Conclusion of a highspeed chase, one that began when russells car backfired. That backfire noise is what the officers say they thought was gunshots. It turns out russell and williams were both unarmed. During todays ruling judge John Odonnell talked about the National Environment in which this verdict was just handed down. Listen. In Many American places people are angry with mistrusting and fearful of the police. Citizens think the men and women sworn to protect and serve have violated that oath or never meant it in the first place. Some of these places are long familiar. New york city and baltimore. Some were unfamiliar until incidents there laid bare the divide between the people and the police. Ferguson missouri. North charleston South Carolina. That coming from the judge who found Michael Brelo not guilty on all counts. Outside of the courtroom, emotions ran high. One woman went inconsolably on the courtroom steps. The mayor of cleveland has asked for his city to remain calm and so far that has been the case. Our ryan young joins me now from cleveland. Ryan you were inside the courtroom when this verdict was read. What was the feeling inside . Were people surprised . I know the judge had a big leadup to the final word. Reporter he did, poppy. So many emotions here. In fact i think some people were concerned when the judge brought in the mannequins that showed all the shots that were fired during this encounter. 137. Thats so much that you hear throughout cleveland because people were talking about the number of shots that were fired. As you started to detail all the things that were alleged, you could tell it was going one direction. Now, these officers still may be fired, but we decided to come across the street because this is outside the court area. All the protesters were kind of standing back this direction and then they made that surge forward. I can tell you the Sheriffs Office handled that pretty well. They came out, they established that line and said hey, you cant go any further than this. People were chanting here for about two hours and then took to the streets of cleveland. The officers kept a barricade between them and the traffic and they marched on. They have been marching throughout the city for about the last two hours or so but that is starting to dissolve to a certain extent. More protests are planned for later. Some folks are standing over here in this location and were told in the next half hour or so more people could be coming here outside the Justice Center to have this conversation. But we talked to the pastor in this area a couple of pastors in this area who were telling us they have been working for months to make sure when this verdict came down there wasnt the unrest they have seen across the country. Everyone has their fingers crossed to get through this weekend because they thought with this being a holiday weekend, so many people may be dispersed and it may take a few hours before people show up here. Talking to the williams family, her brother says he will not stop until justice is served. They really believe there was a miscarriage of justice here and their family has been left out in the cold after 137 shots were fired. They were unarmed. Talking to Michael Brelos attorney he believes theres been a rush to judgment. He believes the officers have been lumped into the rest of the nation. He wants to make sure that each case be evaluated differently. Then as you know ryan we heard the judge, judge odonnell, say it is not whether or not they were armed, it is what the officer perceived. He found cause there saying it was correct. He believes that the officers perceived that they were indeed armed. Well talk a lot more about that this afternoon throughout the program. Ryan young, thank you very much. I appreciate it. Officer Michael Brelos attorney spoke just moments after this verdict was handed down. We want you to hear part of what he had to say. We fought tooth and nail as you saw in this courtroom. It was classically a case of david versus goliath. At the end, you saw lawyering at i think its very highest level in this courtroom, and i dont say that as a braggart. Im proud to have played a role in this case and i hope that all the naysayers out there, all the socalled plaintiffs lawyers that claim that theyre civil rights lawyers and never have tried one of these damn cases for a verdict but theyre out there for a money grab all the time. Officer brelo as the judges opinion set forth risked his life on that night. Well images of the bulletriddled car unmistakable but judge odonnell ruled that officer brelos actions at the end of the chase, jumping onto the car, stomping on it in the middle of the School Parking lot, firing those final 15 shots were constitutionally justifiable because it was not clear, the judge said that any perceived threat to the officers had ended. A lot to discuss. Lets bring in hln legal analyst joey jackson. Also with me a former Police Officer himself, also former fbi assistant director and cnn Law Enforcement analyst tom fuentes. Joey let me begin with you. Are you just your reaction to hearing what the attorney for the officer had to say there. I mean listen these trials are always hardfought battles and i get that but the judge could have went either way. You can do the most fabulous lawyering in the universe and lose a case. You can do the worst lawyering and win a case. It comes down to this poppy. Whenever you have a bench trial, remember that the judge is operating as the trier of fact and the concluder of law. So the judge is putting himself in the position of a jury and the judge is processing those facts. As the judge evaluated and went through the opinion, in giving the opinion, remember he discredited some expert testimony. That was very critical because it was expert testimony which would tending to show that the fatal shot was indeed fired by brelo. If you come to the conclusion as a juror, which was judge was in the role of that brelo did fire that critical shot that was fatal, guess what its an entirely different result here. The judge decided not to credit that expert testimony. Why . Because there was too much what the judge basically said was there was a causation issue. Wherever you have a shootout where theres 137 shots that are fired coming from various angles and the judge took the unusual step of a, taking an hour to deliver the opinion, poppy, in addition to walking down and talking about the mannequins and talking about the trajectories of different bullets, where the angles came from and before brelo was at the time. This particular judge decided not to Credit Expert testimony that would have him firing brelo, the fatal shot and as a result of that said causation in terms of who fired that fatal shot could not be established and, therefore, not guilty. I automatically thought and i think a lot of our viewers are thinking why is this not a case that was heard by a jury a jury of ones peers when youre talking about two civilians killed . Why a bench trial . Because the defense opted to waive their right to a jury. Remember the Constitutional Rights that apply apply to the individual that stands accused. If you stand accused, as the defense attorney you have to make a decision whats best for my client. Is it better to go to a jury of peers or is it best to take the emotional elements out of it and have a judge evaluate it based upon the facts, the underlying circumstances. This proved to be a very good move strategically for the defense because the judge in his analysis analyzed it and said causation cannot be established. That was not the straw that broke the camels back. There may have been a fatal shot but we cant say it was the fatal shot and as a result of it said not guilty. Tom fuentes, your perspective as a former Police Officer looking at this. To put this in context, this is also a Cleveland Police department that was reviewed by the Justice Department and the Justice Department found rampant cases of Excessive Force used by the department. So this is already a department under review and guidance of some experts to retrain them going forward. Whats your assessment of the outcome here . Well the problem here poppy, is that all of the activities of the Cleveland Police Department Going back several years werent on trial and the other 11 or 12 officers that fired over 100 shots werent on trial. So you have one officer who fired, you know a number of shots. As joey said you know to be able to say whether he fired the fatal shot you know couldnt be exactly determined or the judge chose not to listen to expert testimony, which is his prerogative as the trier of fact. And thats what you have here. So i think that a lot of the outrage of this case is that over 100 shots, that many Police Officers that many Police Officers involved in the pursuit was clearly excessive. And i think any reasonable Police Officer would agree that in totality it was excessive. But the totality wasnt on trial. It was one cop firing the shots he fired at that car with the belief that possibly there was still a situation where his life might be in jeopardy. And what we do know is that the Cleveland Police Department Still has officer brelo on paid administrative leave. Theyre doing their own review of him, the other 12 officers and we dont know what may become of that. They may be punished or charges as a result. Tom fuentes, appreciate the perspective. Joey jackson as well. Two People Killed in a hail of bullets, but ultimately a judge ruled that the cleveland Police Officers as i said Michael Brelos actions were justified. Todays verdict garnered swift and emotional reaction. Take a look. We dont know why they didnt pull over but i can tell you what i do know. I know that those officers were upset. Adrenaline was flowing. By the time they reached up caught up to tim and melissa in that parking lot, they simply let them have it. Tim was a loving person. You know he was a forgiving person. He would have said were going to love them anyway. Were going to pray for them. One of our citizens was taken on by the state of ohio. We fought tooth and nail as you saw in this courtroom. It was classically a case of david versus goliath. I am convinced that this prosecution in this case will prevent future deaths of police and civilians in the future. We encourage and support peaceful protests. I want to make sure that those who are here that have a different agenda understand that actions that cross the line whether by Police Officers or citizens cannot and will not be tolerated. We want we want justice for tim and melissa, but we want people to see the tim that we knew. You know because the public they have tarnished him, just made him like he was a thug or a drug just a drug addict you know, on the street without family that loved him, that our family didnt care for him. But this is an example of what tim was. He had a heart of gold. And they took that from us. Were going to have a lot more on this verdict ahead. Also the department of justice we now know is reviewing the case. Well have the details of that. A live report from washington, ahead. Every Auto Insurance policy has a number. Moments ago flash flood warnings were issued for several counties in oklahoma. We have just received this video. It comes to us from wichita falls, texas, where 3 to 5 inches of rain have pelted several counties in just the last few hours. Elien elena, were they expecting this . Reporter yeah they have been talking about this for a few days now, poppy, and this area is no stranger to potential flooding. Back in 2007 they had record level flooding in this area. I want to show you what this situation is like here in this subdivision called tanglewood. A lot of homes have sandbags covering their front doors, garages. 