At least 12 people have been killed after a gunman opened fire at a California Bar last night. It was College Night with people dancing, playing pool, hanging out with friends. Police say the shooter was a 28yearold white man, and they add they had been called to his home before. Thats his home where he lived with his mother. They were called there because of a domestic disturbance. A neighbor telling cnn that the shooters mother lived in fear of her son. Authorities still do not know the motive behind the attack. Its a scene that has become all too common in the country. Its the worst mass shooting in 11 days, disturbingly cnn was told by at least one survivor of the shooting last night he was also a survivor of the shooting at las vegas at the route 91 Harvest Festival just over a year ago. More from outside the shooters house in newbury park, california. The shooter was known to Police Including this incident where apparently some Mental Health specialists were called to that home . Yeah. They came here. This is the second time this year that police had besendedde on this home. Police had known about this man, a troubled young man. The neighborhood knew and the mother spoke about her fears of her unstable son, the police, the neighborhood, the mother could still not have predict what had happened next. Weve got multiple people down. We need a lot of ambulances. Reporter initial 911 dispatches from the scene only hint at the horror unfolding inside. We have one victim. He was shot and is bleeding at the entrance. Reporter College Country night at borderline bar in Thousand Oaks, california, outside of los angeles had drawn a crowd of more than 100 young patrons. Parents now just beginning to learn which of their children will never return. Oh, son, i love you so much. Oh, heavenly, just please be with him. The gunman, ian david long was a 28yearold war veteran who entered the bar just before 11 30 p. M. Carrying a. 45 caliber glock and an extended magazine. I saw him point to the back of the cash register, and he just he just kept firing. He shot the front doorman, bouncer. Just a young man, and he shot the cashier. First responders rushed to the scene as survivors scrambled to escape. So they, unfortunately, are young people, people at night clubs, have learned that this may happen, and they they think about that. Reporter and then he broke through bar windows while others ran to hide in bathrooms and attics. Friends got the bar stools and they started slamming them against the windows so we could get out. Victims were carried out one by one and desperate lifesaving efforts took place in the parking lot. Still, many remained inside. Were still missing two people. We cant find them. The gunman was found dead inside the bars front office, an apparent suicide according to police. Were now learning he was a former marine, infantry machine gunner who served in afghanistan. He was also known to police. Last april Law Enforcement responded to a domestic disturbance at this newbury park home where he lived. Reporter the Mental Health experts out there cleared him that day. The deputies went out to the call with the crisis team that felt he might be suffering from ptsd. Richard berg who lives a block and a half away tells us longs mother feared for his future. Reporter she might have been afraid of him herself, i dont know. She never said that, but she was living in hell. Reporter the department of defense records show he was active marine for five years, from 2008 to 2013. It was after that that he enrolled at cal state northridge, but he did not graduate and that man that i spoke with, jake, richard berg, the neighbor who lives around the block. He says that his mother was often desperate. She would talk to neighbors lime hick how she wanted her son to get help at the v. A. But her son simply refused. Jake. Thanks so much. I want to bring in a Law Enforcement panel now. Ill start with you, phil mudd, the shooter was known to police for some minor incidents, but one in particular where Mental Health specialists were called. Take a listen to the sheriff. In april of this year, deputies were called to his house for a subject disturbing. They went to the house. They talked to him. He was somewhat irate and acting a little irrationally. They called out our crisis intervention team, our Mental Health specialist who met with him, talked to him and cleared him. So Law Enforcement knew about him. Mental Health Specialists went there. They ultimately cleared him. There are going to be people who say and ask did Law Enforcement drop the ball here. What do you think . Are you kid considering me. Wolf, pardon me. Jake. I live in an urban area. Im going to pass people with Mental Health disabilities when i go out to my home tonight. Instead of asking about this individual case, the question you have to ask is among the thousands of people encountered by Law Enforcement and psychological experts, 5,000, 10,000, 20000, how many pop out as exceptional . Is this person exceptional . When you get to that standard theres a couple other questions i would ask. One in particular would be what are your protections against legal action in the event you bring this person in and attempt to take their weapons . Put that in connection with Broward County where we also saw some Mental Health questions. If you see 10,000 of these, how certain can you be that you can pick out the one that can go ugly on it . Josh catch bell formerly of the fbi and now with cnn, police say, josh, they dont have any motive so far. What will they now be doing to try to figure out, no the that theres any reason that would make any sense, but to try