David gregory, the split screen was interesting yesterday to hear joe biden and President Trump ignoring the other candidates and just going after each other and, you know, obviously there were there is insults and name calling, but i guess we are going to get used to this through 2020. Yeah, but theres going to be a numbing effect. We always say this in these cycles that they start earlier, but its the case and the fact that theyre going mano a mano so early. This is not a settled matter. For joe biden its quite good for him that trump is elevating him to becoming his opponent at this stage because this is not a settled matter on the democratic side. Its important for biden, too, to show because i think theres a question for democrats how youre going to take the fight to trump. How are you going to avoid the trap that some others have fallen in, think about jeb bush and low energy, how are you going to fight back. Trump has no discipline, if he had more discipline he would talk about the economy, talk about jobs and would lay off biden, which is what his advisers presumably would like him to do, but, you know, the other thing about these head to head polls is we want to look at whats happening in the states and we obviously want to look at when its truly a one on one contest how trump streets it then. Bianna, it is interesting because the president yesterday one of the things he claimed was that he thinks that joe biden would be the weakest of his opponents. On the other hand, we hear from the president s advisers that they dont want him elevating joe biden and that hes got serious concerns about him. So which do you believe . Well, the president will do what the president wants to do, right . He can have advisers talk to him until theyre blue in the face and say dont talk about joe biden youre only elevating him, hes going to talk about whats in his gut. Thats the kind of person he is. Whats on his mind is clearly joe biden. He really gets at him. And joe biden has a way of focusing on trump without excluding the Republican Party as a whole. Something that youre seeing separate him from the other democratic nominees who are saying, this is much bigger than just one person. The Republican Party has changed and thus we as democrats have to focus on that as well. Joe biden is thinking about a general election and saying, listen, there are a lot of republicans who may have voted for obama, for me, for our team and now were wondering whether or not they are going to vote for trump if they did already in 2016, maybe they dont do so in 2020 and here is why. Hes focusing on one person, using this as an excuse to say, listen, President Trump for now was an anomaly, anybody who votes for him Going Forward in 2020 if hes reelected then we fundamentally will see a shift in this country. Before we move on to the other 2020 candidates lets get an impeachment status report from manu raju because you were able to capture Nancy Pelosis attention for a moment and pose it directly to her. Reporter thats not unprecedented for members to get testy when you ask them questions that they may not want to answer and she views the impeachment issue as a distraction because she thinks that her current strategy is working. She disagrees with the calls from a faction, it is a growing faction within our caucus, to open up a formal impeachment inquiry because she says the way that she wants to pursue things is to investigate, legislate and as she says litigate. She points to Court Victories that they had at least on two cases so far in order to get their subpoenas complied with, those subpoenas dealing with trump financial records, but the real fear, john and alisyn, is that if they lose in Court Democrats are really worried that if they do not succeed in one of these court fights, it could dramatically set back their efforts to oversee the executive branch, it could have a dramatic effect on their investigations. So thats why the argument youre hearing internally from people like jerry nadler making the case to pelosi an impeachment inquiry will add heft to their argument in court and thats why they should open it. Jerry nadler said congressional power is at their zenith then we have an impeachment inquiry. Pelosi didnt go that far when i asked her that direct question, she said its still an open question, shes not sure if an impeachment inquiry is the way to go. Its unclear what will move off her opposition because shes not saying if a majority of her caucus supports an impeachment inquiry she will go for it. Its uncertain what ultimately will get her to move. On that point, though, jerry nadler also said thebls at he believes or he knows that Robert Mueller will testify in public before the end of the summer. Summer is a long time, starts on your birthday. What day is that . That is june 21st. Lets listen to jerry nadler. Talking about a birthday. Conversations with him and he will come in and if we have to subpoena him we will. Would that be, say, by the end of the summer if he doesnt come in . Oh, i would think it would be way before that. So my impression is that if theres no agreement within by next week maybe slipping to the week after that there will be a subpoena issued by the House Judiciary Committee to compel his testimony probably sometime in july. Thats reading between the lines, this he have not said that so far, but thats where it seems to be going. As weve reported, Robert Mueller does not want to testify in public, he wants to do it privately, and thats something the democrats are not going to allow. So i think were going to end up seeing that subpoena fight play out. And thats really the point is that this is a longer process. This is going to be a longer grind about fighting in court about getting access to information, getting access to witnesses and a lot of people and a lot of reporters are going to want to get to the bottom line, you know, with nancy pelosi, but, i mean, i understand her frustration, but she also has this tension she has to deal with. She does have a restive caucus but its not the majority who wants to go to impeachment. Shes trying to keep them on the pace of lets keep investigating, keep it rolling without