target health care right now. Jeremy, what are you learning about this white house infighting over this decision . Reporter it all began in december when a federal judge in texas ruled that the entire Affordable Care act should be struck down. That ruling is now working its way through the appeals process. But at the time, the administration believed that only parts of that law should be struck down. So this ruling from this federal judge ignited a heated debate within the administration about what the administration should do. Thats what one white house official told me. It essentially broke down the battle lines between the attorney general bill barr and the health and Human Services secretary alex azar and allies of the white house chief of staff mick mulvaney. Azar and barr were arguing essentially according to politico that the administration should not support fully striking down this law as long as they did not have an alternative. This administration has not put forward any kind of new alternative to this law. If the law is indeed upheld, 20 million americans could possibly lose their health care coverage. The president seems to be relishing the idea of putting health care at the center of the political debate especially heading into 2020. That has some republicans scratching their heads. We know health care was one of the most galvanizing issues in the 2018 midterms. Republicans have yet to come up with a cohesive viable alternative to obamacare. If that ruling from the federal judge in december is upheld, that could leave 20 million Americans Without Health Insurance coverage. So the focus right now on what they would do if that would happen is required because we know how quickly Congress Moves on this front. Lets look at this through the eyes of a veteran republican congressman. Charlie dent represented pennsylvania, retiring last year. I feel like weve talked Health Care Many a time in the past couple years. Are you scratching your head right now . What do you make of this move by the president as health care being the next chapter to focus on for republicans . Oh my, this is a real head spinner. Think of it this way. Part of the problem with the president on health care, here was his plan, were going to cover everybody, its going to cost less and its going to be beautiful. He never played out his plans for health care. Thats a big reason why the whole thing failed. I cant understand why they would bring this up. Theres no viable alternative on the table. I think this is a political gift to democrats. What youve just said is a really important point. Maybe theres not a full plan out there, but do you have any indication that there has been any work on the republican side to come up with a new alternative . Remember, when republicans were in control of congress, they couldnt get it done with the alternatives they were coming up with. Do you have any indication theres any new idea out there now . No. There is none. Candidly if the Medicaid Expansion is repealed, i think that is probably the most difficult issue, particularly for members of the senate. Say the obamacare is thrown out completely. They have to come up with an alternative and they have to do it fast. I suspect theyd have to reinstate several pieces of obamacare pretty quickly amid then make whatever changes. Zero chance of that happening with a divided congress. Maybe im cynical, maybe thats realism. No. I think thats safe. Do you see republicans becoming the party of health care . The president can message it. Can he make it so . I guess the republicans could own health care but maybe not in the way they like. If the issue is that preexisting conditions are gone, protections for people with preexisting conditions are gone, the Medicaid Expansion would be gone. Yeah, you own that. The question is how would they deal with that administratively. How would they deal with all these people, tens of millions of people, who would lose coverage . They would have to somehow be taken care of. If you cant do it legislatively, what would the Trump Administration do administratively. Just this morning senator mcconnell blocked another attempt by democrats to try through unanimous consent to call for the Mueller Report to be released to the public. That resolution, nonbinding, passed the house unanimously, 420 0. What do you think oconnell is doing here on not letting it come forward . Im not sure. It seems to me that the report is going to be released at some point. There will be redactions. We all know that. I suspect it will be fairly politically damaging. I mean, the summary for the president was very good. This is a win. Hes not going to be criminally charged or knick anythianything. At the end of the day this report doesnt exonerate him according to mueller. I suspect mueller is just going to dump this thing on congress and let congress try to figure it out politically. So i dont see any gain by not releasing the report if mcconnell is trying to slow this thing down a little bit. Its coming. Might as well accept it and own it. As i mentioned the expectation is it had bewill be but not months before the Mueller Report is given to congress. Top democrats in the house have already set a deadline for next week to get the goods. So what is next for this when it comes to the Mueller Report . Joining me is madelyn dean of pennsylvania. Thanks for coming in. My pleasure. Thank you. You serve on the house judiciary committee. The chairman of your committee and others have set this deadline to see the full report by next tuesday. If its not delivers by then, what happens . I believe the chairman is prepared to call attorney general barr into our committee to explain why hes not producing it or if he does produce it, to explain his take on it. We will get our hands on that report. The American People expect it. Remember, the president called for full transparency and the release of the report. So its time we saw that report, because as you know, the white house is spinning it one way. The