Reporter the committee will be voting tonight to release the democrats memo if they do if that motion passes then it goes to President Trump where he gets to make the decision on what happens to the memo next. We heard from Senate Minority leader Chuck Schumer over the weekend. He saint letter to President Trump demanding him in essence to release this memo saying in part, a refusal to release the schiff memo in light of the fact that chairman devin nuness memo was released and is based on the same underlying documents will confirm the American Peoples worst fears that the release of chairman nuness memo was only intended to undermine special counsel bob muellers investigation. There was no collusion and there was no obstruction. The word now used because after one year of looking endlessly and finding nothing, collusion is dead. This is an american disgrace. Now thats certainly not the thinking echoed by some members of the president s own party over on capitol hill who spent the weekend insisting that that memo actually did not undermine the special counsels investigation. So you dont agree with President Trump when he says this vindicates him in the entire russia investigation . I dont. This memo has nothing to do with the special counsel. The dossier has nothing to do with the meeting at trump tower. It has nothing to do with an email sent by cambridge. The dossier has nothing to do with George Papadopouloss meeting in great britain. It also doesnt have anything to do with obstruction of justice. So theres going to be a russia probe even without a dossier. Reporter now its worth noting that trey gowdy actually helped draft that republican memo, but like someone said the president has five days once the House Intelligence Committee decides what to do with this democratic memo and will be watching to see if he decides to block it or let it be released to the public. As we listen to all the back and forth, jeffrey you said that the president has succeeded in memogate. How . Because this issue is now a largely partisan issue that whether Robert Mueller is doing a decent investigation, whether its appropriate whether it was begun in an appropriate way, whether the fbi behaved appropriately in obtaining surveillance on carter page. That is something now that if youre casually follow politics as most people do they think something that democrats and republicans disagree on like so many other things. When, in fact, if you look at the actual fact there is no evidence that the fbi did anything wrong. There is no evidence that the fbi behaved improperly. The devin nunes memo i think was a total farce. Even these republican congressmen think it doesnt prove what the president thinks, but, you know, when you are the president , when you have an ally in the chairman of the House Intelligence Committee, you get to muddy the waters and the waters are now sufficiently muddying that i think the president s supporters can say, well, its all just politics. Its interesting. You mentioned other people coming out and we heard from trey gowdy of course. Even listening to Reince Priebus yesterday lets listen to what he has to say and ill get your take on this. I never felt of all the things that we went through in the west wing, i never felt that the president was going to fire the special counsel. So when were listening to this, in some ways you have to wonder because were talking about the messaging of the president and how successful thats been but what about the message were hearing from Reince Priebus . Is this once again someone trying to directly message the president without maybe talking to him but going on television . I think thats possible, but it is dubious at this point to even believe Reince Priebus as hes saying that because we now know through reporting that actually the president did try to fire Robert Mueller last summer and that it was actually only the blockage by White House Counsel Don Mcgahn that stopped the firing of mueller. So this is something that has cropped up in the past and that we should be concerned about going forward, although certainly there is continued to be comments from the white house saying that they dont intend to fire him. You saw comments on friday that even though the president was leaving it ambiguous, that the president doesnt intend to fire Deputy Attorney general Rod Rosenstein either. But its its really hard to know with this white house and this president in particular, given what we have seen of his relative level of impulsiveness based on whatever the last data input he has is. Erica, i think what Reince Priebus said was very interesting. He said i never felt that the president was going to fire Robert Mueller. He didnt say the president didnt say he was going to fire Robert Mueller. I think a lot of people now are thinking, well, you know the president says a lot of things. He gets angry and says hes going to do something and he doesnt do it. It certainly seems based on the reporting weve seen with Michael Wolff book and the the New York Times that the president wanted to fire Robert Mueller. It certainly seems from his demeanor from his tweets that he still wants to fire Robert Mueller. Whether his staff can prevail upon him, including his exstaff like Reince Priebus not to fire him, well, i think thats an open question. But whether the president wanted and wants to fire Robert Mueller, i dont think theres any doubt. You dont think theres any question there. We talked at the top of this hour about the latest tweet from the president. Adam schiff has responded on twitter. Mr. President , i see youve had a busy morning of executive time. Instead of tweeting false smears, the American People would help if you turned off the tv and helped fund the crisis, protect the dreamers and really anything else. When we look at whats happening. We also have dick durbin feeling jake tapper saying that were setting the stage for constitutional crisis. To say thats the end of the investigation, that this is all that donald trump needs to fire rosenstein or to fire bob mueller, ill just tell you this could precipitate a constitutional crisis. Is this, jeffrey, democrats stoking that partisan flame that were all looking at that you just referenced or is there legitimate concern about some constitutional crisis moving forward . I think it is legitimately a very serious thing if the