This. I dont know what new information he has that he didnt know on august 9th. Him being outside for us is a Public Safety risk. For him, the same person who killed mike brown, and just to be out there, its very hard for the community to take that. What do you mean its a Public Safety risk for him . I just feel that the person who killed mike brown shouldnt be outside patrolling our community. Its a lot of measures that need to take body cameras and civilian review board things that need to be in place before the Community Even trust the police. Were waiting on obviously the decision from the grand jury. What if there is no indictment but this officer does ultimately say, okay, i resign. How might that impact the protesters where you are . Its not one person is not the end of racism. Dismantling ferguson pd is not an end to racism. Its simple justice. We want accountability for those that defend the system and those who say they protect and serve it. Does that mean im just going off of your words, if he is indicted, that would be the end of racism . That would not be. Just today a young person in new york was killed. You got trayvon martin, you got so many names. All of these people are killed by the police so it needs to be steps in the system of racism that were up against. We talked before when we talk about message and how this is more than one specific person in one specific case. We have heard from the attorney general in this country. We heard from major missouri Football Players and Civic Leaders calling for calm. Let me play sound from a Public Service announcement from Michael Browns own father. I thank you for raising your voice to end racial profiling. Hurting others and destroying property is not the answers. I do not want my sons death to be in vain. I want it to lead to incredible change. Positive change. Change that makes the st. Louis region better for everyone. You have heard this. Youre in the thick of it. You are leading and helping craft a message that you want heard out of ferguson. I wonder from the people youre working with and others coming in from out of town, will they heed that call for calm . If you just go over the last 100 and some days, all of the organizing, we just did our 22nd civil disobedient nonviolent direct action training. We did everything to marches in the streets. Were very committed to nonviolence, you know, and to bring in what mike brown, sr. , said. A change in the ferguson community. I absolutely believe you that you are part of this peaceful protesting but then you have what happened last night. Take a look. So you have that. You hear her cries. That was just last night. Arrest last night and the decision hasnt even come down and then i was looking at your twitter page and you are tweeting some provocative images. I have to ask you, are you afraid that could be inciting potential violence . Im afraid that the police is going to come out just like last night and arrest Peaceful Protesters and arrest that people are crossing the street to the other side of the street and to the sidewalk and to the parking lot. All of those cries and screams and tears that youre hearing and youre witnessing are just a grieving community that is responding to the killing of Michael Brown. And also his body being laid out. I have to be fair and press you on the other side. The images you are posting on twitter. That was from action that people feel the same statistics that show how black people have been lynched over 150 years, those same statistics are coming from the police. We have between 300 to 400 police killings. The same way if you would say a hundred years ago or 50 years ago that a person is being lynched almost every day in this country. We feel strongly about that languag language. We feel thats a sign. We were right outside and we think that what were actually saying is does the United States government who said they freed us, are we really free and willing to defend the rights of the people they said were free by the emancipation proclamation. Thats a question. Were still dying in the streets. Were still being publicly displayed of our killings by the local government or even the state government. I know you want peace. President obama waited for more than 17 months in fact for boehners house of representatives to act on reform legislation already approved by the u. S. Senate. Well talk about that in a hot minute. Good to see you. Sorry its not in person today. Lets just share a little something. We have a lot talking here at cnn today. You have barack obama. And then you have former president george w. Bush. Specifically on the subject of ilLegal Immigration, we have both of them saying basically exactly the same thing. Let me play something. This is george bush from the oval office in 2006 and barack obama from last night. Roll it. My fellow americans i asked for a few minutes of your time. To talk about. The we form of americas immigration system. We must begin by recognizing the problem with our immigration system. The system is broken and everyone knows it. Immigrants live in the shadows of our society. Remain in shadows risk families being torn apart. Were a nation of laws and we must enforce our laws. Were a nation of immigrants but were a nation of laws. Were also a nation of immigrants and we must uphold that tradition which strengthened our country in so many ways. For