25,000 sandbags have been delivered to wichita falls. The National Guard is here. Also assisting in the efforts to prepare ahead of the storm. This is why. This is the area that is going to flood if it floods here. Theres already water creeping up behind these houses. Theres water making its way to the road. This road is passable. There are some people youre going to see a car right now go through, which is exactly what they dont want people to do but its not as deep as you would imagine. So this road is not actually closed even though there is water on the road right now. The hope here is that obviously the waters dont rise as high as theyre expecting. But poppy, ive got to tell you, from talking to people here they are definitely worried about what could happen if they see the rain that they have been forecasting. No question. I mean texas has been hit over and over again already this storm season. The last thing they need is severe flooding. Thanks for that. Chilling new development in the washington, d. C. Quadruple murder case. Prosecutors now say the man accused of killing a wealthy couple their 10yearold son and their housekeeper could not have acted alone. Court documents just released on friday say the prime suspect, daron wint, and others carried out the brutal murder inside of that familys home. We now know the victims were bound with duct tape and held hostage for hours before they were brutally murdered. Also a delivery of 40,000 was made to the house, and then that house was set on fire. The Court Documents also revealed that three adults were beaten and stabbed. The 10yearold boy, their son, was also stabbed. He also showed signs of excessive torture. Lets bring in our cnn analyst to talk about this. Criminal defense attorney joey jackson and in washington tom fuentes. Tom, lets begin with this. What at the scene at a burnt scene, by the way, a burntdown house, can tip off police to make them so certain that one person didnt carry this off alone . I think, poppy, first of all, the house didnt burn enough to obliterate all evidence inside of it so the forensic search that went on inside they would be looking for any and all dna, skin particles, hair follicles, hairs and fibers from other people. And then matching that against the people that had been in the house legitimately the family members, the two housekeepers whether the boy had friends over or the adults had friends over. So they would have to match everybody elses and then look for additional dna that normally didnt belong there, especially if it was around the bodies. You figure for the amount of time that this Home Invasion lasted more than 18 hours, you know they could have been going through drawers, touching the refrigerator looking for things to eat or drink, silverware cups glasses, all of that would be possibly leaving fingerprints and dna from skin particles and hair follicles. So thats the main part of the forensic. If they have found indications that other people were in there that havent been identified that dont belong then that would be a clue to them that theres somebody else involved besides wint. Joey as we talk about that the key witness, the assistant who brought over the 40,000 in cash has apparently according to these Court Documents changed his story a few times about when the request for the money was made how it was dropped off. I wonder what you make of that. Is that typical of someone whos in trauma whos obviously lost their boss in a horrific very public murder or is that suspect . Theres two ways to explain it. The one is as you mentioned theres an innocent explanation. Youre in shock, its a very traumatic experience so as a result of that okay you can make a mistake, thats plausible. The other way is a nor nefarious way and that is there are basic things youd know. In the event that your boss asked you to bring over some type of cash well did he text you the night before or did he text you the day of . That seems to be pretty basic, not requiring a lot of memory. The other thing in terms of how you stack the cash the bundles you made of the cash and what envelope you put it in again, pretty basic. And so to the extent that its not, it just raises questions. You could be sure and tom could certainly address this much more thoroughy than i could that the the investigation is going to entail the computer records of this assistant, any Text Messages any phone records, any surveillance information is going to play big. One other critical point and to add on to what tom fuentes was saying regarding the dna. Dna is important not only to include suspects but to exclude suspects as well. I think police are concerned based upon the nature of how this occurred the Blunt Force Trauma the gagging, the coordination in terms of getting the money speaks to more people being involved. I also did want to ask you about that. Motive is a key thing here and the police have not, tom, come up with yes, we think this is the motive. They believe money was a big part of it. But looking at the savagery of how this was taken out, duct taping them torturing a 10yearold boy, do you think that speaks to a crime just about money . No it would indicate that theres a lot more to this in terms of as youre mentioning revenge or retribution against the family to make them suffer. We know wint worked at that company. We dont know what the circumstances were. Did he know the boss . Did he have an altercation . Did he get fired . Did he have other problems in his employment there . So there could be other factors here at a personal level that the police will learn in their investigation that may not come out publicly right away. All right, joey jackson, tom fuentes. It is a tragic, tragic story. Well keep you posted on the leads. Also ahead, clevelands mayor pleading for peace in his city after the verdict in a Controversial Police shooting. Protesters are in the streets of downtown cleveland following a verdict in yet another Police Shooting. Just hours ago officer Michael Brelo was acquitted of all counts in the deaths of an unarmed couple back in november of 2012. He and 12 other colleagues fired a total of 137 shots at the couples car after the car backfired. Officers thought the noise was gunshots. The mayor of cleveland was quick to speak, urging peace instead of violence. I want to emphasize that this is a defining moment for cleveland. As we look at this verdict and we respond to that verdict and we as a city move ahead in a way that will ensure that whatever injustices may be will no longer happen again. Following that verdict being handed down the department of justice says it will review the case. Lets go straight to washington. Thats where athena jones joins us. This is not the doj laumplingnching an investigation, this is a review. Reporter thats exactly right, its not a fullscale civil rights investigation, its a review. We know the statement from the Civil Rights Division of the department of justice, also from the special agent in charge of the cleveland fbi and the u. S. Attorney for the Northern District in ohio they have been monitoring this case monitoring the investigation since the events occurred back in november of 2012 and so they are going to be continuing their assessment reviewing the testimony and the evidence presented in the state trial. Theyll be reviewing all available Legal Options and will collaboratively determine what, if any steps are available and appropriate given the requirements and limitations of federal law. I should point out even if there were to be a fullscale investigation, theres a very very high bar from bringing federal charges in these cases. You didnt see federal charges in ferguson missouri in the Michael Brown shooting or the Trayvon Martin case in florida. This follows a broader doj investigation for two years of the Cleveland Police department. It started in 2012. It just ended last year. Reporter thats right. So this Police Department was already on the Justice Departments radar, already under some intense scrutiny. That twoyear investigation showed that the Cleveland Police department had engaged in a pattern of Excessive Force. There are numerous examples. In fact this case was one of the ones that was cited. And so this is not a new issue for the Cleveland Police department accusations of excessive use of force. And as a result of that finding in that Justice Department report that was released last december they developed what they called a Court Enforceable Consent Decree. Thats so that they can Work Together with the federal government to make necessary reforms of the Cleveland Police department. Poppy. Right. And of course those are two separate things that investigation and then this trial where, again, officer brelo was found not guilty on all counts. Athena thank you very much. An omaha Police Officer shot and killed just hours before her Maternity Leave will be laid to rest on tuesday. Flags have been lowered to half staff for officer kerrie orozco. She was part of a Fugitive Task force trying to serve an arrest warrant on wednesday when a gun battle broke out. She died after being struck in the chest right above her bulletproof vest. In february she gave birth to a beautiful little girl. The baby who was born prematurely, was finally set to leave the hospital and to go home with her mother this week but orozco never got that chance to take her daughter home. Lets talk more about this case with michael daily, a special correspondent for the daily beast. You wrote a beautiful piece about her. As you were reporting on this woman, this 29yearold who had everything you see her family here what stood out to you here . She not only had everything she gave everything. And its you know this was the cop that all cops should be. I mean she when she was not on patrol she was coaching inner city kids in baseball she was working Special Olympics she was in a program called shop with a cop where she took homeless kids shopping at christmastime. She was there. And then but the thing thats just so hard to even think about is that she had this baby in february. She decided that it would be best to spend the time rather than spend her Maternity Leave while the baby is in the hospital, she thought ill use that Maternity Leave for those first magical days at home with a baby. If you had a baby those are the days she decided to put it off of she was supposed to pick up the baby and begin her Maternity Leave on thursday. Wednesday afternoon shes on surveillance for guys wanted in a shooting. They see the guy. The guy sees them. The guy starts firing. Shes hours away from picking up her baby. She knows this. And she still runs towards him. She does not hide. She doesnt duck behind. She doesnt say to somebody else ive got a baby you go. She does what she is. Shes a cop, and she goes and she goes right into harms way. The way fate sometimes works, she just caught a round right above her bulletproof vest. It was like of all the times, of all the places to get hit, of all the cops this was the one you just didnt want to see. Her colleague yesterday on cnn calling her an angel. Thats the way that they described her. She looks angelic. When you look at the focus on the police in communities, look what were covering in cleveland today, right . Theres such a tendency and sort of easy to focus on that but actually you have to focus on people like this too. Youve got to remember her. You cant i mean we all owe it to her little kid to remember her. And they just just had footage from Cleveland Point his finger and screaming at the cops. Right. Who does he know what that particular cop is. If he has a problem what certain cops did, thats what they should be protesting. But to lump all cops together say racist cops did this cops did that and youve written very critically about police when they do do wrong. Absolutely. Absolutely. And i think each one of those things you have to look at it like a plane wreck. All right, what caused