And right now protesters are already gathering outside the white house, at times chanting i cant breathe, George Floyds last words. This comes as President Trump once again is encouraging Law Enforcement to use aggressive tactics and calling for military action, saying new york city was lost to looters last night. The president insisting he has no issue with peaceful protests. But that was assuredly not the case, at least in fact if not rhetoric, hours ago in the Nations Capital when peacef ff protesters last night, gathering in Lafayette Park across from the white house, were tear gassed and brutally pushed back by Law Enforcement officers deploying flashbangs and tear gas, Peaceful Protesters, all of which so the president could walk across the street and pose in front of st. Johns Church Holding a bible, a book he did not open or read from. First lets go to cnns Miguel Marquez live for us in st. Paul, minnesota. Miguel, youre at a protest at the state capital building. Tell us more. Reporter we were here last night. There are about 2 or 300 protesters. And ive got to tell you, were in five minutes of silence right now. Im going to show you ill take this off and show you how big this crowd is. It is absolutely massive. Thousands and thousands of people have showed up. If the president fought his photo op yesterday was going to have an effect, this is the result. Now eight days after the brutal killing of george floyd, still no word on the fates of the other three officers involved in his death, who either helped hold him down or stood by watching him die. I want to assure everybody that we are looking very carefully at holding everybody accountable who failed to do their duty. Reporter as the country grapples with the searing pain of another innocent life ended by police action, protests turned violent in many places around the country monday, some against police. In las vegas, a Police Officer is on lifesupport after being shot in the head during protests on the strip. At least four Police Officers were shot in st. Louis, their injuries are believed to be nonlifethreatening. Some coward fired shots at officers and now we have four in the hospital. Thankfully, thank god, theyre alive. Theyre alive. [ crying ] can we make some sense out of this . Reporter and a graphic video coming out of the bronx. An nypd sergeant suffered serious injuries after looters in the black car hit him and took off. That officer survived. An attack on a Police Officer is an attack on all of us, pure and simple. Reporter that attack amid absolute chaos in the heart of manhattan. The historic macys, site of the thanksgiving day parade, ransacked by opportunistic looters, sparking this reaction from the governor. It was a disgrace. Reporter an 11 00 p. M. Curfew in the city that never sleeps considered too late by many. Today the mayor changed it to 8 00 p. M. You saw stuff last night that we will not accept. We can fight back and we will fight back. Reporter but this afternoon, a different scene. Peaceful demonstrators marching in the big apple toward nypd headquarters. Also today, celebrities and activists using social media by posting blank black images to their profiles. But some advocates say it downstairs out critical updates from people on the ground. This young protester telling us after decades of empty talk on change, this feels different. For once everybody is ready for change. White people, black people. If you look, this is not just black people in this movement. We have white, black, asian, hispanic, native. Everyone is sick of the racism in this system. Miguel marquez brought us that piece. The curfew in new york city is going to start earlier, at 8 00 p. M. Tonight, than last night which was 11 00 p. M. Looters smashed storefronts across manhattan last night. Governor cuomo put the blame on his fellow democrat, new york city mayor bill de blasio and the nypd, cuomo saying they failed to do their jobs. I am disappointed and outraged at what happened in new york city last night. The nypd and the mayor did not do their job. The mayor underestimates the scope of the problem. And the police in new york city were not effective at doing their job last night, period. It was a disgrace. Harsh words from governor cuomo. Cnns Shimon Prokupecz is in new york. This morning President Trump was back at church, a Catholic Church this time after condemnation and criticism after peacefully protesting american citizens were tear gassed by Law Enforcement yesterday so that the president could hold a photo op in front of st. Johns Episcopal Church. Trump and his team have voiced concerns about how they are losing support among some christian conservatives as Cnns Kaitlan Collins reports, including evangelicals and catholics. Reporter President Trump visited another Iconic Church in d. C. Today while still facing fierce backlash for his historic trip to a church near the white house yesterday, after Peaceful Protesters were cleared from the streets using smoke, flashbangs and child. The president and First Lady Melania Trump stood at the shrine of Pope John Paul ii. The washington archbishop said he would not condone the use of tear gas to silence, scatter or intimidate protesters. Trump has faced heavy criticism for his trip to st. Johns church. Trump, who rarely attends church services, did not go inside to tour the damage to the church or stop to pray. Instead he took photos outside and used a bible as a prop. Reporter is that your bible . Reporter sources told cnn the president wanted to be seen outside the white house grounds because he was angered by reports that he had been rushed to an underground bunker during fridays protest. Today a Justice Department official confirmed attorney general bill barr personally asked