2004. The Montgomery County d. A. Filing the charges before the 12year statute of limitations was set to expire in just weeks. Constand worked at temple universitys Athletic Program and considered cosby 37 years her senior a friend and mentor. She accuses cosby of drugging then assaulting her when she visited his pennsylvania home. Mr. Cosby urged her to take pills that he provided to her and to drink wine. Reporter in the complaint, constand said cosby told her the pills were herbal. After taking them, she felt dizzy, nauseous, paralyzed and was aware of cosby fondling her breasts and putting his hands in her pants. Constand filed a civil suit against cosby, forcing him to be deposed. He settled the suit with her, the terms of which were sealed. In his own words unsealed this july and the original criminal case reopened. In it, cosby admits to giving women quaaludes but never without their knowledge. Constand, the first to publicly come forward, accusing cosby. Since then, some 50 women have come forward with similar allegations over four decades hoping now they may finally get justice. For many of my 29 clients, seeing him criminally charged and having to face a trial is the best Christmas Present that they have ever received. Reporter the comedian has repeatedly denied any wrongdoing and has yet to directly answer a question about the allegations. Theres no response. Reporter but in may, he tells abc news ive never seen anything like this. And reality is the situation. And i cant speak. Reporter in a statement, his attorneys called the charges, quote, unjustified. And vowed that he will, quote, be exonerated by a court of law, and the constand lawyer tells me that constand was notified before the charges were filed. And shes extremely grateful that this District Attorney is placing their trust and confidence in her. The preliminary hearing, alisyn, is set for january 13th. Joining us now is criminal defense attorney Midwin Charles and joey jackson. Good to have you both. Joey, how unusual was what we saw yesterday . Not only was it bill cosby, but after more than 50 women have made these accusations since the 1960s, the prosecutor decides to move forward with one case from a 2005 deposition in a civil lawsuit. Is there anything typical about this case . Very atypical. But then again, theres something very atypical about someone being accused of having indecemb inda sessions with different women. The District Attorney evaluated it and said, you know what, theres not much here to move forward. It was a very big part of the political discussion between castor and the gentleman he was running against, steele, who is assuming office tomorrow really. Lets talk about that, midwin. Thats what the cosby camp says. These charges are politically motivate because they became a centerpiece of the campaign to win District Attorney in Montgomery County. A campaign ad is based on whether or not bill cosby could be charged. Well play a little portion of that ad. Kevin steele, First Assistant d. A. With a 98 conviction rate. And tough sentences for sexual predators. Or bruce castor, a former d. A. Who refused to prosecute bill cosby. Castor said we dont charge people for makes a mistake or doing something foolish. Many more victims came forward and castor admitted he could have used their testimony against cosby but castor didnt even dry. Bruce castor was not looking up for the victims. Kevin steele, he made an issue of that, and then kevin steele won with that. Mr. The judge take that into account . I dont think so. I read the affidavit report against bill cosby, its 23 pages long, its very detailed and very particular. But one thing i know he bases opening this investigation, which was opened in july, by the way, on the deposition transcript which became public only this year in 2015. So i dont think that the judge is going to focus on that. But i will say, this may have been politically motivated as joey points out. But in a prosecutor is doing their job, then so be it. Let me put up on the screen what came out of yesterday. The arraignment details. There were charges, three counts of aggravated indecent assault in the second degree. What sentence does that carry, joey . Ten years in jail, cosby is 78 years old. Obviously, youre looking the a death sentence. A lot of what they knew in the deposition was known but the deposition has damning information. Such as, in his own voice, he tells the lawyer who is interviewing him, yes, i got prescription, seven of them, for quaaludes, because i was going to use them on women. When asked in the deposition was it in your mind that you were going to use these quaaludes for young women that you wanted to have sex with . Yes, he says. Thats what the new Prosecutor Says is the tipping point. Right, ive taken many depositions in state and federal court, and i have to tell you, they are taken under oath. So the fact that these are bill cosbys own words, we always know in criminal cases that your words can be used against you i think is remarkable. Im surprised that his attorney representing him at his deposition didnt object. To at least get at that answer in some specific way. And what we should talk about, that if he testifies during trial, the trial against him, he has to stay within the confines of what hes on record saying under oath already as midwin as pointed out. If he veers anyway from what he said hes going to be what we call impeached from a prior statement. And if he admits that he said, is he guilty. I think this is on the battleground was it consent or not consent. Hes admitting they had a relationship and he engaged in, i guess, fondling. But the basis of the charge is the fact that she could not give consent because she was unconscious . Youre both attorneys wow, let bill cosby testify in this trial . I think its a very difficult thing to do, he would have to establish really, hed have to follow what he said within the deposition. I think if he does testify and say, look, this was consensual. I did it in as much as i fondled her. We had somewhat relations but she knew. Remember, when you read the affidavit, also it talks about their prior relationship and the fact that they had some type of romance. Well, thats his view. Thats his view. Would you let him testify, midwin . If he doesnt testify, is it that damning . Well, i will say this, when i saw him walk in the courtroom with the cane, say little dishevelle ll dishevelled. And stricken. This may have been orchestrated and if so, wonderful kudos. What you want to get to do is get the jury to sympathize with your client. Remember, he does have a lot of supporters, still. I think if you put him on the stand, it may play into his favor the fact that he is elderly, 78 years old. There are a lost of people who cannot divorce bill cosby from huxtable. There are obstacles that are just incredible. He was clutching the arms of his attorneys walking in. He tripped. He appeared frail. He appeared every day of his 78 years old yesterday which is a different look than what we normally see from him. Joey, lets talk about how tough this case would be to try. Andrea constand agreed in a civil lawsuit of a settlement of some undisclosed amount of money that bill cosby paid her. She has never spoken since that time. Because there was a gag order. She wasnt allowed to speak because of the settlement. How is this going to work . It will work that shes a victim in a