having to get to the finish line. She also wants to say we want to follow the law. Its a slippery slope if you have democrats already concerned that the judges in the judicial system may not be working in their favor and thus we need to focus on impeachment. That may be going a step too far and playing into the white houses talking point that this is all a witchhunt. That having been said americans have short attention spans. If we are talking about into august of 2019, bet for hold out for democrats to 2020, august of 2020 as we lead closer to the actual election if were going to hear from bob mueller. One of the things in his prepared Statement Speech that Bernie Sanders is going to say, now, lets be clear, while President Trump and his fellow ol low garks attach us for our support of democratic socialism they dont oppose all forms of socialism. They may hate democratic socialism but they absolutely love corporate socialism that enriches trump and other billionaires. I think they have a branding problem because socialism is a loaded word and conjures because it failed. Yeah. Right. Orwell owns that. In any event he is proud, he is a proud democratic socialist. Hes going to go out on the campaign trail and try to make people understand his brand of it. I think thats important to take the offensive to talk about in terms of class division, to talk about it in terms of gross income inequality and how that plays out from, you know, being devastated by healthcare costs or the cost of Higher Education and access to Higher Education and he is speaking to a growing and really animated part of the democratic base. And this is an interesting inner play, i think. You ask biden right now about a lot of things, like he said about claik the other day, do you know what my Climate Change policy is, beat donald trump. There is a part of the democratic wing, the progressive wing that is supportive of sanders, the broader electorate probably less so right now. You have an opponent in donald trump who is saying come on in and we are going to brand you as were going to turn america into venezuela and its going to have traction with a lot of people. There was reporting this morning that thats one of the complications with joe biden, joe biden is harder to point as an extremist, however, the Trump Campaign is looking at the rest of the candidates and waiting with bated breath. And joe biden is saying, listen, we can talk about specifics down the road. All democrats will they are liberal, whether they are more down the middle, they want one thing and that is to get donald trump out of office, so im the best candidate as far as joe biden is concerned to make sure that that happens. I think Bernie Sanders issue is in many respects hes still stuck in 2016. He was the outlier, he was the one with these extremist ideas, he notes that all the time, now, look, everyone is talking about universal healthcare, pre education, the problem is hes not bringing in more specifics like youve seen with a senator warren, even last weekend with dana bash when she was asking him for specifics he said i dont have them on me right now. What can and should congress do immediately . Well, i will tell you theres a number of things. First we gave this administration over 400 million in february to address the humanitarian concerns at the border. Ive been there since in the last five or six weeks, you know, in el paso and the situation down there is gruesome and inhumane. It is not acceptable in the United States for people to be treated this way. I think the department of Homeland Security knows that. Theyre asking for additional funds and i can tell you without fear of contradiction were going to provide the funds on the humanitarian side. The democrats feel that weve got to make certain that these people are treated in a humane fashion while going through our Legal Process. In addition, we need more Immigration Court judges, the president s longest shutdown of our government in history shut down the Immigration Courts at exactly the wrong moment. In addition to that weve got to come down hard on the smugglers and transporters who are exploiting these people. Mitch mcconnell reportedly is going to propose 4. 5 billion in funding for different m grags actions. Is that something that the democrats in the senate will get behind . I think youre going to see the overwhelming majority that we will support. There are some differences they want in policy, which we will have to debate, obviously, and may see differently than senator mcconnell. When it comes down to it we demand the humane treatment of children. We had too many children die at our border who shouldnt have died. We have got to make certain that we have show responsibility. The zero Tolerance Program of this administration which they tried and abandoned, separated 2,880 infants, toddlers and children from their parents. It was a gross mistake. The president even admitted it. Were not going to turn to treatment that mistreats children. And you would put restrictions on that money that mcconnell is asking for . Because thats what his side is saying at this point, the democrats are asking to put too many riders on this money. Let me tell you one of the riders we want to put is that the money actually has to be spent for what its appropriated for. This president is raiding funds right and left to build his all mighty wall at a time when they should be spent to make ur border secure in a reasonable fashion. Yesterday during the course of the hearing Lindsey Graham said and we all understand a wall isnt going to stop the problem that we face at this border. Lets deal with it realistic terms. He absolutely did say that. He also had another Interesting Exchange with Kevin Mcaleenan and this was on the issue of people have been granted asylum hearings, brought into the United States and whether or not they showed up for their initial hearings. Lets listen to this. We do see too many cases where people are not showing up. We did an expedited pilot with family units this year with i. C. E. And the Immigration Courts, out of those 7,000 cases 90 received final orders of removal and abstention, 90 . 