for the protesters to be shush pushed back on monday. Washingtons mayor called the use of force shameful. I didnt see any provocation that would warrant the deployment of munitions. Reporter most republicans have either defended the president or remained quiet. One exception is senator ben sasse of nebraska who said in a statement that while there is no right to riot or throw rocks at police, im against clearing out a peaceful protest for a photo op that treats the word of god as a political prop. Joe biden accused the president of fanning the flames of hate and criticized him for posing with the bible. The president held up the bible at st. Johns church yesterday. I just wish he opened it once in a while. Reporter ignoring the criticism, President Trump congratulated himself on twitter today, saying d. C. Had no problems last night, many arrests, overwhelming force, domination, likewise minneapolis was great, thank you President Trump. Now, jake, after the president sent out that tweet, the attorney general, bill barr, put out a statement saying it was much more calm in washington last night and he said, quote, there will be an even greater Law Enforcement resources and support in the region tonight and this comes as were already seeing protesters gather as close as they can get to the white house given that new barrier that they put up overnight. Shimon, protests are under way right now but theres been a lot of criticism of mayor de blasio and even the nypd, most notably by governor cuomo, about the lawlessness yesterday. Reporter yeah, there have been. As you can see here, very different from what we saw last night, across manhattan, across new york city, when looters just took over the city. At one point there were, jake, more looters on the street than anything else. There was looters, Police Officers, and journalists. The curfew did not seem to work. Now of course the governor is not happy about what we saw. Around us here today, as you can see, jake, diverse crowd, people just marching. And its become a march of people chanting, different names of people who have died at the hands of police. You hear black lives matter and people saying no justice, no peace. One thing i want to point out is, when you look around, there are no Police Officers around. And the police have allowed them to just march, a big difference from what we saw last night. Its important to distinguish the groups we saw, and there were groups, hundreds of them in groups that were running around manhattan, overwhelming the police. And the police just seemed surprised at what happened. And so they were running free all across the city, breaking into stores. And theyre criminals. Here today what were seeing are peaceful demonstrators, marchers who are expressing their feelings. And if you look around, there are no police around us, jake. This afternoon, protesters peacefully laid on the ground in Lafayette Park chanting i cant breathe in honor and memory of george floyd. Those were his last words. They were met by lines of what appeared to be military officers separated by the crowds by a brandnew fence. Cnns Alex Marquart joins us. Alex, this seems a much more peaceful scene than yesterday in front of the white house when Law Enforcement, using gas and flashbangs and more, cleared out that crowd. Reporter its a much more peaceful scene than yesterday evening, jake. It was peaceful at that time as well. If the president hoped that crackdown on Peaceful Protesters would get them to stop protesting, he very simply was wrong. Clearly he is anticipating more unrest because weve seen this new fence going up, about eight feet high steel fencing around Lafayette Park. You can see the Law Enforcement forces are a bit more at ease because of the fencing that they have just put up but really the only effect appears to be spreading the protesters out rather than having them gathered right here in the middle. And if anything, it has poured a bit of fuel on the fire. There is definitely a high theres a lot of tension out here. Weve already seen a lot of people shaking these fences to express that anger. But it is very peaceful for now, jake. Those chants that weve heard throughout these protests, black lives matter and the name of george floyd. And jake, it was right here that that crackdown started yesterday evening in order for the president to then be able to walk across Lafayette Park and go right there to st. Johns church for that photo op, jake. All right, alex marquardt, thanks so much. As alex note, yesterday we saw Peaceful Protesters pushed back to President Trump could have that photo op in front of st. Johns Episcopal Church. Joining us now, the rector at st. Johns Episcopal Church in georgetown but was in Lafayette Park yesterday to support protesters. Reverend, thank you for joining us. What did you see on the ground, i guess you were on the patio of st. Johns, because the armored Law Enforcement officers showed up with gas and flashbangs and the like. So what i saw was a peaceful protest. And what i had seen all day was people using that space as really a respite, a place for prayer or to sit. There was some shade at one point. And as we got around 6 15 or 6 30, what i began to see was the police that had previously been deep into Lafayette Park beginning to move toward h street. And out of the corner of my eye, because i was like helping wash peoples eyes out from having gotten gas or pepper spray or something in them, i literally saw out of the corner of my eye Police Beginning to come up h street on horseback. And i at that point had gotten began to work with the black lives matter sort of medical support volunteers. And we were, you know, handing out water and paper towels with eye wash on it and that sort of