case. Its null and void . Its not that its null and void. The fact is that you have to balance things. Obviously, shes not in a position to speak about it, its a gag order, its confidential, but now there are criminal proceedings. In light of that, our society says if somebody is facing a crime, if youre the victim, come tell your story. I think will it center on veracity. It will center on credibility and whether or not the jury can relate to her remember, even though allegations are, i dont want to say uncorroborated, you could call them that as much as it was her there and bill cosby there. But there are other people going to come forward like her mother saying her behavior changed. She was having nightmares. Screaming in her sleep. Finally, she breaks it and ace i cant hold it anymore, mom. The alleged incident. We call these things in rape cases a he said she said. Is this not a layup. This is going to be a tough one for the prosecutors. It is going to be say tough one. You raise a point, oftentimes, they fall won this sort of he said she said. If you cant have forensic evidence, if you dont have physical evidence, theyre difficult to prove. However, joey is right. There are other actors and prominent people that played a role at the time. I think its important she came forward ten years ago about this that can sort of say well, bill cosby asked me to do this. There were certain people who worked for bill cosby who he told, call her and tell her i will do anything for her. I will fly her here. And that particular person said that bill cosby had asked him to do that for other women as well. So there are all of these individual actors that can sort of help lend credence to her claim. Underground here, theyre protecting this area. Both seen and unseen is what they say they will be deploying in order to detect from any possible threat. The mayor of new york saying that this city is safe. This is going to be a very, very safe place. Times square on new years eve is going to be one of the safest place in the country because of the huge concentration of police security. Six more people have been detained. Weve learned that the two men arrested this week are now being charged with threatening terror attacks being members participating in a terrorist organization. One of the men arrested is being labeled as a leader and recruiter for a terrorist organization. So they will planning to attack right here, the grand plaza right in the center of brussels. A beautiful square. You get a lot of revelers here on new years even. But the fireworks cancelled. The arrest associated with the paris attack. The man arrested there is being charged with terrorist murder participation of a terrorist organization. Ten cell phones recovered in that arrest operation yesterday. And most of the information that the paris terror attacker, the bataclan theater, the cell phone found outside there, had sent Text Messages, multiple Text Messages to phones here in belgium, hours before the attack. Some 6,000 officer, being stationed right there in times square. Federal officials are investigating a u. S. Terror threat to three u. S. Cities. I want to discuss these threats with our cnn security analyst julian khiyam. Before you start your reveling, we want to get your idea on this. We know the president has been briefed on these threats. Threatening in new york, los angeles and washington. Officials say the threat is uncorroborated, based on a single source. How seriously do local authorities need to take this kind of threat . Well, i want to put this in context, since september 11th, 2001, almost every new years has encountered some sort of threat from one or two sources. Just putting it in perspective for everyone, while were on edge, because of the isis threat, because new years eve is a highprofile event, because cities tend to, you know, have these big parties, people congregate, we are always at an elevated risk and an elevated Security Apparatus during new years eve. So, this should feel familiar to many people who can remember the last 14 or 15 new years eves. Well its elevated fear, right. Given paris and San Bernardino, is this going to fuel more fear for some people already on edge. Thats exactly right. Part of what youre seeing coming out of new york, los angeles, other cities. Isnt so much well, we know something bad is going to happen. We know theres a specific threat. This Large Police Presence is what we call, i dont mean this as criticism, security theater. A lot of it is to put a big show of force, so that people feel secure. And i do believe that thats very important, because then people are willing to live their lives, enjoy tonight. And enjoy reveling. Otherwise, look, this wont end. This is what i have to refined people. At what stage are you going to feel comfortable going out there . Were not going to see peace on earth relatively soon. I want to play a little sound from new york as you counterterrorism official who is trying to allay fears. Take a listen. We monitor threat information and intelligence information through our partners with the fbi and all the other government agencies, department of homeland security, cia, et cetera. And we are very, very confident that new years eve in new york city will be the safest place in the world to be. He vows its going to be the safest place in the world to be. Youre a former d. A. Test official. What is your feeling tonight . Its certainly not times square, the combination of the physical capability and covert and intelligence apparatus and all the other elements make me feel pretty confident with a place like times square. What would concern me are those places that are not getting that focus. Places that are soft targets. Towns like San Bernardino, places like most of us have never heard of before until something happens. It doesnt mean not to go out in those places, it just means, look, we have an infinite number of soft targets tonight than almost any day in the United States. The third piece of security, one is the physical presence. One is intelligence sharing. The third is engaging people to see something, Say Something philosophy. You have to get people engaged in their security, you see a backpack, notify someone. Thats part of what it means to be engaged in our own security. I was thinking, its as though these things are sort of a regular warning now. As you mentioned, since september 11th. This is sort of an annual routine that we go through. Do you worry that people are going to get sort of desensit e desensitized. Juliette, how concerned do people need to be as they celebrate . I always say we will never be at zero risk in this country. Im not just talking terrorism. We are a nation that is quite vibrant. People flow in and out. Thats what makes this countrying exciting, right . You that can get on a subway and be at an exciting celebration in new yorks times square in just a few minutes. For people to realize we have accepted a level of risk in this country and adapt their lifestyles. See something, Say Something. As i say, talk to family and friends about preparations. Lynn, thanks for being with us. You are one of our countrys great political lawyers. Yet week watching this social unrust and policy discussion taking place in chicago. When you watched the mayor discuss the reforms and changes, do you see that as more of a political response or more of real honest to goodness change . The