president were to fire either rosenstein or Robert Mueller. However, i think we have almost United Republican Party behind the president , so, you know, i dont think theres anything this president could do that would move the house of representatives as its currently instituted to impeachment. I dont think there will be a constitutional crisis. I think a lot of people will be upset but this house of representatives is behind the president and he can fire anyone he wants without consequence, i think. When we also look at the messaging, what the president can and cant do and just Public Perception of whats happening there, garrett, in terms of the investigation, the messaging is so convoluted, the messaging is so partisan, the waters so muddied as weve all talked about ad nauseam at this point, when we finally do see the ultimate finding, how much is it going to matter . How much are people going to believe what they read in that report or is everyones minds in terms of the American Public, is it made up . Its hard to say of course because we dont know whats going to be in that final report. I will say and i think that Jeffrey Toobin made this point very smartly that what the Republican Party has managed to do, what the president has managed to do particularly with this memo controversy is try to sort of boil this down to, oh, its just another fight between democrats and republicans, whereas its really not. There are incredibly important rule of law questions wrapped up in this. There are separation of power questions wrapped up in this. There are congressional oversight questions wrapped up in this and this is something that goes really to the heart of american democracy in a way that, like, the fight over the budget which we are also going to live through this week doesnt. We need to stay focused on that. Were living through something that is not normal and what the Republican Party particularly around this devin nunes memo has managed to do is to make it seem like its normal. I dont think that that memo fundamentally changed a single mind on friday. People read it with whatever theyre preconceived notion and saw the confiration bias that they wanted to see in it. Id like to offer a little bit of hope that facts matter. Umhum. And that, you know, the Mueller Investigation i do think mueller still has a lot of credibility and whatever he concludes will will matter, and that may wind up helping the president , it may wind up hurting him, but, yes, we respond to things in partisan ways but not entirely to the exclusion of facts. I liked a bit of hope. But to call on what youre both saying here, yes, its important and yes the findings and we dont know what they are yet, yes the findings are important but by the time we with get them, will it be difficult to make the American Public care about that because all of this partisan messaging has in its own way been successful of derailing . Maybe. Im not prepared to say that. I do think that the Mueller Investigation is now perceived differently by democrats and republicans. Theres no question about that, but the results of that investigation will still matter. There will be facts in this report, whatever format it comes out in and i think thats not clear. There will be emails quoted. There will be intercepts quoted. I think, you know, the facts will have some impact, though certainly the partisan framing will be a big part of it. Right. We know theres the competing memo that adam schiff has written. Theyll be under pressure to release the next week. Already calls to release the full fisa application thats underscrutiny in the nunes memo and can they control the information flow that works to their advantage which was the whole idea here. Erica, the second track of this is if we werent talking about the memo and if we werent talking about carter page and fisa warrants, republicans would have a pretty free field to talk about the economy and to talk about the tax bill and to sort of lean into the 2018 message that they have been wanting to deliver for a year and instead theyre not doing that. Were in the middle of that pingpong match that you just described. These are all the things that are getting ignored. While yes there was a rough day on the markets on friday. The jobs numbers were not. It is a terrible tragedy that we have seen once again dealing with obviously the trains in this country and yet this also sets up an important conversation on both sides of the aisle about infrastructure. So there are so many easy i mean easy balls to hit, frankly, here for the president. Why is it so tough to make that happen . Its less surprising to see the president reacting to this memo in the russia investigation overall the way he has. He clearly does not want this russia investigation, the Mueller Investigation to go forward. The republican reaction is a bit more questionable. They could be talking about new Approval Ratings for the tax cuts and how more and more americans seem to be embracing that as well. Instead we saw republicans really doubling down supporting the nunes memo being released. Paul ryan two times last week speaking out saying that it should be released. One has to question what is their longterm end game . This is the party of law and order, right, and to go after the Justice Department this way youve got Jeff Sessions whos been muted this entire time, youve got chris wray sending out memos of encouragement within his own party and administration the fbi and to see republicans reacting the way they have, i dont understand what they envision for a longterm gain, what their ultimate gain is out of all of this. You bring up a good point about Jeff Sessions. He has been mia on all of this and we did see a very strong reaction from christopher wray. Should it be a surprise to folks that sessions has been this quiet . No. Just based on the relationship that he and the president sort of have developed or eroded between the two of them since sessions recused himself last year from the russia investigation. I interviewed Jeff Sessions last week in pittsburgh, he did talk about it was the day the mccabe decided to retire early and to his point, he said, look, we need to have a fresh start and a new start in the Justice Department and within the fbi but this happened before, you know, the memo came out. But to alexs point, i think youre dead on. This is