thing. And increasingly we began to see those little tracers of smoke and the sounds of explosions which i guess are those flash grenade things. And what was your reaction when Law Enforcement started to push in and people had to flee . I know some people complained about being hit with rubber bullets and the like. You had to flee too, right . Because of whether it was tear gas or some sort of gas with an irritant was bothering you as well. So i was in complete completely stunned, really, because i never would have imagined that i would look up and literally see an entire line of Police Officers all in this heavy military gear, all black, and these shields, literally pushing and shoving and driving people off of the church patio. Like, i looked up and there they were. And i was literally helping wipe away tears in peoples eyes and tried to tend to them and help them on the grounds and suddenly the police were pushing us back. And the people were dropping to the ground, afraid. And they were when they hear those flash sounds, they thought they were being shot. And people were running at us. And literally at some point when i looked up and the police were so close, i had to just grab some things and run. And you said that holy ground was turned into a battleground yesterday, and ultimately it was because President Trump wanted to stand in front of st. Johns and hold up a bible. He didnt read from it, he didnt go in and pray as many president s have, and he has in the past. It was just for a photo op. The white house put out a video minutes later, essentially. What was your response, that thats what this was all about, was so President Trump could stand in front of st. Johns and hold a bible . So i was already stunned and shocked and deeply, deeply offended that they had taken what had become holy ground and had been holy ground for 200 years and literally did he say desecrated it, turned it into a literal battleground with those officers and heavily armed and just the aggression and the hostility. And the innocent protesters, driving them off church property, for whatever reason, at the time i didnt even know why. That already desecrated that, already turned holy ground into a literal battleground. I could not believe, literally, what people were texting me as i was going back to my car, saying, is the president really there . And i could still hear the flashbangs and the people were texting me saying, hes walking across the park. I could not believe it. I was saying, no, no, that must be stock photos, no, im sure thats not happening. I couldnt believe it. And when i realized that people had been hurt and terrified for a political stunt, offended hardly begins to describe how i feel. It was a sacrilege for all people of all faiths, faiths that are grounded in peacefulness and loving compassion, reconciliation, wholeness, healing, forgiveness. Peace, love, compassion. And to push innocent people out, and people who, by the way, were protesting the violent treatment by the government, was sickening. And to stand in front of a church and somehow claim that as his right and privilege and culture and holding the bible, was sacrilege. An absolute sacrilege. And i wouldnt make im not joking when i say i would rather the president live by those words, those words of healing, wholeness, compassion, love, peace, generosity, care for those who have been marginali marginalized. For him to turn that book into a prop, for him to turn that holy ground into a battleground, for him to turn that holy ground into a photo op is a sacrilege. And offended begins to describe how i feel about it. I feel heartbroken. And the images of people running and crying and dropping to the ground because they thought police were shooting real bullets instead of rubber bullets was heartwrenching. And yeah, i breathed in some of that, i was causing, and my seminarian, tears were streaming down her eyes as we were trying to rinse out peoples eyes. Why shouldnt i put up with that . That is what a person of faith does, right . You show up. And you show up in service of peace. And my brothers and sisters who have been marginalized and killed and incarcerated and undereducated and underestimated and overlooked for generation upon generation. And for that man to take that witness of presence and peacefulness and shoot tear gas or pepper spray or whatever those canisters were, and those little exploding things, and rubber bullets, and the show of force, was not the kind of faith i have. Reporter there is a great deal of passion, to say the least, in this crowd of people. Thousands, jake, have turned out to support george floyd. Of course this is his hometown. And this is where he spent many years of his life. And this is a march where you have heard the chants of no justice, no peace, peace on the left, justice on the right. That has been a theme that has carried out extensively throughout this. This is a massive protest. As you see this protest winding its way and this march winding its way through the streets of downtown houston, its only about a milelong march from the park where this started just a short while ago. And it is ending at dallas city hall. But this is a massive crowd of people who have turned out here in George Floyds hometown, jake. All right, ed lavandera, thanks so much. Breaking news now, the minnesota governor has Just Announced a civil rights investigation into the Minneapolis Police department. This comes after the death of george floyd in Police Custody just eight days ago. Lets bring in former federal prosecutor and cnn legal analyst laura coates. Laura, can you explain what exactly a civil rights investigation might include . It will look at the patterns and policies and practices and perhaps procedures of the