Democrats are not dropping investigations and nadler is preparing a subpoena for the unredacted report. Attempts by the president out lined by muellers team in the obstruction part of the probe. So this was the out standing question that so many people had. Why mueller didnt make a determination on obstruction and he laid out i have them here, ten areas that they looked at. Whether it was the firing of the fbi director. Michael flynn. Etc. So, for the American People who have not read all 448 pages, what is the most glaring question that remain ins the obstruction front . There is overwhelming questions that need to be asked and follow ups that need to be had. The conduct with the white house counsel, don mcgahn and the alarm bells going off within his head. When the president was asking him to to do things. You can see there was a lot of concern. In the interview that is he gave sot special counsel. 30 hours with them. Every question about the obstruction issue. He was central to this. The big part his 30 hours of testimony the call from the president. At his home. To call the what was it it was the acting attorney general to fire miller. They wanted mueller fired. Mcgahn basically didnt do it. And said he was not to himself i was not going to do this. He knew what could happen. If he was to do that. Its people like mcgahn who despite what the president wanted to do and they were really treated poorly by the president in the end. They tried to protect the president. They tried to protect the white house. And the country. Because they saw what could happen if they were to follow through on what the president wanted. One of the claims that stood out from the attorney general today in the press conference was his claim the white house in his words fully cooperated with this information. Yes, the white house handed over documents and allowed aids to talk about to mueller. President never sat down for an interview. In what world is that full cooperation . Thats the thing. He never sat down with the interview and the answers he gave the take home test the questions he answered at home with his lawyer. No follow ups. He was evasive. He didnt give a full accounting of everything. Parts he didnt remember. 30 times. How is that youre right. How is that full cooperation. Why the attorney general standing there saying that when he knows theres questions that need to be asked that maybe we didnt get the full cooperation. Special counsel in the end realized they were up against a fight. If they were to go ahead and subpoena the president. It would take too long. It would draw out the process even more and in the end what happened is they werent going to get the answers they were seeking from him. Theres no lawyer that would have allowed they said they werent going to let him talk. If they subpoenaed him. They were concerned the president would be exposed. Thank you very much. The evidence would have to be quite overwhelming and such that it would generate bipartisan support for the idea that it renders the president unfit for office. His point you need bipartisan support. I have an opinion that id like to to share. We send it to the senate and let the senate have the opportunity to produce a trial. Let witnesses come forward. Let us find out what the senate will do. There maybe senators who will realize that impeachment is important to their citizens once the ed is revealed. First, we have a duty to go forward and to try our best to bring this to justice in the senate. It acts as a deternl. The second point is this. Mueller found in evidence the campaign conspired with the russians to enteer fear in the election. And also declined to conclude a criminal charge of obstruction against the president is warranted. He put in his report multiple occasions when the president did try to intervene in the investigation. Out lining ten different areas they looked at on the obstruction front. If we had confidence after a thorough investigation of the facts that the president clearly didnt commit obstruction of justice, we would state so. Based on the facts and the applicable legal standards we were unable to reach the judgment. The evidence we obtained about the president s actions and intent prevent us from determining that no criminal conduct occurred. Accordingly this doesnt conclude the president committed a crime. It doesnt exonerate him. Joining me now. Law Enforcement Analyst and former fbi supervisor special agent. Chief media correspondent. And legal analyst. And civil rights attorney. Our legal analyst and former federal prosecutor. Good morning, good evening to all of you. Its 1 00 in the morning. Let me begin with you. Given what you did before you worked here, Justice Department and fbi. Barrs framing of this, what should the American People walk away with . Confidence . The American People should know they have been taken for a ride here. And i was one of the fist people on the air whenever this letter came out from barr we discovered the 14 page job before that. When it came out he submitted a letter criticizing the mueller investigation. When he was a private citizen. People looked at that with suspicion. What was he trying to do audition for a job. I was actually one of the ones defending him saying pump your brakes slow your roll. We dont know the motivation. I have evolved on that. I see a pattern. You have that and framing this document. In his four page memo. Saying no collusion. And he determined there was no obstruction. What he