to figure out why this happened so we heard earlier from authorities, jake, that they were waiting for a search warrant to go in to where the subject lived. That would potentially provide a treasure trove of information if they were able to go through a computer, if he left anything behind such a letter or manifesto or something that would allow them to get into the mindset of this person. We know he has as social media presence. Thats something they will be looking into no doubt and trying to get search warrants there, too. All thats going on. Right behind me is where they are doing the forensic examination, a very sad undertaking behind me because they are going through and processing the scene and trying to identify some of the victims and some of the bodies, so a multifacetted investigation here, jake, but ill tell you. We got here in the Early Morning hours covering this, and throughout the day it finally dawned on me, you know, that the American People are becoming experts in investigating mass murders. At some point they wont need us. They know by now what cops look for. They look at the motive and associates and the social media. Its really damning, an indictment of where were as a country that we continue to see these all over again and sad on a number of fronts, jake. And james galianos here with me. He apparently had one handgun. Is that unusual and does that tell you anything . Unusual from this sense, a handgun to do this type of damage, 12 killed here, but we need to recognize who this shooter was. Four and a half years in the corps, in the marine corps, not only that but served in afghanistan during some of our bloodiest fighting. 2009, 2010, 2011. He was there during the surge. He was also rated as a machine gunner. I mean, he carried an m240 or 249. He knew his way around weapons. If he had the extended mag that police talked about or was proficient in changing magazines, yeah, you could do that kind of damage if youre that skilled and a marine corps serviceman that served in the helmand proves where the bloodiest fighting for the corps was, yeah, he could accomplish that. Youre also a veteran, and youre not besmirching veterans. Youre saying he had a certain kind of skill that he learned. An aptitude, certainly. Some witnesses, phil, say the gunman used smoke bombs and they were unable to confirm that. If its true does that say anything about the planning or motivation . It doesnt say much to me. One of the simple questions i would have in that circumstance, jake, is to determine when the person acquired these. If they had them for years, that would suggest to me that those smoke bombs werent something that showed he was intending to conduct an action. If he acquired them in the past few days, your answer changes there. I think the issues here arent going to be about planning. They are going to be about the mental state of this person and what Mental Health professionals do when people in the neighborhood call in, again, as they did in that case in Broward County with the kid who shot up the high school. What do Law Enforcement and Mental Health professionals dozen . Today, thank you one and all for your expertise. Today a ceremony honoring the Ventura County sergeant who lost his life protecting everyone at the bar. Sergeant ron helus was a 29year year Law Enforcement veteran who was looking towards retirement in the next year or so. Moments ago we learned the name of another victim, alaina housley. She was the niece of tv actress Tamara Mowry Housley and also killed, cody coffman 22yearold with three younger brothers. Coffmans father had a heart wrenching press conference. A father burying his sone. Its almost impossible to watch. We are starting to learn more names of the dead now. These are young people whose lives had barely begun. We did just get the news that he was one of the 11 that were killed last night. Reporter jason coffman, father of 22yearold cody receives the worst news imaginable. His name was cody coffman. My first born son. Only him and i know how much i love how much i miss oh, god. This is so hard. Oh, son, i love you so much. Oh, heavenly father. Reporter for much. Day coffman hoped, prayed, his son was simply missing. He used the tracking function on his sons phone to find him. Its not moving. Its not moving. Thats the problem. The last thing coffman said to his son is dont drink and drive, and son, i love you. That was the last thing i said. Reporter shockingly others in the bar had survived the mass shooting in las vegas just last year. Unfortunately its the second time in about a year and a month that this has happened. I was at the las vegas route 91 mass shooting. Its a big thing for us. Were all a big family and, unfortunately, this family got hit twice in all, 13 are dead, including the gunman. At least 21 injured. When the call came, Sergeant Ron Helus was on the phone with his wife. Sergeant helus was having a conversation with his wife as he does several times during the shift and says, hey ive got to go. Handle a call. I love you. Ill talk to you later. Reporter as others rushed out, helus, a 29year veteran of the vent rah countys Sheriffs Office rushed in. When Sergeant Helus and the Highway Patrol officer went in, they immediately, changed gun mire with the suspect, and thats when the sergeant was shot several times. Helus who was planning for retirement was remembered today in a spur of the moment memorial. People lined the route as his body was moved from the hospital to the funeral home. Now also dead is 23yearold justin meek, his University Cal lutheran said he helped save lives before he was killed and alaina housley, the 22yearold you