truth is we dont know the full take of the Mueller Report, a 22month investigation which im sure is very dense and in some 48 hours attorney general barr gave us a scant summary and a legal conclusion that he exonerates the president. Thats not what the report will say. Are you comfortable if you hear from attorney general barr, the Justice Department that they need time, theyre working with mueller to scrub this to make sure that what cant be released isnt. Are you comfortable giving him more time . I can imagine giving him reasonable time. Notice how quickly attorney general barr apparently completed his review. Over the course of the weekend he completed his review and came to a legal conclusion to exonerate the president of obstruction of justice. We would give him reasonable time. But really theres no other reason than possible grand jury testimony that this report shouldnt come out immediately. Are you going to be okay seeing a report that isnt by definition the full report . Youre mentioning grand jury testimony. Because it is going to be scrubbed for information like with ongoing cases, classified information and possibly more. Are you okay not seeing the full, full, full report . I want us to see the full report. Make no doubt about that. If theres classified information, i will trust that will be kept from the public but probably should not be kept from congress and the committees of oversight. Lets think about what just happened here in the course of the last four or five days. Mueller told us he had completed his investigation of 22 months. That report was delivered to attorney general barr. Attorney general barr came up with a scant, very strange summary of it not ever including even a single complete sentence of special counsel mueller. And then concluded at the end of his fourpage letter what he already concluded in a 19page audition memorandum that theres no obstruction of justice. Then the president makes this attack on the aca. This is head spinning. Let me tell you my outrage, that this administration would pivot from this moment and his call for transparency of the report for all america to know the facts and the evidence about what happened with russia and the many multiple meetings with russia and interference in our elections to tearing down aca. Congressman dent rightly points out that in our own state of pennsylvania millions have gotten Health Coverage and coverage for preexisting conditions and coverage for their children under 26 under aca. The other important piece of this is the Medicaid Expansion. In pennsylvania when Governor Wolf opted in for Medicaid Expansion, 1 million pennsylvanians got coverage, including for Mental Health and substance abuse. That the administration would tear that down is inhumane. On this very issue, but if obamacare is struck down in the court and democrats are in control of the house, is it your responsibility to deliver an alternative, a replacement . You know what weve done today and perhaps you saw some information about that yesterday. Today we introduced legislation. We are putting in legislation to protect preexisting conditions to build on the Affordable Care act. Thats what people want us to do, to continue to bring down the cost of health care, to continue to work on and they asked this of us when i knocked door to door. Get control on my Prescription Drug prices. Democrats are poised in introducing substantive legislation to build on the Affordable Care act. Strangely, this Administration Says they want to tear it down and they have no replacement. This president has gone one beyond the 65 attempts or more of the last congress or two that tried to repeal and replace. Theres no replacement. One quick question on the Mueller Report. Seeing adam schiff, the House Intelligence Committee chairman, he told the Washington Post and this is despite the top line findings that there was not a conspiracy with the russians. He says undoubtedly there is collusion and vowing to continue investigating. Do you agree with what adam schiff says there . What i would tell you is whats interesting in the barr letter, the barr letter at one point says there was no coordination or knowing conspiracy. So actually im wondering what attorney general barr saw in the report. Was there unknowing . Was there unwitting conspiracy or coordination . I choose not to use the word collusion. Its legal meaning is quite different from conspiracy. So thats all the more reason why we must see the full report, to see if there was any coordination, any conspiracy knowing or unknowing. They say theres no evidence there was coordination. Thats the line from the Mueller Report that they quote. Thats right. But did you see in the broader letter he says no knowing coordination, no knowing conspiracy. Its interesting why he chose to put in the word knowing. Likely we will see soon enough. Happening today in washington the crisis of the safety of the boeing 737 max 8 is in the spotlight on capitol hill. Top aviation officials are testifying before the senate about the ongoing problem with the boeing jets, now grounded world wide. The aircraft has already been involved in two fatal crashes overseas. Less than 24 hours ago in orlando, one of southwests max 8 planes had to make an Emergency Landing due to an engine problem. Thankfully no passengers were on board that plane at the time. There has been a lot of criticism over this selfcertification process where these manufactures are allowed to sign off on their own work in the faas name. The administrator is set to talk about potential changes to this system. This is what boeing used to certify its 737 max planes. It looks like changing to this process are happening as soon as this summer, though. We really dont know the details. They havent been revealed. Perhaps they will at this 3 00 hearing. Were expecting the faa to acknowledge that the agencys ov oversight approach needs to evolve. At the same time, we expect they will defend that process that boeing went through for its 