did is the essentially a liable mission in my judgment. You say a couple things and leave important things out. He left out what mueller actually said in the report. That is President Trump according to investigators had this pattern of attacking investigators and control the investigation. Trying to get witnesses not to cooperate with the investigation. All that is troubling. None of that was in the original framing. Four weeks ago this was baked in. Now we have to refute it based on facts. Legal perkts on this. Mueller also out lined in here. Why he didnt come it a conclusion on obstruction of justice. And also made it clear that congress has the ability and the right to take the ball and go from here if they choose. Im wondering if mueller comes to testify, well see, whats the most important question you would ask him on the obstruction . What we want to hear from bob mueller is why didnt he reach a conclusion with respect to obstruction given all the evidence that he lays out in the 400 plus page report. We heard barr make the statement this morning that had had nothing to do with the office of legal counsel. Policy about it did. Not being able to indict a sitting president. That was a misstatement. And its clear from the report that was a huge consideration for special counsel mueller and that but for that policy, i think there would have been a different determination. And i think mueller he laid out this road map for congress to look at the issue of obstruction and talked about what can happen to President Trump when he leaves office. He didnt say congress this is only for you to take a look at and consider impeachment. He said the kind of conduct that trump was engaged in also can be something subject of a prosecution once he is out of office. That was very telling. As we talk about things that were left out of barrs brief press conference this morning. That was a critical point he doesnt punctuate. About the president being exonerated. In barrs remarks this morning her cede the Deputy Attorney general and disagree with the legal theories and felt the episode didnt amount to obstruction. How significant is it that he notes he kp rosd rosenstein disafreed. Its clear they did. That was the poent of the audition letter. As josh put it. He doesnt believe legally the president can be charged with obstruction for exercising article 2 powers. And mueller does a good job in the back end of the report. This is the part most people glaze over. A careful point by point reputation of the legal arguments that were raised in this case actually by the president personal counsel. The essentially the same arguments barr raised. I think what barr is saying we disagree on the law. Really what we were doing is saying that on the facts we dont think theres enough evidence to justify it. And because reasonable lawyers can disagree on legal arguments. He wants the people to believe theres not enough evidence. Thats why hes pushing that narrative. When you read the report, i have to say you have to come to the opposite conclusion. Thats the thipg. Trump world is doing. Unfortunately the attorney general is part of this. Is promoting this big lie. Theres little lies revealed in this report. You have become used to. Theres a bigger lie. The president promoted this witch hunt lie and the no obstruction lie. And a lot of people are helping him do that. Media and allies inside the government promoting what is essentially a big lie. Hes telling it over and over again. Thats the new playing field. Are people going to believe the big lie . Its not a crime. To lie to the press. American people. True. No wup should do it and the president shouldnt do it. And the press secretary. Certainly shouldnt do it. Explain why it is so key what we learned from the report about whats Sarah Sanders admitted to mueller and the team of prosecutors when she had said the rank and file is at the fbi arent happy with james comey. They wanted him ou. She heard from countless members calling her up saying we want hip out. It was a lie then. She admitted it was a lie. This is one of many misleading statements out of the white house. Shes admitting to it in the Mueller Report. Example of how little credibility this white house has. I remember watching that press conference with colleagues saying the fbi didnt have confidence in the former director. My former boss. There was another component. She stood at the podium and said she had personally been in contact with countless fbi agents. It was actually a reporter that got so he essentially gave a one word response. Really . Giving her the opportunity to back out she said there was Text Messages and emails. This wasnt a shlip of the tongue. She was tripling down. She was on fox news tonight saying she misspoke. Special counsel provided President Trump with questions to answer but according to the Mueller Report, mueller is not satisfied with the president s responses calling them inadequate and saying on 30 occasions the president said he doesnt recall or remember or have recollection of information called for by the question. The report also says i quote, the written responses we informed counsel demonstrate the inadequacy of the written formatt. We had no opportunity to ask follow up questions that would ensure kploet answer ands potentially refresh the clients recollection or clarity to the extent or nature of the lack of recollection. Mueller viewed face to face interview with the president to be quote vital to the