mentioned at the top, niece of adam housley who we know from the news business. Thats what a source close to the new acting attorney general Matthew Whitaker tells cnn despite the fact that hes been something of a frequent critic of special counsel Robert Muellers russia investigation, previously questioning the scope and reach of the investigation, calling muellers appointment ridiculous and fishy. Whitaker has even defended donald trump jr. s decision to seek dirt on Hillary Clinton from russians once it was offered, an act that even steve bannon he regard as treasonous. Whitaker spent some of his first day on the job at the side of the president and Deputy Attorney general Rod Rosenstein previously in charge of probe. Cnn jut tis correspondent Jessica Schneider joins us. Do you know if they could force him to recuse himself. Reporter this is a question for ethics advisers at the Justice Department, and really even if the advisers suggested that whitaker step aside, hes not obligated to follow their advice, especially since his questionable comments are more of a conflict of interest than a legal conflict, and tonight there are ample indications that whitaker has no plans to step aside. In his first full day as acting attorney general Matthew Whitaker went to the white house amid demands from democrats that he recuse himself from overseeing the russia probe, but whitaker has given no indication he believes he needs to recuse himself according to a source. That philosophy is echoed by white house officials who sources say also dont believe whitaker needs to step aside, and the Washington Post report that had people close to whitaker dont believe he would approve mueller seeking a subpoena for President Trump. My understanding of the scope is that it is limited. Reporter the news is no real surprise, since whitaker spent several months in 2017 making the rounds in the media, picking apart the special counsels case. There is no criminal obstruction of justice charge to be had here. The evidence is weak. Reporter whitaker was working as a legal commentator for cnn when he defended that trump tower meeting in june 2016 where donald trump jr. And others met with a russian lawyer who promised dirt on Hillary Clinton. To suggest that theres a conspiracy here. I mean, you would always take that meeting. Reporter on cnn. Com in august 2017 whitaker warned that muellers investigation into the president s business and personal finances has come up to a red line hes dangerously close to crossing and if he didnt limit his concerns that it was just a witch hunt. Whitaker seemed to foreshadow what he might do now that hes acting attorney general. I can see a scenario where jeff session is replaced with a recess appointment and that attorney general doesnt fire bob mueller but reduces his budget so low his investigation grinds to an almost a halt. Reporter whitaker spent years on the political circuit. Im not sure what were passing on to the next generation. Reporter he lost his bid for the republican nomination for a u. S. Senate seat in 2014 and state treasurer in 2002. President george w. Bush named him u. S. Attorney in iowa in 2004 where he served for five years. Whitaker later joined the Advisory Board and was first paid in october 2014 for a company has since been shut down and slapped with a 26 million fine by federal authorities. I want to start with the new cnn reporting that acting attorney general matt mate ker has no intention of recusing himself from overseeing the russia investigation. Listen to what he said about muellers appointment on a radio show last year. Whatever reason Rob Rosenstein has determined that the department of justice couldnt handle there in their ordinary course of work. Exactly. Which was an effort by jim comey to get this, you know, put in place and have somebody that hes very familiar with in bob mueller conducting the investigation. You know, i i think it smells a little fishy. I think it smells a little fishy. Your response, sir . Well, look, this is why if he doesnt recuse himself that any decision he makes in the Mueller Investigation is going to have a taint about it. Its going to cause a profound question among the public about whether these decisions are being made by the new attorney general, acting attorney general in the interest of justice or purely in Donald Trumps legal liability interests. This is exactly why he ought to recuse himself, and one question that we have here in congress right now is did he, was he forced somehow to make a commitment to the president to ignore the advice of ethics lawyers at the Justice Department or not seek out their advice . Was that part of his getting the job because this president is guided by one thing alone and thats whats good for donald trump. The country doesnt matter that much. If President Trump ultimately takes any action that results in mueller being fired, whether its by whitaker or some other way, what action will the democratic controlled house of representatives take . Well, one of our first actions even in the minority has been to send out preservation letters to the administration to make sure they preserve all evidence, but if the president effectively undermines the rule of law and causes the special counsel to be fired or an abrupt or partisan end to this investigation, then will fall on congress to find out the facts itself, to get those facts from the Justice Department, to continue our own investigation so that we can tell the country exactly what happened, and we can hold people accountable if they take any unlawful act of obstruction of justice, so there are remedies that we will have and exposure