Senator schumer laying out his proposal for this. Do we have any sense whether Mitch Mcconnell will accept that proposal . Its highly unlikely that he will. This is going to be the start of negotiation. Of course as you mentioned, a momentous week in the house beginning with that wednesday vote, but there will be steps needed to be taken before we reach that historic vote on wednesday in which the president will be the third president in history to get impeached by the house. There are procedural steps that have taken place last night. The House Judiciary Committee released its report detailing its findings wrapping up everything that occurred during the twomonth investigations and why the democrats believe the president should be impeached and removed from office tomorrow the rules committee will meet to discuss the floor debate on wednesday. In the hearing the chairman of the House Judiciary Committee, jerry nadler, and Top Republican on that committee, doug collins, expected to field sharp questions from fellow members on that committee and that historic vote on wednesday in which the president is going to be set to be impeached. Ultimately the question in the house is how Many Democrats ultimately vote for impeaching the president on two counts, abuse of power and obstruction of congress, relating to his handling with relations to ukraine and whether he leveraged his office to push for an investigation by that country by his political rivals. Slotkin a democratic freshman, announced her support for the two counts of obstruction, two counts of impeachment and we expect more of those vulnerable democrats to come out and support, so ultimately democrats may lose a handful of votes on the floor but it will still be more than enough to impeach the president which is what well be looking for on that historic vote on wednesday, guys. All right. Also manu, before you go, it looks like, according to sources, cnns reporting, is that new jersey congressman democrat this morning, jeff van drew, will switch his party affiliation, will become a republican, talk to the president about this over the weekend, six people who work for him resigning because of it. What can you tell us . This has to do with his personal politics, the question whether or not he could even win a democratic primary including the positions he has taken, coming out in opposition to the impeachment inquiry. He was one of two democrats to vote against moving forward on the impeachment inquiry. He has made clear he planned to vote against both counts on impeachment on the floor of the house and privately all weekend hes been on the phone talking to fellow new jersey democrats about his decision to switch parties. The president urging him to switch parties and we expect him to do and as you mentioned, the six staffers resigning really leaving be a hole in this office, this freshmans office. These staffers put out a letter saying that sadly, congressman van drews decision to join the ranks of the Republican Party led by donald trump does not align with the values we brought to this job when we joined his office. We will see what he has to say when he returns to washington today or tomorrow. Guys . Manu on the hill, thank you very much. Cnn National Correspondent Suzanne Malveaux with more on the impeachment trial negotiations going on in the senate now. So schumer has put out his opening position in effect in these negotiations, but we do know that there are republican senators who might bristol at the idea of denying these witnesses. Where do those negotiations stand now . Already theres controversy about this. Were a couple weeks away from a senate trial, schumer putting out this letter to Mitch Mcconnell and others saying essentially that warning against this becoming a show or a circus, but also calling for more witnesses as well as new documents, really going bigger, if you will, against mcconnells wishes. On that wish list of witnesses, he is calling for bringing forth acting chief of staff Mick Mulvaney, john bolton, their aides, robert blair and Michael Duffy of omb, following the money and where the money went, the delay and how it was released and then also just lining out a timeline for after the new year. Youre talking about january 6th, pretrial measures to be established and adopted as well as the following day the swearing in of chief Justice John Roberts and senators and then two days after that, the house managers making their presentations. The president s counsel also its rebuttal. Some restrictions when it comes to these presentations. 24 hours for the opening presentations and the rebuttal, 16 hours for the questioning of the republicans and then the democrats, all of this schumer making the case he thinks this is a process that will be fair to both sides. Yeah. A lot of them based on how it played out in 1999 with the clinton impeachment. Tell us about Mitch Mcconnell. He has said openly hes coordinating with the white house. Now if you look at precedent, there was some coordination between democrats and the Clinton White house in 1999, but not the majority leader. What are you hearing on the hill here . How much further is mcconnell going here in effect . Well, jim, i covered the bill clinton impeachment proceedings and it was nothing like this. What we have seen be open and blatant statements that both Majority Leader Mitch Mcconnell is making as well as senator