Breaking news. Welcome to the lead, im jake tapper. We start with breaking news in our political lead, shocking news that the office of the u. S. Attorney for the Southern District of new york is investigating Rudy Giuliani who himself used to be the u. S. Attorney for the Southern District of new york. The probe deals with not only potential corruption, but also includes a counterintelligence investigation about whether giuliani helped wealthy foreign figures attempt to influence the white house. Joining me is cnns evan perez and sara murray who broke this story and former federal prosecutor kim whaley whose knew book how to read the constitution and why is out now. The fact there is a counterintelligence component, how stig is that. It is a big deal. Because this means that this goes beyond just runofthemill financial crimes, possible corruption. It means that there is a National Security component that there is that National Security threat component to the investigation and that is why fbi agents and prosecutors are looking into whether or not Rudy Giuliani witness wittingly or unwittingly was part of an influence operation targeting the trump white house. People overseas figuring out a way to use Rudy Giuliani and his close tied to the president to influence the way u. S. Policy is carried out and that is a big deal. And sar a, last week the two figures connected to giuliani, the two that were arrested but the indictment didnt arrest giuliani and what does that say about the scope of the investigation. When they put the dieindictm out it was narrow and had to do with lev parnas and igor furman and made clear this is an on going investigation and now were starting to get a glimpse of how wide spread that investigation could be. It was just yesterday i think that Rudy Giuliani said he doesnt need a lawyer any more. And i dont necessarily know that is correct for him over the longterm. What were learning today is that it is very clear that investigators were looking into how Rudy Giuliani could potentially be playing into this entire scheme and as evan said whether it was wittingly or unwittingly and why he was in business with these two guys to begin with. When you talk to people, they say they were shady characters and Rudy Giuliani should have known better. And kim, how serious is that their counterintelligence investigators. There is criminal investigators on the one side and fbi and then counterintelligence and the idea is to rule out espionage and ruling out behalf of the Ukrainian Government, that is not consistent with what is best for American People. And to the extent to which President Trump was part of that, that is scary stuff. I think it is important to keep in mind in light of the impeachment hearing, now were seeing the Justice Department kick in. The power of grand jury subpoena overseen by a federal judge, we dont have the questions of can congress enforce the subpoenas. We have professional prosecutors gathering the evidence, not just members of congress. Because remember in watergate, ken starr had one big binder and here you go and congress has been hamstrung doing it on its own and now it has the Justice Department behind it. And one of the fascinating things about this, jake, last month when we got the briefing about the president s july phone call with the ukrainian president we heard that they looked at Campaign Finance as an issue and they had found no violation. Case closed. Turns out the new york prosecutors and new york fbi was working on this separate case and it appears to be a lot bigger. Certainly involving the president s attorney, personal attorney. And that is one of the things that main justice headquarters of the Justice Department doesnt have tight reins on. We know the new york prosecutors march to their own drum beat and do things that headquarters doesnt like. Well see how this goes. There is a lot more here that is kind of out of control frankly from d. C. Than people realize. And lets remind people Rudy Giuliani mentioned in the original trump zelensky as the guy to talk to who knows what is happening and giuliani admitted to chris cuomo he asked ukrainian officials about joe biden. Take a listen. You did ask ukraine to look into joe biden . Of course i did. You just said you didnt. And you want to cover some ridiculous charge that i urged the Ukrainian Government to investigate corruption. Well i did, and im proud of it. Lets walk through giulianis role. Officials are accusing him of leading a shadow diplomacy and the personal attorney for the president and mentioned in the phone call with the ukrainian president and there are these guys arrested last week, lev parnas and igor trueman and they contributed to pete sessions. Hes the center of this whole thing. He is. And hes at the center of what was a ukrainian and or Russian Misinformation Campaign that made its way to President Trump and Rudy Giuliani was at the heart of that. He was one of the people and the president certainly embraced it and championed it but one of the people until t people in the president s ear and this ambassador is having problems and bad mouthing you and not doing what you want and there is information about the bidens. We should be pressing them to investigate. And giuliani was going on his own trips to press ukrainian officials for more information. Now we dont have any indication that