more than 200 years our tradition of welcoming immigrants from around the world has given us a tremendous advantage over other nations. The United States must secure its borders. We have more agents and technology deployed to secure our southern border than any time in our history. Some in this country argue the solution is to deport every illegal immigrant and that any proposal short of this amounts to amnesty. I disagree. Even as we focus on deporting criminals, the fact is millions of immigrants in every state, of every race and nationality live here illegally. Tonight i want to speak directly to members of the house and senate. An Immigration Reform bill needs to be comprehensive because all elements of this problem must be addressed together or none of them will be solved at all. I worked with congress on a comprehensive fix and last year 68 democrats, republicans and independents came together to pass a bill in the senate. America needs to conduct this debate in a reasoned and respectful tone. We are and always will be a nation of immigrants. We were strangers once too. We must honor the Great American tradition of the melting pot which made us one nation out of many peoples. As my predecessor once put it, they are a part of american life. I mean, down to the tie color these two were in sync. Straight up. What do you make of that. What i was thinking as you were running that, production was terrific. That was my first reaction. The second reaction is that perhaps in the future youll intersperse jeb bush from that same locale because the bushes seem to be in sync with president obama in this regard. Whether jeb bush can survive the caucus and the primary process to become president because he once said that he regards ilLegal Immigration as an act of love and not a violation of immigration statutes. Thats what remains to be seen. Theres a great lesson in all that. Perhaps if president obama had not acted the way that he did last night and then again today, years into the future there would be another president who would make similar promises. Interesting you bring up jeb bush. Thats a whole other conversation we may be having in time. Hit pause on that one. The real difference it seems between president obama and president bush is that president bush gave up when congress couldnt and wouldnt act and after white house lawyers advised him he didnt have authority to act on his own. On the flip side, you have president obamas lawyers saying the president does indeed have that authority. What should we make of that . We should make of it that its an open question and if theres a case brought and theres a party that has standing and i think two or three states are already talking about it, there will be a federal judicial decision on exactly that point because you know that the president himself, president obama has been out there for a long time making statements and saying i would like to act but i dont have the Constitutional Authority to act and now hes saying something different. One other point about watching this whole speech last night. Im curious if you talked to listeners about this. This part struck us. Play this. Scripture tells us that we shall not oppress a stranger. For we know the heart of a stranger. We were strangers once too. My fellow americans, we are and always will be a nation of immigrants. We were strangers once too. That was the president of the United States quoting scripture. I have an idea of what the answer may be but do you think that was a personal or was that a political there . Maybe it was a combination of both. When i heard it for the first time as he said it in realtime, i thought it was a political statement and i thought that it was a calculated effort on his part to reach a constituency about the way he was going about the plan. I talked on the radio today and came at it from that angle. How did people feel about it just curious . They werent caught up on that today. They were more caught up on potential violation of the constitution or whether it was warranted that which he had done. People are so dug in on this issue. This issue truly is in a realm with guns and Climate Change and abortion. You mention immigration to a Radio Audience today and all of the lines will illuminate and people will be dug in from both advantagea vantage points. Were expecting president obama to sign that executive order into action within the next hour. He just arrived in las vegas there on the left side of your screen. Air force one. And you, brooke. Good afternoon. Its worth revisiting because this could be a day where a decision could come down from this grand jury. Lets talk about the process. Let me kick it off with you, joey. Remind me how many grand jurors are involved and the makeup of this grand jury and how many they need to determine this outcome. Sure, brooke. Unlike an actual jury in the event he were indicted and it would go to trial, you still have 12 members but theres not that need for a unanimous conclusion. Generally speaking when theres a trial, you know, you need unanimous approval and in this case there are 12 jurors and you need nine of them to vote an indictment and of course the standard as we look at the composition of the jury, the standard is two things really. Is there probable cause to believe that a crime was committed and, b, did Darren Wilson commit that crime unlike