is probably among the most powerful. Youre likely going to be chairing the House Intelligence Committee come january. Youve hint that had you might reopen the committees russia investigation and interview individuals that the republicans on the commit were not willing to do so. Who are some. Names on the list . Well, look, you know, what happened actually six months ago when the republicans walked away from the investigation is they decided to focus all of their investigation on investigating the investigators, on harassing the Justice Department and the fbi and basically do the bidding of the president. Weve continued, jake, to do the investigation. Weve continued to bring witnesses in. That wont change when we take the majority. It will just be that much easier because we can compel people that have been unwilling to voluntarily cooperate. I dont want to go through the list of witnesses. Were going to look at what work we were able to do, what work we were prevented from doing and it may be that when we do get the gavel in january that we already have the advantage of a robert from bob mueller or subsequent indictments that will help guide us in terms of what work remains to be done. President trump said on twitter and then he reiterated at his press conference yesterday that if the House Democrats with new subpoena power investigate him, he could have you all investigated as well. Whats your response . Well, look, that sounds like if hes talking about using the Justice Department in order to do his bidding, another violation of the rule of law. If hes talking about having the senate do it, i dont know what exactly hes referring to, but hes been on a war footing with democrats from the very beginning. This is the first president who has made no effort to reach out to the other party, no effort to find common ground, who seems to get up every morning to find new and inventive ways to divide us certainly along lines of party but also race and ethnic origin and Everything Else so hes been on a war foot. Were going to try to work with him where he can on issues like infrastructure, if he has any genuine interest in it. We would welcome that, but we will not be intimidated by into holding back in any way from our constitutional obligation to do oversight, and the fact that this hasnt happened until now, the president has been able to used a congress that would simply do his will and look away at any allegation of malfeasance or corruption. Those days are gone and the sooner he realizes that, the better. Were going to do our jobs and he needs to do his. You were very critical of the republican chairman of the house intelligence chairman devon nuance for not running the committee of running the committee in a way, bipartisan way. Do you plan to return to the previous model making sure that all actions are done hand in hand by republicans, or are you going to do what you want to do regardless of what devon nuance and the republicans on the Committee Want . Were certainly not going to be running the committee the way the republicans did. And in fact where we had a rapture was with the chairmans midnight run and that whole sag a. You cant run an independent investigation if youre essentially working in cahoots with the subject of the investigation, so were going to try to return to regular order. Well continue the nonpartisan tradition of the committee. Of course, were going to need a willing partner on the other side and it remains to be seen whether they will adapt a different tactic in the minority than in the majority but we have no interest or intention to be punitive or try to exact retribution. I would love to see us restore comity on the committee, and more than that resort the confidence of the Intelligence Community in the committee which was squandered when the nuance memorandum was published and map the majority selectively declassified information. A noted conservative attorney once considered for a major position in the Trump Administration is today slamming President Trump for appointing Matthew Whitaker as acting attorney general. In a new oped he coauthored, George Conway works also happens to be the husband of Kellyanne Conway calls the decision illegal and unconstitutional writing, quote, because hes not undergone the process of Senate Confirmation theres been no mechanism for scrutinizeding whether he has the character and ability to even handedly enforce the law in such a position of grave responsibility. The public is entitled to that assurance especially since mr. Whitakers only supervisor is President Trump himself and the president is hopelessly compromised by the Mueller Investigation. Lets discuss some strong words there, margaret hoover. Right. So you constantly this reads like a legal brief. Very easy to understand. Its a very clearcut case, right if youre a principal officer you directly report to the president of the United States, advise and concept, they have to be able to weigh in. Thats the merits of the argument. What about the author what im interested in right now. Fascinated by this right now. I cant imagine if my husband wrote this and i was working in the white house. You can actually imagine that. I can see that theoretically. That could happen. I cant imagine myself working for donald trump. Thats the only place that where the parallel doesnt play out. I think the flip side is trying to think through what the counterargument is and this is through the vacancies act, the president can they have to have legal argument on their side. What is a white House Counsel going to say, through the vacancy act somebody has to be able to serve in that position. Thats Rod