Violence and a deadly encounter. Angry protesters converged on the scene the next night, and 24 hours later that restaurant was set on fire and burned for hours. Vehicles were also torched. Protesters shut doubt nearby interstate highway for a time. The officer who fired that fatal shot seen here on the left has been fired. The chaos was captured on several individual crisivideos, difficult to watch. The first was taken by a bystander between the two officers and brooks. They say he failed a sobriety test and resisted arrest. The next video was taken by surveillance cameras and shows what happened after that. Again, it is graphic. Brooks is seen running with the police in pursuit. At one point, he turned, it appears he discharges the taser toward the officers. Later he falls and dies of his wounds. I do not believe that this was a justified use of deadly force and have called for the immediate termination of the officer. Chief shields has offered to immediately step aside as police chief so that the city may move forward with urgency in rebuilding the trust so desperately needed throughout our communities. And a lawyer representing the Brooks Family says firing the Police Officer and chief of police resigning are not enough. I can say we want justice, but i doesnt cant care what ti dont know what justice is anymore. Is it getting them arrested, getting somebody fired . A chief stepping down . I know this isnt justice, whats happening in society right now. Where do we stand right now . We are at 3 00 in the morning, what are they doing . Reporter for the most part, the protesters have broken up. There are still protesters in atlanta working to get home. They had to work their way through irritants and tear gas that were dispersed earlier. Now the police have been trying to get the protesters to go away from that area for some time. Many of them said they were just trying to get back home and had to go past areas that had been blocked often. We do know there were arrests that were made, but the fire appears to be out at this point, and theyre working on trying to restore some sense of calm in atlanta before undoubtedly the next round of protests begin. The city of atlanta has been dealing with peaceful protests for nearly three weeks now since the death of george floyd in minneapolis. And incidents that have happened with the Atlanta Police during those protests have only seemed to incite more anger in the community here that already felt frustrated with its police force, john, and so the killing of Rayshard Brooks just seemed to explode that anger. And thats what were seeing on the streets of atlanta now, the frustration that has boiled over and culminated in that wendys going up in flames, taking over the interstate for a period of time. And taking to the streets to express that frustration. It does seem, you know, incredible to think that youre doing, police have brutality, we have seen some incredible examples of Police Brutality and the killing of africanamericans, we now at the end of the week have the killing of an africanamerican man at the hands of police. This seems to negate the argument that they can reform the Police Department. It does give strength to the argument that maybe they need to start again. Reporter and look, the Atlanta Police department had worked on some of these methods that were hearing being tossed around the country right now. Making your police force look more like your community. The Atlanta Police force have done that. They have many black and brown officers for a city that is so rich in black and brown culture here. And it hasnt seemed to do much, at least in atlanta, in mending that trust that has been lost between the police force and the community. And when we talk to these protesters over the past few weeks, the frustration is in the fact that they dont feel that the officers are held accountable for their actions. They feel as if the police seem to operate without any sort of accountability, especially when there may not be video. Weve had video in this case here and in some of the others, and over and over again weve heard that same refrain. What do you think is happening that isnt caught on camera . And thats what the people in atlanta say they are living through. The police chief stepped aside to set a path for getting back to normal, finding out what the normal may be, because whats happening right now obviously is not working. We have seen swift motion on arresting officers involved in an incident previously, with some College Students who were very aggressively tased after one of the protests here early on. And seeing the firing of not just those officers but the one who was involved in the Rayshard Brooks case last night. Were seeing swifter motion, but for the protesters were talking to, john, its not enough just yet. They want to see longterm change. Seeing actions when the magnifying glass is on the city isnt enough. They want it to be systemic, the general policy and not just when the world is watching. Diane, thank you. They say the culture of american policing needs to change. It is unfortunate that we are repeating this now over the last six weeks. This is the fifth incident dealing with some type of videotaped racialized activity. You know, if in fact he had a, he had been drinking, we would have preferred