this here in this particular instance. But what you cant do is you cant forget the good ones. As you wrote in your piece at the end, what we all need to do for this child, this little baby girl who is now growing up without a mother is we all we all owe something to that child. What do you think other people can do . Well i mean if nothing else you can remember her when people Start Talking about the police in a lump. And remember what she did and the way she was. And you can also maybe try being a little decent in the way she was, to help make the world a little better yoursel. You know if youve got a free saturday afternoon, go do something for some kids. If youve got a few extra dollars, take a couple kids shopping. You can use her as an example. If youre not going to use her as an example, at least remember her. At least dont lump all cops together. No matter what you feel about the police. I dont think theres any sane human being who could not honor this woman, no matter what you feel about other cops. I agree with that. Well remember her. Michael dailey thanks so much. Its a beautiful tribute. Good to have you on the program. Coming up in the next hour were going to talk to her colleague, officer kerrie orozcos colleague who remembers her so faungdly lyfondly and well also talk to one of her friends about how they are coping and trying to keep her memory alive for her little girl. Some of the president ial gop candidates and likely candidates have posed for photos with the Christian Conservative Reality Television star. Lets be really clear. This was long before any of the scandal surrounding him emerged this week. Duggar apologized for reports that he allegedly molested girls includeing his own sisters wheel he was a teenager. Hire is duggar with Mike Huckabee and Wisconsin Governor Scott Walker also jeb bush senator ted cruz and former senator rick santorum. A picture was also taken with former president bill clinton in 2011. All the shows of 19 kids and counting counting with him in it have been pulled from the air. It is true that you have him as a political heavyweight, running a big right wing group, but at the same time do you think this hurts these candidates at all give then apparently no one knew about the allegation until this week . As you said he was the head of this lobbying organization. His job was to meet with these candidates and politicians. Time, the next question after that, knowing what you know now, do you still support him . Its fascinating, Mike Huckabee came out with a long Facebook Post yesterday saying quote, good people make regrets and do regrettable even disgusting things. And went to point to the insensitive blood thirst as he calls it of the media. Is that a good strategy for a candidate for president . Duggars were an early supporter of him and put him on the map in 2008 when he ran for president. You have to remember theyre pretty key. They hold a lot of sway over evangelical christians a key voting bloc in the republican party. I hate to say this is a political calculation, but for Mike Huckabees president ial sort of thoughts he needs to again play very well in iowa so he needs to again show this strength and show the support for evangelical christians. When you look at this the familiar research council, very prominent group. Hes stepped down from that roll but as i mentioned before also duggar took a picture with president clinton, both at the today show in 2011. Is this just a republican gop issue . We havent seen them sort of campaign for Democratic Candidates the way theyve campaigned for republicans. You did see an active effort for lobbying the duggars going into 2017. They are a significant sort of political force. It raises these questions for the republican party, how do you espouse Christian Conservative values when you may be supporting a family that may be a little hip crate cal on that issue. I think well be getting a better answer this week on the campaign trail. I think Mike Huckabee made it very clear that hes going to be coming out with a very strong opinion either way on issues just like this. You havent heard from any of these other folks by the way in the photos. Thanks so much. Good to have you on the show alexandra. This is about whether or not a warrant with a single name of a Single Company can be used to collect all the records, all the phone records of all the people in our country with a single warrant. Our forefathers would be aghast. His fem low republican Mitch Mcconnell was stunned, ordered the lawmakers to return from their break next sunday the 31st of may to vote on this one day before it is due to expire. Next hour ill speak with a member of the House Intelligence Committee over the fight for this law. Memorial day weekend is here, and we remember the sacrifice of veterans who defended their country but also those who gave their lives for this nation. Ahead, meet a veteran who is helping a lot of these fellow veterans over come one of their Biggest Challenges when they come home. What hes doing next. Boy once upon a time, there was a nice house that lived with a family. One day, it started to rain and rain. Water got inside and ruined everybodys everythings. The house thought she let the family down. But the family just didnt think a flood could ever happen. The reality is floods do happen. Protect what matters. For many veterans as tough as war was, returning home comes with an entire new set of challenges finding a job, transitioning back into civilian life. Lets bring someone who knows about that and someone helping solve the issue, kat doorbly founder of door bean. Com. Sells coffee on liechblt lets sell coffee and help veterans as well. Thanks for being here. Thanks for having me. The real challenge because so many times employers cant or fail to work hard enough to really translate the resume of veterans to figure out what good employees they would be. Whats your goal . To try and get the word out and really educate some of these folks who have the opportunity to employ veterans that the resume might not match up but you need to upped sand the amazing intangible qualities youre getting from the men and women that served our country, they will figure out how to get the job done exceed your expectations. Im asking folks out there, if youre hooirg consider hiring a vet. When you look at the unemployment numbers, the Unemployment Rate for post 9 11 veterans the younger veterans is higher than the national average. Id like to talk about another number real quick. Were losing 23 veterans a day to suicide. Most of these folks are looking for a new mission, a new team wanting to get that sense of identity back that they had when they were in the military. If we can get these folks to start their next mission, give them a new direction in life surround them by good folks, and that number will start dropping as quickly as the unemployment number. I think its been really im hopeful seeing these Big Companies like walmart, jpmorgan hiring veterans. Walmart announced theyre expanding their projection of hiring their 100,000 by 2018 to 250,000 by 2020. Its not just about getting them in the door. Its also helping them advance to higherup positions once theyre in there. It is. Very first you need to give them the opportunity. I mean it. They will figure it out. The things these folks have been exposed to either in iraq or afghanistan, yeah terrible nasty stuff. They had to figure out a way to overcome and take the missions successful. They will do that for you here. You have to give them a triechlt memorial day were remembering those who we have lost but lets not forget those folks that we still have with us here that can contribute to society in a great way. Absolutely will not. Youre giving them a lot of that opportunity. Cade thanks for all you do and thanks for serving this country. Thank you very much. Captions by vitac www. Vitac. Michael brelo was acquitted of all charges after firing on an unarmed couple. Timothy russell and maam liss is a williams were killed. The shots came at the conclusion of a highspeed chase, one that began when russells car backfired. It was that backfire noise the officers say they thought was actually gunfire. It turns out that russell and williams were not harmed. Outside that cleveland courtroom emotions ran high today, but so far the protests in the city have been peaceful. Our ryan young is in cleveland. He was in the courtroom when the verdict came down. I wonder if this was a surprise to people. Were they expecting an acquittal across the board, and what the reaction has been . What a mixed bag so far. People did believe he was going to be acquitted but they thought one charge would stick. That didnt happen. We saw the crowd surge toward the front of the courthouse. The team on the inside came right out and met them. So far it was okay. They said everybody back up a little bit. Everybody did. They protested on the front steps. They stepped in the middle of the street and blocked traffic for some time. The remnants of the protesters are just right there. Theyre holding their signs, not even chanting anymore. Some other protesters decided to walk lou the community to have their voices heard. Everything remane sos peaceful right now. Talking to community leaders, they tell us they believe all the front work theyve been doing for the last two years, talking with the community, Lessons Learned from ferguson and baltimore where they wanted to get ahead of this to make sure when this verdict came down, there wasnt the unrest theyve seen in other cities. People are upset about this, they were angry. In the courthouse we heard poems voices being raised. They feel this was a travesty of justice. We talked to the Williams Brother a short time ago. I was so hurt i aint know what to do. My mind went somewhere else you know what im saying . I held my composure. I know where im at. Im in cleveland. Like i told my family if this case was tried in any other city that police would be in jail right now. We know it and they know it. Reporter you can see behind me protesters walking with signs like this one. People obviously upset. The leaders here are telling me theyre wanting to see what happens over the next 24 to 48 hours. This is memorial day. Some people feel this announcement was made during memorial day for the simple fact they knew people would not be here. You can see protesters are having their voices heard, this monday behind me standing with a sign. Several others walking through the street. Poppy, as you know its usually in the next few hours when people start learning about this and having conversations and organizing before you see anything happening. Ryan young, thanks for the reporting live in the ground in cleveland. Two People Killed in a hail of 137 bullets. Ultimately the judge today ruling that cleveland Police Officer Michael Brelos actions were justified. Todays verdict garnered swift and emotional reaction. We dont know why they didnt pull over but i can tell you what i do know. I know those officers were upset, adrenaline was flowing. By the time they reached tim and malissa in that parking lot they simply let them have it. Tim was a loving person, you know. He was a forgiving person. What he would have said were going to love him anyway. Were going to pray for them. One of our citizens was taken on by the state of ohio. We found tooth and nail as you saw in this courtroom. It was classically a case of david versus golliathgoliath. Im convinced this prosecution in this case will prevent future deaths, both police and civilians in the future. While we encourage and support peaceful protests i want to make sure that those who are here that have a different agenda understand that actions that cross the line whether by Police Officers or citizens cannot and will not be tolerated. We want justice for tim and malissa, but we want people