any of that information is true. That the bidens did anything wrong. That this ambassador did anything wrong. In fact everyone that you talk to said the information cant be believe and the ukrainian officials that are peddling it are liars and yet Rudy Giuliani wrapped his arms around it and took to the president and it is hard to believe that is not something investigator are interested in. What mike pompeo caused him to abruptly quit his position at the state department. And President Trump treating the oval office as a game show surprising a grieving family that the move the family described as an ambush. Stay with us. The calls upon the president to urge the turks to exercise restraint for us to have humanitarian assistance to the some of the kurds, children are being killed there, and most importantly, it asked for a clear plan on how were going to fight isis. I think that vote, the size of the vote more than two to one of the republicans voted to oppose what the president did probably got to the president because he was shaken up by it. And that is why we couldnt continue in the meeting, because he was just not relating to the reality of it. Again, we are proud of our men and women in uniform. Those who have been in syria have conducted themselves in a way that makes us all very proud and i conveyed that to the chairman of the joint chiefs. We had some questions about isis and im going to defer to distinguished leader from the senate from new york who focused on isis in the meeting. Thank you, speaker and thank you leader hoyer. I told the president being from new york as he was were particularly aware of the problems that terrorism that an organization like isis can create. And the fact that someone no less than general mattis has said that isis has been enhanced, that the danger of isis is so much greater, worries all of us. I asked the president what his plan was to contain isis. He didnt really have one. He said the turks and the syrians will guard the isis prisoners. I said is there any intelligence evidence that the turks and the syrians will have the same interests that the kurds or we did in guarding isis and the secretary of defense was, thank god he was honest, he said we dont have that evidence. And so i said then how can we think that this is a plan when there are syrians and turks who are not our friends who isis, if they escape, does them very little harm, how can we let this happen . They didnt have any good answer. This is appalling. The president had no plan, to real plan for containing isis other than relying on the syrians and the turks. Then why did we spend a decade, billions of dollars and lost lives in trying to curtail isis if on a phone call, on a whim, the president is going to undo all of that and turn this over to the turks and the syrians. I would also say one other thing. He was insulting. Particularly to the speaker. She kept her cool completely. But he called her a third rate politician. He said that there are communists involved and you guys might like that. This was not a dialogue. It was sort of a diatribe, a nasty diatribe not focused on the facts. Particularly the fact of how to curtail isis, a terrorist organization that aims to hurt the United States in our homeland. Just briefly, youre going to hear the president say we walked out. We were offended deeply by his treatment of the speaker of the house of representatives. The president in my view has created a crisis in the middle east. A crisis that undermines the worlds competence in america. This crisis required a rational, reasonable discussion between those of us elected by the American People to set policy. Unfortunately the meeting deteriorated into a diatribe, as the leader schumer has said, and a very offensive accusations being made by the president of the United States. I have served with six president s. I have been in many, many, many meetings like this. Never have i seen a president treat so disrespectfully a coequal branch of the government of the United States. Ill yield to the speaker and to the leader for questions. I just want to say this other thing and that is i think the president was very shaken up by the fact that 300 354, i had to make sure i had the number correct and that means the majority, a big majority of the republicans. There are 194 republicans, 60 voted against the resolution which said the president s decision was wrong and dangerous. And lacking in giving our allies competence that we would stick with them in time of trouble. And one point i want to make that i hadnt made a moment ago, so leader mcconnell said he thought the president s decision was wrong. He said it in strong terms. I beseech leader mcconnell to put the same resolution that passed the house on the floor of the senate. It is a bipartisan resolution. Sponsored by senator menendez a democrat and the senator from indiana, young, a republican, and we urge leader mcconnell not just to condemn the president but put this resolution on the floor because the the safety of america, the safety of the kurds are in the hands of one person, President Trump. And the best way to pressure him is a strong bipartisan resolution such as passed the house to undo the damage he has done. Thank you. The witness on the part of the president was a meltdown. Sad to say. Speaker pelosi no, it did not come up. Not at all. No, it did not come up. It