a regular jury where it would be proof of guilt beyond a reasonable doubt. Low standard here. Lets see what they do with that standard having heard all of the evidence in the case. All of this has been behind closed doors. It was supposed to be top secret. We talked about leaks going forward. This is my question. Once the decision come down, we have seen with big trials where people chase down the jurors and jurors want to talk. Can the grand jurors talk after the decision comes forth . They will talk. Whether they can is a completely different question. They are going to talk. Theyre going to talk about what a low standard it is, probable cause because its a low standard. I say it means is my client breathing . Probable cause is less than you need in a civil case to get a verdict. Its a really low bar. I someone in my ear with a great idea. Throw the graphic up of the grand jury again. From a lens of a lawyer your gut feeling on this grand jury . It would not surprise me given the racial makeup of this grand jury, it would not surprise me if they struggle a little bit because it tends to be a polarized issue. When you look at this, theres a significant part of the population that is law and order abuse from the officer and also a significant part of the demographic that views this from the point of view of Michael Brown frankly and so i think that this cuts along racial lines unfortunately and thats one of the reasons i think were talking about it, if you will, and i think also you have if they dont have nine votes, its not a hung jury so to speak. If they dont have the nine votes, its a no bill. Joey, same question for you. No true bill obviously would mean theres no indictment at all. You know, what it comes down to, brooke, were all product of our individual experiences. Thats why jurors are important. Theyre important as grand jurors and in this case theyre important as regular jurors because when lawyers pick a jury, you want jurors that can be fair and impartial but in being fair and impartial, thats fair and partial from your perspective. When you are being reasonable, its being reasonable from your perspective. So how did you grow up . Where did you grow up . With whom did you grow up . What were your experiences. Thats significant. Joey, i disagree. I want jurors that are on my side. I dont want them fair and impartial. I want them voting with me. We would always love that. Always love that. The prosecutor would have a lot to say about it and would think differently than you did. Somewhere in the middle, brooke, we get that jury. Brooke, theres something particularly strange about the way this whole thing has been handled. If the prosecutor thinks hes got enough to file charges, then he should have just filed charges. To throw this to the grand jury or punt it to the grand jury what does that say to you . To me it says that he doesnt think hes got enough. And i dont think that in a case with this much attention youre doing the public, the community, or anybody else any favors by putting that evidence in front of a grand jury, leaks or no leaks, and letting people not see whats going on and not understand whats happening. Generally in most state court jurisdictions, they dont go by way of a grand jury. They can just file charges and you have a preliminary hearing. And theres a lot to be said for that briefly, brooke, in terms of preliminary hearing because evidence is aired in a public fashion and not only does the prosecutor asked questions but the defense attorney gets to cross examine and so therefore its a very transparent process unlike what were seeing here. Totally different. Fellows, thank you. Appreciate it very much. Well continue the legal conversation in the ensuing days. Meantime, another woman comes forward saying she was terrorized by bill cosby and as youre about to hear, her allegations are shocking but what may shock you more is the response by bill cosbys lawyer. Cosby coowned the restaurant where she worked and she said one day he sat down at one of her tables, told her she was pretty and offered her a ride only and traitz said she was star struck and didnt see any red flags so when he asked her to get in his car, she did. It was a rollsroyce. They went to the beach. These where traitz says cosby opened a briefcase full of pills. All he said was why dont you take a couple of these and they will help you relax. What . Help me relax. For what . Reporter did you take any of the pills . No. Reporter what happened . He started grabbing at my chest and started to try to fondle me and then he started to push himself on top of me like against the seat and against the door. As he was groping me. I dont remember the conversation. I do know that thats when i panicked. I opened the door behind me and ran out of his car. I ran down the beach and i had on a long hippy peasant skirt. Thats what we wore back then. I was running and i was running toward the shoreline and my foot must have hit the bottom of my skirt because i fell and it tore up my skirt probably to the knee and partially fell in the water so i was wet. He was coming after me trying to calm me down because i was making such a scene. I was crying and i was in a panic. I was crying and he said ill take you home. Ill take you home. At that point i was not raped but i was groped and terrorized. Thats the latest voice to come forward here. This