737 max certification. Theyre defending this process saying for certification itself was over the course of five years. They say there were nearly 300 certification flight tests. Theyre pushing back a little bit, but also acknowledging they have to change this process. Boeing is going to be making an announcement of its own today with regard to the software that folks think might be at the center of all this problem. Right. Theyve got this big event happening just outside seattle at some point today. Were expecting about 200 pilots and industry stake holders to be at this center. The session itself will center on the 737 max as well as this planned Software Update, which the Company Plans to submit to the faa by the end of this week. Of course this is a Software Update set to resolve issues aviation authorities believe led to that crash of the lion air flight back in october when investigators have said that a malfunctioning sensor fed incorrect data to the system and of course the Software System pushed down the nose of the plane while those pilots fought to correct the course of it. So this is a nation we knfix th could be finished by the end of this week. This is part of what we expect boeing to be telling industry stake holders at this open house and briefing today to maybe quell some of their jitters here. Maybe a step towards making sure these planes are safe to fly. Exactly. To say he was exonerated by us or anyone else is not true. There are plenty of other cases, like i said over 5700 that have gotten some kind of alternative or deferred type prosecution involving a dismissal at the end of the case. What happens now . All of a sudden we find out that all the charges have been dropped and apparently he went to the Rainbow Push Coalition and spent two days there as part of his Community Service before all the charges were dropped. On top of all this, the case sealed so we cant even go through it. Theres a lot of people on the ground to try to find out the extra details to see how he got to this point. What are Jussie Smolletts attorneys saying now . Theyre not staying silent about it. Yesterday when he stepped to the mike i was kind of standing there shocked when he said, look, ive always been innocent of this. Listen to his attorney as she talked last night to don lemon about this case. Did someone potential ly, yo know, very important or influential do a favor, make a call on jussies behalf . No, there was no political influence in this case. Just remember this. The state Attorneys Office had to pull themselves back from this case after Text Messages were revealed from a friend of Jussie Smollett to the state attorney. We had people fired at the hospital who looked into his medical files after that was figured out. We had the police department, people were asking questions about whether or not they were fair to jussie. You have these two brothers who went to a grand jury and charges were put forth, 16 counts. Now thats disappeared. Theyve never talked before. Youre left with one question, what happened that night . I still cant tell you. It wasnt caught on camera. Its just a big whodunit at this point. This certainly isnt the first time hes tried to address this anita hill controversy. I think the reception to this was a little bit mixed. I was standing by two women when he started talking about it. They were like, oh wow, this is something he does need to be addressing right now. Some people have said its a good start to making sure he makes amends with anita hill regarding this incident. But theres also people who say he was the chairman of the Senate Judiciary committee at this time. If anyone could have given her the hearing he says she deserved, that could have beewo him. Its very clear that he knows they need to clear some of this up because it is going to come under a lot of scrutiny especially in the me too era. You wrote that you think the anita hill hearings are bidens biggest weakness. The anita hill hearing is probably or one of the biggest moments of bidens career in the senate. He was chairman of the Senate Judiciary committee. I would urge people to watch those hearings. It will feel like its from the 1930s as opposed to 1991. Joe bidens elected to the senate in 1972. He leaves the senate after he becomes Vice President in 2009. Theres a lot of votes and a lot of things between 72 hes also run for president before. Twice. Yeah. In 87 he drops out before the race really gets underway due to a plagiarism scandal. He doesnt get the scrutiny from other kanlcandidates or the med. Is he don draper in a peggy olson world . He was once the perfect fit for the party, but no longer. How does he sort of meld that . Hes trying to. He has apologized multiple times now for his handling of the anita hill hearings. He cant go back and change it. Question is, does the party want someone who doesnt have that in their past . That is the word from the Justice Department on how long until the attorney general bill barr will deliver the Mueller Report to congress. So when exactly will that be and how much will congress and the public really get to see . Joining me is the chairman of the Senate Judiciary committee, senator Lindsey Graham. So you had dinner with the attorney general last night. Right. Were be eeve been told it not months. Heres the process. Hes going through the report to make sure grand jury information is taken out because by law it cant be divulged. Hes going to go to the Intelligence Community to make sure theres no sources and methods or classified information that theyre worried about. That would be taken out. Hes going to talk to prosecutors who have cases associated with all of this to make sure it doesnt undercut them. When he does that, which will take weeks not months, hell turn it over to the senate and the house and hell come before the Senate Judiciary committee and tell us about it. Youre thinking mid april . Sometime in april probably. Before may . Yeah, i think so. How much of the report are we going to see, 50 , less . I dont know how much grand jury material is in there. Mueller will be the guy to tell us about that. He says im going to go to mr. Mueller and make sure anything thats grand jury related is taken out. Do you get a sense that youre going to be able to see the majority of the report . I have no idea how much grand jury material is there. I dont know. You said last night in another interview heres what i do know. Youll get everything that doesnt Compromise National Security or violate the law. You said last night in an interview you spoke to the president. Yes. Is he giving you any assurance that he will not be invoking executive privilege . Thats right. He said just release it. Executive privilege is off the table . As far as i know. Thats what they said yesterday. Do you think the white house is going to see a copy of this before its released . I doubt it. If theyre not going to claim executive privilege the president told me just release it. You said in another interview last night that there are some things in the report that will be interesting in terms of conversations. Im sure there will be. I dont know whats in the report. But you know he interviewed people that worked at the white house. Heres what you can say yes, he interviewed people that worked at the white house. I imagine theyll have some interesting stories to tell. Interesting in terms of that went look good for the president . I dont know. Time will tell. The point is the people who testified before mueller must have done it in a credible fashion in a way that mueller believed them and did not find a crime so thats the bottom line. Did bill barr tell you what went into his Decision Making process . Well, i guess him and rosenstein in terms of not charging the president when it comes to obstruction of justice . Does he say hes troubled with the decision . If a guy who looked at it for 2 1 2 million years, had 40 fbi agents tells you three weeks before he gives it to you, i cant make a decision about obstruction he said he wouldnt make a decision. I dont know why wouldnt he, but the bottom line is if im the defense attorney and my clients being charged with obstruction of justice and the guy who actually investigated the case said, hey i cant decide, its complicated legally and factually, thats the end of the discussion. How could you in good faith bring a case after mueller says i cant decide . Do you think that barr in good faith looked at it, though . Often the investigator presents the facts hes not the investigator. Hes the special prosecutor. His goal was to see if there were any crime there is there. Doj was conflicted. There was no decision, you think i dont know how in the world could you, as the attorney general, move forward on a case you know, were talking about a criminal matter here when the guy who investigated it for 2 1 2 years says its complicated factually and legally . I dont know how in good faith you could do that. Again, if youre the defense attorney, your first exhibit to defend your client would be the Mueller Report. Its written this way. While this report does not conclude that the president committed a crime, it also does not exonerate him. Thats the end of the criminal matter. The goal of a prosecutor is to bring a case or not. If you cant meet the beyond a reasonable doubt standard, if youre confused about the law and the facts, then you dont bring the case. The goal is not to exonerate people. The goal is to find out whether or not a crime was committed. Its also up to congress then. Thats the point here. Barrs job and muellers job is to look at criminality. Our job is to look at systems, oversight of the executive branch. Look at the fisa warrant. Juligiuliani calls that last a cheap shot. I dont care what you call it. It means to me that, yeah, he didnt say i find you not guilty. He says i dont have sufficient im not comfortable with the fact pattern and the law to recommend that you should charge the president with obstruction. Lets talk about investigates that youre going to be doing. Youre going to be looking at fisa warrant process and quite a bit more. The Counter Intelligence investigation. You tweeted right after the barr memo came out that its time for the country to move on. How is it moving on the the Senate Judiciary committee is looking its time for us to move on. Looking at the investigators . Its time for us to move on in terms of mueller. 2 1 2 years, 25 million, a bunch of inquiry and look by a really competent guy. The congresss job to find out was a fisa warrant issued against an american citizen based on a bunch of garbage, i think everybody should want to know the answer to that. How come they would give it to the court if they couldnt verify whether it was lengitimae and did bruce or indicated that he wants to know about that, as well. Yeah. Ive heard people ask this and i want you to respond that you are now using the Senate Judiciary committee as an instrument of revenge for the president. What do you say to that . I say thats stupid. If the shoe were on the other foot, if the Republican Party had hired steele to investigate clinton and they got a warrant against a clinton adviser everybody would be up in arms. The medias coverage of mueller was horrendous and missed a whole big story about how it got off the rails and its not revenge to ask the question. It hasnt gone off the rails. You appreciate what mueller did. No. The reason no, mueller did this job fine. How did this whole russia stuff start . Was there a corrupt intent when it came to the counterintelligence . Heres the question, why did they never go to trump and say you may have some people in your Campaign Working with the russians when they went to Dianne Feinstein and said there is someone in your office that we think is working with the chinese. So if the dossier is garbage. If it is garbage, youve now said that you told john mccain when he received the dossier to give it to the fbi. Right. To investigate, do you regret making that suggestion . Not at