90 did not show up . Correct. Do you have any reason to doubt those statistics . Of course i do. Let me tell you what it boils down to, if you have something as basic as people sitting down and giving these people basic information about the Legal Process that they face, they have an overwhelming turnout for the hearings, over 90 . If they even can sit down with Legal Counsel who will explain to them, all right, here is what youre going to face, here is the standard of proof which you are going to face, even that basic information helps them to understand the procession and be there. Its a bewildering process anyway, let me say that as a lawyer and a person who is has been to the Immigration Courts. But just a modest effort to give them legal information they do turn out in numbers over 90 . So i disagree with mr. Mcaleenan and his generalization. Well, you dont disagree with the numbers, you just say that those numbers are happening because these people arent being given the information that you think they need . No, i disagree with his numbers. He talks about a sampling. Be careful about the samples and how they are taken. These samples dont reflect the reality. Over the last four or five years weve done a survey and found over 90 of those who are supposed to come to a hearing on asylum status actually showed up at the hearing and that isnt what was reflected in his testimony yesterday. I want to ask you a question, a little bit of a campaign question but its also a Foreign Policy policy, you are also on Senate Foreign relations. It has to do with south bend mayor Pete Buttigieg who gave a speech yesterday on his Foreign Policy laying out some of his ideas and themes. He was critical of the administration as you would imagine, but also of democrats. Listen. Since the election of the current president the United States hardly has a Foreign Policy at all. Unless that seemed like a partisan jab, i should acknowledge that for the better part of my lifetime its been difficult to identify a consistent Foreign Policy in the Democratic Party, either. No, i think mayor pete is wrong in that observation and i like him and agree with many of the things he said, but when it comes to the basic Foreign Policy of the obama administration, i understood it. We did our best to keep us out of war, he made it clear the United States was going to stand up and fight for human rights around the world, he treated dictators like the head of north korea in a fashion that they had to prove good faith efforts to end any threat to the United States. Well, its been this just consistent roll back of regulations without a seeming analysis of why this particular regulation is no longer relevant and particularly when it comes to Climate Change its the scrubbing of any mention of Climate Change, its the restriction of the scientists, their ability to do their work, to say this could be a problem and here is what we need to watch. This is whats happening. You know, its not going to make it go away. By denying it its not going to go away. We are not as humans the only cause, but we certainly are a large part of it. So we need to be studying this and the public sees t you see every poll that says better than 50 of the American People even among republicans know the climate is changing, say the climate is changing, say its serious, humans have some role to play and we should be doing something and this Administration Just refuses and theyre hamstringing scientists and their ability to do their work. The public also feels it. I mean, we report every day it feels like, certainly every week on extreme weather thats gripping the country, extreme weather events and that of course is getting peoples attention. You know, i asked our producers to make me a full screen graphic so we could show the viewers some of the roll backs that President Trump has done since hes taken office and they came back and told me that they couldnt make it because there are 83 of them. They said no graphic could ever support those 83. So weve narrowed it down to just three. Here are three at random that we will put up on the screen that the Trump Administration has canceled a requirement for oil and Gas Companies to report methane emissions. As the ozone layer is being threatened theyve canceled that. Revoked a policy designed to preserve oceans and other waters and revoked obama era flood standards for federal Infrastructure Projects just as the midwest is having historic flooding. What is the one thing that keeps you up at night . Is there any way to put your finger on the thing that has been most alarming to you . Well, its all of this. Its the roll back of the tail pipe standard with cars which makes no sense. The car manufacturer is already there, the big manufacturers are coming to the administration to say dont do this. It seems to be this attitude if obama did it its gone, good, bad or indifferent. That really worries me. The biggest thing long term is this erosion of trust in science. They are trying to create confusion in science, by not allowing pure science, they are replacing people on the Science Advisory Board with people from industry. While industry has a right to be heard when there is a regulation that affects them they should not be the dominant voice. Thats what were seeing this administration again and again talking about just the economics of an issue. Epa is about protecting Public Health and the environment. The economics play a role, i mean, you are allowed to consider it in some cases on clean air standards, you might consider it in others on their third set of clean air yar i cant say where you are not allowed to consider cost benefit at all because its too important for human health and yet this administration seems to be ignoring that entirely and as if theyre also going to change the way you assess deaths and attribute deaths to particular things. Studies will tell us that between 200,000 and 300,000 americans die from dirty airborne related causes, diseases, heart attacks, plaintiff seem ma, cancer, those kinds of things, asthma. Its the number one reason for missed school days in children. I defy anyone to go to an event, if youre giving a speech sore a talk, and ask the audience who has