is what bill cosbys attorney has to say. Let me quote them. Mrs. Traitzs long criminal record for numerous offenses including charges of criminal fraud, possession of oxycodone, cocaine possession, marijuana possession, possession of Drug Paraphernalia speaks for itself. Consider the source. Traitz says shes had drug problems that started long after her encounter with bill cosby. Shes specific in saying she was not raped and she never went after bill cosby for this alleged groping incident. Mark, bring you in. You have covered hollywood and crime for a long time. You are a reporter with the daily beast. I read your piece ill get to in a second. I would love to hear your take on this bill cosby lawyer sort of bringing up this womans past as she is speaking about being groped allegedly. Your thoughts . These kind of lawyer tactics while theyre not surprising, its really a slippery slope. Instead of having bill cosby come out and speak to the issues and the allegations, using a lawyer as a mouth piece, discrediting the alleged victims is not the way to go. They should have bill cosby step up and answer these allegations. Thats the big question. Will he do that . So far, not. You have been covering these allegations against bill cosby for years. You write this piece saying you warned us. I wrote the original piece in 2007 and i couldnt get any traction with the media. I even went to the ap news wire with it. Their response to me was we dont want to libel mr. Cosby. I had three sources at the time. Green in upstate california, joan is in woodstock, new york and via her attorney in canada, andrea who, by the way, bill cosby has already settled with. Now, that said, these web are from three different parts of the world sharing the same story. I was drugged and i was raped. These are their allegations. They didnt get together and conspire with this. And not only that, you know, people are calling them attention seekers and trying to cash in, i didnt buy a cup of coffee for any of them. There you were in 2007 with three separate sources banging down doors to get your piece published, i talked to a number of journalists who have sort of done similar things and the onus falls on members of the media as well. Sure it does. They treasure their icons and they try to protect them. Americans do. Yeah. Its really unfortunate. I mean, the tabloids actually used allegations as a bargaining chip to get an exclusive interview with bill cosby. This came out today in the guardian. I was eyewitness to that. Its extremely frustrating in the kind of environment that wants to coddle celebrities even when allegations are as deep and dark as rape. You have been working this beat for a long time. Im wondering just if you think the chorus grows louder and louder, do you think ultimately bill cosby will address this . You know, he seems to have lost everything dear to him. They pulled his netflix special and pulled his intended series where he would play americas granddad. Hes dropping out of live performances. What else does he hold dear besides his wife that stands by his side with a pasted smile on her face . You know, these people are trying to ask him whats up with these accusations . You know, i think his career is done. If he wants to save face at all, he should step up and meet the press on this. Mark ebner, thank you. So continuing along talking about ferguson now. How it fergusons police chief getting ready for fallout from the grand jury decision. The answer to that might surprise you. Well play that for you. Thomas jackson has been described as a colorful character and hammered by critics for his handling of the fallout in the Michael Brown shooting from august. In fact, the governor of missouri, jay nixon, even take authority from the Ferguson Police department but still jackson says his local officers will be patrolling the streets. And for his part, he says he wont be stepping down. Joining me now, erin burnett. Erin burnett, you talked to him. You asked him about what makes him think that hes the guy to lead people through all of this. What did he tell you . Hes adamant about that as you just said. He believes that he is going to see this through and he was clear that that means not just right now but on the other side when this is done, indicted or not indicted, he wants to stay. Hes had a 30year career in the st. Louis county Police Department. This was supposed to be sort of the end of a career, go to ferguson, its a small town. This cant be that hard and obviously its become the test of his career and there were some very, very significant horrible errors that were made. When i asked him about why he was going to stay, heres what he said. You are not overseeing the local response and the governor of missouri didnt include you in the press conference when he laid out his plan to deal with violence, do you think you should be running that response to show the community it can trust you and it can trust your police force . Well, im running a response here locally and were still going to be the Ferguson Police department will be patrolling the city of ferguson throughout all this. Were a smaller Police Department in a Small Community and this is a much larger regional issue and i know the chief of police for st. Louis county for decades and i have absolute confidence in his ability to see us through this thing. Reporter in august