him to stop at the wendys drive through, take a nap, then drive drunk drive and kill someone else. Police need training. This is not acceptable. I commend the mayor of atlanta for taking decisive actions to ensure the safety of her citizens. I commend all of the protesters who continue to raise the question. And that question is central. We need to change the culture of policing. We need to evaluate how we train police. We need to make sure police not only support the communities that they are, have a duty to protect and serve. But in many cases they need to be in the community they have a duty protect and serve. We have far too many officers who work outside the jurisdictions which they serve. There for they have little to no regard for the citizens. This is a true indication, another indication that we must change the culture of policing in our communities. Private investigator has now been hired by the georgia naacp to gather their own information and evidence about the shooting. A social commentator and host of the list joins me now from los angeles. I guess you know that didnt take long, did it . What does it say about the mind set of these officers in atlanta after outrage over the murder of george floyd, when theres a conversation about defunding Police Departments, reframing the way policing is done, for just one moment they didnt stop and think, maybe i shouldnt shoot this guy in the back as hes running away . Well, its like a very bad ground hogs taday, except for many of us, were not waking up from it. Its another Police Brutality, another example. He was at a wendys drivethrough, and when dylann roof murdered people he went to burger king. If you are black and you fall asleep at wendys, you end up dead . I cannot fathom with everything going on, with cameras everywhere, shoot a man running away from them in the back. And fine they fear for their life because he is holding the taser, they are not in imminent danger. This one is going to be hard for the people of atlanta and the country to stomach. And, as you can see, the protests in atlanta, theyre not so stomaching it anymore. The police chief has resigned and the officer has been fired and hopefully will be prosecuted. Youre asking, im asking, a lot of people are asking, listen to this. How many more examples will we need . The cameras arent doing it. Yall filming it isnt doing it, covering it isnt doing it. Protesting isnt doing it, what is it going to take . How many more examples are we going to get . I actually thought we were going to get over all this. I thought this was finally going to start ending with all these changes. Weve seen incredible progress in the last couple weeks. It was moving at a speed weve never seen before. Has that come to a screeching halt . I think it has come to a screeching halt. It doesnt mean it cant progress. But as you can see with whats going on in atlanta, we are at a deadlock right now, because you cannot keep seeing this over and over again. Videotape after videotape, Philando Castile being shot by the police. Me mike brown in ferguson. I can keep naming names and it will just get more and more disgusting and aggravating to the point that we want to look away and we cant. And its not stopping. So, until the police start to see the people that they are policing as human beings this is whats going to continue. And its not lost, again, on black people that they do not see this. That man running away from rashard brooks does not look like that guys uncle or brother or son or friend or anything. So hes not even registering thats a human being whose life hes taking. And i know all cops are not bad, but please, if you dont want people to think you are, we are desperately asking you to do better. The mayor of atlanta, kesha lance bottoms has received a lot of praise. I want you to listen to what she said earlier about this fatal police shooting. What has become abundantly clear over the last couple weeks in atlanta is that while we have a police forceful of men and women who work alongside our communities with respect and dignity, there has been a disconnect between what our expectations are and should be as it relates to interactions with our officers and the communities in which they are entrusted to protect. Yeah, at least shes moving beyond that asinine bad apples excuse. Systematic racism is not a disconnect, okay . We didnt just, oh, my gosh, my phone is off the hook, its a disconnect. No, this has been going on for far too long. This is rodney king, emmett till and his mom leaving an open casket so the world could see what they did to her son. Its not a disconnect. Its the inability for the people with badges and guns to see the people that they are supposed to protect and serve as one of them. And if they are not part of the community, then they are part of the calamity. And what you are seeing is calamity after calamity after calamity, and until it offends enough people, i dont think theres going to be change. Heres something that may be offensive to some. As minneapolis is looking to rebuild its force, this is how the system bends toward the police. If officer chauvin is found guilty, he could receive 50,000 a year in state pension payments. The family of floyd could get access to that money as part of a legal settlement, but the fact that they