Minneapolis Police department in Hennepin County to determine whether there is a systemic problem. We heard from the National Security adviser questioning whether this was a systemic problem. Weve heard about things happening in other parts of the country as well. This will be an investigation, not a criminal prosecution, whether there has been some government or Department Sanctioned activity that has led to not just George Floyds killing but any other violations within the department that have gone unnoticed or unheard up until now. And if this investigation finds serious issues within the Police Department, what kinds of actions could be taken . Could anyone face charges . Remember, we heard about consent decrees. I know its a topic people forget about. I was talking to my colleague and yours as well, poppy harlow, a fellow minnesotan, but this issue this morning. Before Jeff Sessions was fired, one of the last things he did was to write a memorandum to make these socalled consent decrees, an agreement between a Police Department and a state or an entity to ensure there will be changes, structural changes to deter and prevent this sort of behavior, he made it that much harder at the federal level, theyre rolling back these consent decrees. They dont often lead to criminal liability in those instances, but it can be a guide in minnesota about how we can implement structural changes. Having said that, whatever information they derive or glean in the investigation about patterns, about practice, if the officers involved happen to overlap that investigation, it could surely be used as evidentiary support by the state in the prosecution. Remember, the attorney general of the state of minnesota, Keith Ellison, was one of the people who wrote a report back in february about Police Misconduct in minnesota. And now he is overseeing this really quintessential misconduct case. So i suspect there will be an overlap. Lets talk about that, because as you note, Minnesota Attorney general Keith Ellison says his office is taking another look at the actions of every Police Officer who was on the scene when george floyd was killed. Ellison has previously said he expects all of the officers involved to face some sort of charges. If youre working in that office, what are you doing right now . Im taking a fresh look at not only the investigation, the video, eyewitnesses, any of the police records, Text Messages between the time that, say, the event occurred, the killing of george floyd, and after the arrest, was there any communication that would give me greater insight into what happened contextually. Im also looking at the actual charge. Remember, he has a third degree murder charge in front of him. In minnesota that means an unintentional killing even though you acted in disregard of human life. Normally thats Something Like driving down the wrong side of the highway or shooting a gun into a crowd of people. Minnesota has a nuance, jake, that says, hold on, if your focus was on one particular person, i cant reconcile the unintentional aspect of the law with the intention al depraved action. How do we charge, do we go up, do we go down, and if we do have charges, who has accomplice liability . The other officers, and what to degree . As you note, the officer who had his knee directly on George Floyds in the case, derek chauvin, was charged last week, third degree murder and manslaughter. But video shows obviously there were three other officers there including officers on top of floyd, one other officer standing there watching. Why would prosecutors be able to charge chauvin so quickly but not the others . Thats a good question. Of course we also now have new video footage, as you remember from a few days ago, of other officers at some point adding to the compression by being on his body in some form or fashion and you have competing medical examiner reports, one the official one, one from the victims family. All of that increases the evidence and evidentiary burden here. The thing is, lalthough there i a police manual, jake, that says there was a duty to intervene for other officers seeing a colleague engage in deadly force, the house, which is democrat, in minnesota, codified the duty to act or intervene, it never passed the senate in minnesota. So you have this tension of what was the right thing to do according to policy and procedure versus whether there has been some violation. However, i do expect if ellison has already said he has an eye toward prosecuting and charging those other officers and the medical report supports it, he will be as thorough as possible. It was really drowned out by a lot of the chants but the mayor came out to show his solidarity for the movement, for the protesters here today. I can tell you that today, the daytime protest has been very peaceful, very calm, lots of chanting, singing. We just met up with another group of marchers who are coming eastbound toward downtown. We started out at the Police Station, went around the corner to city hall. They had speeches there, then marched down here, near staples. Now theyre heading back towards the Police Station now. Ive talked to a few people out here, every single person, it was the first time they had ever been out for a protest, very first time. I asked them what did it. For all of them it was the video. It was the video of seeing george floyd, on the ground, pinned down for nearly nine minutes. That was enough to cause them to respond and have to do something. One man i spoke to was very upset. He was holding a sign that said asians for black lives. And he was saying that he felt it was so important for him to be here and that he had been dealing with this and donating to causes but even though he has respiratory concerns, he had