Rosenstein. He intentionally bypassed him to get a person in to pursue the investigation. This is beyond the he said and she said of it. It sets up a real legal argument for a suit to be we filed to resolve this. It may not work out before the president wants. Before you get into the legal weeds, just step back and this is whitaker trying to manifest to the secret and most perverse way. Hes on the record saying theres a scenario where sessions is forced to recuse himself and then, i dont know, they appoint someone, this guy, and then i come in and you put a stranglehold on us by not giving us the resources financially to do the investigation that it requires. Thats one. Few ways in which he can influence this investigation. He can also limit the scope of it. Not make the report public, so, i mean, this is a whole new ball game. Whitaker he worked for, former Trump Campaign staffer who has been interviewed and called muellers appointment fishy and overreaching. The thing about President Trump is you give him credit for its all transparent. Its all right there. All there. The lengths to which this has been the person who has been on record saying how they feel about this investigation and the fact that they would be it had closed down is something that was plain for the eye to see, so the fact that they still went ahead with this just another example of President Trump and this white house really flouting a rule and guidelines and floutings things that have been norms for a long time and even more so than that doing it with a kind of arrogance for the population to say that this is what we know they wanted to constrain the Mueller Investigation and they are doing so infront of the playoff. Last week when cnn and nbc and fox refused to air had a commercial, was that last week whenever it was, it was so offensive even fox wouldnt air it and now were hearing people on fox, judge napolitano, talking about how unqualified it is. The president has every right to have whoever he wants to run the Justice Department, yet hes chosen someone who does not qualify under the law to be the acting attorney general. So hes really not i mean, and judge napolitano. Who generally thats who wants to be the next ag of the United States of america. Come on, come on. You audition on fox news. He couldnt take a pay cut, a pay cut. Please, when fox hosts listen to trump go after his picks it leaves a mark and he seems to be making a similar argument to conway. This is so apparently what it is which is why people with legal pedigrees are saying, why, this guy doesnt represent the best and the brightest, a pure political play to represent the president and this is setting us up for a constitutional crisis. Do you think the way nat senate, the 55republican vote senate would not confirm Matthew Whitaker . I think they probably would confirm him. Its hard to make that judgment. I do think something thats interesting thats coming out of this is the fact that you finally see republicans like senator flake coming forward he wants to advance legislation with senator koon. To protect muler. We were asking when that was going to happen. Im really skeptical of that. Flake represents an outgoing wing that have party and we know that the base of this party still very much with the president , and thats reaffirmed on tuesday, and so so i think looking forward the question of would the Senate Confirm whitaker, all signs point to yes and all signs point to republicans never say no to trump. Now i would like to introduce special agent in charge of the los angeles atf office, bill mcmullen. Good afternoon, im the atf special unit in charge of the los angeles field division. On behalf of the men and women at atf i would also like to send our condolences to the victims and family members who are trying to get through this tragedy together as they get through the healing process. I would also like to recognize the leadership of sheriff dean and the entire vent rah county Sheriffs Department as they were going through the same emotions and trying to fine the strength to brick together all the if the, state and local agencies to make sure we Work Together as a team and throughout the night in cop junction with our state and federal partners, well continue to do that until this investigation is completed. They are still processing the car. The evidence that they have obtained both in the car and the residents inside they are still processing the car. They are also processing the residents as well as the bar. The items that are taken out of there, were not disclosing that at this point. If you could just address in the few hours, and it has been some time this morning, on why this took place, can you offer any sort of explanation at this point to where you have an understanding as to how weve arrived at where we are now . As you suggested, its only been a few hours. It will would be premature for me to speculate on the motivation, but i can assure you that well follow all the leads that are developed through witness interviews, evidence recovery, the forensic evidence, any Digital Media that we recover, and we will be sure to paint a picture of the state of mind of the subject and do our west to identify. [inaudible question ]. So ive seen those reports, but i dont have any familiarity with his medical history or medications. Can you give us an idea of the scope of the resources that your office has been provided for this investigation. So the fbi, los angeles evidence Response Team on scene right now. Were going to be supplemented by evidence Response Teams from other field offices around the country. The resources of the Fbi Laboratory are en