Lindsey Graham. Listen very quickly to what graham said over the weekend. I am trying to give a pretty clear signal i have made up my mind. Im not trying to pretend to be a fair juror here. So really setting this up for a partisan food fight, divide if you will. You have schumer saying that this is demeaning to graham and that history will treat him poorly, saying it was totally out of line for Majority Leader Mitch Mcconnell to say he will do anything the president wants. As you know this is something theyre going to look to history, going to look to previous precedent and how they behaved before. We expect that its going to be just as ugly this go round. Jim and poppy. Suzanne, thank you very much for all of that. Lets talk about it with our legal analysts. Good morning to you both. Lets listen to senator schumer. He was on with new day moments ago. One thing that struck me from why he thinks that his demand for these fact witnesses to appear before the senate may get some republican support. Heres what he said. I expect some of my republican colleagues when they see this letter say thats fair. They dont want to be part of a coverup. Mcconnell needs 51 senators to do anything. When you think about a Lisa Murkowski or a Susan Collins and the makeup of their state and the actions they took in the kavanaugh proceedings, saying lets pause and consider more evidence here, is he right . Do you think its out of the question that any republican senator would agree that hearing from a john bolton or Mick Mulvaney is important as impartial jurors in this process . I think its very, very unlikely and lets keep in mind, i mean this is only a third time in United States history this has happened. Theres not that much in the way of precedent, but i think one of the things that republicans will cite is the clinton precedent where there were no witnesses who actually testified before the senate. There were motions to dismiss and then a few depositions and then they went right to closing arguments. I think republicans will cite that as precedent. You know, its i think as americans, its not how we would probably like to see the process go, but, you know, thats likely how its going to go this time. I would be surprised if any republicans sign on to the witnesses. Lets acknowledges the differences though, asha, you did not have a concerted effort to block all witnesses in the house portion of the clinton impeachment investigation and after all the president testified and thats something this president has refused to do. Thats right. The factual scenario and clinton was very different than it is now. You also had a very lengthy investigation by Kenneth Starr where there were underlying interviews and depositions and a lot of fact gathering that could be relied upon whereas, as you mentioned, jim, here, very basic fact witnesses have not been allowed to testify and i would argue that precisely because one of the articles of impeachment is abuse of power, the use of the office of the presidency, that what the president did, any direct orders that came from him, that affected whether or not aid was released, for example, really matters here and i think for some senators, maybe important even if they want to acquit to say we heard the evidence and we have waited, whether or not they want to take that oath seriously remains to be seen given the reporting we heard from graham and Mitch Mcconnell. Overnight, the House Judiciary Committee put out a 600 plus page report on the articles of impeachment. It basically accompanies them throughout this process. And let me read part of it. Quote, President Trumps abuse of power encompassed the constitutional offense of bribery and multiple federal crimes, he has betrayed the national interests, the people of the nation and should not be per p permitted to be above the law. In the articles themselves they did not include words like bribery or lay out bribery, extortion as crimes. They went with the broader abuse of power. Why do that in this report and what effect does it have . Yeah. Talk about burying the lede. Constitutional standard for impeachment includes specifically the word bribery. Right. As you note it wasnt included in the articles and it was included in the report. Its an effort by the judiciary and democrats to have it both ways and i understand why. If they put bribery in the articles of impeachment, then will be held to the standard of bribery and the republicans will say well, you know, you havent met all of the elements of criminal bribery and so now what the democrats can say is, bribery is encompassed by the very serious offense of abuse of the public trust and its included, but they need not prove all of the elements of bribery or the other criminal offenses. I remember, though, asha, and youre both lawyers so you know this better than me, specific lines of questioning from adam schiff during the public hearing, attempting to establish what is bribery, using Public Office for personal gain, from your perspective, do they have the evidence to make that case for bribery specifically . As a lawyer . I think they do and i think thats why they mentioned the constitutional crime of bribery, not the statutory crime of bribery. But i do think they wanted to avoid getting into the legal weeds of the distinctions even though the constitutional definition would be the prevailing one, given that was what was in effect when