to see the tim that we knew. Because the public they have tarnished him, just made him like he was a thug or a drug a drug addict on the street without family that loved him, that our family didnt care for him. This is an example of what tim was. He had a heart of gold, and they took that from us. Reaction came swiftly once that not guilty verdict was read in that cleveland courtroom today. Lets talk more about it with Cleveland City Council Member zach reid. Thank you for being here sir. I appreciate it. You know what . We lost his shot. Well work to reestablish that and bring it to you as soon as we can. As we continue to follow this storey just after the ruling and two years after the shooting happened the Justice Department says lit review this case. Our Martin Savidge looks back at the controversy surrounding this det deadly event. Reporter november 2012 when a couple in a car speeds away from an undercover cop, their engine back fires, it triggers a police radio report of shots fired and the chase is on. Investigators say the pursuit involves as many as 62 police cars at speeds of 100 Miles Per Hour through the streets of cleveland. In ends in a hail of gunfire killing two unarmed people. An investigation reveals a stunning 137 shots fired by 13 Police Officers but only one, Michael Brelo, was on trial, charged with two counts of voluntarily manslaughter. He is shooting repeatedly he is shooting excessively and he is shooting to kill. Reporter prosecutors say the 3 isyearold former marine did what other cops didnt, reloaded. When the car police were chasing finally came to a halt brelo is said to have jumped on its hood and fired 15 shots directly through the windshield. The prosecution blooefts those are the shots that killed 43yearold Timothy Russell and 30yearold Malissa Williams. Brelo said he thought he and his marter in were in danger believing the couple in the car were shooting quote i had never been so afraid in my life. I thought my partner and i would be shot and we would be killed. Brelo went on, as which point i drew my weapon and shot through the windshield at the suspects. Recorded Police Radio Traffic that night gives conflicting accounts at one point Warning Police about weapons. Use caution, theyre armed. Reporter while other officers report seeing no weapon. He does not have a gun. He does not have a gun in his hands. Reporter neither victim in the car had a gun. Defense attorneys says officer brelo had no way of knowing that at the time telling the court he wasnt trying to rambo, he was just trying to survive. Well, as i said reaction came swiftly once that not guilty verdict was read in cleveland. I want to talk about it with a Council Member from the city of cleveland, councilman zach reid. Thank you for being here. Thank you for allowing me. I appreciate it. This is a case that captured National Attention when it happened and obviously the attention of your entire city became known to many locally as 137 shots. What are you hearing on the ground there from the people from your constituents who now have heard the judge say he believes that this officer, Michael Brelo, is not guilty on all counts . Well most of them said councilman i told you that was going to be the verdict. Theyre just telling me theyre not surprised and they say the situation between the Africanamerican Community and the Police Department just continues to go on and on and weve got to fix that problem. Weve got a very serious problem of the relationship between africanamericans and the Police Officers in our nation and weve got to fix that problem. I think its interesting because we just heard from the brother of one of the victims, the young woman who was killed who said if this was in any other city this wouldnt have happened. I wonder what your reaction is to comments like that. Actually we have seen similar things happen in other american cities. Although the cases are different, but the verdicts have been similar. I think the Justice Department made it clear, that over a period of time theres been Excessive Force in the city of cleveland by Police Officers that the way that were policing in the city of cleveland is unconstitutional and weve got some very Serious Problems between relationships between our Police Department and the citizens. So weve got to fix that problem. Weve got a very serious problem. My hope is that while the federal government is looking and evaluating our Police Department from top to bottom that we come up with concrete solutions so that the city of cleveland can become a model for the nation and how we can Work Together to have the best police force in the nation. Just to be clear here the judge, when he was handing down this lengthy verdict today, judge odonnell, he said in fact this use of force was found he believes to be constitutional because of the perceived threat that the officer thought that he could die, he thought they were armed. He said his gun and badge offer no special protection here. If indeed he were found guilty he would be treated like every other criminal. Do you believe that the outcome here of this case was just . I believe the outcome came about simply because he was a Police Officer. If this would have happened between me and another citizen, i believe that wed be going to jail today. But because the Police Officer, as the judge said feared for his life and laid out how other Police Officers feared for their lives, therefore, he felt it was justifiable to allow officer brelo to go free. Is that are you saying that fear i dont know what its like to be a Police Officer. I have no idea what its like to walk in those shoes. Same here. Are you saying you think that fear is not legitimate . I think thats the way they do what they continue to do. You saw the case in South Carolina. Until that film came out in South Carolina that Police Officer was going to strie to just try to justify a fact that he shot an innocent man in his back while he was running away. I dont know how it feels to be a Police Officer. I dont know how it feels to go out every single day knowing that you may not go back home to your family and your friends and the people who love you the most. So why they say that they are going out and they say that we fear for our lives and thats what the judge said that brelo feared for his life so therefore, he was justifiable in jumping on top of a car, using statements that are used in afghanistan remember what he said . He said i learned this in afghanistan. The last time i checked, this is not afghanistan. This is the city of cleveland. So weve got a serious problem between the relationship between the Police Officers and the Africanamerican Community in this city and my hope is while the federal government is here and we become under this Consent Decree that we will fix this problem. By the same token, we cannot solve the problem by rioting, by looting, by causing harm against people or properties. Councilman zach reed, i appreciate you coming on the program. Thank you, sir. Thank you for the opportunity. More ahead on this verdict. The congresswoman had this to say, quote, today we have been told yet again our lives have no value. Well discuss what she means by that next. Right now, verizon is offering unlimited talk and text. Plus 10 gigs of shareable data. Yeah, 10 gigantic gigs. For 80 a month. And 15 per line. Tylenol was ok, but it was 6 pills a day. But aleve is just 2 pills all day. And now, im back aleve. As we continue to follow the breaking news from cleveland, i want to take you to a press conference where police chief Calvin Williams just spoke about todays verdict. As you know this morning one of the first protests major protests was at the park on the west side. That protest has ended. The individuals from there have moved to another location where theyre joining with other people throughout the near west side. As the mayor stated right now, people are peacefully exercising their First Amendment rights and the division of police is allowing them to do that and assisting them in doing that. We want to make sure that continues. We expect nothing less. We also want to make sure that our parents out there are aware of where their children are over this weekend and that they keep them close if possible. We dont want anyplace caught up in an unnecessary situation, especially our kids. So if they can do that wed definitely appreciate it. For the people out there that have experienced some of these minor coninconveniences the traffic, people exercising their First Amendment rights bear with us. Were in this together and people can be assured that were going to do everything humanly possible to keep this city safe and keep traffic moving. Bare with us for now. Also as i stated earlier, we are definitely going to monitor this for as long as it takes and make sure that there is no violence or destruction within the city. The city will not tolerate any violence or destruction. People need to understand that. We need to Work Together to ensure that doesnt happen here in this city. Thank you. Questions . [ inaudible ]. The police have discretion. Theyre professionals. They have discretion on that. We have a pretty good tolerance level as regards demonstration as we have demonstrated ourselves in the past. The chief can answer that more specifically. As i stated earlier, we are trying to ensure that people exercise their First Amendment rights but within the bounds of the law and whats decent and necessary in the city. People that commit violent acts be it against property or persons, wont be tolerated. Our officers are prepared to step in and make sure that stops as soon as it starts. People should know and understand that that doesnt move the needle. That doesnt get us anywhere. Violence only sets us back and what we really need to do in the city to make things better. So that was our request and our expectation of people from the beginning, is that we do this in a loud boisterous peaceful way and we hear you, over the last six, eight months and even before that. If people stay on that track, we can really get things done in this city. Im committed to that. The mayor is committed to that. Believe it or not, the majority of the men and women in the Cleveland Division of police are committed to making this situation better and making our division better. [ inaudible ]. Im as concerned that as i was when things started this morning. Any time theres a situation like this in the city, im concerned. I live in the city my family lives in the city. Im concerned for the rest of the silt sens in the city and our officers. Were along the tracks of where we should be as a city as it pertains to demonstrations. This is how we do it and this is how were going to continue to do it. Our people will come out, theyll be peaceful theyll voice their opinion. They may get overboisterous and thats their right. As long as it doesnt result in anybody getting hurt. Were there to support them and make sure that happens. [ inaudible ]. Weve prepared for everything thats coming up in this city. [ inaudible ]. Right now the situation only calls for cleveland Police Officers officers. We do have a contingent from the state highway patrol. Theyre assisting us today to make sure that we allow people to exercise their First Amendment rights, and some of those officers are sprinkled throughout the city. So you may see of those cars out there as well. Cmha police of course, is a continuous partner along with rta. Rta is protecting rta assets and things like that. Yes, youll see other Law Enforcement officers. Make no mistake, theyre all under the command and supervision of the Cleveland Division of police. [ inaudible ]. Ill do that at the proper time and in the proper way. Thank you. There you have it. A press conference that wrapped up a few moments ago from the Cleveland Police department cheech Calvin Williams