you spoke to Jason Carroll and said wilson was treated at the hospital for a swollen face. You didnt see him personally. Have you seen any evidence of officer wilsons injuries since you last spoke to cnn . No. I specifically kept myself away from all of the evidence in this case so that the county and the prosecuting Attorneys Office can conduct a fair and impartial investigation without interference. He was very careful to say he had stayed away from this as you heard since then. One thing i thought was really interesting is i asked why there was only three africanamerican Police Officers on a police force of 53 even though 66 of the population in ferguson is africanamerican. He said, well, were trying to get as many minorities as possible but now we have four. So now they have one more so they have four out of 53. And in an environment where obviously africanamericans are not minority. They are by far the majority. And when i put that question to him, he said, look, the reality of it is that we dont have enough africanamerican applicants. Were doing everything we can about that. Were trying to ramp that up. Thats what he blames that disparity on. So they are maybe plus one on that end but they could be minus one as we report today sources telling cnn this Police Officer shot Michael Brown is in talks about a possible resignation predicated upon how the grand jury decides. You asked him about that. What did he say . So hes very careful to say were going to figure out what happened about whether he stays or goes. I think it seems to the logical person that hes not going stay at least going out on the streets. That wouldnt make sense at this point. They havent made a formal decision as to whether he would have a desk job or anything like that. As you heard him say, chief jackson said i havent been in contact with Darren Wilson since all of this happened trying to distance himself from that saying he didnt want to taint the investigation. I asked him again what was Darren Wilson like as a Police Officer because you may remember at the very beginning when he gave those impromptu press conferences and everyone would sort of surround him and he would talk about, well, he was a good man. Heres what he said. He said officer wilson was a hard working Police Officer, was very personable. Is very personable. He tried to switch the tense. Is that past tense indicating its a done deal that he isnt going to come back to this force even if hes not indicted. He said he was a personable guy and a hard working guy and nothing further than that. Interesting. Great interview. Erin burnett, thank you. Well watch for you at 7 00 eastern here on cnn. What we all admire about this line of work, this is someone who has truly had a front row seat to history to some of the most important and dramatic events of our lifetime so in a tribute to my friend, roger, heres one of them. When i tell people i not only have a cnn original directing my show each and every day i tell them he directed tenman square. Im told that the government officials are coming into the cnn control room now. Im sitting there directing in the control room and there are three guys from the chinese Army Standing right there in the row behind me carrying machine guns and you dont often have to direct with people carrying machine guns behind you. We were trying to extend the broadcast as long as we could and he was negotiating in the control room with those chinese soldiers and a representative from the chinese government. All of this while were doing live tv from a site in china. That was history. Thats when cnn said were here and were cnn. Hes an amazing person. He is a phenomenal journalist. Hes a friend. I hope for a long time. And i will throw my arms around him and say thank you. I want to be remembered as a person who got the job done. A person who came into the control room and gave the producers exactly what they wanted. Let me just say that whenever i fly out to vegas on air force one, that the planes a little more crowded. For some reason, folks want to come to vegas. But today it was also crowded with a whole bunch of people who have been passionate about making sure america always remains a nation of immigrants, including your senator harry re reid, the leader of the democrats in the house of representatives, nancy pelosi. Some extraordinary members of congress who have been leading on Immigration Reform, they are doing unbelievable work and i want to just name a couple. And if i forget somebody, make sure i dont get into trouble. From left to right, we have javi javier basilla, luis guttierez, titus, bob jimenez. We have the soninlaw of say czar chavez and hero to farm workers in his own right, arturo rodriguez. And i just want to and sense were on farm workers, a legend, something who has been a great friend to working people all across the country. Love you. You know, im so inspired by the sw introduction by astrid. Last night i spoke directly to the American People about immigration and you heard me talk about astrid. And if you watched her introduction, you heard her talk a little bit about herself. She was brought here as a little girl and grew up believing in america and in her identity as an american just like malia or sasha. And then as she grew up, she found out that she was undocumented. Which meant she couldnt do all the things her friends could do. She