would have to go to court and fight for it, it seems to say a lot. Yeah, it says that maybe the going rate on killing a black person is you still get to keep your pension even though you lose your job or that you may get prosecuted and go to jail but that your family might enjoy your pension. This is part of what makes people so aggravated and so frustrated, john. This is what keeps them in the street for 19 days, protesting. Because even when you take a Police Officer to court they still have operational immunity where they can say, i was operating under the auspices of my job. And thats a hard thing for a civilian to prove. I mean, shouldnt that offend you . Shouldnt that as americans offend you that american citizens are dying in the street for no other reason than the color of their skin . It would be, its a sick joke that keeps getting told over and over again. And like i said, im a solutionsoriented guy, john, but even i am running out of ways that we can bridge this gap. Unless youre going to go camden, new jersey and defund the Police Department and rehire the police but make them have to pass tests and look at their record, because that is a program that seems to be working, it seems as if the system is irrevocably broken, and it cant be repaired. He said in a series of tweets that after speaking to africanamerican friends and supporters, he has been asked to postpone the rally and move it to another day. Now juneteenth is a holiday celebrated by many africanamericans. It marks the day that some enslaved people in this country learned that they had been freed some years after the emancipation proclamation was actually signed. Now here in tulsa, news of President Trumps plans to host a rally was met with anger. Many of the residents here saying it was a slap in the face that the president would schedule a rally on juneteenth. On top of that, tulsa is the site where 99 years ago hundreds of black residents of the city were massacred by an angry mob of white tulsaens. This is an incident many of the black residents have been trying to draw attention to for many, many years. It is a sore spot for the community and on top of that, recent days have brought renewed tensions between police and black residents in the city, all of it coming together to produce just a volatile environment here in this city, going into the end of this week. Now organizers of a counter protest say they still plan to p get people together to protest against President Trumps coming to this city. The chief of police in atlanta has resigned, sixyear veteran of the force fired. This all began friday night outside a Fast Food Restaurant. A man asleep in the drive through. There was a confrontation and one man dead. Angry protesters set upon that restaurant and it was torched. The interstate shut down. The partner has been placed on streeti stre administrative duty. And a warning all the videos are difficult to watch. This is video taken by one bystander. The Georgia Bureau of investigation says brooks failed a field sobriety test and was resisting arrest. He manages to break free and grabs one of the tasers. Surveillance camera shows what happens next. And again, it is graphic. Brooks is seen running with the police not far behind. At one point he turns, appears to discharge the taser at one of the officers. Minutes later he falls and later dies of his wounds. An attorney for brookss Family Says Police must be held to a higher standard because of the power they have. When being a Police Officer is the most powerful job in this county, theres no other job when you can take someones life, liberty or freedom. You just, you just, theres no job that is as powerful as a Police Officer. They should be up on the standard of doctors and lawyers and looked at like that, but theyre not. And thats got to change. Steve moore is a contributor and is with us this hour from los angeles. Steve, the last time we spoke was in the context of the killing of george floyd. You made the point that one moment Law Enforcement officers can be involved in a shootout. The next they can be involved in trying to save the suspect they just shot. With that in mind listen to what the lawyer for brooks had to say. There why multiple witnesses out there. We talked to some Witnesses Today who said that the officers went and put on plastic fwlofs and picked up their shell casings after they killed him. Before rendering aid. We counted two minutes and 16 seconds before they even checked his pulse. Just emphasize there is an investigation under way. Lets start with the timeline of the shooting and when they took the pulse of the victim. The first thing you have to do after a shooting is determine that the person is no longer a threat to you, assuming that he was a threat in the beginning. You have to determine that he or she is no longer a threat. You can hand cuff the person who is not dead at the time. And then you must render medical aid to that person, because they were no longer a threat. And you are essentially the First Responder at that point to their wound. And would it take two minutes and 16 seconds to determine if someone is still a threat . I dont think it would take two minutes and 16 seconds. I wasnt there, but it doesnt sound reasonable. And if you do anything else besides that, i dont know why they were