route. We have victim specialists who are inbound as well to assist at the Family Assistant Center with the victims families. We will pursue the digital trail and any other leads that we need to. We have the manpower to conduct as many leads as are necessary in coordination with the Ventura CountySheriffs Department investigation. Any Technical Resources that they request. We will look to supply. [inaudible question ]. Well, so, the investigation is developing. It might be premature for me to talk about a specific timeline. I know were working on the seeiens of events as they occurred, but i dont want to get out in front of what the evidence in the investigation will show. This morning the sheriff said it looked like [ inaudible ] i dont think we can say anything about the cause of death until the autopsy comes back, so at this point our crime scene investigators are on the seen. They have had a closer rook many at the evidence, and well look for developments in that record. Who is in charge of the investigation . Ventura county Sheriffs Department, our federal partners and the fbi are here to support the sheriff. Can you talk a little bit about sgrsh were there any cameras inside or outside . Im sorry. [ inaudible question ] do you know anything specific about the magazine . Its been reported that theres been highcapacity magazines. But in terms of the specifics we need to work that out so were much more precise. Your investigators have been able to talk to his parents. In coordination with the sheriffs president a number of investigations were going often i dont want to speak to all the investigative avenues that are ongoing. Sir. [ inaudible question ] so were per suing all the available leads and well be seeking anything in and around the premises and also any video taken from witnesses inside the bar at the time of the crime. Can you talk about anything that you may have already recovered from the suspects home that may that for a long time he was trying this. No, i dont think i can xhont on that. It will be premature. Im sure you can appreciate the sensitivity of this situation and our need to protect the privacies of the family. I want the families to be rernlg of the development before notifications have gone out through the Sheriffs Department or other investigative vefs. Walk us through the process. Well, so the evidence Response Team is in place. Its going to be a thorough and painstaking process. It will take as long as it is takes, quite frankly. It will take some number of days. Well make sure we bring the appropriate resources from the Fbi Laboratory division. They are en route. We will use all the resources that we can bring to bear, and and well pursue the appropriate interviews. Recovering the evidence from the scene and once again were doing this all in support of the Sheriffs Department and were bringing our Technical Resources to bear in terms of our investigation and well lease it to the captains and well take of the investigative steps after that. Im not going to comment on the evidence as its been recovered from the crime scene at this time. What similarities or differences have stuck out to you from other crime scenes such as San Bernardino or others that youve been to or studied . What sticks out here compared to those . Well, i i think each one is horrible in its own way. You know, the similarities that we would draw at this point are that they are all tragic circumstances. From a Law Enforcement point of view, certainly we try to do some pattern analysis in order to get out in front of these types of threats, to be involved with our Mental Health community and be involved with state and local partners and to reach out with private sector communities and to make sure that individuals are at risk will come to our attention. The fbi acting director of the los angeles office, paul dell agincourt, they just said they will be processing the scene. What exactly does that mean. This is a local investigation but appears that they will bring in all of the resources that the federal government can behind. Inside the crime scene is a neck and horrific effort. They will be identifying of the victims inside and they need to account for every dank did round. We heard that the suspect didnt have a phone on hip. Do they know the difference between a phone that belongs to a victim. This is the same team that, unfortunately,ing in to 14 was processing the situation in San Bernardino when it happened. It will take several days but it will be very thorough anything else that caught your ear that might be news . Has fash said. This was a local investigation. The Trump AdministrationJust Announced a new interim rule to ban migrants who enter the United States at the southern border for call firing for asylum. Cnns Abby Phillips at the white house. What can you tell us about this move. Reporter jake, just a few minutes ago the Trump Administration announced they issued a rule that would change the criteria for how migrants are allowed to apply for asylum at the border. If they cross the board el lylely they will be prohibited from seeking asylum. Now, this is part of what you mentioned that President Trump says last week he would be doing this woke. It will be interesting tomorrow were announcing a proclamation who will give us inside. Olympic they apply a blanket to everyone crossing the border or those people specifically from the Central American country where the caravan is coming in. The problem is you have detection facilities at call capacity because the Trump Administration is not willing to look into alternatives to hold beam, if they dont like this, there are acts that can be taken.