answer, john, and good morning, is all of the above. No one would have imagined after that video surfaced in november of a teen shot 17 times that we would have another incident. And this tragedy happened just last saturday, so soon. So the mayor put in a bunch of changes after the Police Shooting video surfaced in november. And then he put in more changes now. So is it enough . I think it just remains to be seen. And it depends if theres another tragic incident or controversial incident. Because we could never have predicted that we would have this second one. So, in the meantime, though, is it political and policy . Well, in chicago, i think, its one and the same. You know, they usually say good policy makes good politics. And good politics makes good policy. In this case, we have a mayor, national figure, whose at a low point in his career, because of these crises that happened. So, while some people have called for him to resign, i dont see it happening, because part of what his challenge is, i watched the press conference, to see whether or not he could fix this on his watch. Talking about fixing it. He issues a promise of tasers with every cop which is a change that a lot of people say should have have been made a long time. Surely, that can make a difference. But hes also talking about a significant cultural change within the Chicago Police department. Listen to this. Be sure that our officers are not just operating in either first gear or fifth gear, but to recognize the degrees in between so they can respond appropriately to each individual situation. Where force can be the last option, not the first choice. You know, that takes a lot. That takes more than just putting tasers in every police car. It does. Well, there have been problems, like Chicago Police have done, isnt everything. Its the problems that get the spotlight, not the daytoday good work of Police Officers in chicago. But brutality has been a problem going decades. Going back to the police from grant park during the 1968 convention. A code of silence has gone back decades. Rules that allow the city to pay off people who allege theyve been victimized. Police have caused the city treasury to write checks for multiple millions of dollars while very few police are ever disciplined, who have records of not following the rules. So, all of this is a system that needs changing that i dont know if it could move that fast. What does he need to do, the mayor, over the next year . You dont think hes going to quit. I dont think a lot of people think hes going to up and quit despite the calls to resign . But how does he rehabilitate not just his image, but the public trust . Lets say there are no more incidents than business can proceed with the department of justice investigation going on, that well look at best practices. Look at the past, present and future put in place recommendations that could be enforced by a federal court order. Well, you know, im compounding this, john when you talk about mayor emanuel and trust. He has a massive problem with the chicago teachers union. They have a strike now coming up and problems with city finance and pension. So if he has problems with Public Schools and policing, he has to, in a sense, just have a change of course. He has to try and bill constituencies where none exists now. Being more, and i know this is kind of antirahm emanuel, of how he likes to approach things, be a little more gracious about listening. And dealing with people. Its just he has this abrasive way sometimes. I dont want to be saying that people cant change. But he doesnt have a real Political Base that is there to help prop him up. I think what he has to do is go out and find one. Create one. New leader, heading rahm emanuel starting tomorrow. Lynn sweet, thanks for being with us. I appreciate it. I believe theres a piece of this that dealing with the super pac. The fact that the super pac has spent tens of millions of dollars with tv ads and has almost nothing to show for it. Shes been stuck around 5 in iowa for months. I think months ago, we were asking either to drop out or do something drastic. I think its smart at least now to admit that, yeah, we need to make a change. I dont know if this change is going to make a whole lot of difference for this campaign. There are a lot of people looking at it saying was it a strategy mistake . The problem is not the campaign per se, but is the problem jeb bush . We saw in South Carolina, katrina shealy, and jeb bush made a joke about her name. Lets listen to what he said. I dont know why your great great state senator reminds me of a hurricane. But she does. Shes strong and shes fierce and shes solving problems for you at the state capital. You should be honored to have her as your elected official. I hope you agree with that. Thats the new nickname. The bush family always gives out nicknames. Yours is now Hurricane Katrina. Association, errol, like bush family and Hurricane Katrinaee ooh. The bush family, when governor of florida, he was credited with doing a great job. Yeah of all the things to invoke your family name around, maybe not the best choice. One factor youve got to keep in mind here, john, youve got consultants who get paid in many cases by how much they place on television ads. So, theres part of this whole big money problem that has affected american politics that really i think is on display here. Which is that, you give 10 million to some consultant. He says, if i buy a bunch of ad time i can take a percentage of that and put that in my back pocket, compared to spreading it out over a whole bunch of volunteers who can knock on doors. They line their own pockets. The Political Consulting industry has done very well by the bush family this year. They are the big winners, not so much the candidate. Patricia, before we leave the Hurricane Katrina reference and move on, what is that . Is that jeb bush just being tonedeaf . Why did he make a regrettable reference like that . Oh, my god, i think it just shows he is rusty and hes not that great of a campaigner. Weve heard recently that he is so much better than he used to be. He is not good. With 40 million in advertising, it just shows you cant make people want what they dont like. I think Republican Voters are just not buying jeb bush. Really, if his last name wasnt bush, i think he would have dropped out a long time ago. He would have been basically George Pataki if he werent jeb bush. Nobody with those retail skills in the game without all that money would still be in it. Patricia, what was it like yesterday when you heard the news that bill cosby was being charged with Sexual Assault . I was very emotional when i heard the news. It took me about a moment, amaye two minutes to process what happened after i received a text from a dear friend. I just started to cry. We were in a public place, my husband and i, i just put my arms around him and stood there and cried. It was very emotional for me. What was that . What were those tears that you were crying . Ive been thinking about this since yesterday. I think they were tears of relief. Tears of joy and tears of validation. Because for so many years people did not believe me when i told them what happened. And many of us were not believed. You say that bill cosby drugged and sexually assaulted you in 1978 and 1980. You much like so many of the women that weve interviewed didnt, and dont know exactly what happened, because