feared that she and her brother could be separated from their dad and then one day she decided to started a vow catting for her fellow dreamers and to stand up for her family and to fight on make a difference in this country that she loves. Part of what makes america exceptional is that we welcome Exceptional People like astrid. It makes us stronger. It makes us vibrant and dynamic. It makes us hopeful. We are a nation of immigrants and that means that were constantly being replenished with strivers who believe in the American Dream and it givens us a tremendous advantage over other nations. It makes us entrepreneurial. It continues the promise that here in america you can make it if you try. Regardless of where you come from. Regardless of the circumstances of your birth. Now, our immigration system has been broken for a very long time and Everybody Knows it. As americans, we believe in fairness. The idea that if we work hard and play by the rule, we can get ahead. But too often the immigration system feels fundamentally unfair. Youve got families who try to come here the right way, but sometimes get separated or stuck in line for years. You got Business Owners who are doing the right thing by their workers, offering good wages and benefit, and then youve got companies that are ignoring minimum wage laws or overtime laws taking advantage of undocumented immigrants and as a consequence undercutting the employers who are doing the right thing. All of us take offense to the idea that anybody can reap the rewards of living in america without its responsibilities. And folks like astrid and astrids parents who desperately want to make amends, embrace the responsibilities of living here, theyre forced to either live in the shadows or risk having their families torn apart. Weve known about this for years. And weve known we can do better. And for year, we havent done much about it. Well, today were doing something about it. When i took office, i committed to fixing this broken system and i began by doing what i could to secure our borders because i do believe in secure borders. And over the past six years, illegal border crossings have been cut by more than half. Dont let all the rhetoric fool you. There was a brief spike this summer in unaccompanied children being be apprehended at the border. But it was temporary and the number of such children is now actually lower than its been in nearly two years. Overall, the number of people trying to cross our border illegally is at its leeowest lel since the 19 seven70s. When i was in high school, and ive got gray hair now, so its been a long time, and nearly two years ago, i came here right in this gymnasium and i said that the time had come for congress to fix our broken immigration system. And i laid out some basic principles for reform. That a lot of different parties could agree on. And what was remarkable was the consensus that started to develop. We had Business Leaders and labor leaders and evangelical leaders and Law Enforcement leaders. We had republicans and we had democrats and independents. And they all said that, yes, we should secure our borders, we should bring our Legal Immigration system into the 21st century and then once and for all, we should give the 11 billion People Living in the shadows a chance to make amends and earn their zint ship the right way. So those were our principles. We laid them out. We were very clear. And after i laid out those principle, we then went to work with congress and we started in the senate. And you ended up with a big majority of democrats and republicans and eindependents al coming together to pass a bipartisan bill based on these principles. The senate bill wasnt perfect. It was a compromise. Thats how things work this congress. Thats how things work in a democracy. Not everybody was satisfied with every provision. But it was a good solid common sense bill that would have made our immigration system a lot better. Would have doubled the number of Border Patrol agents. So for those who wanted more border security, that was in the bill. It would have matt Legal Immigration system smarter and fairer. It would have given the opportunity for young people who are talented and who have gotten a degree, maybe in Computer Science or some technical field, to stay here and work. And contribute and create business and create more jobs. [ from the crowd ] youre welcome. And it would have given millions of people that chance to get right with the law. But it wasnt just a gift. They would have had to pay a fine. They would have had to learn english. They would have had to get to the back of the line. They would have had to pay back taxes. It was a sensible bill. And all these members of congress, they worked on it. And were supportive of it. And independent experts, not me, people who analyze the economy for a living, they said that over two decades, the new law would grow our economy, shrink our deficits, in other words it would help to solve some big problems in a bipartisan way. And nobody was happier than me. And when it passed the senate, we said, all right, lets send to the house. We have the votes in the house. We have democrats and republicans who were prepared to vote for it in the house. It has now been 512 days. A year and a half. In which the only thing standing in the way of that bipartisan bill and himy desk so that i ca sign that