and the mayor Frank Jackson talking about the protests that have happened in the wake of this not guilty verdict coming down for officer Michael Brelo who shot and killed two people in their car back in 2012. Main points here people are exercising their First Amendment right to be heard and doing so in a peaceful way. The police chief saying the city of cleveland is prepared for anything that may come up. Lets talk about this with michael daly from the daily beast who has written specially on this case before the verdict came down today. Thanks for being here michael. A congressman from ohio marsha fudge said this after the verdict, quote, the decision of judge john p. Odonnell to acquit Michael Brelo is a stunning setback on the road to justice for Timothy Russell, Malissa Williams and the people of cleveland. The verdict is another chilling reminder of a broken relationship between the Cleveland Police department and the community it serves. Today we have been told yet get our lives have no value. Your reaction to the last part our lives have no value. I cant believe the judge would not have reached the same decision no matter what the race of the people who were shot. I dont think he was making a decision regarding the lives of the people who were murdered or killed. What do you make of a congresswoman saying that . Particularly if youre africanamerican it seems like theres one after another after another after another. Weve had several situations where no officer was indicted. So you say, boy, theres no justice there. This was a case where someone was indicted goes to trial and then is acquitted. You might keep in mind, too, that that could happen in baltimore. Youve got officers who are indicted. That doesnt mean theyre going to be convicted. Thats a good point. You have to talk about how the judge, before he gave his verdict, i was looking at my notes here. He set this up setting the stage with the National Environment right now. He talked about Staten Island new york. He talked about baltimore. He talked about ferguson missouri. He said if not guilty, then i will not sacrifice him to a public frustrated by historical mistreatment by the hands of officers. If you look at this case really the it was a 22mile chase where the people went up to 120 miles an hour through a series of traffic lights. It ended in this terrible cataclysm where they were unarmed, but shot as many times as bonnie and clyde were shot. It was one bullet less than bonnie and clyde. If the Police Departments their own investigation found there was a failure of the department. In their investigation they say there has to be a system in place where officers who are under extreme stress are restrained from acting how they might unless there were a system there. What happened was you had a communication failure. You had a command failure. You had no commanders there saying hold it guys hold. No one pulling that cop back and oftentimes situations are saved when theres one person who says thats enough hold up wait. You didnt have that here. One thing that youve reported extensively on that i dont think a lot of our viewers know about is this lawsuit. There has been a federal lawsuit filed by some of these Police Officers. Nine of the 13 Police Officers that used deadly force against these two individuals filed a federal lawsuit saying they are victims of racial discrimination. Eight of those that are the claimants in this are white the ninth is hispanic. That is still on going right now. They charge that because they are not africanamerican that they are disciplines more severely than if they were africanamerican Police Officers. The main instance in this is the cop who made the original stop that triggered this chase eventually and decided not to do anything was africanamerican. He was not involved in any of the shooting. These guys the punishment theyre crying about is 16 months of limited duty. Theyre involved in an incident like this and that to me is you cant call that severe punishment. You cant call that the other thing about them is they give up their own guy. Clearly both sides feel wronged. One thing we can determine is there is a problem in this city of cleveland between some in the Police Department and some in the community, and theyre working to repair that. Lets hope so. They filed this lawsuit the same month that tamron rice was shot and killed. Right after that happened they filed this lawsuit. So hopefully everybody is working together. This particular bunch of Police Officers i dont know. Michael daly with the daily beast. Thank you. Well be right back. A funeral will be held on tuesday for an omaha Police Officer brutally murdered one day before she was supposed to start her Maternity Leave. 29yearold kerrie or rose cowas a new mother given birth to a premature baby back in february. She was so excited for her daughter olivia ruth to leave the hospital this week. In a cruel twist of fate she was shot and killed by a fugitive before she could bring home her baby girl from the hospital. We want to honor her, remember her and talk about what she was like. Joining me kerries friend brunettea and officer terry who worked with her in the gang unit. Detective, she was described by one of your colleagues on cnn yesterday as an angel. Is that what youd call her . I think thats probably the best description, just a selfless person. One of the better people ive ever met in my lifetime. This is a woman, detective you know the dangers of being a Police Officer. You run where everyone else runs away. You put yourself in the line of fire literally. Thats what she did less than 24 hours before she was supposed to go pick up her baby girl. It seems to me like shes someone who wouldnt even flinch who wouldnt say, no, you go because i have a new baby. Thats exactly who kerrie was. Kerrie considering the circumstances, she was so smart and she wanted to save her time so she could spend as much time as she could with the baby but she also had so much love pour the Police Department. For the citizens and for the people that she had the opportunity to interact with both on duty and off duty. Youre absolutely right. She was all in no matter what she did, on duty or off duty. Renetta, what was she like as a friend . Kerrie was very excited about being a mom, and she even until she gave birth, kerrie was involved in volunteering with the community to ensure an annual gala we do supporting Special Olympics nebraska she wanted to make sure that event was carried out smoothly and we were able to raise funds. Kerrie was we would talk about our dreams and our goals. We would talk about our families. There was a time when kerrie first met my children she ran back to her car to grab little Police Officer sticker badged. She was just always ready to smile, to meet any and everyone always helpful. We would text early in the morning, late at night. She was always concerned about the community and the event. Once she had her little baby girl she would text me pictures like at 11 00 at night, at midnight sharing just the cutest intimate photos and moments. She was just always so loving so humble so quiet and so involved. So involved. Thats what we heard, so involved was volunteering with the community, helping everyone as much as she could. Detective, can you tell me about the tshirt youre wearing . I know that has some significance. Support blue First Responders foundation. What the First Responders foundation is doing, theyre going to support kerries causes give people an opportunity to give back. Thats what the family wants, is for kerries legacy of service to carry on. Thats what we all want. I think thats what gives me peace and is helping me deal is that her legacy will live on through service and giving back to the community and to the Police Department. Right. As my colleague and one of our contributors michael daly was saying, what we owe that little girl is to do something to hon orr her mother and to do something to help the Community Just like she did. Vernetta i know you guys are working with people in the community to try to raise money to help the girls, right . Right. Tell me about the effort and for people who are watching if they want to help how they can do that. They can give back through the omaha Police Department. Theres a Facebook Page that has all the direct links. I believe theres two organizations right now that are accepting donations thats going to support olivia ruth and her family. The talk i hear from other Police Officer peers is some officers are also donating portions of their paycheck towards a fund a trust fund for olivia. So see that communication happening and to see that dedication happening amongst her friends, her officers its just tremendous. Its unspeakable. The Omaha Community is a wonderful community, and theres been citizens that have donated food. Theres been businesses that have donated services to help with funeral arrangements. Theres been businesses offering accommodations to help with family. Its just tremendous. Detective, let me ask you this youre a Police Officer. Were covering this situation involving a Police Officer and tension between some Police Officers and their community in cleveland. Today it has erupted across cities across this nation. I wonder if you can speak for a moment from the Police Officers perspective of what thats been like for you as an officer and also holding up someone who was an ideal officer also for people to see. Its definitely been very challenging. But i think what it shows the importance of, of service. Kerrie embodied service. It shows the importance of community policing. I think in omaha we have a lot of organizations that have done a fairly good job of bridging the gap and getting involved in the community and letting them know that we care. Your build those relationships to where citizens are able to see the person behind the badge and vice versa, police are able to see the citizens more than just suspects witnesses or victims thachlt see them as people. I think we do a pretty good job here in omaha. We still have work to do. The hope is to carry on that legacy of service and build those bonds. Detective Marcus Taylor vernetta cossack ka thank you for helping us and everyone remember her. Thank you. As we mention, this fund has been set up to help support kerries various causes especially for her little girl olivia ruth who was just born. It gets rid of the controversial section 215. This is sort of the compromise that president obama supports. His attorney general Loretta Lynch on friday explained why. Our biggest fear is that we will lose important eyes on people who have made it clear that their mission is to harm American People here and abroad. You think it makes america less safe . I think we run the risk of essentially being less safe. Here is important context. While she was states attorney in the Eastern District of new york Loretta Lynch prosecuted the most terrorism cases out of any department across this country in the wake of 9 11. Republican senator rand paul and other critics say the patriot act is so bad that it cant be fixed and it should go away. We have entered into a momentous debate. This is a debate about whether or not a warrant with a single name of a Single Company can be used to collect all the records, all the phone records of all the people in our country with a single warrant. Our forefathers would be aghast. Congressman mike quigley joins me now, democrat from illinois member of the House Intelligence Committee. Thanks for being here sir. I appreciate it. Thank you, poppy. Glad to be here. What do you say to rand paul who say our forefathers would be aghast that this is not what this law was intended to do . I think our forefathers would understand this is a very scary world right now and theres a balance to be played. Usa freedom act got it right. It was a rare bipartisan