all. Now youre looking into what the fbi did with the dossier . In december somebody gave the dossier to mccain. He didnt give it to the press. He said, i dont know what do you think . I said listen, it could be a bunch of garbage, it could be true. Its not our job to figure it out. Hand it to the fbi. The fbi had the dossier months before. We didnt know, but what do we know now . We know now that the information with the dossier is unverified to this day. You surprise a lot of people, though, when you revealed that mccain talked to you about the dossier and that you told him to turn it over. The president has over and over again spoken on misinformation and lied about that and the dossier, and spread the dossier around and that is a stain against him. People that the Mccain Institute guy shopped all over town. That is not what donald trump was saying. You talked to trump about it. Did you set him straight . I know what happened, and i know that mccain acted responsibly. Did you set trump straight on that one . I dont care. Im not out to please the president about john mccain. Hes my friend, john mccain. I love the guy to death. Hes an American Hero and i want to help the president and i like him. John mccain acted responsibly, did the fbi act responsibly did the department of justice act responsibly . Did they lie to the fisa court in did they set up a counterintelligence investigation against the Trump Campaign that was a back doorway to infiltrate the campaign. I dont know the answers to this, but i do know somebodys going to look at it, me included and i hope some prosecutor looks as to whether or not the doj and the fbi was corrupt. Can i ask you about john mccain, though. The president has really relentlessly attacked him for months. You say that you had a conversation with him about it. I want to play you something that democratic congressman Hakeem Jefferies said about this, and it was just yesterday. Listen to this. Lindsay graham spent years as the sidekick to john mccain and then donald trump gets elected and donald trump continues to bash john mccain in reprehensible ways and Lindsay Graham on the issue is in the witness protection program. Do you want to respond to that . I could give a damn what he thinks about me and john mccain. The bottom line is that my relationship with john mccain was one of the highlights of my time as being in congress. He was one of my dearest friends and its okay for john mccain and donald trump to disagree. Its not okay, in my view, for the president to go after john mccain personally. Ive said that a thousand times, but the bottom line here is im going to help President Trump. I dont want care whether mr. Jefferies likes it or not. Ill honor my friend until the day i die, but this president feels like people around mccain were out to get him. John mccain wasnt. Just square this i do want a lot of folks wonder and ive wondered it, too. How do you square this one . John mccain was one of the world. Its easy. How do you work with someone with the capacity to attack someone like that . There are two sides to this story. President trump is the president of the united states. I represent the state of South Carolina. They want me to work with this president. I want to have influence with this president because he is president. I think hes doing a damn good job, quite frankly, on National Security and Economic Policy and i will continue to help him. To all those people who bring up this narrative, you just take trump. You dont really care about mccain and me. I know this. This is a game. Youre not offended about me and mccain. Youre trying to use me to get to trump. Im not playing that game. If you think the only way to honor john mccain is to tell this president , i wont work with you, i wont ever help you. Thats your agenda, not mine. My agenda is twofold, to honor my friend for the rest of my life in any way i can and to help this president and the only way to honor john mccain is to trash out trump. President trump has been good to me in the sense that hes allowed me in his world. Hes made decisions, i think, based on some input ive given him. Hes subject to changing his mind and i want him to be successful and im the senator of South Carolina and im going to do what the people of South Carolina want me to do is help make this president successful. One of the things on the table now once again is health care. Yes. Very quickly. I i am surprised to sense excitement in your voice about this. I am very excited. The president says republicans will be the party of health care . Do you want to run on health care . Seriously . You do . Senator . Because obama care is failing. Right, but Graham Cassidy failed as well. Well, it didnt make it through, but its a good idea. They want socialism. We want federalism. How do we ignore health care . If you are out there struggling, if you make 100,000 as a couple and youre losing your private coverage because companies are dropping coverage. Id like to have an answer and heres my answer. Take all of the money theyre spending on obama care in washington and block grant. You are also an astute politician. You think republicans running on health care in 2020 is not a gift to democrats . No, not at all. Because if youre in pennsylvania under the block grant you get more money. If youre in wisconsin under the block grant you get more money. Youre giving money to california, new york, massachusetts and maryland. Are chances any greater than zero that this congress could come together on a replacement . You know, i doubt it, but what is the Republican Party for . Dont you think whats the Republican Party alternative . A block grant to take the money. I watched them to give it to the state to spend on healthcare, cover preexisting conditions and flexibility at the state level. You can vote them out of office under obama care. You dont each know who rauns obamacare and most states get more money under the block grant, and its versus washington. I think that is a good thing to run on.