when you came to consciousness, bill cosby was just standing over you. You knew something had happened because your clothes were off, as were his. As you say, at the time, you told people, you tried to tell people, and you were not believed. So what was it like yesterday to know that in a case very similar to yours, Andrea Constand that a prosecutor believes her . It felt very vindicating. I know we have a long way to go in this process. All of us, as we observe and to the extent possible participate, if the prosecutor and the judge allow it, but it was very it felt very vindicating. The last time we interviewed you on new day, we did so isnt silhouette. You cant want your face to be seen. You didnt want your identity to be shown. Here, we have a clip of it, where you can see me, but we cant see you. Why today are you willing to show your face and have your identity be known . Well, a great deal has happened since then, alisyn, as you know. The deposition from 2005, with mr. Cosbys sworn testimony was leaked. Or was leased in the press. And there were some things in that deposition that were very enlightening for a lot of people. And also since then, new York Magazine did their piece about the 35 survivors. And i was just willing to be known by my full name after that point in time. I was willing to protect my privacy and private vaegs of my family. Did you watch the arraignment yesterday of bill cosby walking into that courtroom . I did not see it live. But i did see portions of it in recordings. And what was it like to see bill cosby there, clutching the arms of his attorneys as he sort of stumbled at one point towards that courtroom . My mother died last year she was just a little bit older than mr. Cosby is now, and i have compassion for anyone of that age. She was struggling with any kind of a disability. And i know that he has one. I dont assume that that was put on in any way. That he probably did need the assistance of the people that were on his arms. So, i have compassion for anyone like that. But it seemed only right that she should be there and answering for things that occurred he was disabled. That is awfully compassionate and generous of you, patricia, because i know that these 35 years since what you say happened with bill cosby have not been easy for you. And you have carried the trauma of that. Can you tell us a little bit about what these years have been like four, and what changed yesterday . Well, thank you for asking that. I think everybody who endures any kind of trauma has, what im going to call, a semitic ghost. We all we have an impression in our body. The body remembers, no matter what your mind does to try to forget and put it behind you. The body remembers. And sooner or later, the body will break down, will show you that theres something that needs to be attended to. So, ive had physical triggers as a result of what happened to me. Anytime im touched by anyone, i jump. That has been difficult within my marriage of 35 years. My first reaction is to jump, even though im with a very safe person. And love him very dearly. So, i am just now beginning therapy for these assaults that occurred 37 years ago, and looking forward to having some relief from those triggers. Do you think theres any chance that there could be any more charges . There are at least 50 women who have made accusations against bill cosby, and like your case, most of these statute of limitations has passed or we believe it has passed. I know that youre in touch with some of the survivors, as they call themselves. Do you believe there could be any more charges . I really i dont know what will occur. In fact, i didnt think this was ever going to occur in my lifetime that he would be criminally charged. So, i dont really feel like i can speculate about that. Most of us have expired statute of limitations which with our cases are involved. I really dont know. What do you want to see happen to bill cosby . People ask me that all the time. I dont have any sense of vengeance. I dont believe thats mine. Its not in my purview. Its not in my control. Its not an outcome that i have any power over. So, im going to leave that to the Justice System because thats now involved with mr. Cosby. And trust that whatever happens is appropriate. And what about you, patricia. I mean, what do you what changes in your life do you see now in the future after what happened yesterday . Well, as i said, ive been carrying the ghost of what happened for 37 years. Thats almost four decades. And for some of us, its longer than that. I really, really hope and anticipate that what happened yesterday and going into the new year will be part of the healing for me. Can you give us an idea of how those levees are doing. They been overtopped yet . The levees very doing very well. The corps of engineers are making sure of this since monday. We patrol the levees every hour. And the courps has said the integrity of the levee is still very good. We know that mandatory evacuations were orlandered foru wednesday, for the lower end of the city to order 8900 people to evacuate. Can you give us an update on the evacuations, did they go smoothly . Yes, maam. We followed the top corps guidelines for evacuation. With a mandatory evacuation. Everything went very smoothly. People had already started packing their belongings and getting them ready to move because we had been giving them notices and hand delivering letters to update them and updated our website to keep everybody informthere was no mass exodus. It was very smooth. And i just wanted to thank all of the residents for working so well. And the businesses in this town. We know that your resident, fairly well versed in this. This area, we understand, floods fairly frequently. And it sounds as though they use their expertise. I wanted to ask you about this. Were hearing some reports of some residents saying, look, these bridges ended up acting like dams. The water is so high, the bridges end up catching all of this refuse and dams. Are you seeing a lot of this happen in the jerry. We have two bridges that go into the town. One is the regular 141 highway. It holds debris there. It does pick it up a little. Its getting around it pretty quickly, though. A moment ago, you talked about is the levees. And you were please that they were holding. Confidence is in those levees and the levee system in the next 24 to 48 hours as the river begins continues, rather, to rise . Our river has crested maybe 30 minutes ago. Okay. The river here at valley park. And were going to see the downside from there. Well, then we know the work begins then. Of cleaning up. Youre definitely not out of the woods for sure. Right. Talk to us about some of the residents there in terms of what they can expect as they begin to wake up this morning, agency you say, the river has crested now. What you can tell them about the status of Emergency Services and the businesses that are going to be affected . Were having an 8 00 meeting this morning to go over when we would lift the evacuation so they can get back in town. And as the river recedes, when were going to open up the floodgates, and where the city is going to be open, you may be in a different area, but they will be back monday. A lot of people are recalling the great flood of 93, this looks like its going to surpass it if it hasnt already. What are your thoughts . Im very confident that the corps building our levee here