did not come up. When you called you a communist . He didnt call us a communist. He said lets clarify. He said the communists are some of isis were communists and you would be happy. That might make you happy. That might make you happy. And speaker said we walked out. At that point . No. Later. When he started calling Speaker Pelosi a third rate politician. And i said i wish you were a politician, mr. President trump, then you would know the art of the some of the members on both sides stayed behind and wanted questions. I waited a moment to ask him the question about intelligence reports on the turks and syrians guarding isis. Which i think is we also expressed our concern that we have been asking for a a all member, bipartisan, briefing to the house of representatives on what is happening in se in syria and was scheduled for tomorrow and they canceled it. That was part of our question. Why are you not briefing all of the members of congress . Thank you, everybody. Speaker you just heard House Speaker nancy pelosi, House Majority leader steny hoyer and Senate Minority leader Chuck Schumer, democrat of new york, all talking about how they had walked out of a meeting with President Trump. Schumer called it a nasty diatribe by President Trump where he insulted house Speaker Pelosi as a thirdrate politician and Speaker Pelosi said the president had a meltdown and this comes right after the house of representatives overwhelmingly, 354 to 60, with three voting present, voted to rebuke President Trumps decision to pull u. S. Service members from the border of turkey and syria from Northern Syria, including 129 republicans, including all of the House Republican leadership voting to rebuke President Trumps decision. It is a stunning dis by the house. A small handful of times that has happened and that sums up the sentiment among republicans across the spectrum. Evangelicals, moderate republicans and others who believe that, a. , they are not sure if the president has a strategy, and if he does, they are not believing it is the right one here. But this is something that the question is what happens in the senate . As senator schumer was saying, there is leader mcconnell going to bring this up in the senate or not. But i cant remember a time, if were thinking back 18 years since 9 11 there could be this type of discussion or this type of meltdown, politics aside, about isis. It is trike it is striking that there are not cooler heads on any side prevailing. And weve heard Strong Language from the strongest supporters, senator Lindsey Graham saying that the president is going to have potentially blood on his hands if the prisoners the isis prisoners escape and kill people including americans. I know. It is incredible from a political perspective because weve seen Lindsey Graham align himself so closely with the president and now hes drawing daylight were used to see him draw daylight on with past president s when it comes to Foreign Policy but people are aghast by the images theyve seen and theyve seen what is playing out is exactly what they expected and fears would play out when the president has made the decisions that he has made here and that is why i think youre seeing these kind of reactions. People like Lindsey Graham who were issuing stern warnings about removing u. S. Troops in the first place and now theyre saying reward you and it is only worse. Stick around. The power vacuum created when the u. S. Abandoned syria and a move the president called strategically brilliant. His former envoy in charm of fighting isis called it disastrous. Our soldiers are not in harms way. As they shouldnt be. As two countries fight over land that has nothing to do with us. Sear may have some help with russia and thats fine. It is a lot of sand. They have a lot of sand over there. I want to bring in senator rand paul of kentucky. He sides with the president on pulling u. S. Troops with Northern Syria and out with a brandnew book called the case against socialism. And i want to ask you about this. You might be President Trumps biggest supporter when it comes to withdraw troops from Northern Syria, and what advice did you offer the president before he made this decision. He and i didnt talk oneonone on it. This is his decision but it is the best thing for our troops but to adhere to the constitution. The constitution said you dont declare a war unless Congress Votes on it and who are we going to declare war against. Our ally turkey or the Free Syrian Army that used to be our ally or asaad. He was told by the turks they were coming one way or another and they have 50 troops, 50 troops dont stop 10,000 troops. I think he made the right decision. Im reminded of beirut when we had 300 marines in a barracks that werent protected and so i think he made the border with u. S. Service members, that is the only thing that kept them from attacking before. O, i think what you found is in the early footage, you saw and i think you showed some of the footage, that you saw the special operations teams having droms dropping close to them so they didnt seem to be deterred even though we still have soldiers in the region. So i think it was strategically the best thing to do. But also here is the thing that may end up happening. This may be the best thing that ever happened to the kurds. Because they need a protector in syria willing to stay. We had