a conversation you shouldnt be having if youre the republicans or the democrats. If i were the democrats id be talking about, like, you know, how we would be the better party to lead and this is why you should vote for us in november. If i were the republicans id be talking about look at your paychecks. Youve got more money there. Look at the economy. Look at our infrastructure bill, which is going to create not only just create new jobs in small rr towns but its going to create new opportunities for more businesses to come to your town because your sewer systems are better and because your roads and bridges are better. It is remarkable in terms of the messaging that there are certain messages that seem so easy and even some of those lawmakers cant get right and i bring up just in terms the of the economy. As were looking at the messaging here, why is it so difficult . Lets take the president out of the equation. Why is it so difficult for lawmakers to try to hammer those points home . The president is a huge piece of it, right, because even if as paul ryan or nancy pelosi or Chuck Schumer you want to talk about Kitchen Table issue, if the president is out there doing what hes doing every day he does have a way of commanding the news cycle. Separate from that, the bases in the two parties are already pretty fixated on the same issue that the president is. Republican primary voters do want to talk about the nunes memo, they do want to go after Robert Mueller. Democrat based voters want to talk about the Russian Investigation and impeachment. There is an enormous space on both sides to talk about issues like taxes and the economy and wages and health care, but for whatever reason, whenever members of congress are in washington, its a political different when they go home to their districts, in washington its just tough for them to stay focused. Also easier during a crisis mode to be focused on the issue at hand, when we were going through the recession that was the topic of day because thats what americans cared about. Now when you have an economy adding jobs, theres only so much you can tout that every single doubt without a president s tweet getting in the way and for a while paul ryan would say, i didnt Pay Attention to that. Im focused on my constituents and people thought he looked toned deaf. Hes having to address like alex said a lot of the issues that the president s bringing to the forefront if no one else. And youre hearing more about those issues when youre going home because thats when youre seeing your constituents and thats when theyre bringing you their concerns. When we look at, though, all of the were told there are more memos to come and its not just the democratic response, obviously. When all of the ingredients for the sausage making is laid out there ahead of time, how damaging is that potentially on the end product . Youve ahead intelligence heads formers and currents saying that this has longterm repercussions that nobodys considering right now. Its funny because over the weekend you saw republicans speaking out saying that this memo has nothing to do with the russia investigation and while they may say that, it was clear thats not what the president s intent was. He said he was going to be releasing this memo prior to even reading it following the state of the union in the tape that we heard. So it doesnt necessarily bode well when you have heads of organizations, these heads appointed by the president having to go internally to boost up morale and tell people like chris wray did that your work is great and i still support you and im quite surprised that other intelligence heads havent come out now defending the fbi because, of course, the fbi isnt the only Intelligence Organization that uses the fisa courts and the fisa system. Investigators overnight pouring over camera recordings of amtrak train 91. The conductor and engineer both killed when it diversitied on to the wrong track. Ntsb Officials Say they hope to have more details from the cameras recording later today. Kaylee hartung joins me now from South Carolina with the very latest. Reporter erica, we have learned that a switch was lined and locked as they say in the Railroad Industry on the track that diverted that amtrak train from the main line on to a siding line, squarely into that Freight Train that was parked. Now that switch locked with a padlock. Questions now from investigators are why . Why was this fatal mistake made and thats a question that csx is going to have to help the ntsb answer. The csx, the Railroad Corporation that owns the track, theyre responsible for maintaining and operating that track. Its signals and switches and advertise dispatching. Csx put out a statement, erica, offering their condolences to the families of the two victims. The amtraks train conductors and engineer. They said they would be cooperating fully with the investigation but they have not acknowledged any wrongdoing. We will continue to keep an ill on it. Theres also talk about some of the technology that could have possibly helped here, maybe prevented this. What more do we know . Reporter thats something really troubling to understand, the technology does exist that could have prevented this from happening, that could have alerted the engineer on the amtrak train that that switch was locked in the wrong position. If the positive train control system a system that the ntsb has been lobbying for it was supposed to be installed nationwide bit end of 2015 but the reality told us it wasnt enough time for the Railroad Companies to do it. Reporter larry nassar is being sentenced right now at the moment the judge is speaking and the prosecutor is asking for up to 125 years. Larry nassar was given his chance to speak moments ago in court. He did. Take a listen. The words expressed by everyone that have spoken including the parents have impacted me to my inner most core. With that being said i understand and acknowledge that about pales in comparison to the pain, trauma and motions that you are are feeling. Its impossible to continue the depth and breadth of how sorry i am to each and everyone involved. Your testimonies will forever be present in my thoughts. Reporter the judge had to swear him in before he gave that statement under penalty of perjury and the judge just seds in her remarks that in the presentence Investigation Report