pecking up brass, if that was true. But you do need to do, see what you can do for that person. How many times did you stop, put on fwlofs and peck up shell casings . I never, i dont think i would have even thought about picking up shell casings. I have been, the fbi trains very specifically that once the threat is removed, once, and i dont mean the person is killed. But once the person is no longer a threat, your job is to render aid to them. You can take seconds to make sure that the person is no longer a threat to you, but its not like he was wearing a bomb vest. I mean, you can come up and check that fairly quickly. As far as the investigation goes, what doesnt seem clear is how did this go from a conversation between the officers and the suspect and a confrontation . Again, i want you to listen to the lawyer representing the family. Hes talking about what he was again told by multiple witnesses. Here he is. They thought that the conversation appeared civil or decent. They didnt see him screaming at the cops or doing anything, and out the blue they started to arrest him and he got upset and pulled away, like why, what are yall doing . And then it went from there. So you have to have this in context, about the number of incidents involving black men and police. And suddenly, this mr. Brooks is being confronted by the police. Is there anything which could have happened in that conversation between conversation and confrontation that would justify the deadly actions of the police . Well, i mean, there are, when a person wrestles with you and takes away one of your weapons, yeah, deadly force is at least on the table. And frequently, people you are talking to civilly are believing that you may or may not arrest them. When you decide to arrest them, their behavior changes almost always. It doesnt mean that theyre going to become violent, but just because violence ensued after a person was told they were going to be arrested doesnt mean that the officers necessarily provoked that. And i am not making a determination right now, because i dont think theres enough complete evidence to make a determination. Certainly, it can look pretty suspicious, but once you wrestle with an officer and take away a weapon, you have, by your resistance ramped up the situation. That does not necessarily mean that they have the, that does not mean, based on just that, that they have the right to, to use deadly force against you. But you have certainly moved the continuum. The question being asked is why was this an option on the table of shooting the guy as he was fleeing the scene . They had his car. They had his license. What was to be gained by actually trying to neutralize him and stopping him from leaving the scene . Why couldnt they have easily let him go and follow up at a later time . Well, john, youre absolutely right. If all he did was run away from them i dont see any reason to use deadly force. I just dont see it. If, however, and im speaking hypothetically, because ive heard Different Things from different people. If he turned and aimed a weapon at them, even if it was a taser. If he got the nearest officer and was able to tas he him and take his weapon, that is, in the training as exists today, that is a reason to utilize deadly force. Very quickly, even if that taser is considered a nonlethal weapon, which it is here in georgia . If the weapon allows you to incapacitate an officer who has a deadly weapon, the question would be whats your end goal there, so the officers have the right to use deadly force to protect somebody from taking their weapon. Thats the way the rules are. This is a complicated one as they often all are, obviously, theres a lot to get to. Thank you for be being with us, retired fbi, steve moore. Always good to see you. For three weeks, this c country has been having a conversation like none b there is one voice most notably absent. On saturday the u. S. President traveled to west point for an appropriately socially distanced ceremony. Cnn reports on what the president did say and did not say. Reporter President Trump delivered the commencement address at west point on saturday. And while he did say america was facing a turbulent moment, he really sidestepped those flash point issues were seeing across the country, namely coronavirus and massive protests after the killing of george floyd. When you talk about coronavirus, he just thanked the military for all their help to fight the invisible enemy, but when it came to the protests, a moment when he could have use d it to talk about racial injustice, he did not, he sidestepped that and seemed to focus on the National Guards role. I want to thank the men and well women of our National Guard who respond with precision to so many r many recent challenges, from National Disasters to securing peace, safety and the constitutional rule of law on our streets. Reporter see you hear it there, just a vague reference to protests that have been massive, that have taken up night after night after night. And we saw them of course in his back yard or front yard at the white house there. And this is coming at a time when the president has really not offered remarks on unity or bringing the country together. And its a time of deep unrest and a real reckoning on race in america. And while he has of course condemned the