been preventing having them talk to assad and now they made an alliance with assad and the irony is it may be the best thing that ever happened to them. If assad and erdogan will have a truce and there is patrol they could have a similar situation than in iraq. That sounds like thinking. U. S. Personnel has been scrambling surrounded by turkish back oppositions forces and evacuating under duress and bombing positions so nobody could seize them. Do you have any concerns about forget withdrawing u. S. Forces but you understand the way many people feel this was rash and sudden and not done in consultation with the pentagon and or in consultation with the state department and ally and there are innocent civilians killed by the turks. He said from the very beginning our goal was to wipe out isis and we did. Our goal was not to create a homeland for the kurds. By isis prisoners are getting free. If you want to have a homeland for the kurds it might take a hundred thousand troops. That is not what we signed up for and im not for putting troops into the area. Here is the irony. The left hated the iraq war and hated george bush for it. A syrian war where we created a homeland for the kurds is just as messy as the iraq war. So the left needs to get over their hatred of President Trump and say, you know what, do we want another messy it used to be the left was against war in the middle east. What happened to the left. What im asking about though if there wasnt a better and more measured and more programattic way asso poeds opposed to get them out right now. I never seen this. Lindsey graham would say article two gives the president the authority to do whatever he wants and we dont question the president because he has latitude and now Lindsey Graham and those are up in arms on both sides of the aisle saying oh, my goodness, President Trump moved 50 soldiers. He may well have prevented them from dying in a massacre and drawing us into a big huge war with five different parties in it. It wasnt it is not just the war hawks the way you describe Lindsey Graham there was a major vote in the house in which it was overwhelmingly rebuking President Trump. Including the majority of House Republicans. I would say that the majority of leadership on the republican and democrat side are interventionists. They are people who believe not just the leadership. It is the like 360 or something. Ill give an example. The president said we should leave afghanistan. Mitch mcconnell and all of the Republican Leadership and the democrat leadership voted to rebuke the president saying it would be precipitous to leave after 19 years. This is the prevailing swamp opinion. Republican and democrats are unified in being in support of war, support of intervention and support of never going home. Do you have any concern about the isis prisoners that were now told there is a great risk of them escaping and President Trumps response was, well theyre not going to come here and go to europe. Here is my response. Everybody said well, the kurds will release them on purpose now. No, President Trump said that. Im not saying that. Why would the kurds the kurds live there. The kurds are the ones who have seen the way isis behaved. Why would they release these people. Im not saying purposely release them but do you not have any concerns. No, i do. But im reassured with the alliance with syria that it will be less chaotic and with asad. And i may be wrong. But i think the turks will slow their advance and it will come to a standstill and i predict there will be a discussion between erdogan and assad and there is a possibility we could get the turks to pull back within turkey. Last question. The russians and turkey and assad could have done something about isis to begin with and didnt and that is why the u. S. Stepped in. But the u. S. Has been preventing any kind of discussion because it is the policy of the war caucus to have assad removed. This is the john bolton and Lindsey Graham. They believe in regime change. And the Hillary Clinton group wants this too. So it is left and right saying we have to regime change. The troops werent there for regime change, they are there to fight isis. Initially they were there. But everybody kept changing their view. If i didnt ask one question about the book, the quait against socialism you write the poor are better off under capitalism because they are motivated to work if government destroys this incentive it destroys productivity and you acknowledge that younger people no longer as enthralled with capitalism as the older generation. Do you think youre losing this argument . I think we have to be concerned that the Younger Generation isnt appreciating where all of the great wealth of america came from. Our gdp is doubled eight times in the last 200 years. In 1820 poverty was 90 of the whole world. Now poverty is less than 10 . Measured in extreme terms, less than 2 a day. Capitalism is working. It has created enormous riches. Just in the last four years under President Trump the Median Income has gone up 4,000. There is a lot of good news out there and people get i guess obsessed and think it is a terrible world. It is the best time ever to be alive. Longevity and childhood and infant mortality and everything is down. It is a great world to be alive in. Wow, listen to you. I dont think ive heard you sound that way before. The book