when nassar was interviewed, he said that, yes, he pleaded guilty that there was no medical procedure involved that the intent was sexual but that was wrong. That it actually was a medical procedure he did and that was his intent and purpose. So the judge is saying, you cannot be reformed and that will fair for a very lengthy sentence in my courtroom, erica . Well watch that final sentence happening right now. Thank you. This is the sentencing for three charges to which he had pleaded guilty, three counts of felony criminal conduchlkt this happened at a jim in michigan which a number of young gymnasts got their start at and went on to great careers in many cases. If this sounds familiar, 40 to 125 years. Its very similar to what we heard on seven different accounts also to which he had pled guilty and to which he was sentenced a couple of weeks ago. Jean casarez is covering all of this. Both of the sentencings, these horrific charges here. Jean, ill hand it over to you now. Reporter the judge in issuing the sentence said the reason i am not giving you a life in prison term is under michigan law. You can get paroled well before that so by giving you 40 to 125 years in prison, you will have to serve that amount of time, of course 40 years being the minimum. Its a mandatory minimum. In this case it is just something in theory. The 125 years obviously will be the sentence but this is the third sentence because 60 years in federal court, up to 175 courts in ingham county. The assistant attorney general and her argument this morning focused in on the victims that were not believed for so long, that they were not believed by their families, they were not believed by authorities and now for ever more when someone is nice to them, like larry nassar was, they will not know if that person is to be believed if they can trust going into all of the lives that have been changed and damaged forever. Larry nassar also stood up in court and gave a statement. What did we hear from him . Just another apology . Reporter larry nassar apologized, said he was so sorry. He will carry these words with him forever and the judge said, in your presentence investigation you were interviewed and you said that it was a medical procedure, that my pleading guilty and saying it was not medical, it was sexual in nature, that you just said that, that it was medical and so she did that in looking at the sentence by saying, youre not remorseful. Criticism of the fbi is needed. We have to have oversight. We cannot police ourselves. But when myself and my colleagues have been concerned about are the political attacks. Joining me now to discuss, cnn Law Enforcement analyst james galliano, and retired fbi supervisory special agent. He talked with us this morning on cnn and wrote an oped over the weekend, why im leaving the fbi and talked about the attacks undermining not only the nations security, but creating this long lasting trust issue for the men and the women of the fbi. What are your thoughts . Well, first of all, we welcome mr. Campbell to the voices here. We all have divergent voices and thats the business of being able to give your opinion. I dont speak for the fbi. Neither does mr. Campbell. He certainly is speaking for a segment of the populous. I think i speak for another segment. And what i want to say is this, last week it was very unsettling for a lot of us, a survey monkey came out saying 38 of polled republicans view the fbi favorably. 64 of democrats talk about upside down and only 49 of the American Public. That hurts me. Im sure that hurts mr. Campbell too. Now, where were going to diverge, were going to have dissenting opinions is on causality. Is part of it the president s punching down and the relentless barrage . Absolutely. People follow the news stream, follow his twitter and thats unsettling and causes them to lose some trust and confidence. National security concerns, thats a little overblown hyperbole. I also believe, and i know we touched on it in his speech this morning, and i listened to it i watched the entire segment from the green room, he touched on, you know, the fact that yes, we need to have the fbi be policed from the outside. I read his oped and his oped was pretty stridently one way. He was driven out of the fbi because of things that the president said. I served under four different president s while i was in the fbi for 25 years. I never agreed with all of them. The ones i voted for and the ones i didnt. I disagreed with president george w. Bush when i served in afghanistan. I didnt agree with everything he did in the prosecution of the global war on terror and i certainly didnt agree with president barack obama when i served in mexico city and his immigration policies were different than what i would have liked, but i served as part of the executive branch. And i took my orders. I put my head down as some agents apparently advised josh before he left, and i basically waited for the storm to pass, knowing i was not going to agree with everything, but my sworn duty was to the constitution, and to the American Public and doing the right thing. So thats that is, again, to your point, thats your take and what you see the job as being, that being said, some of the concerns he brings up, you talk about the the impression that the American Public now has of the fbi. How damaging is that to the work that your former colleagues are now doing every day. And to the outcome of the investigations or whatever theyre working on . The president of the fbi Association Tom oconnell, good man, i know him from my time on the job, hes come down and put out a couple of unprecedented press releases saying that he believes that it is having a deleterious effect on the rank and file. I talked to tons of on board employees that are in the opposite corner that say, you cant think that fbi agents arent savvy enough to know this is the president punching down and doing some unseemly ways of approaching this, attacking Certain Senior leadership that josh didnt mention that made some egregious mistakes. We know chris wray has come out and sent messages to the rank and file, to the folks there. Do we need to hear very quickly from other intelligence heads to say, stay the course . I think thats fair. Christopher wray tried to steady the ship and get the fbi agents to put their heads down and go do what theyre supposed to do.