victory in the house with the president s support. It protected our constitutional freedoms while protecting our country and our troops. I have no idea why mr. Paul is taking this action. Hes certainly campaigning, not governing. Hes taken this position for quite a while. When you look at this one thing rand paul points out is this, he says why hasnt the president used the executive authority he has to end the program . Why hasnt he stood up and done that that . I think when the president acts and tries to do unilaterally they attack him for usurping authority. He gets criticism from senator paul as well. It makes no sense. We had a great opportunity to get the right thing done here. Its so rare to have a victory. Unfortunately senator paul saw it otherwise. You said we had the opportunity. Senator mcconnell is calling the members back the day before this expires on the 1st of june. Do you think the window is closed here . Do you think theyre not going to come to an agreement . They certainly havent shown that capability. You have to understand you dont shut these programs off like a switch. Theyre already starting to phase down. Not only did we lose important intelligence capabilities to keep our country safe we also lost what senator paul should be championing, an opportunity for muchneeded reforms, reforms that hes talking about. He also has to acknowledge the fact that there were two other provisions in here besides the gathering of data including the lone wolf provisions which are extraordinarily important. Does anyone think in this country now that were more safe than we were before that there arent more home grown extremists out there plotting against this country, there arent more lone wolf terrorists out there right now plotting in cities like my own . Let me ask you this this isnt saying the government can never listen in to these peoples phone calls it says they have to get the authority from the court to do it instead of bulk collecting data without authority. The government hasnt been able to show where its played a key role in thwarting a terror plot. Is there one you can point to sir . Its really interesting watching this process through the Intelligence Communitys eyes in the last six month. The Intelligence Community takes a boating on measures like this. The fact of the matter is a lot of times theyve had victories, they cant exactly have a press conference. When they talk about how theyve done Something Like this point to exact examples theyre giving away the keys to the kingdom, giving away the game book. You sit on that committee. Are you saying yes, in deed there have been instances but theyre classified . I think that there are instances in which all three of these provisions have kept our country safer. I think with senator pauls actions, this country is less safe than it was before. Congressman mike quigley, we thank you. Last night was very special for the family of fallen troops. When you think of florida, you naturally think of sunshine and oranges. This may surprise you. A whopping 95 of florida oranges are squeezed into juice and one quarter of that is exported to places like south korea, canada and japan. Almost 100 years ago in 1922 a florida farmer named deeley hunt planted a single seed that would lead to 5,000 acres of citrus and a business that would change a family tree forever. In cleveland, ohio the mayor is asking the people of his city to remain calm after a controversial legal decision raising tensions and emotions. Protesters in cleveland are out. A small but upset Group Walking block to block, some blocking heavy traffic on a cleveland highway, and this group who gathered outside the county prosecutors home. At least one protest sign reading cage killer cops. Here is the reason for the high emotion in cleveland. This morning a Police Officer acquitted on all charges stemming from the shooting death of two unarmed people in 2012. This is the car that officer Michael Brelo and several other Police Officers fired into after a 22mile highspeed pursuit. Brelos defense team argued it could not be prove then he fired the lethal bullet and a judge agreed that this killing was justified. Cnns ryan young is live in cleveland following the verdict for us. What are you seeing there, ryan . Reporter right now only a small group of protesters are left. Were told more protests are scheduled for the weekend. A wide gamut of emotions throughout this afternoon. Weve seen people take to the streets, marching through, stopping traffic. It has remapd peaceful as people were raising their voices. One of the things weve been doing is talking to people directly involved in this case. Jackie russell is the sisterinlaw to tim russell who was in that car that day. A lot of people have been talking about the shots that were fired. When you saw the verdict you were in the courtroom, how did you feel as the judge was giving his sentence . Well i must say that we were not surprised, not at all that it was a lot of not guilties. Of course we were expecting for him to be convicted of at least one of the counts you know. We feel as though basically the judge basically gave him a pat on the back and said good job for shooting these people good job for standing on top of the hood of the car. Thats acceptable in the police force, thats acceptable in the community to stand on top of a car and shoot down into the victims, multiple shots have already been fired. When you hear the police chief and the mayor say these officers could still lose their job, does that give you any solace at all, or are you still upset of the fact that he was not found guilty on any of the charges . I think that some of the officers should definitely lose their jobs. I think definitely brelo is one of them. I dont know if it gives us solace or any sense of victory or justice, you know. We lost our loved ones. Theyre no longer here. So we were expecting for the Justice System is set up is that its supposed to give you justice for crimes committed. We didnt get any justice. Were without our family members. You talk and how long this last two years has been. Can you describe to everybody at home maybe how difficult this has been and then to get to this day and walk away empty. Its been a long journey for us emotionally. Its been you can grieve over a death in your family you grieve. Things start to get back to normal a little bit. With this case weve constantly had to relive it throughout the twoyear process, this two and a half year process, weve had to relive this expecting justice for our loved one and we didnt get zblit Community Members say theyll be protesting some more. Only a small group behind us. Were told sunday and monday more people will take to the streets. Ryan young, thank you very much. Appreciate it. Lets talk about it with our legal analyst Danny Cevallos also with us tom fuentes, former fbi director and former Police Officer. Danny, let me begin with you. What is critical here when you heard the judge set the scene before he read his verdict. He said this is an environment where you have ferguson Staten Island the Michael Brown case et cetera. He said if hes not guilty im eve not going to throw him out to people who want justice because of whats been happening across the country. What did you make ef the judges claim that because the officer feared for his life believed people were armed, he was fully justified and the killing was constitutional . Well, the justification, poppy, is a tail end of the opinion. There are two reasons for this acquittal, the first is the judge couldnt find beyond a reasonable doubt the element of causation. To boil it down the judge said even though the officer took he believes beyond a reasonable doubt he believes one of his shots was a fatal shot he could not find beyond a reasonable doubt that the other shots that came from other officers which were equally as lifethreatening equally as fatal, were the ones that caused the death. Its a fascinating discussion of causation in this opinion. And then only after that does the judge discuss the affirmative defense of justification, the 120mileperhour chase, the side swiping police cars the driving right at Police Officers and then concludes that, in addition to failing to prove causation in this case the justification was because this officer reasonably believes that he or other brother officers were in fear of eminent serious physical harm. Tom, when you look at 137 shots fired, what do you think . I think the number of shots sounds excessive, but to dannys point, if theres justification for the use of Deadly Physical force, it doesnt limit whether its one shot or 137 shots. At that point the officers will continue shooting until they think the threat is over and oftentimes under a high stress situation, if youve been driving ive been in highspeed pursuits. Its extremely stressful and youre very wired at the end of that. What would happen is typically officers firing shots would be unaware of an officer standing right next to them firing shots and wouldnt realize that that many had gone out. So thats part of the problem in these things. It always sounds excessive, but an officer firing his or her own shots would really not know all of the other shots being fired or be aware of it only be focused on the threat that theyre facing. You bring up these other officers. There were 13 in total. So 12 of the officers. Danny, i wonder what you think in terms of what they may face in the Justice System in terms of what this verdict does for their cases. Well their cases from the beginning you had all of these officers firing off all these rounds and one officer indicted. From the beginning you could see this was always going to be an issue of causation. In theory according to those officers, they would each testify that each one of those shots was justified. When officers shoot, they dont shoot to wound. Theyre shooting to stop the threat. I should add, too, another issue. We heard other people talking about how this officer jumped up on the hood of the car to fire into the car. Whats fascinating, poppy, in this opinion is that there was testimony, expert testimony that it was against the general training of Police Officers to jump onto a hood and shoot people. But in spite of that the judge still found that the reason thats against training is not for the safety of civilians, but for the safety of other officers. That is some very interesting logic. Danny cevallos tom fuentes, thank you. Poppy, if i could add to that quickly, the reason he would have done that when youre trained in shooting at a car, the bullet will ricochet off a windshield. Hes trying to have it so its not at an ang and firing bullets off into the distance but having it perpendicular to the window so it would penetrate. Thats what the rationale would be forgetting in the hood and shooting down into the windshield. Thank you very much. Well talk a lot more about this. Appreciate it. Including this, the defense attorney representing the Police Officer in this case what he had to say in the immediate aftermath of that verkt, and the mention of the naacp. Well talk about that next. Boy once upon a time, there was a nice house that lived with a family. One day, it started to rain and rain. Water got inside and ruined everybodys everythings. Reporter the timing of this case is important when were talking about the cleveland verdict that just came down. It comes at a time in america when the relationship between some Police Departments and the public is very strange. The judge in Michael Brelos verdict today reading today specifically addressed that. Listen. In Many American places people are angry with mistrusting and fearful of the police. Citizens think the men and women sworn to protect and serve have violated that oath or never meant it in the first place. Some of these places are long familiar new york city