and with all of the residents what they have been through and all of the city employees, everybody has stood up and helped, and you know, worked together to continue to try to get past this situation. Kama rat that. Thanks for being here. Lets talk about what happened yesterday in the criminal court and criminal charges. You represent seven of cosbys most vocal victims. Linda bowman. Just to same a few. How are they feeling . I cant give you an answer to be specific to them. But i think theres a sense of vindication, a sense of looking forward to a trial, a criminal trial, that will bring justice to Andrea Constand. Its somebody looked at the evidence and found theres just cause to proceed to trial on very significant criminal charges. And the reason you dont want to give us a specific answer about your clients is because of this ongoing defamation suit, i believe. Your clients, your seven clients, are suing bill cosby, correct me if im wrong, for defamation, for basically suggesting that theyre liars. He, mr. Cosby, is countersuing them for the claims that theyve made on our air and elsewhere about what he did to them. And thats why you dont want to give any specifics about them. Thats exactly right. I cant talk specifically about their feelings or what theyre intending to do, other than being in court. Because of the pending case. But mr. Cosbys counterclaim, as weve said, is nothing more than a defense lawyers page out of their playbook. To shift attention from his own actions, and divert it to somewhere else. But my clients are resolute in their day of court. They believe at the end of the day, their good name and reputation will in fact be restored. Well, bill cosby is speaking out about your clients, at least through his representatives. Let me read for you what he has said about their claims. Cosby stated plainly that he neither drugged nor sexually assaulted the defendants. And that each defendant has maliciously and knowingly published false statement and accusations in evidence to cause damage to mr. Cosbys reputation and to extract financial gains. Whats your response . Well, thats just lawyer speak. But lets look at the evidence that has already been out in the public with respect to that allegation of nondrugging. The Andrea Constand deposition was in part release. The public portion that dealt with one of the my clients, recounted how mr. Cosby gave her quaaludes. Put her in an altered conscious state and then had sex with her. She says it was nonconsensual. When asked mr. Cosby, do you know if he consentsed. He said i dont know. She knows i did not consent and she says i was raped. So his claim that he gave anybody drugs is not supported by his own admissions in the constand litigation. But look, we have a courtroom. We have a forum where truth can be tried, where the rules apply fully and fairly to all sides, to you aof the ladies and mr. Cosby. And my clients are looking forward to having their case heard by a jury of their peers. And they believe at the end of the day, that it will be proven that they are the ones telling the truth, and not mr. Cosby. But heres whats confusing about whats about to happen in your court case, and that is that these seven accusers have not been able to prove in a court of law that mr. Cosby has sexually assaulted them because the statute of limitations has passed. If theyre not able to prove that, how are they going to prove now that hes lying about it or telling the truth about it. Im not sure what you mean by having to prove. There is no test by which they had to prove anything to anybody. They came out publicly and they made statements that said that they were assaulted or abused by mr. Cosby, period. There was no proof that had to be established. I mean that the statute of limitations has passed. They havent had their day in court so there is no sort of evidence that theyve been able to hold up. So how will they prove it now that their words are true . I understand. Well, first of all, we have lets start with number one. They claim that they were given drugs, and then taken advantage of by mr. Cosby. Mr. Cosby has admitted, he got prescriptions, not for his own use, but to use with other women. Quaaludes. Controlled substances. A sedative that knocks you out. Makes you incapable of consentsing consents i ing to anything. Thats number one. Number two, he said at least to terrese, one of the seven women i represent, that he had sex with her after he gave her the quaaludes. Thats what she says, too. When asked, did she consent, he says, i dont know. But she knows i didnt consent. So i dont know how much farther you have to go beyond that. But we also have evidence of a pattern and practice of mr. Cosby allegedly doing this to some you know, dozens of other women. Some 54 in number. And so, its that type of evidence that will also be at issue in in our case. Right. Now, mr. Cosby has put into issue his own reputation. He says he says hes the truthteller and the ladies are liars. Well, were going to see just what type of reputation, what type of character he had. Was he known as a woman a woman as he known as a man that was abusing and assaulting other women . Right. Thats to be tried. And the depositions, i believe, in your case, begin starting one week from today. So it will be fascinating to watch bills proceed as well as the criminal case. A writ of impara which is similar to the writ of habeas corpus. An unlawful detention. Here hes filed an action that says you know if you send me back to the United States it will be a violation of my rights. And i know most people are thinking wait a minute. Hes not a mexican citizen. How does it apply . Apparently it does. Once you are on mexican soil you can file this. Does it only apply to International Fugitives or to mexican citizens. It applies to mexican citizens so this is something that is available to them if they believe a wrong has been committed against them that would infringe upon their Constitutional Rights. Now chances are it is not going to be successful. What he is doing is hes asking for a judge to make a determination as to whether or not he should be extradicted back to the United States as opposed to an immigration agent. Dont mexico and the United States have extradition treaties and arrangements, etc. Etc. To writ of omparo super se supersedes that . I think ultimately hell be brought back here to face the music. So its not going to work. No. And we have great relations with mexico. Weve seen fugitives sent home numerous times. And it is going to follow that analysis. Which is does the United States have jurisdiction . Has he committed a deportable offense . Is there probable cause to believe hes committed the offense . And probation exactly. So once that is established ultimately hes brought back here. And the net effect is if he were back here he would be in a detention facility until hes 19. Hes being detained in mexico. So the net effect is hes detained. Exactly. Does the fact that he was a minor is not any longer. Hes 18. Does his age play into any of this in terms of extradition . I dont think it does. The writ focuses solely on whether or not his Constitutional Rights have been violated. This is where it gets complicated. It does get complicated but mexico is a sovereign country. They have laws when it comes to immigration. And one of the reasons i think they actually granted his but denied the mothers. We got talk