a big mask on, he was very much moved to be out here today, wanted to be out here today. So there is something about this that feels a little bit different, jake, in the response and in the number of people and the kinds of people showing up here in downtown l. A. For these protests, jake. All right, lets hope they continue to stay peaceful, stephanie elam, thanks so much. An officer pinned his knee down on the neck of george floyd. Along with peaceful protests, there has been violence at times. Police have responded with force of their own, heavily armed officers and members of the military, with rubber bullets, tear gas, flashbangs. There have been video and photos of protesters and cops coming together, its clear so much more is needed to wipe away centuries of mistrust. One question were all thinking about is, is it time for a different approach. Nicki jones, professor at cal berkeley, thanks so much for joining us. This video shows Kansas City Police pepper spraying a protester after he yelled that police had used excessive force. The police came, pepper sprayed him, took him into custody. A spokesman for the kansas city Police Department says the officers actions are under investigation. They didnt specify what law the officer is accused of breaking. Obviously we see violence from some of the looters and protesters as well. Whats the impact when somebody who is merely speaking gets sprayed, pepper sprayed and arrested . You know, i just had a moment to take a look at the video. One of the things that struck me is that what were seeing is the use of arbitrary actions on the part of officers, actions that are unrestrained. And when you have that arbitrariness and the lack of restraint on the part of officers, that makes any authority that they have i will legitimate. That is the perception that people have when they witness Something Like that. I also think immediately about the young people ive worked with in the research that ive done, young people who grew up in neighborhoods where there is a Constant Police presence and are very much aware of how arbitrary and unwarranted officers can act. So its surprising and i think shocking for some segments of the population, those who are watching it, or watched during ferguson, an understanding of it now. But its not surprising for the folks who have been the targets of these arbitrary actions for years and years and years. And so in both of those groups right now, theyre out in the streets for those reasons. Its a shocking video. Its also an example of something that scholars, race scholars doing this work have right again and again, is that officers can be instigators of violence as well. They can escalate the violence. And so thats another example of that. And so its shocking, but again, not surprising. Again, i just want to make sure, were not talking about, neither you nor i are talking about when somebody, a person, a civilian, is violent and then police arresting the person for being violent. Were talking about people who are not being violent. And i have to say, it does seem like this neverending vicious cycle, an act of police brutality, then you have protests in response, theres some violence by some in the crowd, or maybe not, police overreacting, police crack down, it never stops. How do we stop it, professor . We have to stop it. Yeah, thats a challenging question. When ive heard that question posed over the last couple of days, there can be a fatigue that accompanies it, cant we get this to stop already. And i have to say that we have to have we need to get our stamina up a little bit and we have to understand that this is a struggle with deeply rooted a deeply rooted struggle that people have been involved in for centuries, right . So its not going to stop in five years, its not going to stop in ten years. And we have to think about the moment then as an opportunity, an opportunity to move a project forward, a Racial Justice project forward. Thats what weve seen in the past, including since ferguson and since baltimore. We have seen change at the local level. Weve seen the elimination of fines and fees, weve seen the progressive prosecutor movement, weve seen efforts at decarceration. Any time theres anything that looks like a victory there will be a retrenchment. Thats what we have to expect. That is the struggle. Thats what were dealing with. And the former police chief of former chief of police in camden, new jersey, scott thompson, which has a new approach to policing now after centuries or decades at least of issues between police and the black community, he told the news outlet 538, quote, there is this failed mindset, if we show force we will deter criminal activity, and show me where thats worked. Do you agree with him, the idea that meeting a protest, even one thats potentially violent or has some violent elements in it, meeting that with force, more often than not, escalates the violence as opposed to lowering the temperature . If im understanding your question correctly, youre asking if officers show force at the beginning, does that escalate the encounter, the potential of violence in protests. I would say absolutely, because once youre up here, theres not much room, right, to go. Its harder to deescalate when you have to be very skilled at deescalation, and we see a lack of that in cases around the country even though theres been a real effort to improve that training for officers. So what we see in those cases, in the kind of warrior cop, is an effort to get people to defer to the show of force on the part of officers, right . And to comply immediately, to not test the authority of officers. And absolutely, when you have officers coming out as if people are the enemy, thats the potential for escalation right there.