is the case against socialism and come back. I do have more questions. Congratulations again on the book. Little johns, yeah 3, what . in our politics lead, President Trump trying to muddy the water as another key witness testified in the house of representatives. Former Trump Administration official, mckinley who resigned last week just wrapping up testifying behind close doors and as Alex Marquardt said a source confirmed lawmakers that he was concerned about the firing of a u. S. Ambassador sounding the alarm about the activities in ukraine of the president s lawyer Rudy Giuliani. Reporter today a new member added to the parade of officials going before congress. All confirming the concerns raised by the whistleblower over what has been called the president s shadow policy with ukraine. Now stunning new revelations from a former top adviser to secretary of state mike pompeo. Accusing him, according to sources, of staying silent and Rudy Giuliani stepped up his pressure to have the president recall the u. S. Ambassador from ukraine. Mike mckinley testifying to lawmakers less than a week after abruptly resigning his position. Most of this is a concern by a colleague for an ambassador that he held in high regard. Reporter behind closed doors he said he repeatedly asked pompeo to show support for former ambassador Marie Yovanovitch who sounded alarms about giuliani trying to dig up dirt on the bidens in ukraine. She said she was targeted by giuliani with false accusations. And was removed from her post by President Trump. Yovanovitch had been railing against corruption in ukraine, including opposing the ukrainian prosecutor who was investigating the company that hunter biden was on the board of and who has been indicted three times for corruption himself. Mckinleys testimony like that of officials before him reflecting the whistleblowers report, despite this from the president today. The whistleblower didnt know what he was talking about. Reporter it started with envoy kurt volker, one of the socalled three amigos who led the president s outreach to ukraine. He provided Text Messages showing giulianis active role in pushing for an investigation of joe biden and his son. Then yovanovitch who told lawmakers there was a Concerted Campaign against her that she was attacked by giuliani and his associates. On monday, former white house russia adviser fiona hill testified she was also deeply uncomfortable with the rogue Foreign Policy giuliani was leading. She said her boss, former National Security adviser john bolton called giuliani a hand grenade who is going to blow everybody up and followed by george kent a career diplomat who testified he was told by a boss to lie low after complaining about giulianis projects in ukraine and today mckinleys revelations about pompeos role. Everything weve been hearing in depositions has corroborated the evidence we have in front of us. And we have just gotten word another crucial official will testify and that is ambassador bill taylor, the most senior u. S. Diplomat in ukraine. He was the one who, according to released Text Messages, said it was crazy for the white house to withhold 400 million in military aid to ukraine to help the president s Political Campaign and hes set to testify on tuesday. Alex mar cart, thank you. Lets chew on this. David, youre a trump 2020 Campaign Adviser and working on behalf of energy and defense Transportation Companies and it is clear that the president and the white house were not willing to back up Career Foreign Service individuals and were siding instead with Rudy Giuliani and dirt of questionable veracity that he dug up. That is what it seems. And, listen, back to but as far as ukrainian and the ambassador goes, there have been several ambassadors, Foreign Service ambassadors that have thrown in the towel with the president s this administration had disagreements with so it is not just ukrainian. She said she was fired because of misinformation that was coming from ukraine that rudy has admitted he helped pass on to the state department and to the white house. Well, well see. Well see what when the hearings and it all comes down to it. Again, it be be good to get a consistent story from mayor giuliani. Yeah, that is for sure. Karen. Dont hold your breath. And what is frustrating, working in the Clinton Administration and working with folks in the state department and our National Security, these are policy people. These are not political people and they from the administration to administration are the keepers of the continuity of our relationship. Things change a little bit here and there between agendas and different president s but not to this degree. And from what i think weve heard, these folks were legitimately shocked by what they saw and it sounds like the three amigos created their own back channel who is that the volker, giuliani and sondland rick perry. Rick perry and with mulvaney that they sort of created their own back channel to circumvent the normal process that we would go through and create their own sort of policy channel rather than and frankly put at risk our normal relationship which is that the United States we are souped to be a supporter of ukraine and never threaten them. And sarah one of the big wild cards, we dont know if adviser john bolton will testify and if et cetera going to testify, what hes going to say. Hes