investigation. He efb considered issuing a subpoena. But decided not to because he was concerned about the delay that would add to the probe. Experts are back with me now. Josh to you, i hear muellers argument on we dont want this to drag out longer. But it already took two years. So, what do you make of the calculation made it is not worth waiting for pushing for trying to subpoena the president . Is this an assumption he would have pled the fifth . The possible delay. This could have been litigated and the supreme court. On and on. Thats one aspect. Another being the report says mueller determined they had a will the of answers to questions. Sufficient enough they didnt feel they needed today press the issue. So i think the two things taken together were important. Is that they have at least 30 nonanswers. They felt in terms of on the obstruction side of the investigation they felt they had gathered enough evidence to sort of form late in their own mind about what was going on here. The other thing i do think to draw out this whole entire process over a subpoena, politically may have been really bad for the special counsel. He should take political considerations. Youre right. Why drag i think time and the longer this dragged on i think mueller realized it was not going to be good for anyone. Department of justice realized. When we were doing the reporting on this, it was sort of the sense that we were getting that the longer this dragged on, the it was not good for the country. For anybody. And the other thing the president s lawyers made some very strong arguments to this special counsel. So two are lawyers on that. Martin. How effective do you think even if you dont like the politics or agree, how effective legally were Rudy Giuliani and jay sekulow. They were effective. I disagree with the decision mueller made with respect to getting trump to participate in an interview. First of all we heard trump say that he would be happy to sit down with the special counsel. And answer any questions that would be posed to him. He had this dog and pony show he did in really tricked the American People and told us this what we can call a straight out lie about his willingness to participate. Because now we learn not only did he not participate in a sit down interview, he gave the really nonresponsive answers to the written questions and we should state those were only questions that has they related to the russian collusion part of the investigation. He refused to answer as it related to obstruction of justice. When we look at what the president is doing, yes it may have taken time, it may have been a bad or fought battle to the supreme court. Its setting a bad precedent to not participate in the interview. If we dont have impeachment hearings in the congress, this sends the message this president is above the law. And no one should be above the law. Even the president of the united states. Jennifer, question for you on the special counsel statute vs. Independent counsel. You hear democrats and congress now screaming they want the full on redacted report. And they want the under lying evidence. Because many of them point to ken star. And clinton investigation you had a Station Wagon with boxes of documents of under lying evidence driven over to cap it will hill and the footnotes and the details. Salacious. Its congress that let the independent statute lapse in 1999. Yeah. And ken star willingly went to court to get the grand jury material. Released as well. So look its swung maybe too far in the other direction. Folks felt after the ken star incident. Or series of incidents that it was too intrusive and invasive. Too much independence. This statute was meant to curtail that. So that ultimately the attorney general would control the release of informs. Now of course the democrats think its not enough independence. The problem with any of the statutes its hard to see how theyll play out until you are in them. I suspect well have a new independent special counsel regulation. Whatever it will be called. That will probably move us a little toward back where we were with ken star. Its really hard to get these right in advance. Its the problem. I suppose it depends what party you are in in the moment. A new era now. That well the department of justice now because of the what went on during the clinton investigation and the are lease of that information are now its going to now be basically the case where they have to release information. Because bill barr into this was very hesitant in wanting to release any information. Now its sort of he said this today. Were in a new phase now. Of where information that previously would be kept secret or wouldnt be released by the government by the department of justice has to be released. Its their own doing. This was a dark day. Maybe a dark month or year for the department of justice. Again going back to what we talked about early with the transparency. Do the American People have confidence behind the walls is done independently and fairly. He cast shadow but coming up and parody the president s language. Using the term spying. It will require transparency. The American Public will not believe if they continue to operate as they did today. Fairly. Were not done. The fbi interviews. That will come out at some point. They reference it in the document. And the report. In the footnotes its a 302 from reince priebus. That will come out. Well give you more information. Well watch it. But its also notable that