death of george floyd, he has not offered a more unifying message. That has really led to a lot of his top current and former military advisers distancing themselves from his response. But, again, he did not use this opportunity to address that, to take this conversation one step further. Traveling with the president in new jersey, kristin holmes, cnn. West point alumni are speaking out against the president s threats to turn the military on american civilians executing their constitutional right to protest. The alumni group writes in part we are concerned that fellow graduates serving in senior level positions are failing to uphold their oath of office and commitment to duty, honor, country. Their action threaten the credibility of an apolitical military. General mark hurtling spoke about the criticism of the president s leadership during this time of national crisis. I said back in april in a piece for cnn. Com that it would be interesting to watch to see whether or not the juice would be worth the squeeze. Would there be as much coming out of this as what was being put into it. Two of the other Service Academies both did a distance graduation, a virtual graduation, the air force academy did it in person because the cadets had stayed there over spring break and never left the campus. But youre talking about pulling back over 1,000 people from the ports and airports of new york city during the time of the virus. And in fact, several of them tested positive, about 15 pested positive before the ceremony. The academy did very well. But truthfully, the speech in my view was not all that emotional or uplifting for the cadets. There might be some that would think otherwise with the president , but im not sure pulling them back for the two weeks of quarantine basically for a twohour ceremony was the best use of their time. Im seeing certainly some fraying of the relationship. There had been some Senior Officers who have attempted to try and persuade and influence the president in terms of what he should and should not do, in terms of using the military or having them available for photo ops or saying things like his generals are my generals. Thats not who we are. We support and defend the constitution of the United States. We do not serve any one man. And this seems to be a recurring theme with this president. He has done this even prior to his election during this campaign where he was talking about what he would make the generals do. And were seeing that distancing in terms of some of the policies and strategies that the generals know are not in the best interest of legal activity. Former u. S. Commander for europe. At times bottles were thrown at police and scuffles also broke out with police. Officially, black lives matter canceled their rally wanting to avoid this kind of confrontation. Joining us i can never get your last name right. She joins us live. Across the country, black lives matter turned out, they were peaceful, they went ahead. In london, it was the presence of far right groups and their supporters who were looking for some type of confrontation. Reporter im in parliament square, and this is the boardedup statue of winston churchill. This has been part of the controversy around this. This is why the right wing groups came out yesterday. They claim they came out to protect britains monuments, its cultural heritage. They will tell you they came out to cause trouble. We were here when there were hundreds of demonstrators. They were hurling insults, behaving aggressively. It devolved into a game of cat and mouse in the streets as the police tried to clear demonstrators. As you mentioned, black lives matter canceled their protest yesterday and they did it specifically because they did not want to get involved in these clashes. They did not want their image tainted by what unfolded here yesterday. And they have been sharing images of the clashes yesterday that happened in this area. And theyve been saying, you know what . Were glad we didnt come out. But theyre also arguing that ultimately, this is a distraction. This is a tiny group of ultrarightwing people who did cause trouble with the police, but by and large, the black lives Matter Movement has been peaceful and it simply does not want to be tarnished with this brush, john . There were incredible images but one in particular that really stands out. It show a black lives matter supporter or protester carrying someone from the far right group whod been hurt and actually carrying this person to safety. Reporter its a very strong image, john, and its being shared on social media by so many people who are saying this is what black lives matter is about, our message of peace. And i did spend some time yesterday with a small group of black lives matter supporters who came out even though the movement had said for everyone to stay home. They still went out. When i asked why are you here, they said because we dont want to be afraid. We understand these right wing demonstrators are out here to cause trouble, but what they do is on them. It is not on us. And you see that very much reflected in the image. And whats really happening here john is as a backlash against the antiracism movement, black lives matter as an Umbrella Movement of all these smaller, sub organizations is trying to figure out whats next.