the constitution was written. I will say its not necessarily unusual for say in the criminal process for prosecutors to charge a crime that they can definitely prove beyond a reasonable doubt even when the underlying conduct may constitute other offenses. For example, when you look at the charges against Michael Flynn for making false statements, the underlying behavior he lied about his registering as a foreign agent, he was talking to members of the foreign government, which, you know, could theoretically be violations of other laws which they chose not to charge but chose something that was much broader, i think thats what you see here and the articles of impeachment describe the conduct of bribery as we generally understand it, coloke wally. Asha and ross, great to have you as always. Senate democrats and republicans very different takes on what this upcoming trial will look like and should look like. Republicans hold the majority there and therefore the power, although their margin is thin. It does mean republican leader Mitch Mcconnell could lead his party to strike any and all requests from the democrats down. Schumer and mcconnell expected to hold a meeting. Have you spoken to republican colleagues who support calling these witnesses as well . I have not had conversations directly with republicans on this, but i would think that members of the Senate Acting as a jury would like to hear directly from those who had the information as to why the president did what he did. The motivation here is important, as the president points out over and over again in his tweets, so to hear directly from the parties involved, i would think is a requirement in the United States senate to have a fair trial. I think what senator schumer is suggesting is a limited number of witnesses that have direct information about the specific facts of the president s conversations with the ukrainians. Let me play you a sound from Mitch Mcconnell speaking about his discussions with the white house regarding the senate trial, have a listen and i want to get your reaction. Everything i do during this im coordinating with the white house counsel. If your view has the majority leader prejudiced the process being in close coordination with the white house . I think he has. We take a separate oath once the impeachment trial begins to be impartial jurors, so that gives the clear impression that the majority leader is working on behalf of the white house, rather than as an impartial juror. He himself is a juror. I would have hoped that the majority leader, Mitch Mcconnell, would have said lets sit down with the democratic leader and lets sit down with the president s lawyers and the house managers and figure out a fair process for how the senate should conduct its trial. That would have been totally appropriate to include all stakeholders in those discussions and try to reach an agreement as to how an orderly way the senate should proceed with the trial. But instead, Mitch Mcconnell says hes only going to work with one party, that is the white house itself. In fairness, some of your democratic colleagues, Kamala Harris, Elizabeth Warren, have already stated publicly in weeks past theyre ready to vote to remove the president from office. To senator schumers credit he said this morning, he still is reserving judgment on that. To your colleagues who have said publicly, i know how im going to vote, is that also prejudicing the process . I think its very clear that members of the senate need to be impartial going into the trial. Thats what the oath we take requires us to do. We also didnt know until wont know until later this week the specific articles passed by the house. There was some question at least earlier in the process whether it was going to be limited to two, additional articles, we have to work on the specific articles presented by the house and the evidence thats presented by the managers and listening to the president s defense, so i think its inappropriate for any member of the senate, whether a democratic or republican, to reach a conclusion before the trial. I was listening to president ial candidate andrew yang this morning and he made the point that in hundreds of conversations with voters, as hes been out on the campaign trail, he can barely recall instances where voters have brought up impeachment. Theyre bringing up health care and their jobs and bringing up trade agreements, et cetera, i just wonder, as a democrat, you have an election coming up in 2020 with enormous consequences for the country here, if youre concerned that by pursuing this so aggressively and so far, that democrats are just out of step with what voters want to focus on . Jim, there is no we have no choice in this. This is our constitutional responsibility. The president s conduct is extremely serious. The allegations is that he asked a foreign power to get involved in our domestic elections for the benefit of the president. And then that he ob struktsd congressional investigation into those channels. Theyre very serious matters. We have no choice. The politics of it will have to play out, but it cant be controlled by the politics, the house and the senate need to exercise their constitutional responsibilities. But as you know, impeachment is also a political process. Its also like throw have political consequences. You have democrats and particularly in swing districts worried and you know