the one that said Rudy Giuliani was a hand grenade that could blow everybody up. What do you think . Hes weirdly silent right now. This is not i think the john bolton that washington is used to, so if i were a betting woman i would say he will emerge at some point. Weve seen the Committee Work quietly behind the scenes to arrange these and some are sensitive and i think bill taylor will be a interesting person when he shows up on the hill next week. This is the person who is pressing Gordon Sondland saying i dont this is crazy that were with holding assistance as part of a campaign issue. Is this now a quid pro quo. He was pressing that and pressing it in a way that indicated to you that he really wanted to get it in writing. He wanted a paper trail. What each witness were learning more. These are not people not making headlines. And jeff, the president trying to project confidence and trying to project that hes not concerned about this. What is it like behind the scenes at the white house . Behind the scenes at the white house, there is a lot of concern about just what is going on. I was very interested earlier today the president was speaking very favorably about mr. Bolton. Which is not always been the case. No. He said he was certainly not he had bad relationships, he was fired. But when people are on the verge of possibly being called to the hill to testify, the president is suddenly being nice. Behind the scenes people are concerned, worried, dont know what is going on but this whole syria policy is overtaking this as well so it is a bit of a mess as his mood indicated. The white house just confirmed to me that President Trump sent a letter to turkeys president in october 9th. Let me read you the letter. It is quite something. Dear president erdogan. This is a week ago, october 9th so before the president announced his troop withdrawal from Northern Syria. Dear mr. President , the president of turkey, quote, lets work out a good deal. You dont want to be responsible for slaughtering thousands of people and i dont want to be responsible for destroying the turkish economy and i will. Ive already given you a sample with respect to Paston Brunson and ive worked hard to solve some of your probation. Dont let the world down. You could make a great deal. The general is willing to make concessions they would have never made in the past. Im confidently including his letter to me. History will look upon you favorably if you get this done the right and human way and look as you as the devil if good things dont happen. Dont be a tough guy, dont be a fool. I will call you later, sincerely, donald trump. So i have to say, i saw this letter and it was broken by trish reagan at fox business news, i saw this letter and thought it was a joke. I thought it was a hoax. But then i sent it to Stephanie Gresham and she said it was real. I mean, you dont want to laugh because it is a very serious issue but it is emblematic of Donald Trump Style and do the right thing or everyone will think of you as the devil and by the way ill call you later. I dont think this is what the letters normally look like when you send this kind of thing. But its pretty clear that erdo go erdogan didnt take this seriously but a striking how the president operates oneonone. I misspoke, the president announced the troop withdrawal on sunday the 6th soo this is a letter sent after he had already announced and so he was saying even though the troops have been taken back, erdogan dont slaughter the syrian the syrians so lets make a deal. I have a different opinion. I think the president is making it clear to erdogan this is the best deal with the general leading the fdf there is what deal is there . I dont know. He said imen closing the generals letter enclosed here within so im not sure what deal they were trying to cut. I dont know. Do you support the withdrawal . So i, like senator paul and tim kaine, i think there should be a vote on authorization of use of military force. We should not put americas men and women in harms way without robust debate in the senate and the house and congress and people should so you think it was too rash. I think it was rash but i hear Chuck Schumer saying turkey is theyre our alley. What are we there for. What is our object. We should know what we are there for. What are kids dying there for. It is a fair question. But you agree it was rash . I would like to know, i hope we are learn more about what the deal was as cnn reported on the 12th it was that general mass lem said you are leaving us to be slaughtered and whatever happened days prior fell through and weve seen what have happened. The letter is very unusual. Dont be a tough guy. History will look at you as the devil if good things dont happen. And dont be a fool. And theyve had several phone calls and the president talked about this. It is a way for the president and this president in particular has an amazing command of the bully pulpit to explain american Foreign Policy. There have been contradictory things over the last several days and the release of this doesnt clarify it but give a speech to the nation. Say what the objective is. There has been nothing like that at all and it is confusing. And the release of the letter comes as the house of represents just overwhelmingly democrats and republicans voted to rebuke the president for his decision to withdraw u. S.