about mom too. Shes back in l. A. Back on american soil. Shes facing numerous charges and some of them fairly serious. Among them is a charge of hindering the apprehension of a juvenile of which she could land in jail for up to 10 years. Thats correct. Now does her involvement in her sons travel to mexico, does that at all lessen the burden on him . Two separate issues here. He has to face the music for his probation violation. Which hell face when he comes back to the United States. In terms of the mother she has a stand alone issue to deal with. And that is when you are harboring a fugitive, when you are assisting and aiding and abetting getting him to mexico and when you know the authorities are looking for him based upon that violation of probation and you are really doing everything you can to shelter him in have him in mexico. Of course it violates a statute in texas and ten year maximum punishment. And bottom line, what does couch have to gain by delaying . I actually think this is a bigger issue. You know the net gain as joey pointed out is hes still going detained. I think this goes back to this whole idea of affluenza. This is a boy a young adult who believes that hes privileged. He has the audacity that he cannot only throw a party before he leaves the country but that he is going to do whatever it is he can to prevent facing the music. Once americas beloved tv dad, now disgraced Comedian Bill Cosby arm in arm with his legal team stumbling as he arrives for his arraignment on wednesday. The 78yearold, released on 1 million bail for three counts of alleged aggravated indecent assault in 2004. The da filing before the statute of limitations was set to expire in just weeks. She considered cosby, 27 years her senior, a friend and mentor. She accused cosby of assaulting her when she visited his pennsylvania home. Mr. Cosby urged her to take pills that he provided to her and to drink wine. Cosby told her the pills were herbal. After taking them she felt dizzy, nauseous, frozen, paralyze but was aware of cosby fonlding her breasts and putting his hands into her pants. Though she came forward in 2005 the da did not file a lawsuit. In his own words, unsealed this july and the original case reopened. Cosby admits to giving women quaaludes but never without their knowledge. Constand the first to publicly come forward. Since then some 50 women have come forward with similar allegations over four decades. For many of my 29 client, seeing him criminally charged and having to face a trial is the best Christmas Present that they have ever received. Reporter the comedian has repeatedly denied any wrongdoing and has yet to directly answer a question about the allegations. But in may he tells abc news. Ive never seen anything like this. And reality is the situation. And i i cant speak. In a statement his attorney called the charges unjustified. And vowed that he will be exonerated by a court of law. Its been an emotional 24 hours for bill cosby accusers as they learn hell Face Criminal Charges for the first time. One woman has been waiting for this moment since 1969. Victoria, how are you feeling this morning great to see you. Well, very emotional. Its really been a shock. I dont think any of us anticipated this was going to happen and certainly if it was going to happen we didnt anticipate that it would happen at the end of this year. Its been a long year. So were very grateful. I know you are. How did you get this surprising news yesterday . Well, my cell phone started lighting up while i was sleeping. And i kept thinking why am i getting all of this activity when Everybody Knows i was sleeping in because i stayed up late reading and crocheting the night before for my granddaughter. And i thought well something must be going on. And as it turned out a lot of friends started texting me and did you see the news . Get up, turn on cnn. And so i did. And then i started receiving requests for interviews right from the beginning of the day. So it was a long day yesterday. It has been a busy day. But how did you react, i mean after decades . His time . Were you happy . Relieved . What was your first reaction . I think my first reaction i was just sort of if shell shock. Relieved. Elated. Emotional. I started to cry. W the mug shot it was it just hit me so hard. And i really didnt anticipate that i was going to react that way. But i did. And i was i think it is going to take a while to really process the feelings. You know, you go through this whole thing of what does this mean for the first seven that are being counter sued . How does that effect their case . What is going to happen with him . Is it really going to progress . Is he really going to get jail time . Is he going to have to really suffer the consequences of five decades of his own actions . You know, you just keep going through this litany, this grocery list of things. Of all the different scenarios. What can happen, yeah. And victoria, just for people who may not remember, your story in particular was us a one of the most heartbreaking of what you say happened to you in the hands of bill cosby. Because you didnt know him. That night. You met him at dinner. But you shared with him you were in the middle of a terribly traumatic time. Your sixyearold son had just died. And you always felt that bill cosby really preyed on that vulnerability of yours. So for you in particular, what was it like for you to see that video of him walking into the courtroom yesterday . Well, i saw him stumbling and acting frail. And i think i think my roommate and i, we were acting that way pretty much that night after he gave us pills. And, you know, so it was kind of compensation maybe to see him in a vulnerable position as well. And the fact is that i had met him once before at dinner. I had gone for a potential audition and had shown him a picture of my son. He knew that my son had drowned. And he preyed on my grief over my child, my vulnerability to get to my roommate who he was really interested in. He was not even interested in me. That is what made it so shocking i think because i basically saved her from being raped while she was unconscious. And i was the superficial lamb. So what do you want to see happen to bill cosby now . I just want him to stand up and tell the truth and take it like a man. I want the truth to come out. I want justice to be served. And i want justice to prevail for all of the women, all of these victims that have suffered watching him receive accolades all of these years while they were suffering the consequences of ptsd from their encounters with him. You know, it just makes you feel so much more powerless when you see him growing and blooming, and you are just having to lock away these horrible memories in this dark little room and try to ignore how it made you feel. You know, it just makes you feel well, just powerless. Yeah. This will not be an easy case to try. Weve heard from our legal experts. It is from 2004. There is no physical evidence. Does justice to you only mean jail time for bill cosby . Or just seeing him go through the adjudication process . Could that be enough . Well yeah in a way just seeing him have to stand up in court. I dont know jail time. I think im gonna just have to leave that to the judge. But i think just seeing him have to face face us all. Because i can almost guarantee you that many of us will be sitting out there and standing in solidarity with andrea. Just