asthma, who knows someone with asthma, a Family Member with asthma, twothirds of the hands in that room will go up. Its happened to me every time ive done it, no matter where ive done t i even did it at a graduation and the sapg thing happened. We dont know what causes asthma, but we do know what can trigger an attack and make it worse and thats dirty air. We ought to be going after these things, they contribute to Climate Change as well. You bring up the economics, what the president s people in his administration have told me along with his supporters they felt there were too many regulations that had piled up over the decades and they were a stranglehold on business not just big corporations but even Small Business owners and formers and was that a fair point . Yes. I mean, thats absolutely fair and i think regulations should be revisited because we learn more. Science gets more if you allow science to be science, it will find out more things, it will determine that maybe something that we thought was really bad isnt quite as bad or that you can there are new technologies to deal with it that arent as burdensome. Thats absolutely appropriate. But as you mentioned at the start, if youve rolled back 85 regulations in this time period in less than four years, youre not doing the kind of Scientific Study behind them to justify those roll backs. Thats the one piece of good news because the roll backs will be challenged, they will be challenged in court and if they havent done the job they being epa hasnt done the job in saying this is why this is no long ever irrelevant you just cant get up and say i think arsenic is okay, go ahead and have a glass. You have to come back with this is why the standard is set at the wrong place, it needs to be high higher, needs to be lower, this is the backup, the Scientific Data backup that justifies that. The apology rejected, he served nine years in prison and now lives in las vegas. And it is worth noting that the murders of nicole brown and ron goldman are still officially listed as unsolved, john. Cnn chief legal analyst Jeffrey Toobin covered the trial for the new yorker. You can see him there in the crowd. There he is. Right there. There he is, thats Jeffrey Toobin. Boy reporter. Hasnt aged a second since then. Hes also the author of run of his life, the people versus o. J. Simpson which is a terrific read, like all of jeffreys books. Look, we barely have enough time to talk about this. We could talk about this for days on end. I want to focus on two moments, if i can, first, that picture we saw you of the verdict. Talk us to that moment while young Jeffrey Toobin is in the courtroom while the verdict is being read. The extraordinary thing about verdicts in general, in so many of our political lives and so much of the News Business you sort of know whats coming. Everybody you know, when somebody is giving an acceptance speech, an election result, you have polls, you have some idea. No one knew. I mean, the tension in that room was so extraordinary. It was like there was no one breathing. I mean, you could just see all the air molecules sitting there not moving because no one was exhaling. The jury talked in and, you know, one of the cliches that i find is true about verdicts is if a jury is going to con difficult, they look away from the defendant but if a jury is going to acquit they look at the defendant. All those jurors were looking right at o. J. Simpson. That famous shot youre looking at right there, the camera was right above the jury box, you never saw the jury on television, but they were all staring right at o. J. And i remember, you know, dominic dunn, a lot of people in that courtroom are gone, Johnny Cochran has died, dom anyone dunn the great reporter for vanity fair who was sitting a couple seats away from me he has died. I remember dominics mouth just dropping open and i remember mr. Kardashian who, of course, was not as famous then, that name wasnt as famous then, and he looked almost stricken. And the Goldman Family who were right in front of me, joe mcginnis the reporter over there hes also died. Theres ron goldmans father, his sister. I mean, they were so distraught, it was you know, you just had the sense and little did i know you just had the sense that the story as big as it was was going to get even bigger because so many people thought he was guilty, including of course me, and i continue to believe that with all my heart, but the idea that he got acquitted after all this evidence meant that the story was going even farther into the stratosphere. And of course and then it revealed the deep racial divide in this country. Previously probably unknown to that degree of how people saw the trial and how people saw o. J. Alisyn, that to me is why the trial matters. It was a celebrity event and obviously the heart break of the families of ron and nicole, thats always going to be the most important thing about the trial, but what made it a Major National event was the videos we all saw after the verdict where you saw crowds of black people cheering, crowds of white people stricken and it really was a lesson in how the races view the criminal Justice System so differently. I dont think we all realized how profound the divisions were in this country about race and criminal justice. Berman, you mentioned the series that i was very proud to be associated with and it was fx not netflix, but the reason why i think that series resonated so much is that it came out right at the time of ferguson and black lives matter and all of the renewed tension between africanamericans and law enforcement, of which the o. J. Simpson case for better or worse was a big part. That to me is the big larger lesson of the o. J. Case was about race and criminal justice. When did you know we have to let you go, were out of time. When did you know in the process that this was going to be something we would be talking about 25 years later . You know, i guess i didnt. I mean, i really didnt know how big it was. And it was only after the verdict. It was only after we saw the racial divisions and the aftermath that i thought, wow, this isnt just some celebrity murder case, this is a Major National event.