and baltimore. Some were unfamiliar until incidents there laid bare the divide between the people and Police Ferguson missouri North Charleston South Carolina. Lets talk about it with cnn political commentators ben ferguson and marc lamont hill. Thanks for being here. I certainly stopped in my track when the judge opened like that talking about the National Environment. Marc what do you think . Did he need to preface his verdict with those comments . I think so. I think we tried to pretend that jurors are somehow objective and operating in a vacuum outside the broader social context. The truth is jurors everyday citizens and the judge have to think about this against the backdrop of whats happening in america. I think theres also a very practical concern that whatever happens today in this courtroom is going to be seen as in conversation with ferguson in conversation with baltimore, new york l. A. Charleston, et cetera. I think it was important to lay that out. Even if i disagree with the decision, i think the ultimate point here was a significant one. Ben . I think it was very responsible by this judge to put this in context and to remind people that theres no reason for this to get out of hand in the streets or for there to be riots or cars set on fire whatever it may be. He obviously wanted to remind people this is our city, weve got to take care of it. Yes, we have people upset with certain things. He may not agree with what the decision is today, but we meade to take care of our city. Thats a smart decision for this judge to do. I want you both to listen to what officer brelos attorney his defense attorney said in the courtroom to the media right after the verdict was read. Listen. I hope that all the naysayers out there, all the socalled plaintiffs lawyers claim theyre civil rights lawyers and never have tried one of these damn cases to a verdict, but are out there for a money grab all the time. Officer brelo, it was the judges opinion set forth, risked his life on that night. So he talked about risking his life on that night. Whats your reaction to it marc . I dont doubt that officers risk their lives every day. It comes with the job, and thats a different conversation. Thats not to dismiss or disrespect what officers do. The question is is there Excessive Force, number one . Did this person go too far . Also theres the question of what does a comment like that do . It dismisses and disrespects people every day advocating for black, brown and white killed every day by law enforce most people arent out for a money grab out there to cheat or steal money. Theyre out here to advocate for people on the underside of american democracy. I think what he did just there is race baiting, dog whistling and dangerous. Dont disrespect all these people dieing in the streets. Ben, he brought up the naacp. What do you make of those comments right after this verdict came down . Obviously hes very passionate about his client and feels his client was given a very bad deal here and his life is going to be changed forever and he feels like his client risked his life by getting in front of that car, jumping on top of the car to make sure the angle of the bullet wouldnt ricochet so his partner and he wouldnt be killed. At the same time, it doesnt mean just because you think the right time to say it would be right now. Be glad the verdict came down and your side won and walk away with a little professionalism and class. If you talkhave those moments, talk about it later. This is not the right havent you venue to discuss it. Say were glad this came down the way it did we agree with the judges decision my client is going to try to move on with his life. This was not the time to start a war in my opinion. Ben, marc, thank you very much. And thats why people are angry. Stick around. Well talk much more later in this hour. Quick break. Were back in a moment. The fit nation team is halfway that their goal of competing in the nautica malibu triathlon this september. Tensions are running high as tens of thousands of motorcyclists gather at different rallies this weekend across the country, this after a texas Police Bulletin warned that some of those biker gangs may be plotting attacks on police. The warnings come almost a week actually a week after a deadly biker brawl in waco texas, youll remember last sunday that killed nine people. More than 170 were arrested. Police confiscated hundreds of weapons ranging from high powered assault rifles, talking one ak47 to chains with padlocks attached to them and knives. Lets talk about all this and the real threat versus perhaps the real threat. Jay dobbins is a former atf agent who went undercover with the hells angels for two years. He wrote about it in his book no angel. Thank you for being here. I appreciate it. Thank you. I had a former navy s. E. A. L. Former fbi agent on the show yesterday who said look you guys the media are grouping all these bikers into one and thats not the case. This is a real minority of them. He said most of them who have weapons, theyre legal weapons. You were infiltrated, undercover with the hells angels for two years. What do you make of that argument that perhaps some of this is hype . I give it the assessment that most of the people that are riding motorcycles, huge majority of the people and the clubs that are out riding motorcycles, that are enjoying the weekend, are not criminals are law abiding citizens. Its the few gangs and gang members that cast a taint under the umbrella of all bikers. So what did you see in your two years under cover . I saw violence extreme levels of violence intimidation power struggle, struggle for notoriety and for acknowledgment. But that was also witnessed amongst people that just had a love of the romanticism of riding a motorcycle. There are a lot of these rallies happening this weekend, some in texas, for example. Some of them got canceled. Youre looking at a map where a lot of these are taking place. Do you think people should be concerned about a potential attack like was noted in that texas Police Bulletin that they believe not only some Police Officers were being targeted this weekend, but also potentially even some of their family members . Absolutely they should be concerned. I take the threats against the Law Enforcement officers with 100 credibility and 100 seriousness. They have the ability to act in that manner. They have the tools of the trade to conduct those types of assaults and i think for anybody out there, you need to be aware of your surroundings and who youre with and who is nearby to stay safe. What kind of role do you think establishments have in all this . Theres been a lot of criticism thrown at the twin peaks restaurant saying they got warnings from Police Officers et cetera, they shouldnt have been allowed to gather there. They sort of encouraged gatherings like this. Anything wrong with that . Well they have an obligation to their entire clientele in my view. If they want to shut their doors down and only let certain people in i cant tell them how to run their business. But if youre running a Family Business where people from society are coming in that are unaware of their surroundings or who they might be with i think they have an obligation to keep all their clients and customers safe. Now were keeping an eye on pretty small and calm protests in the streets of downtown cleveland. This follows a verdict handed down earlier today in a case involving a 2012 Police Shooting. Just hours ago officer Michael Brelo was acquitted in the deaths of an unarmed couple back in november of 2012 their names Timothy Russell and Malissa Williams they were shot at close range in their car after a highspeed 22mile police chafe. Brelo and 12 other officers fired a total of 137 shots at their car. After the car backfired, officers say it was actually the sound of a gunshot. A short time ago clevelands police chief urged protesters on the streets to refrain from any violence. We are trying to ensure people exercise their First Amendment rights but within the bounds of the law and whats decent and necessary in the city. People that commit violent acts be it against property or persons, wont be tolerated. Following the not guilty verdict, the department of justice weighed in saying lit review the case. Cnns athena jones explains how that will work. Poppy, we do have a statement from the department of justice prrks from the head of the Civil Rights Division along with the District Attorney for the Northern District of ohio and the special agent in charge of the fbi office in cleveland. They say we will now review the testimony and evidence presented in the state trial. We will continue our assessment review all available Legal Options and will collaboratively determine what if any, additional steps are available and appropriate given the requirements and limitations of the applicable laws in the federal judicial system. Now, i want to note that they have already been monitoring this case monitoring the investigation from the very beginning, from back in november of 2012. So now theyre conducting this review. I should mention this is not a fullscale civil rights investigation by the Justice Department. This is a review. We dont yet know what the results of that review will be but its important to note that if there were to be a fullscale 1i68 rights investigation, that the bar in those cases for pressing federal charges is very very high. Two recent cases that got a lot of attention, the shooting of Michael Brown by officer Darren Wilson in ferguson missouri last summer and the shooting in 2012 of Trayvon Martin by george zimmerman, those cases were both investigated by the Justice Department. No federal charges were brought against the shooter in either case. Its an important thing to keep in mind as they begin this review which well be watching to see the results of. Back to you, poppy. In touch magazine broke the story. Total of five victims, the ages if you do the math the ages range probably between 5 and 12 years old. In touch magazine obtained the 2016 report. The magazine reports that josh duggar was investigated for multiple sex offenses including some that were felonies. His father told police he was aware of it in 2002 when a girl reported josh had been touching her breast and genitals while she slept. Instead of alerting authorities, the magazine said jim bob told police josh had been disciplined. Then it reportedly happened again in 2003. In a Statement Released thursday josh duggar said 12 years ago as a young teenager i acted inexcusebly for which im deeply sorry and regret. I hurt others including my family and close friends. What his statement doesnt say is his parents didnt tell police about what happened until one year after their son confessed to them, one year. Even then they reportedly alerted an Arkansas State trooper who was also a family friend. That trooper didnt take any official police action. Instead, the magazine says trooper Joseph Hutchins gave josh a very stern talk. Hutchins, by the way, is now serving 56 years in prison for child pornography. Police only started investigating in 2006 after an anonymous letter to the Oprah Winfrey show warning producers if the duggars appear on oprah she would be embarrassed. Oprahs team called the child abuse hotline and police started asking questions. In touch reports one of the victims told police in 2006 that josh told mother and dad what happened and asked for forgiveness. All of this has fans of the familys hit show reeling. The duggars are devout christians. Josh duggar also worked as executive director of frc action the Family Research council, a group known for advocating against the rights of the lgbt community. It also said gays pose a danger to children. Josh also backed his mothers work opposing an ordinance designed to protect transgender people in arkansas. She compared