the math in the senate that a vote to remove is extremely unlikely to get twothirds, particularly 20 some odd republican senators. Are you concerned that acquittal in the senate for the president would actually strengthen him in 2020 . I dont know how the politics are going to play out. I really dont know. But i do know this, from following the mueller investigation, that the only way to hold a president accountable so that hes not above the law is through the impeachment process, so the impeachment process is the only choice we have in regards to the president s conduct. So again, i dont think we have any choice. We have a constitutional responsibility to uphold the constitution of the United States, the separation of branches, Holding Accountable the president of the United States for misconduct, so i think we had no choice. How the politics will play out well see. Theres going to be its a long time between now and next november and my guess is that were going to see an ebb and flow of whats on the minds of the voters before next november. Yeah. Good morning to you guys. Errol, how the nation feels and interesting new polling from fox news. 53 of those polled say they do think the president has abused his power. 50 say the president should be impeached or removed from office, but this also struck me when asked how the democrats are doing, is it a fair process . 45 say yes, 42 say no. Yeah. If youre the democrats running this process in the house what are you thinking . If youre a democrat in the house youre thinking this looks pretty good. The comparable numbers, 20 years ago, 21 years ago for bill clinton, about 38 wanted him to be removed. To be at 50 , weve never seen this before. Theyre halfway there. Literally. To sort of making the case. Clearly people feel like the case has been made. The unfairness part of it, its been partisan, its been angry, its been ugly, but what the democrats also say when i think they have some truth on their side is they say the president brought his on himself. Weve been analyzing this for weeks. He could have said, im sorry, i screwed up, maybe it wasnt the best, maybe i got bad counsel, ill never do it again. Any would diffuse a lot of the anger. But he left everybody no choice. Its become completely polarized. He thinks thats in his best interest and does think there was nothing wrong with the phone call. Lets put the numbers on the screen where americans stand on the president abusing power, obstructing congress, committing bribery because when you look at these numbers here, it appears, sabrina, democrats did make the case for a majority or plurality, majority for abuse of power, by a large margin, and plour realities by a relatively large margin on the other articles of impeachment there, made the case he did something bad, but did not make a marked case that he should be removed from office. While 50 is significant, it has not moved really at all since prior to the public hearings, public support for that for impeachment and removal. I think that mr. Hthere has a slight uptick in impeachment since this particular investigation began after the president s ask of his ukrainian counterpart was revealed to the public, and, you know, i think that there is a case to be made that while its a slim majority, the groups to watch are end peptsz as well as suburban women. Those are the when constituencies that will make a difference going into the next election. Its true opinions are sharply divided along partisan lines but theres another poll out today, Usa Today Suffolk University poll, that shows a significant gender gap in how americans view impeachment which is notable because a majority of men are likely to say they oppose but women support impeachment by double digits. Thats one poll. Republicans in particular in the 2018 midterms struggled to gain support from suburban women, at least one of the groups that swung away from republicans and helped democrats retake the majority. Those are the numbers that Senate Republicans will be looking at as the conversation shifts from the house where a lot of attention has been on the moderate democrats and to the vulnerable republicans in the senate. Lets talk about what this means for the senate because i believe it was angus king over the weekend and yesterday on face the nation dick durbinen said, quote, it isnt just president , the senates on trial and we have a constitutional responsibility, talking about Lindsey Graham saying im not going to be a fair juror, senators like Elizabeth Warren and Kamala Harris who have said they would vote to convict already and havent seen a senate trial yet. However this plays out, what does it mean for the body and how the history books will look back on this senate . Theres potentially a lot of damage to the institution if the partisans take control of the process. We start with Mitch Mcconnell. If he says and hes already signalled in advance, theres going to be no daylight between us and the white house. The white house will essentially be running our strategy, that puts some of his members in a difficult position and the institution in a terrible position. It will be interesting to see, though, once we add and its crucial to remember this the chief justice, judge of the supreme court, is going to sit in and preside over this and make really important rulings. He will become essentially the presiding officer for the proceedings, he