to let her know that she is not alone. Yeah. So hes already lost many of his honorary ph. D. s. The bronze statue at disney world of his has been taken down. A lot hes lost so many of the things that he had, you know, been awarded, that built him up. So hes been tried in the court of public opinion. And for someone like him, i really think that that has been terrible punishment already. That doesnt mean that that should be the end. Everybody has to face the consequences of their own behavior over a lifetime. We all do. It is karma. You know, you reap what you sow. And i know you have met the other accusers. You all have formed a network and a bond. Yeah. And i know that thats been a Silver Lining in all of this for you. Yes. So what is your plan with these ladies now that hes been officially charged . Well, we dont really have a plan. Were waiting. Were waiting. I think we are probably stocking up on champagne and chilling it as we speak. Who knows. You know we i think we are just being very grateful for the fact that we have each other as support and some of us have become very close. And have really bonded. And so many of them are such lovely, lovely human beings and so talented and so brilliant. And mothers and grandmothers. Like me, mother and a grandmother. The mother of the so called affluenza teenager is back in the United States. Facing charges that could land her behind bars for up to ten years. And he is still in mexico fighting deportation. Reporter its not exactly clear why they are now split up. They drove to mexico together several weeks ago. And initially we were told yesterday they filed the paperwork in the immigration process in mexico to fight the deportation here to the United States but late yesterday we hear that essentially they have been split up. Couch being moved from the immigration detention facility, and tonya couch moved and flown to u. S. Where she faces that felony criminal charge that could send her to prison for up to ten years in texas. As far as ethan couch is concerned hes fighting the deportation process in mexico. And u. S. Marshals have seen this happen before and it could take several weeks to get him back here to texas. And this is significant. Because on january 19th, ethan couch is supposed to be in a Court Hearing where prosecutors in fort worth, texas are trying to get his case moved from a juvenile system into the adult system. And prosecutors here say they are not entirely clear at this point whether or not that hearing can take place if ethan couch isnt back here by then. Michae michaela . Well wait to see. Weve taken on more water in history ever that ive known in our city. It is in places weve never had it before and businesses, homeowners are all being constricted because of the water. We understand there has been loss of life. 14 people have died due to flooding. Has everybody in fenton been accounted for . You know i have to complement our street department, police department, firefighters and volunteers, and mo dot. We came in, the flood was very fast. We had to move fast. Subdivisions that became water locked. Weve actually build roads into them so residents could get in and out. And emergency vehicles can get to the residents in event they are needed. So many challenges in an event like this. Getting people out. Trying to get Emergency Personnel in. Talk to me about the Structural Integrity of the bridges and other local infrastructure. Is it holding . Well, you know, so far we think it is. Picture fs on the news of a house hitting a bridge here in fenton. That is fairly new bridge built a couple of years. So were really concerned about that. It was kind of our pride of a new bridge being built. And you see that house hit it, was very nerve wracking. I can understand that. Do you have any information on whos home that was . Weve been asking. We dont know at this time. Theres just such wide spread water it is tough to know what is happening in many places. Ky imagine. Lets talking about some of the reports were hearing about untreated sewage flowing into the meramec from fenton. Can you give us the status of that leak. Yes thats not thats most they have done the best they can. As we know any type of sewer is a gravity fed system. So sewer plants are usually located in lower areas. And the one in fenton under water. The since it cant treat sewage at this time it is dumping raw sewage into the river. And many are concerned about the Drinking Water because the Drinking Water comes from the same river. But our Water Company has assured us that we are safe on the Drinking Water at this time. Are local residents being asked to conserve water . Yes, they are asked to do that because they dont want to put too much pressure on the system that is in place. So we are asked to conserve water. We are asked to actually were in my were even asking residents to try to stay home. Yeah. With the way the roads are and streets and we dont have the real people left to rescue many people from flooded areas. Were building bridges to get emergency vehicles to them. Yeah. No mandatory evacuations thus far in fenton. I know you are doing a lot to protect businesses. You are a Business Owner yourself and im sure there is concern over the economy but that is for later. Emergency service, are folks going to get the Emergency Services if they find out they are in trouble where they are . Are the roads up enough to get to people . Yes. Richard, what do you think of this line of attack trump is taking . Well i think mr. Trump rather shamelessly is trying to appeal to the extreme right in his party. And so johns question he does have to win a republican rime primary first and i think he feels the best way to win over republicans on the far right is to go against bill clinton. But i would just lets all remember that bill clinton is one of the most respected and most beloved figures in america and the world today. So i think if you want to if he wants to make this a referendum on the bill clinton presidency, where he enjoyed eight years of peace and prosperi prosperity. If we make it a referredem on that i think hillary is going to do great. Donald trump is not a choir boy. He has his own history, his own marital past. Will that become an issue in a republican primary . Well, if there is somebody out there as there is with bill clinton accusing him of rape, id like to know her name. You have been reporting all morn on bill cosby. And like bill clinton he was once one of the most popular people in america and around the world. Every time this cosby story surfaces this in effect casting a pall on the bill clinton situation because there are women out there who have serious allegations. I really think this is disgraceful. Here we are on television on new years eve and you are accusing the former president of the United States of rape and these charges these are phony charges that have been dragged out for a long time against the president. Has a long record and reputation. Hillary also i will point out, hillary is running as her own person. She is not running for a third clinton term. She has a record to be proud of on womens rights on all kinds of protecting human rights of people all around the world. I think this is disgraceful sir and i think what you and mr. Trump are doing are really disgraceful. I did not make the accusation. You are a trump supporter. Threatening her to be silent. Im not making the accusation. To