transgenders to child predators. Considering what hes done in his past its hypocrisy. Josh duggar stepped down from the Family Research Council Thursday and tlc pulled 19 kids and counting from the tv schedule. Randi kaye, c nfrmgtsn, new york. Several highprofile gop candidates posed for photographs with josh duggar of course long before the scandal broke. He also posed for a photo with president bill clinton in 2011. Lets talk about this more with our political panel, ben ferguson and marc lamont hill. Mark marc is this an issue for some of those gop candidates or hopefuls . I hope not. There are a millions of reasons to criticize republicans and democrats. Standing next to a Television Star you had no way of knowing was involved in these disgusting disturbing and illegal acts i dont hold them accountable. I hope instead we focus on how to get this person treatment, how to right the wrong and how to find justice for the victims. Thats what we should be doing right now. Ben, i think its interesting Mike Huckabee came out with this really long facebook statement, an extensive one yesterday. He wrote, joshs actions when he was a teen are inexcusable, but that does not mean unforgivable. He and his family dealt with it and were honest about it with their victims and the authorities. No purpose is served by discrediting josh. To see a president ial candidate come out so quickly to support someone who has apologized for child molestation. I totally disagree with Mike Huckabee on this one. I dont know why he thought this was a reason to put this out there in a way defending him. You can forgive someone, yes. But the fact of the matter is first of all, the family has committed a fraud, not only against the network theyre on but everyone theyre on stage with taken pictures with, en dorsed or worked with because they were not honest with authorities early on. They did not do the right thing with their son early on. They allowed it to happen again, which is also a massive problem. If youve ever known someone thats been sexually abused as a child or molested you understand how long that stays with them. And i think its disgusting that this family covered this up. Apparently he also did not tell his employers about this behavior and they did not handle this the way theyre supposed to. Ive never been a big fan of this family. Ive always thought its been a little weird the way they act. I think they can somehow claim god and the bible and this is all going to go away and if people criticize them theyre going to claim theyre being criticized because theyre christians. No let me make this clear. Youve been criticized because you were incredibly stupid for the way you handled this. Ben ferguson with the win today the children were molested and fondled. Dont use the bible to hide behind this. Thats the thing. Look they waited so long to go to the authorities, went to an authority who was apparently friends of the family, never reported it or brought it up the ranks, and its a tragedy for the young girls who were molest zbld here is the thing let me make it clear, they cared more about a tv show than they did about doing the right thing for the victims here. Cared more about getting paid than they did about the victims here and cared more about their family being bigger deal in public than they did about the victims here. They should have the show canceled immediately. Guys got to leave it there. Thank you. Warren buffett penning an op ed in the wall street journal yesterday talking about minimum wage. Is raising it the solution or not . Well talk about it next. 40 of the streetlights in detroit, at one point, did not work. You had some blocks and you had major thoroughfares and corridors that were just totally pitch black. Those things had to change. We wanted to restore our lighting system in the city. You can have the greatest dreams in the world, but unless you can finance those dreams, it doesnt happen. At the time that the bankruptcy filing was done, the Public Lighting Authority had a hard time of finding a bank. Citi did not run away from the table like some other bankers did. Citi had the strength to help us go to the credit markets and raise the money. Its a brighter day in detroit. People can see better when theyre out doing their tasks, young people are moving back in town the kids are feeling safer while they walk to school. And folks are making investments and the community is moving forward. 40 of the lights were out, but theyre not out for long. Theyre coming back. I ask because that is what the richest congressman in the United States told my colleague christina al learn she. Listen. America is the richest country on earth because weve been able to put capital together and been able to make our poor somewhat the envy of the world. If you go to india or you go to any number of other third world countries, you have two problems. You have greater inequality of income and wealth. You also have less opportunity for people to rise from the havenot to the have. The quality of public education, the availability and access. I think america is a good example. Can we do better . I think we can. I dont think the comparison is one we want to make. We dont want to compare ourselves to india. We want to set the bar pretty high. I appreciate your comment, but youre wrong. You do have to compare yourself with the rest of the world. We compete with the rest of the world. Congressman issa called out the critics who called his remarks insensitive. He wrote, quote, the median poor family in the United States live in an air conditioned Home Cable Television cable or satellite tvd, dvd and video game system. The annual salary of 14,500 a year. Far below the Poverty Level for most families of four. A number of cities and states raising their minimum wage to as high as 15. Los angeles voted to raise the minimum wage to 15 by 2020 the largest city yet to make the move. Also this week thousands of mcdonalds workers protested for that same 15. 00 minimum wanl. They protested outside the companys annual shareholder meeting. My next guest says the best way to close the gap between the haves and have not. Rana fru har is cnns Global Economic analyst. Thank you for being here rana appreciate it very much. Lets begin with this. Make the economic case that raising the minimum wage actually improves the economy, improves things for people that need it most and doesnt cost them jobs. Well all the research at this stage really shows theres not a huge cost to raising the minimum wage. And that comes from the congressional budgetary office. Thats something thats partisan. Going to how the average poor family in america has an air conditioned home flat screen tv. Sure those kinds of consumer goods have been falling in price t. Thing is the elements of the middle class life education, health care are actually going up. So getting yourself up the rungs of the ladder socioeconomic cli is harder and harder. I was with a mother in bridgeport connecticut, she lives in section eight housing. Food is getting more expensive every day. Walmart said they raised their minimum wage to 9. 00 in april, going up to 10 for all their entry level workers. Their Earnings Report came out, got hit. Pretty significantly they say as a result of raising the wages. They did say they expect raising wages to have a longterm positive impact because their employees will spend more money. It does take a toll on business. But it does take a toll on business. Yeah. Well ill say two things. First of all, the corporate share of the overall market pie in this psychiatry at record highs. Im not weeping for walmart or any of the fortune 500. The labor share is at its lowest share in decade. That actually affects Companies Like walmart because this is an economy made up of 70 consumer spending. The same people who spend at walmart need in any their pocket to spend. This is not a onesided story. A lot of people who feel if we got get wang wages up beyond fwhaen an hour we wont i think raising the minimum to 15 an hour is a great first step for families that are struggling or below the poverty line. Thats not going to solve the questions. I want you to hear some of this. Warren buffett, smart guy, a guy whos a liberal, supported president obama wrote an oped in the wall street journal yesterday about minimum wage. He wrote, quote, in my mind the countrys economic policies should have two main objectives. First, we should wish in our rich society for every person who is willing to work to receive income that will provide him or her a deig ent life siel. Second, any plan to do that should not distort our market system. The key element required for growth and prosperity, that second goal grumcrumbles in the plan to sizably increase the minimum wage. I may wish to have all jobs pay at least 15 an hour but that minimum wage almost certainly would reduce employment in a major way. What he says is the solution lies in a dramatic change to the earned income tax credit something that already exists but should be expanded. It encourages people to work. When they file their taxes he thinks they should get more money back as a result. And he says at the same time that maximizes employment. Is that a better solution . Earned income tax solution i think is a great solution. I think people would like to see it expanded way beyond where it is now. I think theres not one Silver Bullet here. Raising the minimum wage is a great idea. He argues that will limit employment. I actually disagree with that. I think you can look at research by folks like allen blinder, former vice chair of the chair. Other thats would disagree. It will hit certain do is particularly at the lowernd but i think the spending power that creates and the stability economically that creates would be a great thing. But frankly we have bigger fish to fry here. By raising the minimum wage to 15 an hour that doesnt create the big massive middle income jobs. You talk that about that in your piece. You think that the shrinking middle class is even a bigger problem. I do. Because frankly, 15 an hour even that doesnt get you to a stable middle class life. You really need 25 an hour 50 an hour jobs. Those have been going away. We have jobs at the top for phds, six oust the top ten Fastest Growing top categories are at the bottom. We need those jobs in the middle. Certain local communities are doing an interesting thing. Youre seeing a revival of small manufacturing in detroit. Cleveland has a new coop system where theyre pouring foundation mp into small businesses. There are sluss out there. Why should people care about this . Because it affects the entire growth of this economy. If we dont get people having more money in their pocket then everybodys business is going to suffer. The overall recovery which frankly is still the weakest and lowest one in postwar era will stay weak. Its true. Its taken us longtory get out of this recession than preefrs recessions. Do you think this will be issue number one, two or three in this campaign . Economic issue number one. Youre hearing Hillary Clinton to start to talk about this. Youre hearing republicans start to talk about it, too, which is very interesting. Absolutely. Paul ryan went into poor communities took a tore through them. Absolutely. Its going to be really interesting to see first of all how republicans go beyond trickledown economics which most people feel are broken at this stage and also how Hillary Clinton goes just beyond the 15 an hour and redistribute wealth conversation of the democratic party. She needs to talk about, how are we going to reshape the tax system so were not just rewarding the wealthy. She may have to distance herself and step way aside from that this time around. These are ghosts from the past that will have to be dealt with in the future. A fascinating piece in time. We appreciate it. Well be right back.