may dial back some of that and try to protect the institution. Those who just want to sort of fight for their side and do nothing else, theyre going to do damage not only to themselves but the institution. You talk to democratic lawmakers and i spoke with ben cardin, it strikes me that the strongest emotion theyre expressing now is resignation to some degree. The phrase ive heard repeated often, we didnt a choice. I get that as a sense of constitutional duty here in their view, the president abused his power, but theyre aware, are they not, of the potential political consequences here . Theyre aware of how this might affect democrats in swing districts, some of the districts you talked about that flipped from red to blue in the last cycle . Well, i think from the outset there has been an expectation among democrats that some of those mod rates who hail from districts carried by President Trump in 2016, may not in the end vote in favor of these articles of impeachment. Having said that youve seen in the last 24 to 48 hours, a number of those moderate incumbent democrats in the house come out in favor of these articles of impeachment an thats part of why Democratic Leaders made the calculus to keep the scope of these articles narrow and foes cuss on a clearcut case of abuse of power and obstruction of congress and the argument theyre making now is this is a matter of National Security if you dont take action youre giving future president s a green light to engage in similar conduct. You have seen, of course, republicans try and make a counter argument that while they agree that some of the president s actions were wrong, they dont believe it rises to an impeachable offense. Thats the direction of the debate youre going to see as the trial begins in the senate on the other side of this vote in the house. Were going to bring that trial to you, if it happens. The bill now being considered by the house says that labor attaches will be based in mexico to, quote, monitor and enforce the labor obligations of mexico. The problem here, the Mexican Government now says nobody told them that. [ speaking Foreign Language ] translator this provision was not consulted with mexico, said mexicos chief negotiator saturday, and of course we dont agree. Reporter as a part of this deal mexico did change its laws to make it easier for workers to unionize but when pressured to accept outside inspectors at its work site mexico balked saying they only agreed to participate in dispute resolution panels. Under secretary jesus seade said mexico will never accept inspectors for a reason mexican law prohibits it. He will meet with Robert Lighthizer in washington today. Does this mean the agreement is in jeopardy . Experts tell cnn probably not. For one Mexicos Senate overwhelmingly approved the deal and the strong response from mexican president obrador lopezs administration it could be about domestic politics. Now the foreign secretary here in mexico city did say this morning hes not afraid that this deal could collapse, but still, all eyes will be on this meeting between the two chief negotiators, between the United States and mexico. What comes out of that meeting could well determine the future of this trade deal that both sides were really hoping to pass very shortly. Boeing could announce this afternoon that it is suspending or at least further reducing production of all of its 737 max jets. Its a big deal if that happens and this comes after boeing learned that those jets will probably not be cleared to fly this year. Remember, those planes have been grounded around the globe since march after those two fatal crashes that killed 346 people. And a host of failures exposed not just in boeing but in the handling of this. Our regulation correspondent is in washington. Renee, right now is there even a plan that still exists to get the 737 max flying again . Is boeing giving up or is it just recognizing that its got a long way to go . I think its the they are just essentially realizing that their timeline is not the faas timeline. I dont think that theyve given up. I just think that they realize that this is not going to happen as fast as they want it to happen, so we expect that this announcement will happen either after markets close this afternoon or it could also happen tomorrow. But really, it signals the problems for the planes manufacturer. A source with knowledge of the deliberations tells me that the company could either suspend production or further reduce the production level. The source also said that if boeing decides to suspend the production of the troubled 737 max, that it would just be a temporary pause, at least until the faa clears the plane as safe to fly. But the fact that boeing is even considering curbing production of this troubled plane is a huge turn of events. Up until now, if you remember, boeing has been very positive, in fact bullish, saying that it was looking forward to approval of the plane to fly again some time in the Fourth Quarter of this year and with that timeline boeing even put out a press statement a while back saying that it was looking to resume deliveries to Airline Customers in december. Thats this month. Thats not going to happen. Well, the change in tone of course comes after the faa made it very clear, this was just last week, that they do not plan on clearing the plane to fly this year and that this would stretch into 2020.