your point there are three women that over the course of a couple of decades have come out against bill clinton and made accusations of sexual impropriety. Exactly. But bill clinton as you will recall in the white house there were impeachment trials and everything about this and he persevered. Do you think this is what the voters want to hear about . Well this is relevant the Hillary Clinton in that one of these women is accusing her of essentially threatening her to be quiet about a rape. This is part of the trump this is part of the culture that mr. Trump is trying to create in which you can say anything, there is no factchecking. You can say anything [inaudible] all of these allegations have been long discredited. And people remember whats happened. It is not like were living in a factfree zone. People know, bill and Hillary Clinton. Know what they are about for decades here. [inaudible] you know. This is a very clear tactic by mr. Trump to appeal to the lunatic fringe in the republican party, you know, that is attracted to any kind of bizarre allegations against the clintdens. A reporter brought it up with donald trump. So are your sexual indisdiscretions if you happen to have any now fair game . And donald trump said yes. This is not a joke. This election is not a frat party game like mr. Trump would suggest and i think this is more evidence that mr. Trump is going to become unhinged and this is what the republican establishment is hoping for. Were going to take that moment of agreement in this segment there. To the topic of bill cosby, dogged by allegations of drugging and Sexual Assaulting dozens of women, he now faces his first criminal charges. His lawyers claim the case is politically motivated. Were you surprised the prosecutor moved forward in this case . O not really. I think last july when the federal judge released that transcript of his deposition in this, the civil component of this case. And then when you saw the election where for the Prosecutors Office who brought these charges and that was a central issue. I think anybody who was a close observer there locally expected these things to happen. Yeah, the bill cosby case was a center piece of this election, this campaign for District Attorney. Pand the new, the guy who was running to unseat the District Attorney kevin steele basically said, you know, the old guy didnt do it. Even when there was evidence he didnt brick any charges against bill cosby. He says castro refused to prosecute him. But i will do so. This makes cosbys camp say this is all about politics. Well and i think they have got a point there. The defense is clearly going to build it around that this was a political operation and not a legal or a seeking of truth or justice. But the problem is no judge is going to dismiss the case on that basis. But that becomes the theme for the defense. Then you are going to have these legal skirmishes. The first is going to be whether or not you will see in pennsylvania the prosecution with bring in other crimes evidence. How can they do that . Thats character assassination. Here they bring it under the guise of it shows his common scheme or motive. So it is going to be a battle as to how many people first of all or how many other women the prosecutor wants to put on the stand and whether or not that evidence comes in. Ill betting that the evidence will come in. So this is going to be kind of flattened out if you will and it will involve a lot more women. If they do want to establish his m. O. In court, his modus operandi. They have many different women to choose from. And the New York Daily News this morning calls it a he said, she said she said she said fifty times. There are at least fifty women who could come forward and testify they have similar experience to Andrea Constand. Do you think that is what this case will hinge upon because as we know there is no physical evidence . Well you might remember a couple of years ago in los angeles. They tried phil specter the music producer for murder of a young lady out here in l. A. And one thing they did because california has a similar law to pennsylvania is put on the stand four or five other women who had been threatened by him with a gun. A lot of jurors afterwards said that was very compelling evidence for them this voting to convict specter. I would expect you have at least four or five other women. I dont think you are going to want to put on ten if you are the prosecutor because then you give the defense ability to build a theme or have problems with trying to get consistency out of them but it would not surprise me at all to see five other women take the stand. Mark, do you put bill cosby on the stand . You very well might. This is the kind of case where you might want to put him on. But that is it is way too early to tell you. Never make that decision until you are in the heat of the battle. You have to see who your jurors are number one. You also have to see whether rnt you are trying this case for a not guilty or a hung jury. Those kind of dynamics that go on are really the trial lawyers, that is how he makes his living and you dont make that decision until the very end. Mark thank you. Happy new year. And it is because he recognized something so important about our relationship with technology, about how we live now. That hes one of the few people we admire not for who they were but for what he understood about us. So it is a very personal, a very emotional connection that doesnt have to do with him being a nice guy, but really about a deep insight that he had. It is an extraordinary story. If i loved my iphone and i have two of them, why should it matter to me that he was a pain in the neck to work or a jerk or offensive to work with or worse which this film seems to indicate . Thats really what im saying. That people recognize that he had a kind of deep humanity in the fact that he understood something deep about our humanity and that we were moving into a different relationship with technology. That we would see computers and computational objects as imagination machines, as a kind of second self. As a way to project ourselves into the world of objects. He saw that. At a time when people just said this is another machine. He saw that computers would not just do things for us but to us. He saw that when nobody else did. And i think people recognize that he saw that and they they admire him for understanding that about themselves. It is one thing being singularly focused and directed, which it is clear steve jobs certainly was. Another thing being cruel. Do you think that that aspect of him though is important to understand to get the full picture . I kind of do. He was im not sure that i would the cruelty was in the service of a kind of singlemindedness about a vision. And i think you sense that when you watch the filmed that this is someone focused on a vision that quiet frankly in the beginning he didnt share with a lot of people. Te frankly in the beginning he didnt share with a lot of people. He convinced the world of a vision that made people see was actually the way they experienced this new technology. So that when people walk around with their phone and they feel their phone is part of them, they are living out something that steve jobs saw. But that was not obvious when he started. But he saw that. A long, long career. Quite a legacy but a complicated legacy. Thank you so much for being with us.