many of the what would be bomb shells to the average american, werent so much. Regardless of recommendation i was going to fire comey. Knowing there was no good time to do it. When i decided to just do it i said to myself, you know, this russia thing with trump and russia. Is a made up story. Its an excuse by the democrats for having lost an election they should have won. All right. My experts are back with me. How notable is it to you that a lot of this stuff that would be stunning to people, is significant still but maybe not stunning because either the president talked about it. Tweeted about it. Or the news media cnn and many others broke the story. Thats one of the important pieces of the 400 plus page Mueller Report. It affirms two years of reporting from the New York Times and the post. And out lets. Obviously news makes mistakes like everybody else. The thrust of the reporting for the past two years has been affirmed by muellers team. Because of the information over load and excess. People do have a hard time following the plot. I am a professional paid to do this and i have a hard time keeping up. Thats why the report is important. Right now op amazon, two versions of the report are in the top ten. Best selling books. That indicates to me the americans want to read the full report. The volumes . The Washington Post is coming out with one. Different publishers. By the way. You can down load it for free. It indicates people do want to consume this. And understand it. And in a better bilger picture sense. We have live in the information over load and push alerts and the president in some ways benefits from that. Its hard to avoid being confused. Report does that. Being able to read it in detail helps with that. Theres a lot the president actually made clear by what he chose to say in interviews like that and chose to tweet. When he doesnt think theres anything wrong with doing it. But it is interesting that he was such a light into a will the of this before we read the Mueller Report. We talked about obstruction in plain view. We saw the president engage in conduct that we see now in the report that mueller considered a part of the obstruction case he laid out. In this report. So trumps own tweets and conversations. Things in media interviews are part of the what were seeing in the report that even though he may have thought they were casual comments or they were a part of his using his bully pulpit and position as president. Using the power of the presidency to intimidate witnesses. To as we saw with his white house counsel, to pressure him. To make false statements. To force people in his orbit to tell high lies. This conduct is unheard of for the president of the united states. And see it laid out so very clearly and well documented in this report. It confirms what most of us in the business have been talking about for years. This president has a total disregard for the law. He is lawless. And this report now confirms his complete disregard for the rule of law. And his willingness to encourage others to disregard the law as well. Why i think most people watching right now would be asking, did mueller not draw that conclusion . He didnt see it. So clearly. Of course he had the guidelines. You cant indict a sitting president. But there was more there. I actually think that a careful reading of the report which i do hope that everyone who is interested will do. Demonstrates while mueller decided not to reach a formal legal conclusion because of the memo. That when you read what he said about the obstruction of justice the ten episodes of obstruction they considered, he for each one of those laid out three legal elements of the crime of obstruction of justice. And put the evidence supporting that under each of the elements. And for conservatively speaking six out of ten that he addressed, there was obstruction on all three elements. Really, even though he said he wasnt reaching a conclusion. And he doesnt. The report tells us that there is evidence establishing obstruction of justice. On most of the episodes the mueller team. Its stronger than people are saying. Because of the olc letter and guidelines here. The only remedy for that if that is the case is political. It is. What were seeing it passing of the baton from the law enforcement. To political leadership. Law enforcement is conducted an investigation and completed it. Compiled a report and hand it over. It goes to the attorney general and congress. Its up to congress to make the determination. He wrote in part, the facts in muellers report condemn trump even more than the reports refusal of to clear him of a crime. George conway is a lawyer who at one time wanted a job in the trump administration, and was primarily focused on the obstruction part of the equation, that trump tried to limit the scope of the investigation. He did things that could have been perceived as attempts to influence witnesses and George Conway made the argument in that oped that the ultimate question should not be whether the president committed a crime. He argued that the president should be held to a higher standard than whether or not hes a criminal. Mueller did not decide one way or the other whether the president committed an obstruction of justice offense, but white house aides like Kellyanne Conway have been really focused on amplifying the other half of the Mueller Report, the one in which investigators wrote that they found no evidence that the Trump Campaign coordinated with russia.
